bridge #132 on SR 1631 over Mill Branch The total project length is 0 114 miles The project is located in the Tar Pamlico River Basin The project drainage system consists of grass shoulders grated inlets with associated pipes rip rap pad at the pipe outfall Jurisdictional Streams Mill Branch ENVIRONMENTAL DESCRIPTION The project is located within the Tar Pamlico River Basin in Franklin County The stream is classified as Class C NSW Storm water impacts to the stream have been minimized by utilizing sheet flow on grass shoulders along the roadway using rip rap pad through compliance with Buffer Rules to diffuse flow through buffer before entering the stream The existing drainage patterns have been maintained with the hydraulic design of the project BEST MANAGEMENT PRACTICES AND MAJOR STRUCTURES The primary goal of Best Management Practices (BMPs) is to prevent degradation of the states surface waters by the location construction and operation of the highway system The BMPs are activities practices and procedures taken to prevent or reduce stormwater pollution The BMP measures used on this project to reduce stormwater impacts are Sheet flow on grass shoulders along the roadway This will promote infiltration and filtration of pavement runoff by directing sheet flow over grassed shoulder slopes Compliance with Buffer Rules to diffuse flow NW quadrant Proposed roadway is in till section and no proposed ditch or storm drain outlet (concentrated flow) is expected through buffer Thus sheet flow will be provided through buffer NE quadrant Proposed roadway is in fill section and no proposed ditch or storm drain outlet (concentrated flow) is expected through buffer Thus sheet flow will be provided through buffer SE quadrant Proposed ioadwav is in fill section and cannot be used at this location because the slope of the ground downgrade is 17 2% (too steep) SW quadrant Proposed roadway is in fill section and no proposed ditch or storm drain outlet (concentrated flow) is expected through buffer Thus sheet flow will be provided through buffer No deck drains This will avoid direct discharge of storm water from the bridge deck into the receiving water Bank stabilization Bank stabilization with class II rip rap is provided at both sides of the stream at 13 +10 & 13 +25 to provide long term bank stability to prevent erosion This will provide a stable Transportation ( NCDOT) proposes to replace Bridge Number 132 on SR 1631 (Gum Pond Road) over Mill Branch in Warren County This project is being administered under the Low Impact Bridge Replacement Program As of December 12 2011 the U S Fish and Wildlife Service (USFWS) lists three federally protected species for Warren County bald eagle (Hahaeetus leucocephalus) dwarf wedgemussel (Alasmidonta heteredon) and Tar River spmymussel (Elliptio steinstansana) Both upstream and downstream of the existing bridge crossing are heavily impacted by beaver activity On March 24 2011 a mussel survey was conducted by NCDOT biologists from the confluence of Mill Bian(,h and Fishing Creels (surveyed 0 4 miles upstream to road crossing within suitable habitat) Mill Branch becomes an open freshwater marsh near the confluence with Fishing Creek is a result of extensive beaver damming however there is still a discernable stream channel The channel contained much sand dettrtus and extensive growths of filamentous algae Approximately 100 specimens of Elhl)lio spp were found as well as 1 Elliptao fashci aana Mill Branch is too small and slow and does not provide adequate habitat for the Tat River spmymussel Although there is not habitat for the Tar River spmymussel at this crossing the, receiving stream Fishing Creels may support the Tar River spmymussel and one was iecoided in fishing Cieek tluee miles upstream hom the confluence (with Mill Bunch) in 1999 The dwarf wedgemussel is mote tolerant of impounded conditions if sufficient dissolved oxygen is present and is found in nearby Niurray This letter is in response to your letter of December 15 2011 which provided the U S Fish and Wildlife Service (Service) with the biological conclusion of the North Carolina Department of Transportation ( NCDOT) that the replacement of Bridge No 132 on SR 1631 over Mill Branch in Warren County (TIP No BD 5105V) may affect but is not likely to adversely affect the federally endangered dwarf wedgemussel (Alasmidonta heterodon) NCDOT has also determined that the project will have no effect on the federally endangered Tar River spinymussel (Elliptio steinstansana) These comments are provided in accordance with Section 7 of the Endangered Species Act (ESA) of 1973 as amended (16 US C 1531 1543) According to information provided a mussel survey was conducted at the project site on March 24 2011 The survey extended from the confluence of Mill Branch and Fishing Creek upstream to the bridge crossing Neither of the federally listed species was observed The habitat was unsuitable for Tar River spinymussel and marginal for dwarf wedgemussel However the Tar River spinymussel has been observed in Fishing Creek and the dwarf wedgemussel has been observed in nearby tributaries to Fishing Creek Based on the mussel survey results and other available information the Service concurs with your conclusion that the proposed bridge replacement may affect but is not likely to adversely affect the dwarf wedgemussel We also concur that the project will have no effect on the Tar River spinymussel We believe that the requirements of Section 7(a)(2) of the ESA have been satisfied We remind you that obligations under Section 7 consultation must be reconsidered if (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered in this review (2) this action is subsequently modified in a manner that was not considered in this review or (3) a new species is listed or critical habitat
