MODIFIED STORMWATER MANAGEMENT PLAN APPROVAL
Dear Mr James
On November 6 2008 the NC Division of Water Quality (DWQ) issued a 401 Water Quality
Certification to impact 290 linear feet of unnamed tributary to Cane Creek to construct the
Hambright Road Extension in Mecklenburg County
In order to meet Condition 8 of the 401 Certification for this project a stormwater management plan
was approved by the DWQ on November 1 2010 A modified stormwater management plan dated
October 18 2011 was submitted by your consultant Glenn Morris of Burton Engineering
Associates and was received by the DWQ on October 19 2011 Revisions to the modified
stormwater management plan dated January 11 1012 were received by the DWQ on January 12
2012
The DWQ approves the SMP for the office building and shop (with subsequent revisions received
December 20 2011) to satisfy the stormwater condition required by the General Water Quality
Certification This approval is for the purpose and design that you described in your application If you
change your project you must notify us and you may be required to send us a new SMP If the property
(or a lot on the property) is sold the new owner must be given a copy of this approval letter and is thereby
responsible for complying with all conditions This approval requires you to follow the conditions
listed in the General Water Quality Certification for the project and the following additional
conditions listed below
The SMP approved by the DWQ for the office building and shop consists of a sand filter dry
detention basin and level spreader vegetated filter strip and all associated stormwater
conveyances inlet and outlet structures and the grading and drainage patterns depicted on plan
sheets dated December 12 2011 The approved SMP must be maintained in perpetuity No
changes to the structural stormwater practices shall be made without written authorization from
the DWQ The stormwater management structures shall have maintenance access and at least a
10 foot drainage easement on each side to allow for the ability to maintain the structures and to
perform corrective actions The stormwater easements shall be recorded to provide protection of
the structures from potential alterations by future property owners

2 Operation and Maintenance of BMP Maintenance activities for the proposed sand filter dry
detention basin and level spreader vegetated filter strip shall be performed in accordance with the
notarized O &M agreements signed by Mr Paul Herndon on October 20 2011 The O & M
agreement must transfer with the sale of the land or transfer of ownership /responsibility for the
BMP facility DWQ must be notified promptly of every transfer
