Dear JAMES R. HOWELL:
Reference is made to your request for rescission of the subject State Permit. Staff of the
Mooresville Regional Office have confirmed that this Pen -nit is no longerrequired, Therefore,
in accordance with your request, State Permit No. WQ0006827 is rescinded, effective
immediately.
If in the future you wish to again operate a nondischarge wastewater treatment sytem, you
must first apply for and receive a new State Permit. Operating a wastewater facility without a
valid State lie it will subject the responsible party to a civil penalty of up to $10,000 per day.
If it would be helpful to discuss this matter further, I would suggest that you contact Rex

amended, and anther applicable Laws, Rules, and Regulations

the assigned water quality standards of the surface waters and ground waters..
. The land application program shall be effectively maintained and operated as a non -
discharge system to prevent the discharge of any wastes resulting from the operation of this
program.
a qhe issuance of this permit shall not relieve the Permittee of the responsibility for ages
to surface or groundwaters resulting from the operation of this facility,
. In the event that the land application program is not operated satisfactorily, including the
creation of nuisance conditions, the Permittee shall cease applying sludge to the sites and
tale any immediate corrective actions, including the construction of additional or
replacement wastewater treatment or disposal facilities,
. No craps for direct human consumption shall be raised on these sites for a period f 1
months following sludge application.
6Maximum slope for sludge application shall be 10% for surface application and 18% for
subsurface applications.
7. 7be following buffer zones shall be maintained-,
a) 400 feet from residences or places of public assembly under separate ownership for
surface application method; however, the buffer zone requirement may be reduced
to a minimum of 100 feet upon written consent of the owner and the appropriate
DBM regional office,
b) 200 feet from residences or, places of public assembly under separate ownership for
injection method; however, the buffer zone requirement may be reduced to a
mininium, of 100 feet upon written consent of the owner and the appropriate DEM
regional office,
c) 100 feet from "SA and SB" classified waters and public surface water supplies for
both methods,
d) 50 feet from "WS" classified waters and other streams, creeks, lakes, rivers, and
surface water drainage ways for injection method,
e) 100 feet from "WS" classified waters and other streams, creeks, lakes, rivers and
surface water drainage ways for surface application method,
f) 50 feet from property lines for both methods; however, this requirement may be
reduced upon written concurrence from the adjoining property owner and the
appropriate DBE regional office,
g) 50 feet from public right of ways for, surface application methods,
h) 25 feet from public right of ways for subsurface disposal methods,
i) 10 feet from upslope interceptor drains and surface water diversions for both
methods,
j) 25 feet from downslope interceptor drains, surface water diversions, groundwater
drainage systems and surface drainage ditches for both methods.
Some of the buffers specified above may not have been included in previous permits
for this land application operation. Any sites or fields that are included in this permit,
but were approved with different applicable buffers, will continue to be regulated by
those originally approved buffers. All new sites and fields will be regulated by the
buffers specified above.
8. A copy of this permit shall be kept at the land application site when sludge is being applied
during the life of this permit. A spill prevention and control plan shall be kept in all sludge
transport and application vehicles,
9 All sludges included in this permit must be stabilized by a process to significantly reduce
pathogens (as described in 40 CFR Part 257, Appendix IT prior to application or
incorporation. An evaluation of all sludges as specified in condition 114 must be conducted
as to their ability to demonstrate compliance with this requirement. Upon request, a copy
of this report must be submitted to the Assistant Chief for Operations, Division of
Environmental Management, Water Quality Section, Operations Branch, PO Box 29535,
Raleigh, NC 27626-0535,
10. Specific sludge application area boundaries shall be clearly marked on each site prior to and
during sludge application.
11. No sludge at any time shall be stored at any application site.

Upon classification of the facility by the Certification Cortinnission, the Pertnittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of
the wastewater treatment facilities. The operator must hold a certificate of the type and
grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the Certification Cortanission. The Permittee must also employ a
certified back-up operator of the appropriate type and grade to comply with the conditions
of Title 15A, Chapter 84, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class 11,111, and IV facility at least daily, excluding weekends and
holidays, and must properly manage and document daily operation and maintenance of the
facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202.
Adequate procedures shall be provided to prevent surface runoff from carrying any
disposed or stored sludge material intoany surface waters.
Animals shall not be grazed on sludge applied land within a 30-day period following the
sludge application. Application sites that are to be used for grazing shall have fencing that
will be used to prevent access after each application.

7. Noncompliance Notification:
The Pertnittee shall report by telephone to the Mooresville Regional Office, telephone
number (704) 663-1699 as soon as possible, but in no case more than 24 hours or on the
next working day following the occurrence or first knowledge of the occurrence of any of
the following:
a. Any occurrence with the land application program which results in the land
application of significant amounts of wastes which are abnormal in quantity or
characteristic.
b. Any failure of the land application program resulting in a release of sludge material
to receiving waters.
c. Any time that self -monitoring information indicates that the facility has gone out of
compliance with the conditions and limitations of this permit or the parameters on
which the system was designed.
d. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate sludge treatment.
e . Any spillage or discharge from a vehicle or piping system transporting sludge to the
application site.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
IV. GROUN
3All wells that are constructed for purposes of groundwater monitoring shall be constructed
in accordance with 15A NCAC 2C.0108 (Standards of Construction for Wells Other than
Water Supply) and any other state and local laws and regulations pertaining to well
construction.
. TheMooresville Regional Office, telephone number (" ) 663-1699, shall notified at
least forty-eight () hours prier to the construction of any monitoring well so that an
inspection can be made of the monitoring well location, Such notification to the regional
groundwater supervisor shall be made during the normal office hours from tl u. , until'
p.m. can Monday through Friday, excluding state holidays.
Within sixty ) days of completion of all monitoring wells, the permittee, shall submit two
original copies of a scaled topographic map (scale no greater than 1:2 , ) signed and
sealed by a professional engineer or a state licensed land surveyor that indicates all of the
following information:
a. the location and identity of each monitoring well,
be the location of the waste disposal, system
c . the location of all propertyboundaries,
d " the latitude and longitude of each monitoring well,
e. the relative elevation of the top of the well casing (which shall be known as the
" measuring point"),
f. and the depth of water below the measuring paint at the time the measuring paint is
established.
All monitoring well locations and elevations shall be surveyed b a state licensed land
surveyor,
6 Upon completion of all well construction activities, a certification must be receivedfrom a
professional engineer certifying that the monitoring wells are located d constructed in
accordance with theWell Construction Standards (15A l' C. C 2C) and this permit. This
certification should be, submitted with copies of the Well Completion Form, (GW-1) for
each. well. Mail this certification and the associated GW-I forms to the Permits and
Compliance Unit, Groundwater Section, P.O. Box 29535, Raleigh, h, N.C. 27626-0535.
. For the initial sampling of the well as specified elsewhere in the permit, the ttee shall
submit a copy of the G - l form with the Compliance Monitoring i (GW-5 ) for that
li well. Compliance Monitoring Forms that do not include copies of the G -1 form will bereturned to the permittee without being processed. Failure to submit these forms as
required by this permit may result in the initiation of enforcement activities pursuant to NC
General. Statutes 1-21..

accordance with the conditions f this permit and in the manner approved by this Division.
2. This permit is effective only with respect to the nature and volume of wastes described in
e application and ether supporting data.
t This permit is not transferable. In the event there is a desire for the facilities to chaste
ownership or a name change of the Permittee, a formal 't request must be submitted t
the Division of Environmental Management accompanied by an application fee,
documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may
not be approved.

7. The annual administering and compliance fee must be paid by the Permittee within thirty
() days after being billed by the Division. Failure to pay the fee accordingly may case
the Division to initiate action to revolve this pertnit as specified by 15,A NCAC 2 , . 5
(c)(4).

all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies 1, state, and federal) which have jurisdiction..

extension. Upon receipt of the request, the Commission will, review the adequacy of the
facilities described therein, and if warranted, ll extend the permit for such period of time

The purpose of this letter is to respond to the June 30, 1997 correspondence concerning the
renewal of the above referenced sludge land application permit. It is the town's'intent to
discontinue use of this site no later than January 1, 1998, The town has entered into a "kilo Solids
Disposal Agreement" with the City of Shelby and intends to transport all sludge to the Shelby
composting facility around the first of the year. I have enclosed a copy of this executed
agreement for your information, The torn currently has no intent to renew this permit and most
likely will seek to close out the site once sludge hauling operations have begun to the Shelby
facility.
Any information that you could provide concerning, the procedures and requirements for closing

"BIO-SOLIDS" DISPOSAL AGREEMENT
CLEVELAND COUNTY
THIS AGREEMENT by and between the City of Shelby, a ?"forth Carolina municipal
corporation (hereinafter referred to as "Shelby" or "the City") and the Town of Moiling Springs, a
municipal corporation- (hereinafter sometimes, referred to as "Boiling Springs" or "the Town"), both of
Cleveland County, North Carolina,,

That for and in consideration of the mutual covenants and payments provided for hereinbelow,
the parties agree with one another as follows:
1, Shelby will accept from Foiling Springs and will process and dispose of the Towwrn's bio-
solids (sludge) from its Wastewater Treatment plant within the requirements and parameters of the
ity's i ll'Dl S permits according to the terms and conditions provided. hereinbelow,

. The Town agrees to pay the costs of constructing a manhole intake structure for the
introduction of its bio-solids into the Citv's treatment facilities. The intake structure will be designed;
by the Town's consulting engineers and shall be subject to approval by the City.
. The term of this agreement shall be for a period of twenty 0) years, beginning upon
the date of the signature of the last of the parties to execute the agreement. Not less than ninety ()'
days prior to the fifth anniversary of the beginning of said terra, the parties shall mutually conduct a
general review of the implementation of this agreement for the period from the plate of the beginning of
the terra to the time of such review. A similar review shall thereafter be conducted not later than:
ninety () days prior to the tenth and fifteenth anniversary of said term and a final review shall be
conducted not later than ninety (d) days prior to the expiration of the aforesaid twventy-year to

termination date stated in such l otice; but not, however, to be less than two () years following the
date of the receipt of said Termination Notice by either party,
Unless sooner terminated as provided next above, then upon written notice;,given not less
than one (1) year prior to its expiration date by either party of its desire to enter into a further contract
under the sarae terms as then contained. herein, such a replacement contract shall be created
immediately following the expiration of the initial twenty-year terra. Such replacement contract
shall be for a term of one (1) year thereafter, and shall be automatically renewed annually for a total;
of ten (10) successive terms unless sooner terminated by written notice given to the other party. Such
termination shall be effective no less than six (dmonths following: the delivery of such notice to the
other party.
5. If at anytime Shelby's Wastewater Treatment Plant is not in compliance with its
NPDES pernut in any respect, Shelby shall have the right to refuse to accept bio-solids from the Town
until such time as the plant is in compliance. All such notices by Shelby shall be given only to a
previously designated representative of the Town. Shelby shall be required to notify Boiling Springs
as soon conditions become known to Shelby which may allow or compel Shelby's refusal of acceptance
by bio-solids from Boiling Springs pursuant to this provision. Such notices shall provide an estimate, in
so far as possible, of the number of days during which Shelby, will refuse bio-solids from the Town in
each instance. If the non-compliance is a result of bio-solids from Boiling Springs, the City has the
right to refuse bio-solids until compliance with SOC regulations.
Standard operating procedures (SOP's) will be developed by the parties in order to
facilitate the implementation of this agreement. Such SOP's shall contain regular hauling schedules
for delivery of bio-solids to the City. A two-part, signature form shall be included which will be
required to be signed by representatives of both parties upon delivery of bio-solids. Such fonn shall
contain information relative to the volume, concentration and date of each delivery of bio-solids and
the identity of the party making the said delivery, The aforesaid standard operating procedures,
delivery schedules and related forms for use with the delivery and acceptance of bio-solids shall be
attached hereto and are incorporated herein,by this reference.
6. The content of the bio-solids delivered under this agreement will meet the requirements
of all Federal "503" Regulations. Routine sludge analysis results will be provided to the City of Shelby
as soon as they shall become available.
7. Charges to the Town for the City's acceptance and treatment of the Tow n's bio-solids
will be based upon the volume of sludge hauled and delivered to the City of Shelby. Such charges will
be based on the following formula, the components of which are subject to change July ist of each fiscal
year.

Definitions for the above formula are as follows:
EMSLCP_ars� Debt service will be based on the proportion of debt allocated to
the Compost Facility. Other fixed costs will be based on the
.proportion of line item costs assigned to the Compost Facility.
Total fixed costs are determined from the annual operating
budget adopted each June 30 for the Sewer Administrative and
Plant Departments. For fiscal year 1997-1998, this cost is
$640,000M.
Facility Capacity: Based on the Plant's bio-solid rating and production capability.
As of July 1, 1997, this rating was 15.6 MG per year. This rating
is subject to change based on any upgrades to the facility.
Variable Costs: Costs allocated to the Compost Facility that vary in direct
proportion to volume of treated bio-solids; and generally
include cost of chemicals, electricity, and equipment repairs.
Total variable costs are determined from the annual operating
budget adopted each June 30 for the Sewer Plant. For the fiscal
year 1997-1998, this cost is $109,000M

Shelby reserves the right: to refuse to accept bio-solids from Boiling Springs either
completely or in pert to the extent that the volume requested to be adapted. -by Shelby causes Shelby to
be unable to meet its own bi -solids disposal requirements at the time of any such request by the Town.

Shelby will allow Boiling Springs preferential consideration for the purchase of specified reserve

In addition, the concentration of total suspended
solids(TSS) has been greater than a general standard of 10 ppm
for MWI, MW2, MW3 and MW4 for the past three years. Typically
when TSS exceeds 10 ppm, as it does for MW1 through MW4, it
indicates a problem with the construction of the wells.
In the past we have discussed 2L violations in regards to
heavy metals, particularly lead, for this facility. In reviewing
your monitoring well data, We have found a correlation between
high concentrations of total suspended solids and heavy metals.
The attached figures show this relationship. The pattern t of
fluctuation in the concentrations of TSS and heavy metals,
suggest a possible relationship. The up -gradient well does not
show a relationship between TSS and heavy metals fluctuations;
however, MW2 and MW3 have strong correlations in their patterns
of fluctuation between TSS and heavy metals (See Figures). MW4,
the down -gradient well, has a similar correlation but with much
less variability,
If the levels of heavy metals cannot be shown to be in
compliance with the 2L standards, then the monitoring wells may
have to be replaced.
You should be aware, however, that a violation of IS'CAC
2L may subject you to a civil penalty assessment under the
authority of G.S. 143-215.6A of up to $10,000 per rule violation.

The State of North Carolina is currently negotiating with EPA to receive the federal permitting
authority and delegation to issue land application permits for EPA in our State, If this delegation
occurs, this will allow you to avoid having two permits (one from the State and one from EPA) for the
same activity. While this delegation process is being pursued, permittees legally are subject to the
new Federal requirements while, continuing to comply with it existing State issued pernrit. At this
time, the delegation process is progressing slowly and the formal approval is still in doubt.
Also, enclosed is "A Plain English Guide to the EPA Part 503 Biosolids Rule." This document is
helpful in understanding the new Federal and State monitoring and reporting requirements.

The State of forth Carolina is currently negotiating with EPA to receive the federal
Permitting authority and delegation to issue land application permits for EPA in our State.
This will allow you to avoid having two permits (one from the State and one from EPA) for
the same activity* While this delegation process is being completed, permittees legally are
subject to the new Federal requirements while, continuing to comply with their existing
State issued permit. At this time, the delegation process is progressing slowly and the
formal approval date for the delegation is unknown.

continued operation of a sludge land application program consisting of the application of approximately
44.0 dry tons per year of sludge from the Town of Boiling Springs' Wastewater Treatment Plant to
approximately 12.0 acres of land in Cleveland County with no discharge of wastes to the surface waters,
pursuant to the application received April 27, 1993, and in conformity with the project plan, specifications,
and other supporting data subsequently filed and approved by the Department of Environment, Health and
Natural Resources and considered a part of this pennit.
This pen -nit shall be, effective from the date of issuance until March 31, 1998, shall, hereby void
Permit No. WQ0006827 issued April 5, 1993, and shall be subject to the following specified conditions
and limitations:
1. PER
3'ne issuance of this permit shall not relieve the Pennittee of the responsibility for datnages
to surface or groundwaters resulting from the operation of this facility.
4. In the event that the land application program is not operated satisfactorily, including the
creation of nuisance conditions, the Pertirittee shall cease applying sludge to the sites and
take any immediate corrective actions, including the construction of additional or
replacement wastewater treatment or disposal facilities.
5. No crops for direct human consumption shall be raised on these sites for a period of 18
months following sludge application,

disposed or stored sludge material into any surface waters.

sludge application. Application sites that are to be used for grazing shall have fencing that
will be used to prevent access after each application.

IVY GROUNDWATER REQUIREMENIS
1. Within 90 days of permit issuance, the two (2) existing monitor wells (riot 2 & No. )
shall be abandoned pursuant to 1 A NCAC 2 .00 13.
2. By September 5, 1993, two ( down rad ent monitor wells shall be installed to monitor
groundwater quality e wells shall be constructed such that the water level in the well is
never above or below the screened (open) portion of the well at any time during the year.
The exact location of these wells shall be approved by the Mooresville Regional Office;
telephone number () 663-1699, and shall be constructed in accordance with the
conditions of this pertniL
3. All wells that are constructed for purposes of groundwater monitoring shall be constructed
in accordance with 1 A NCAC 2C .010 (Standards of Construction for Wells Other than
Water Supply) and any rather state and local laws and regulations pertaining to well
construction.
4.
The Mooresville Regional Office, telephone number r (' ) 663-1699, shall be notified at
least forty-eight () hours prior to the construction of any monitoring well so that an
inspection be made of the monitoring well location. Such notification to the regional
groundwater supervisor shall be made during the normal office hours from :f a- . until
5:00 p.m. on Monday through Friday, excluding state holidays.
5.
Within sixty () days of completion of all, monitoring ring wells, the pennittee shall submit two
original copies of a scaled topographic map (scale no greater than 1.2 , ) signed and
sealed by a professional engineer or a state licensed land surveyor that indicates all of the
following information:
a. the location and identity of each monitoring well,
. the location of the waste disposal system
c. the location of all property boundaries,
d . the latitude and longitude of each monitoring well,
e. the relative elevation of the top of the well casing which shall be known as the
measuringpoint"),
f, and the depth of water below the measuring paint at the time the measuring point is

All monitoring well locations and elevations shall be surveyed by a stab licensed land
surveyor.
Upon completion of all well construction activities, a certification must be receivedfrom a
professional engineer certifying that the monitoring wells are located d constructed in
accordance with the Well Construction Standards (15A NCAC 2) and this permit. This
certification should be submitted with copies of the Well Completion Form ( -1) for
each well. Mail this certification and the associated " -1 forms to the Permits and
Compliance Unit, Groundwater Section, P.O. Box 29535, Raleigh, N.C. 2" 2 -f15 5;

For the initial sampling of the well as specified elsewhere in the pen -nit, the permittee shall
subtrAt a copy of the G -1 form with the Compliance Monitoring Form ( -5 ) for that
well. Compliance Monitoring Forms that do not include copies of the -1 form will be
returned to the permittee without being processed. Failure to submit these forms as
required by this permit may result in the initiation of enforcement activities pursuant too NC
General Statutes 1 3-215. .

I The Permittee or his designee shall inspect the sludge storage, transport, and disposal
facilities to prevent malfunctions and deterioration, operator errors and discharges which
may cause or lead to the release of wastes to the environment, a threat to human health, or a
nuisance. The Ise shall keep an inspection log or summary including at lest the date
and time of inspection, observations made, and any maintenance, repairs, or corrective
actions taken by the Pertnittee. This log of inspections shall be maintainedby the Permittee
for a period of three years from the date of the inspection and shall be made available upon
request by the Division of Environmental Management or other permitting authority.
. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the disposal site and facility at any reasonable time for the
purpose of determining compliance with this permit; may inspect or copy any records that
must be kept under the terms and. conditions of this permit, or may obtain samples of
groundwater, surface water, or leachate.
VI. GENERAL CONDITLQ�JS
I. This permit shall become voidable unless the land application activities are carried out in
accordance with the conditions of this permit and in the manner approved by this Division.
This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
. This permit is not transferable. In the event there is a desire for the facilities to change
ownership or a name change of the Permittee, a formal permit request must be submitted to
the Division of Environmental Management accompanied by an application fee,
documentation from the parties involved, and other supporting materials as may b
appropriate. The approval of this request will be considered on its merits and may or may
not be approved.

1. This permit shall become voidable if the soils fail to adequately absorb the wastes and may
be rescinded unless the sites are maintained and operated in a manner which will protect
the assigned at quality standards of the surface waters and ground waters,

discharge system to prevent the discharge of any wastes resulting from the operation of this

3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages

take any immediate corrective actions, including the construction of additional or
replacement wastewater treatment or disposal facilities.

. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge C C) of
the wastewater treatment facilities. The operator must hold a certificate of the type and
grade at least equivalent to or eater than the classification assigned to the wastewater
treatment facilities by the Certification Commission, The Permittee must also employ a
certified back-up operator of the appropriate type and grade to comply with the conditions
of Title 15A, Chapter g , °Ci 2. The ORC of the facility must visit each Class I facility at
least weekly and', each Mass 11, ffl, and IV facility at least daily, excluding weekends and
holidays, and must properly manage and document daily operation and maintenance of the
facility and must comply with all other conditions of Title 15 ., Chapter 8A, .0202.
7. Adequate procedures shall be prodded to prevent surface runoff from carrying any
disposed or stored sludge material into any surface waters
g Animals shall not be grazed on sludge applied land within a Cl-day period following the
sludge application. Application sites that are to be used for grazing shall have fencing that
will be used to prevent access after each application.

7 Noncompliance Notification:
The Permittee shall report by telephone to the Mooresville Regional Office, telephone
number (704) 663-1699 as soon as possible, but in no case more than 24 hours or on the
next working day following the occurrence or first knowledge of the occurrence of any of
the following:
a. Any occurrence with the land application, program which results in the land
application of significant amounts of wastes which are abnormal in quern it or
characteristic.
bt Any failure of the land application program resulting in a release of sludge material
to receiving waters,
c. Any time that self -monitoring information indicates that the facility has gone out of
compliance with the conditions and limitations of this permit or the par a -meters on
which the system was designed.
d . Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate sludge treatment.
e. Any spillage or discharge from a vehicle or piping system transporting sludge to the
application site.
Persons reporting such occurrences by telephone shall also file a written report in letter
forni within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.

I . Within 90 days of permit issuance, the two (2) existing monitor wells (No. 2 & No. 4)
shall be abandoned pursuant to 15A NCAC 2C .00 13.
3. All wells that are, constructed for purposes of groundwater monitoring shall be constructed
in accordance with 15A NCAC 2C.0108 (Standards of Construction for Wells Other than
Water Supply) and any other state and local laws and regulations pertaining to well
construction.

All monitoring well locations and elevations shall be surveyed by a state licensed land
surveyor.
8. All monitoring wells must have identification plates and locks securing the wells against
unauthorized access and use (15A NCAC 2C.0108).

premises or place on or related to the disposal site and facility at any reasonable time for the
purpose of determining compliance with this permit; may inspect or copy any records that
must be kept under the terms and conditions of this permit; or may obtain samples of
groundwater, surface water, or leachate,

4. This permit shall become voidable unless the agreements between the Permittee and the
landowners/lessees are in full force and effect.

7. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after in billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
(c)(4).
S: The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, roles, regulations, or ordinances which may be imposed by other government

Dear Mayor Washburn:
In accordance with your application received September 18, 1987, we are
forwarding herewith Permit No. 15825, dated March 7, 1988, to the Town of Boiling
Springs for the operation of the subject sludge land application program.
The Division's Groundwater Section has commented that borings which were
conducted on the subject site in 1978 indicate that a landfill which exists at this
site has less than two (2) feet of cover over a substantial portion of the landfill.
It is required that a minimum of two feet of cover be placed over those areas, or
that those areas not be used for the land application of sludge. Additionally, the
Town of Boiling Springs should contact the Division's Asheville Regional Office to
determine further measures which may be needed in order to completely delineate the
landfill area.
This permit shall be effective from the date of issuance until. March 31, 1993,
and shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request most be
in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made, this
permit shall be final and binding,

In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations

This permit shall be effective from the date of issuance until March 31, 1993,
and shall be subject to the following specified conditions and limitations:
1, This permit shall become voidable unless the land application sludge disposal
facilities are used in accordance with the approved plans, specifications and
other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4This permit is not transferable.
5� This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes, and may be rescinded unless the facilities are
installed, maintained and operated in a manner which will protect the assigned
water quality standards of tht- surface waters and groundwaters.
6, The sludge land application facilities shall be effectively maintained and
operated at all times so that there is no discharge to the surface waters, nor any
contamination of groundwaters which will render them unsatisfactory for normal
use. In the event that the facilities fail to perform satisfactorily, including
the creation of nuisance conditions, or failure of the land application area to
adequately absorb the wastewater, the Permittee shall take such immediate
corrective action as may be required by the Division of Environmental Management.
7. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and groundwater protection will be established and an acceptable
sampling reporting schedule shall be followed.
8� Surface applied sludge will be plowed or diced in immediately after application
on lands with no cover crop established.
9The issuance of this permit shall not relieve the permittee of the
responsibility for damages to surface or groundwaters resulting from the
operation of this facility.

10. No type of sludge other than that from the Town of Boiling Spring's
Wastewater Treatment Plant shall be placed on the land application disposal site.
11. Adequate provisions shall be taken to prevent wind erosion and surface runoff
from conveying pollutants from the sludge application area onto the adjacent
property and/or surface waters.
12. Sludge shall not be applied in inclement weather or until 24 hours following a
rainfall event of 1/2-inch or greater in 24 hours. Emergency sludge disposal
measures shall be approved by the Division of Environmental Management.
13. The site shall be adequately limed to a soil pH of 6,,5 prior to sludge
application.
14, No root or leaf crops for public consumption shall be raised on these sites.
15. Maximum slope for sludge application shall be 10% for surface application and
18% for subsurface applications.
16. Minimum buffer distances to applied sludge shall be maintained as follows:
a, 50 feet from any public -right-of-way.
b, 100 feet from property lines
C. 100 feet from streams, ponds and drainage ways
d. 100 feet from any wells, active or abandoned, unless the wells have been
permanently abandoned in accordance with 15 NCAC 2C.0113
e. 400 feet from any residence or place of public assembly
17. The Permittee, at least six (6) months prior to the expiration of this Permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if indicated, will,
extend the Permit for such period of time and under such conditions and
limitatinj)- ins it, may deem appropriate,
18. A suitable year round vegetative cover shall be maintained on the land
application sites.
19, Annual cadmium applications shall not exceed 0.5 lbs per acre per year.
20. If analysis shows that PCB is present in the waste sludge at concentrations
greater than 10 ppm (dry weight basis), the sludge shall be thoroughly
Incorporated into the soil by discing, subsurface injection or other appropriate
means, If analysis shows that the PCB concentration is greater than 50 plan, no
sludge shall be applied.
21. Animals should not be grazed on, sludge applied land within a 30-day period
following the sludge application. Application sites that art to be used for
grazing shall have fencing that will be used to prevent access "ring the 30-day

22, In case of any future transfer of these lands a notice shall be given to the new
owners that gives full details of the materials applied or incorporated at these
sites. I
23. Adequate records shall be maintained for tracking the sludge applied to the
permitted site. The records shall include, but not necessarily be limited to the
following minimum information for all three sites:
a. Date of sludge application
b. Volume and dry weight of the sludge applied

27. your monitoring wells must be constructed prior to sludge application, one
upgradient and three downgradient. The location and construction details for
these wells should be by the approval of the Asheville Regional Office, from which
a well construction permit must be obtained. These monitoring wells should be
sampled initially after construction (and prior to waste disposal operations) and
thereafter every March, July, and November for the following parameters:

The measurement of water level should be made prior to sampling for the remaining
parameters,.
e analytical methods used for TOX must be capable of detecting the total of all
halogenated organic compounds present at a concentration of 5.0 parts per billion
(ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is
detected, any individual halogenated organic compound(s) present at a
concentration at or above the method detection limit ( b) must be identified
and
quantified utilizing EPA methods 601, 602, 604 and 611.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules,, and Regulations
PERMISSION IS HEREBY GRANTED TO
Town of Boiling Springs
Cleveland County
FOR THE
operation of as sludge land application program for the disposal of waste sludge from
the Town of Boiling Spring's Wastewater Treatment Plant onto agricultural lands which
consists of approximately 12 acres owned by the Town of Boiling Springs, with no
discharge to the surface waters of the State, pursuant to the application received
September 1.8, 1987, and In conformity with the project plan, specifications, and
other supporting data subsequently filed and approved by the Department of Natural
Resources and Community Development and considered as part of -this permit.
This permit shall be effective from the date of issuance until March 31, 1993,
and shall. be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the land application sludge disposal
facilities are used in accordance with the approved plans, specifications and
other supporting data.
2, This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3The facilities shall be properly maintained and operated at all times.
4This permit is not transferable.
5This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes, and may be rescinded unless the facilities are
Installed, maintained and operated in as manner which will protect the aSSigued
water (Itiality stnndards of tho, �_;urfnce wraters and groundwaters.
6. The sludge land application facilities shall be effectively maintained and
operated at all times so that there is no discharge to the surface waters, nor any
contamination of groundwaters which will render them unsatisfactory for normal
use, In the event that the facilities fail to perform satisfactorily, including
the creation of nuisance conditions, or failure of the land application area to
adequately absorb the wastewater, the Permittee shall take such immediate
corrective action as may be required by the Division of Environmental Management.
7. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and groundwater protection will be established and an acceptable
sampling reporting schedule shall be followed.
8. Surface applied sludge willbe plowed or diced in immediately after application
on lands with no cover crop established.
9The issuance of this permit shall not relieve the permittee of the
responsibility for damages to surface, or groundwaters resulting from the
operation of this facility,

10No type of sludge other than that from the Town of Boiling Spring's
Wastewater Treatment Plant shall be placed on the land application disposal site.
11. Adequate provisions shall be taken to prevent wind erosion and surface runoff
from conveying pollutants from the sludge application area onto the adjacent
property arid/or surface waters.
12. Sludge shall not be applied in inclement weather or until 24 hours following a
rainfall event of 1/2-inch or greater in 24 hours, Emergency sludge disposal
measures shall be approved by the Division of Environmental Management.
13. The site shall be adequately limed to a soil pH of 6.5 prior to sludge
application.
14No root or leaf crops for public consumption shall be raised on these sites.
15� Maximum slope for sludge application shall be 10% for surface application and
18% for subsurface applications.
16. Minimum buffer distances to applied sludge shall be maintained as follows:
a. 50 feet from any public -right-of-way
b. 100 feet from property lines
C. 100 feet from streams, ponds and drainage ways
ii. 100 feet from any wells, active or abandoned, unless the wells have been
permanently abandoned in accordance with 15 NCAC 2C.0113
e. 400 feet from any residence or place of publicassembly
17. The Permittee, at least six (6) months prior to the oxpiration of this Permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequijcy of flie faci[lities described therein, and if indicated, will

18. A suitable year round vegetative cover shall be maintained on the land
application sites.
19. Annual cadmium applications shall. not exceed 0,5 lbs per acre per year,
20. If analysis shows that PCB is present in the waste sludge at concentrations
greater than0 ppm (dry weight basis), the sludge shall be thoroughly
incorporated Into the soil by discing, subsurface injection or other appropriate
means. If analysis shows that the PCB concentration, is greater than 50 ppm, no
sludge shall be applied.
2L Animals should not be grazed on sludge applied land within a 30-day period
following the sludge application. Application sites that are to be used for
grazing shall have fencing that will be used to prevent access during the 30-day
periods after each application.
22. In case of any future transfer of these lands, a notice shall be given to the new
owners that gives full details of the materials applied or incorporated at these
sites.
23. Adequate records shall be maintained for tracking the sludge applied to the
permitted site. The records shall include, but not necessarily be limited to the
following minimum information for all three sites:
a. Date of sludge application
b. Volume and dry weight of the sludge applied
24. Cumulative application rates for metals shall not exceed the following:

25. The Town of Boiling Springs should contact the Division's Asheville Regional
Office (704/251-6208) to determine any measures which may be needed in order to
completely delineate the landfill located at this sites
26It is required that a minimum of two (2) feet of cover be placed over all areas
of the landfill located on this site, or that those areas not be used for sludge
land application.
27. Four monitoring wells must be constructed prior to sludge application, one
upgradient and three downgradient. The location and construction details for
these wells should be by the approval of the Asheville Regional Office, from which
a well cons truct ion permit must be obtained. 71ese monitoring wells should be

The measurement of water level should be made prior to sampling for the remaining
parameters.
The analytical methods used for TOX must be capable of detecting the total of all
halogenated organic compounds present at a concentration of 5.0 parts per billion
(ppb) or greater. In the event that a TOX concentration of 5.0 pp b or greater is
detected, any individual halogenated organic compound(s) present at a
concentration at or above the method detection limit (MDL) must be Identified and
quantified utilizing EPA methods 601, 602, 604 and 611.
The results of the sampling and analysis shall be sent to the N.C. Division of
Environmental Management on Form GW-59 (Compliance Monitoring Report Form) every
April, August and December.
28. The sludge shall be applied by surface application on this site,
29. The water supply well in the land application area must be properly abandoned in
accordance with 15 NCAC 2C.
