In response to your letter dated December 21, 2020, which we received January 8, 2021, we offer the
following explanation for the October 1, 2020 missing total suspended solids result.
Our internal records indicate the sample in question was collected October 1, 2020 at 7:30 am. Please
refer to the attached Backwash Discharge Log as documentation. The sample was then collected by
Environment One Labs currier service at approximately 10:00 am on October 1.
We typically receive analysis results within 7 days. However, given the interruptions in service we are all
experiencing due to COVID-19, we were not concerned until the results of the second monthly sample,
collected October 15'h, were received on November 3, 2020.
We immediately called E1 and inquired about the October 1 sample. E1 indicated they only received 1
TOS sample for the month of October dated October 151h and had no record of the October 1 sample
being delivered or received.
Since the November sample period had begun, we had no opportunity to collect a second October 2020
sample. Therefore, we annotated the DMR Compliance Status as "Non -Compliant" and further indicated
in the DMR comments section "no result for TSR on 10-1-20". Please refer to the attached October 2020
DMR as documentation.
In the future, not only will we continue to annotate such events on the DMR, pursuant Condition 5
Section E of our discharge permit, we will verbally notify the Raleigh Regional Office within 24 hours. We
will also provide a written report within 5 days if directed by Division staff to do so.
Given our explanation, supporting documentation, two annotations made on the October DMR, our past
compliance history and NO history of NOV's, Smithfield WTP respectfully requests that your office
consider not issue any Civil Penalty regarding this matter.
