PROJECT SUMMARY: The applicant requests authorization to construct a community docking facility with access piers, finger piers, gazebo and boatlifts to accommodate 10 slips associated with the Seabreeze Sound Subdivision. PROJECT DESCRIPTION: The project site is located at the end of Rosco Freeman Ave., adjacent to the AIWW/Myrtle Grove Sound, in New Hanover County. The project site occupies approximately 15.4 acres of land located at the newly developed Seabreeze Sound Subdivision, off Carolina Beach Rd. (US Hwy 421), adjacent to Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWW), just north of Snow's Cut Bridge, in New Hanover County. To locate the property from Carolina Beach Road traveling south, turn left onto Seabreeze Road and travel east approximately 0.2 miles. Turn right onto Navigator Lane located at the entrance to the new Seabreeze Sound Subdivision. Once you reach the stop sign, turn left onto Saltspray Lane and travel east until you reach Compass Point. Turn right onto Compass Point and the property of interest would be located on the left. The new subdivision has approximately 36 lots, of which, 6 lots are located adjacent and interior to the AIWW (See Sheet 1 of 1). The tract averages approximately 10' above mean sea level. There is approximately 340' of shoreline along the area of tl~e six lots adjacent to the AIWW. Existing high ground vegetation on these tracts consists of hardwood and other species including Oak, Dogwood, Hickory, Magnolia, Juniper and Pine. Waterward of the highground towards the AIWW, the vegetation transitions to an area of "404 type" vegetation and high marsh consisting of mixed coastal wetlands, which include: Wax Myrtle (Myrica cerifera L), Marsh Elder (Iva fi-zrtescerts), Grounsel-bush (Baccharus halimifolia), Common Reed (Phragmites azrstralis) Sea Oxeye (Borrichia frutescens) and Salt Meadow Grass (Spartina patens). The high marsh then transitions towards the AIWW to an area of low marsh. approximately 250' in width, consisting primarily of Smooth Cordgrass (S/~artina a/lerniflurcr) and E31~~~1. Needlerush (Juncus roemerianus) (See Sheet 3 of 3). The New Hanover County Land Use Plan classifies adjacent waters as Conservation, and the adjacent Nigh ground portion of the project area as Resource Protection. The waters of the AIWW/Myrtle Grove Sound are classified SA by the Division of Water Quality. They are designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish by the N.C. Division of Environmental Health. PROPOSED PROJECT: The applicant requests authorization to construct a community docking facility with access piers, finger piers. gazebo and boatlifts to accommodate 10 slips associated with the Seabreeze Sound Subdivision. The community pier would be located on Lot 33 and would extend from the highground over §404 Wetlands and coastal wetlands approximately 480' towards the AIWW, which would place the structure approximately 85' waterward of the outer edge of coastal wetlands. The pier would then terminate into a covered "L-head" platform (16' x 16'), which would be oriented on the northern side of the pier. The pier would continue through the gazebo for an additional 25' towards the AIWW. Another access pier would extend from the gazebo in a northerly direction a distance of 124'in length by 4.5' in width, which would run parallel to the shoreline creating a "L-head" configuration. The applicant also proposes to install four (4) floating finger piers, 14' in length by 3' in width, which would extend from the "T-head" access pier perpendicular to the shoreline. Tlie finger piers would be spaced approximately.26' apart, which would allow for the installation of the ten boatlifts (12'x12') between these finger piers. Two of these boatlifts would be located outside of the finger piers, one located on the most northern finger pier and one located to the southern end of the access pier. The application indicates that current water depths range from approximately -2.0' to -3.0' relative to Mean Low Water (MLW) within the area of the proposed 10 slips (See Sheet 3 of 3). The application states that a Special Use Permit has been applied for to New Hanover County for the boating access associated with this project. ANTICIPATED IMPACTS: The proposed community dock would incorporate approximately 2,422 sq. ft. of Public Trust Area and Estuarine Waters. Approximately 1,440 sq. ft. of Coastal Wetlands and approximately 780 sq. ft. of §404 Wetlands would be impacted due to shading. Minor increases in turbidity should be expected during construction. The proposed pier would extend approximately 130' into a waterbody that measures approximately 886' across, wl~icl~ would conform to the 1/4 width rule and would not extend beyond the established pier head length. As proposed, the applicant's proposal would not encroach into the 80-foot setback from the AIWW.
