Division of Water Resources' Central and Regional staff has reviewed the application package
received November 23, 2020. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on March 13,
2021.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through J, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete.

revised and/or additional documentation shall be signed, sealed and dated (where needed), with an

Our records indicate that parcels NC-CA-20-12 and NC-CA-20-13 owned by the Sherill Furniture
Company (Parcel 362818404254) have previously been associated with Permit No. WQ0006984
as fields NC-CA-20-01 and NC-CA-20-02. Cumulative Pollutant Loading Rate (CPLR) results are
necessary for fields that have previously been active residual sites.
Per the Catawba County GIS website, a portion of NC-CA-20-13 falls outside of the parcel owned
by the Sherill Furniture Company. The adjacent parcel has recently been developed for Duke
Energy Carolinas LLC, and it appears a portion of the original property was sold for this
development. Please review the current property boundaries and revise this field as necessary.
Please update the acreage on the Land Application Site Certification.
3. According to the submitted maps, there appears to be a water supply well located within the
compliance boundaries of land application field NC-CA-36-01. 15A NCA 02L .0107(d) prohibits
the construction or operation of water supply wells within the compliance boundary, which is
established either 250 feet from the waste boundary or 50 feet within the property boundary,
whichever is closer to the source [15A NCAC 02L .0107(b)]. An alternative to this requirement

can be approved in accordance with 15A NCAC 02T .0105(h). Upon the Permittee's request, the
compliance boundary may be located closer to the waste disposal area (i.e. more restrictive) due to
an on -site water supply well. If this option is chosen, the following items shall be resubmitted:
a. Section III on page 2 of 3 of the Land Owner's Agreement form (LOA 06-16) shall be updated
for the above field to request for the alternative boundary; and
b. A letter requesting redefined boundaries for the affected field. For example, a statement that
says "Field NC-XX-XX-XX: A redefined compliance boundary is requested for this site. The
redefined compliance boundary is located [LOCATION] and shall be located 50 feet from the
well located on [LANDOWNER'S NAME] property" would be acceptable for each request.
New maps do not need to be submitted, just a letter requesting redefined boundaries for the
affected field. Please note that the new boundary must be at least 50 feet from the water supply
well.
4. The County Board Notification for Catawba County was not provided.
H. Site Maps:
1. Per the Catawba County GIS website, the property line for the NC-CA-20-(12-13) parcel does not
appear to be correct. A portion of Field NC-CA-20-13 appears to fall on the adjacent parcel that
has recently been developed for Duke Energy Carolinas LLC. Please revise the site map to reflect
the necessary setbacks for Field NC-CA-20-13.
L Property Ownership Documentation:
1. At the south side of Parcel 362818404254 owned by Sherill Furniture Company, there appears to
be an easement for Duke Energy Carolinas LLC. Does this easement include any provisions that
would make land application of residuals prohibited? Please provide additional information and
revise the submittal documents, as necessary.
