Director Division of Water Quality May 7, 2007 DWQ Project # 07-0389, Ver. 2 Granville County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Ms. Juliana Wright JJ Lee 6604 Six Forks Road Raleigh, NC 27615 Subject Property: Golden Forest Subdivision Ut to Ford Creek [030301, 28-14, C, NSW] RETURN OF APPLICATION Dear Ms. Wright: On March 14, 2007, the Division of Water Quality (DWQ) received your application dated August 23, 2007, to fill or otherwise impact 0.062 acres of 404/wetland, 295 linear feet of perennial stream and 22,068 square feet of Zone 1Tar-Pamlico River basin protected riparian buffers and 17,664 square feet of Zone 2Tar-Pamlico River basin protected riparian buffers to construct the proposed residential subdivision. On Apri127, 2007, the DWQ received additional information from you, however, the DWQ has determined that your application remains unacceptable due to the following items: 1. Per the DWQ Level Spreader BMP Manual Chapter, earthen level spreaders are not allowable. The DWQ sent a Request for More Information letter on April 2,.2007 that specifically states in Item 8: "All level spreaders must be designed with a concrete level lip." You continue to specify an earthen level spreader on Sheet 4 of the plans. 2. If you choose to submit another application for this project, please be advised that although you have the option to seek a variance to construct level spreaders in series within the Tar-Pamlico protected buffer, DWQ staff will not recommend approval for this to the Environmental Management Commission. DWQ staff believe that one of the other options available for areas for steep slopes would be practicable for the Golden Forest project. Also, please be advised that the DWQ will request information about development plans for the southern part of this project as well as building envelopes for the lots on the eastern side of the project that contain streams. For this reason your permit application is hereby considered returned. This includes submitting a complete application package with the appropriate fee, and your level spreader designs must utilize the new DWQ guidelines effective January 1, 2007. Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and any work done within waters of the state would be a violation of North Carolina General Statutes and Administrative Code.
