Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEiviLR). All previous references to
DWQ will remain in older stonnwater permits issued prior to August 1, 2013 until they are modified,
transferred; or renewed. Please note that this letter references DEMLR as the Division responsible for issuance
of the permit.
On August 5, 2009, the Governor signed Session Law 2009-406, This law impacted any development approval
issued by the former Division of ]Water Quality under Article 21 of Chapter 143 of the General Statutes, which
was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the
effective period of any stormwater permit that was set to expire during this time frame to three (3) years from
its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an
extra year for a total of four (4) years extension. Accordingly, this permit,.which was set to expire on January
14, 2009, shall now be effective from the date of issuance until January 14, 2013, which includes all available
extensions.
State Stormwater Management. Permit #SW8 980829 for the subject project was last issued on January 14,
1999 to Southern Assisted Living, Inc. and expired on January 14, 2013 as noted above. Per 15A NCAC
21-1.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the
expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this
is still an active project, please complete and submit a renewal application prior to February 8, 2019. The
renewal application can be found at the following website under the Applications Forms section:

Please be advised that you are required to comply with the terms, conditions and limitations of the Stormwater
Management Permit under Title 1 SA North Carolina Administrative Code 21-I .1003 and North Carolina
General Statute 143-214.7 until you submit the required Permit Transfer Application Form to the Division and
receive approval from the Division to transfer the permit or, if the site has not been built, submit a request to
rescind the permit and receive approval. This includes providing the necessary operation and maintenance of
the permitted stormwater system. The Permit Transfer Application Form is available on our website at:

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8980829 to
Carolina House/Southern Assisted Living of Morehead City for a High Density Project on January 14,
1999. This permit expired on January 14, 2009. Section .1003(h) of 15 A NCAC 2H .1000 (the
stormwater rules) requires that applications for permit renewals shall be submitted 180 days prior to the
expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If
this is still an active project please complete and submit the enclosed renewal application before the
expiration date. If this project has not been constructed and a permit is no longer needed, please submit a
request to have the permit rescinded. If you have sold the project, or are no longer the permittee, please
provide the name, mailing address and phone number of the person or entity that is now responsible for
this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the
properly has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer for
the system installed. This is to certify that the permitted facility has been installed in accordance with the
permit, the approved plans, specifications and supporting documentation. Please include a copy of the
certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater
treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in
appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day.

As requested, on Jul 12 1998 a soil evaluation was performed at the proposed stormwater
infiltration basin location to serve the above referenced site, as shown on the map entitled
"Preliminary Grading & Utility Plan" for Southern Assisted Living (the owner) by The John R
McAdams Company Inc dated 2/24/98. The purpose of the soil evaluation was to determine the
depth to colors indicative of soil wetness conditions and the saturated hydraulic conductivities
of the soil horizons above the probable seasonal high water table conditions for the placement of
a stormwater infiltration basin_
The area is mapped as the Autryville soil series but the soils at and above the 18' elevation
is more similar to the Blantonn soil series taxonomy (see the attached abbreviated MRCS
Autryville series soil description). The following soil description is typical for the area in the
northwest corner of the site at and above elevation 18'.
A ; 0-5" ; gray (10YR 5/1) fine sand ; weal- fine granular stricture ; very friable ; clear slightly
wavy boundary. 4-8"
E ; 5-14" ; light gray (10-r'R 6.5/1) fine sand ; very weak: fine granular and single grain structure ;
loose to very friable ; clear slightly wavy boundary. 6-8"
EBh ; 14-24" ;.brownish yellow (10YR 7/3) fine sand ; few to common medium to large dark
yellowish brown (10YR 4/6) concretions ; very weak fine granular and single grain structure ;
loose ; gradual smooth boundary. 8-13"
E' ; 24-42" ; pale yellow (2.5Y 8/4) fine sand ; few to common medium faint white (2.5Y 8/2)

Soil colors indicative of possible soil wetness. ranged from 4S" to over 66". The Bt horizons
started at from 40" to 50" and has a saturated hydraulic conductivity exceeding 2" per hour. The
overlying sands have saturated hydraulic conductivities that range from 6" to more than 20" per
hour with 6" per hour considered a very conservative underestimate. Please advise if there is
any questions.

Solum thickness ranges from 60 to more than 80 inches. Content of gravel sized fragments, dominantly duartz and ironstone
pebbles, is less than 10 percent by volume in all horizons except the A and E .horizons. which may have as much as 35
percent by volume. Reaction ranges from very strongly acid to chroma 2 or less are within the upper 10 inches of the Bt
horizon. Texture of the Bt horizon is loamy sand, .loamy coarse sand, loamy fine sand, sandy loam, fine sandy loam, ar
sandy clay loam. --The Btg'hodzon has hue of 5Y'to 7.5YR, value of 5 to 8, and chrome of 1 or 2; ar it is dominated.by
chrome of 2 or less and mottled in varying shades of brown, yellow, red, and gray. Texture is sandy loam,fine sandy loam,
sandy clay loam, anal, below a depth of about 66 inches, it.ranges to medium acid throughout. Depth to the Bt horizon is .
commonly 50 to 70 inches but ranges from 40 to 80 inches. Mottles which indicate wetness occur at. depths of between 30
and 72 inches. The A horizon has hue of 2.5Y or 10YR, value of 3 to 7, and chroma of 1 to '4. Thickness is less than 10
inches where value is 3.5 or Iess.TeXture is sand, fine sand coarse sand, loamy sand, loamy fine sand or their gravelly
analogs. The E horizon has hue of 2.5Y to 7.5YR, value of 5 to 8, and chroma of 1 to 8. Texture is the same as the A
horizon. The E horizon is 50 percent or more uncoated sand grains. The BE horizon, where present, has hue of 2.5Y or
10YR, value of 5 to 7, and chroma of 3 to 8. Texture is loamy sand, loamy coarse sand, loamy fine sand, and sandy loam.
Thickness is less than 12 inches. The Bt. horizon has hue of 2.5Y to 7.5YR, value of 5 to 7, and chroma of 3 to 8; or it is
mottles in various shades of brown, yellow, red and gray. In most pedons mottles of sandy clay. Content of nodular and
platy plinthite is less than 5 percent within a depth of 60 inches, but ranges up to 15 percent below that depth.

In confirmation of our phone conversation of 7/21/98, 1 offer the following addendum to the
July 13 1998 soil evaluation report for the proposed stormwater infiltration basin to serve the
above referenced project site.
The range in depth to soil 'morphology indicators of "soil wetness" ranged from 48" to over.
66" based on soil samples at the slope grade break at the -western end of the basin location as
shown on the-2/24/98 "Preliminary Grading & Utility Plan" and a sample location outside -the
basin location at or close to the southern most extent the elevation 18' contour. The closer the
simples get to the northwest corner of the parcel, the deeper the soil wetness indicators as well as
the sandy loam Et subsoil. If the geometry of the proposed basin is limited to at or above the
existing 19' contour in the northwest cornier of the parcel, all portions of the basin will have soil
wetness .characteristics at or deeper than 5' from the -present soil surface. If the basin is
reconfigured to optimize the area lost to the basin, I do suggest that the depth be planned so that
at least 6"to 12" of natural sand be left over the sandy loam. Bt horizon to optimize the initial j
infiltation capacity of the . basin. Based on the present information available, this can be
accomplished by keeping t,'�e basin invert at or above elevation 14',

Dear Mr. Anderson:
The Wilmington Regional Office received a Stormwater Management Permit Application for Carolina
House/Southern Assisted Living on August 21, 1998. A preliminary review of that information has
determined that the application is not complete. The following information is needed to continue the
stormwater review:
1. It is not necessary to design the wet pond to State standards. It acts only as a holding area.
It need only be sized to store 1.5 ° of rain. There is no requirement for a shelf area, or SAIDA
minimums. Please make the pond smaller and relocate it out of the existing wetlands. The
overflow from the vegetated filter can be directed into the wetland in an attempt to preserve
the hydrology. The infiltration area is what the State design requirements will apply to.
2. The complete soils report was not included with the submittal -only page 1 of the letter from
Mr. Raglund. Please provide the complete report. The report must cover the following areas:
the elevation of the Seasonal High Water Table, the type of soil, and the expected infiltration
rate.
3. The calculations use 1.11 acres of impervious area, but the application only requests 1.04
acres. Please clarify and revise.
4. Please provide a distribution mechanism in the infiltration basin to distribute the runoff evenly
across the bottom of the basin.
5. Please provide maximum building dimensions.

6. Please provide a detail of the required 50' vegetated filter on the plans. Remember, the filter
is NOT a ditch. It must be a flat, grassed, sloped area with a flow spreader mechanism, per
the enclosed detail.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to December 1, 1998, or the application will
be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee. The Division is allowed 90 days from the receipt of a completed application to issue the
permit.

SUBJECT: -Review of Application for Nationwide Permit # 26 and Section 401 Water Quality
Certification for Southern Assisted Living, Bryan Street, Morehead City, Carteret
County. .
Staff biologists with the Wildlife Resources Commission have completed a review of the
project with regard to associated impacts on wildlife and fishery resources in the area. A site
visit was conducted on August 12, 1998. Our comments are provided in accordance with
provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.0 661-
667d), Section 401(b) of the CIean Water Act of 1977 (as amended), and the North Carolina
Genera! Statutes ;G.S. 113-131 et seq.). -
The applicant owns 3.21 acres of which 0.84 acres are wetlands. The applicant is
requesting a permit to fill 0.7 acres of wetlands for construction purposes. The stormwater
infiltration basin will be located in uplands on the highest part of the property.
According to a phone conversation with the applicant's agent, Jim Anderson, the original
design located the building and parking lot on uplands and would result in very little wetland fill.
Stormwater would be routed to existing wetlands and allowed to sheetflow through wetlands
before existing the property via a drainage ditch. Stormwater runoff from buildings and paved
parking lots of the Hestron Corp. and some runoff from Highway 24 are currently filtered
through the wetlands located on the applicant's property. According to the agent, the " "
construction design submitted in this application is the design recommended by the Division of
Water Quality. This design is inappropriate especially for an agency who is suppose to protect
wetlands and their water quality and habitat functions. We recommend the project be redesigned
to minimize wetland fill, eliminate the basin and holding pond, and utilize existing wetlands for
stormwater treatment.
