I have attached the stormwater permit for this site. The permit identifies the expiration date as April 10, 2010. 1 have
also attached a letter that acknowledges that the permit expiration date has been extended by 4 years to April 10, 2014.
In looking through the file for this project on our server, I noticed there have been some compliance issues surrounding
this site. I have attached the latest Notice of Violation as well. In looking at this Notice, it seems that a site visit has not
yet been conducted. You may want to request an inspection of the site to see if there are any other outstanding issues.
Moving forward, the first step is to transfer the permit to the new property owner (you or the company listed on the
deed). The form for initiating the transfer can be found here:

Try to complete Section I of this form to your best abilities, but include a note indicating that this permit is "being
transferred per the new Session Law". You can leave Section IV blank or make the same note there as well.
Once the permit is in your name, you will need to modify the permit to identify that outparcel as well as renew the
permit. The owners of that outparcel will need to get its own "Offsite" permit. It is recommended to modify and renew
the permit at the same time since both actions can be handled by one permit fee of $505. The renewal form and the

You are welcome to come in and review the file, we just ask that you call in advance to schedule so we can find the file
and ensure that the file review room is available.

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in
our custody readily available to the public for review and copying. We also have the responsibility to the
public to safeguard these records and to carry out our day-to-day program obligations. Please read
carefully the following guidelines signing the form:
1. Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment to review the files. Appointments will be scheduled
between 9:00am and 3:00pm. Viewing time ends at 4:45pm. Anyone arrivingwithoutan
appointment may view the files to the extent that time and staff supervision is available.
2. You must specify files you want to review by facility name. - The number of files that you
may review at one time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits.
Cost per copy is .05 cents for copies. There will be no fee if the total calculated charge is
less than $5.00. Payment may be made by check, money order, or cash_ at the reception
desk Collies can also be invoiced for Lqur convenience. -
4. FILES MUST BE KEPT IN ORDER YOU FOUND THEM. Files may not be taken from
the office. To remove, alter, deface, mutilate, or destroy material in one of these files is a
misdemeanor for which you can be fined up to $500.00. No briefcases,_ large totes, etc. are
permitted in the file review area,
5. 1n accordance with General Statue 25-3-512, a $25.00 processing fee will be charged and
collected for checks on which payment has been refused.

On February 1, 2010, Wilmington Regional Office personnel performed a file review of
the subject project, located at East Wilmington Street in Burgaw, Pender County, North
Carolina. The inspection was performed to determine the status of compliance with
Stormwater Permit Number SW8 991115, issued to you on April 10, 2000,
The project has been found in violation of Stormwater Permit Number SW8 991115,
issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
Failure to certify the stormwater system. A file review revealed that this
office has not received a Designers Certificate.
Permit condition states that upon completion of construction, prior to issuance of a
Certificate of Occupancy, and prior to operation of this permitted facility, a certification
must be received from an appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with this permit, the approved
plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
To correct these violations you must:
Provide a written "Plan of Action" which outlines the actions you will take
to correct the violation(s) and a time frame for completion of those actions,
on or before March 1, 2010.
2. Submit the required Designers Certificate.
Failure to provide the "Plan of Action" by March 1, 2010, or to correct the violations by
the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.

On February 1, 2010, Wilmington Regional Office personnel performed a file review of
the subject project, located at East Wilmington Street in Burgaw, Pender County, North
Carolina. The inspection was performed to determine the status of compliance with
Stormwater Permit Number SW8 991115, issued to you on April 10, 2000.
The project has been found in violation of Stormwater Permit Number SW8 991115,
issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
Failure to certify the stormwater system. A file review revealed that this
office has not received a Designers Certificate.
Permit condition states that upon completion of construction, prior to issuance of a
Certificate of Occupancy, and prior to operation of this permitted facility, a certification
must be received from an appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with this permit, the approved
plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
To correct these violations you must:
Provide a written "Plan of Action" which outlines the actions you will take
to correct the violation(s) and a time frame for completion of those actions,
on or before March 1, 2010.
2. Submit the required Designers Certificate.
Failure to provide the "Plan of Action" by March 1, 2010, or to correct the violations by
the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.

The Division of Water Quality issued a Coastal Stormwater Management Permit, (dumber SW8991115 to
Country Club Villas @ Coastal Carolina Country Club for a High Density Project on April 10, 2000. This
permit expires on April 10, 2010. Section .1003(h) of 15 A NCAC 21-1.1000 (the stormwater rules) requires
that applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and
must be accompanied by a processing fee, which is currently set at $506,00. If this is still an active
project please complete and submit the enclosed renewal application before the expiration date. If this
project has not been constructed and a permit is no longer needed, please submit a request to have the
permit rescinded. If you have sold the project, or are no longer the permittee, please provide the name,
mailing address and phone number of the person or entity that is now responsible for this permit.
Enclosed is a form for change of ownership, which should be completed and submitted if the property has
changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer for
the system installed. This is to certify that the permitted facility has been installed in accordance with the
permit, the approved plans, specifications and supporting documentation. Please include a copy of the
certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a stonmwater
treatment facility without a valid permit, are viotations of NC General Statute 143-215.1 and may result in
appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day.

Certification for the permitted wet pond, as required under Section 11.7 of the permit.
To date, you have not responded to any of the letters sent to 1111 B The Cape
Boulevard. Please note that contrary to the stormwater application, the NC Secretary of
State lists the mailing address for Country Club Villas Owner's Association, Inc., as 111
The Cape Boulevard, so this may explain why you have not responded to previous
letters. It appears that Country Club Builders, Inc. has been dissolved by the NC
Secretary of State Corporations Division. Please note that the dissolution of the
corporation is considered an ownership change, and per Section 111.1 of the permit, you
are required to provide notification of any name or ownership changes by submitting a
formal permit transfer request to the Division. To date, no such request to transfer the
permit has been received by this Office therefore you are still the permittee of record
and you are still responsible for compliance with the permit.
The Pender County tax records indicate that Country Club Builders, Inc. is the owner of
record for the common area of this project, but that the Bank owns the remaining
property. If you have sold the project, or if the Bank has foreclosed on the property, or if
you retain ownership under another company name, please complete, sign and submit
the attached Name/Ownership Change Form. If you do not notify the Division by May 1,
2012, to verify your current mailing address or the name of your new company, or the
name of the new owner, Division will assume that you have abandoned the permit and
we will modify and transfer the permit to the Bank for good cause, per NCAC 02H.1011
of the stormwater rules.

Good morning Mrs. Scott,
As per our phone conversation earlier I am asking for a 30 day extension on the deadline I
was given in the letter I received concerning the above retention pond.
After meeting with you last month I began trying to correct this situation. As I told you in
that meeting I sold the property in 2006 to George Laney. He subsequently filed for
bankruptcy and never went any further with the development of the project than we he first
purchased it. The property went back to Cape Fear Bank, who later failed and the property
became an asset of First Federal out of Charleston, SC. It has been sitting vacant since that
time and I had no idea I had any responsibility remaining. I called the engineer, Joey Hill, and
asked why the pond was never certified. He replied because the project was never completed
and he would have worked with Laney had he continued the development, but, he could do a
partial certification for $2500.00.

offered at that time to transfer the permit to his client if he would assume responsibility of the
retention pond and certification required.
The next thing I heard was that Kennan was telling the bank's asset manager that to go
further with the sale the bank would have to drop their price or have the work done
themselves. I am told that the bank has refused to assume any responsibility.
I am at the point now that if the potential buyer does not go forward, and the bank refuses
to do anything, then at the price they are offering the property for I will try to buy it myself,
clean it up, take care of my issues with you, then put the property back on the market. In
order to do this I will have to wait for some other property I am selling to close. That should
happen within the next few weeks so with this information I am asking that you extend the
deadline you gave me for at least 30 days.

the day you and I met.

On August '5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 991115 which has already expired on April 10,
2010, is now in effect until April 10, 2014. Please resubmit the renewal application and
fee at least 180 days prior to April 10, 2014, which would be October 10, 2013. A copy
of the Renewal Application can be obtained from the following website:

The forebay calculations have been revised to show a volume of
approximately 20% of permanent pond volume, rather than total pond volume
as originally submitted.

On February 1, 2010, Wilmington Regional Office personnel performed a file reviewof
the subject project, located at East Wilmington Street in Burgaw, Pender County, North
Carolina. The inspection was performed to determine the status of compliance with
Stormwater Permit Number SW8 991115, issued to you on April 10, 2000.
The project has been found in violation of Stormwater Permit Number SW8 991115,
issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
Failure to certify the stormwafer system. A file review revealed that this
office has not received a Designers Certificate.
Permit condition states that upon completion of construction, prior to issuance of a
Certificate of Occupancy, and prior to operation of this permitted facility, a certification
must be received from an appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with this permit, the approved
plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
To correct these violations you must:
Provide a written "Plan of Action" which outlines the actions you will take
to correct the violation(s) and a time frame for completion of those actions,
on or before March 1, 2010.
2. Submit the required Designers Certificate.
Failure to provide the "Plan of Action" by March 1, 2010, or to correct the violations by
the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.

amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the
runoff drains to the system.
4. The outlet/bypass structure elevations are per the approved plan.
