SITE INVESTIGATION ADDENDUM
HICKORY, NORTH CAROLINA
The town of Hickory, North Carolina is currently permitted to land treat
sludge on several locations throughout Catawba County, North Carolina.
Additional sites have been investigated for purposes of land treatment and the
purpose of this report is to describe the conditions encountered on to of
the additional sites. 'In addition, recur unnendations regarding the application
of sludge and appropriate loadings will be made. This report is considered an
addendum to the report previously submitted.
SITE INVESTIGATION
Site Locations
Four additional sites were investigated for 'purposes of sludge treatment.
These 4 sites include: 1) a farm located approximately I mile from the Henry
Fork Plant, 2) a farm south and east of the plant henceforth labeled Finger
Farm, 3) the airport property, and 4) Alexander County farms.

The four additional sites investigated for purposes of land treatment
were typical of the piedmont physiogeographic providence of the state. The
slope is gentle on all sites and the maximuta slope did not appear to exceed
10%. The first site investigated appeared to have the most severe slope
problem and slope did not appear to exceed any maximums whicb can easily
tolerate sludge application. In general, the maximum slope encountered on
most .its was no more than 5 or 6% and topography should pose little or no
limitation to the operation of these land treatment facilities.

Soils
The soils on all sites appeared to be very well drained upland soils
typical of the piedmont. The predominant soil encountered on all sites
appeared to be a Cecil/Pacolet-like clay loam or an Appling-like an clay
loam. The airport property was drastically disturbed land and a soil profile
description for the airport property is really unnecessary. The soils
encountered on the natural sites are very similar to those reported in the
original, soil sampling program and for that reagon soil profile descriptions
for those soils are not 'included in this report arid questions concerning soil
profile descriptions can be referred to the original, report.
Additional soil sampling was accomplished on the four sites and a portion
of the data was provided by the town of Hickory. Site 1, that located nearest
the plant, however, had not been sampled at the time of the investigation and
sampling was accomplished to determine the physical and chemical properties of'
that soil. Soil testing included determination of soil pH, acidity, exchange
capacity and nutrient status. In general, the soil testing indicated that
each site should receive between .5 and 1.5 tons of lime per acre per year.
This should be accomplished prior to receiving any sludge. Additional
potassium (between 30 and 50 pounds per acre per year) should also be added to
ensure balanced nutrient loadings are placed on the site. The potassium
should be added at the same time. as the lime since both constituents move
slowly into the soil. The chemical testing indicated that the exchange
capacity in the nabs_ it was well above the 5 milliequivalents per hundred
gram category; however, the exchange capacity in the topsoil was generally
in the 3 to 5 milliequivalents per hundred gram range and for this reason
conservative sludge loadings would be recommended. The metal loadings onto
Soil pH and supplemental potassium hould be adjusted prier to the
application f any sludgeon any site. These amendments should be added a
recommended in the soil test. The recommendations are summarized in the table
below.

Conclusion
These land treatment sites appear to be well suited as receiver sites for
the town of Hickory. Supplemental site investigations will be accomplished
during a subsequent visit to Hickory and a second addendum will be filed. ld
Metal, the land area available for sludge application for the town of Hickory
should well exceed the laced area required for the assimilation of all of the
onstituents encountered in the sludge. The laced application operation; for
the town of Hickory will prove to be a very viable land treatment alternative
and very coat effective in the long run

An inspection of the City's land application procedures was made on August
13 and 15, 1986 at Site No. d (Sherrill Property) by Mt.. Thurman borne of this
office. This inspection was made in response to a complaint received by this
office.
As a result of this inspection, it was observed that the City was in
violation of condition No. 14 of the subject permit by failing to maintain a
minimum buffer of 100 feet to adjacent lando er's property lines. Mr. Horne
observed that sludge was applied immediately adjacent to a property line which
separates the Sherrill property from the property of Mr. Kenneth lass.
All other aspects of the application program that were observed during the
investigation appeared to be in conformity with permit requirements.
It is requested that you submit a written response by no later than September
S, 1986 indicating your intent to take appropriate action to prevent future
violations of the permit requirements. In responding please direct your
correspondence to the attention. of Mr. Thurman Horne, Natural Resources and
Community Development, post office Box 950, Mooresville, North Carolina 28115.
Please be advised that violations of the subject permit are subject to
possible enforcement action pursuant to NCGS 1 1 21 .6 including assessment of
civil penalties up to $10,000 per violation.

As per ;your request, the staff of the MR0 have reviewed the history of
Hickory's unpermitted sludge disposal practices and offer this memorandum an
attached correspondence, etc., to summarize the events that have transpired..
As can be seen from review of the:: "Chronological FileSummary" there have
been numerous incidences, dating back to July 14, 1980, of illegal sludge disposal
practices. There have been at bast three 3 letters sent to the City advising
them that this activity requires' a permit. There have been at least as many
""warnings" by telephone.
The MR0 has tried' to work with theCity to obtain a land application permit,
but this has: been a frustrating experience. The Cite has-been aware of permitting
requirements for several years but did not make application for permit uatil.early
this year(application received January 23, 1984). Upon receiving this application,
the Permits & Engineering Unit advised the City of deficiencies in the permit
application documents* Since that time, there have been several telephone calls
by the P & R Unit ; (Arthur Hagstrdm) and the '' it (Thurman an Horne) to the City (eft.
Jerry I i.ggs) trying to get the City to submit the required additional information.
Only recently has it appeared that our message has finally gotten through. After-
this. latest ;incidence of unpermitted sludge disposal '(as referenced in the newspaper
article in question) and our subsequent warnings by telephone and by letter, it
appears that the City realizes that we can not tolerate any future such incidences.
It appears that. the City has now submitted all of the requested additional information
(received in Raleigh June a' 1r} to allow completion c_ f processing

haul anymore sludge to Mr. Smith.

This Office received an additional complaint on ,June 20, 984, concerning
disposal of sludge on the property owned by Dr.Hart located on state Road 2029
(Hog Hill Road) The complaint vas investigated on .luxe 21, 1984. This investigation
revealed that sludge had been disposed of on the Hart property.

REPORT: On July 27, 1983, this Office received a complaiht from Ms. Alice Spencer
of Route 4, Box 21, Conover, N. C. The complaint concerned odors from 4ludge being
applied to pasture land. The aludge was from the City of Hickory's at ate
treatment Kant and the pasture land belonged to Mr. Merritt Smith.
- On july 28, 1983, W. Smith was 0ntacted and an investigation was conducted
of the pasture land. It was noted that a rather large pile of dryed sludge was
located in *ha` center of the pasture across from W. Smith's house. Mr. Smith statc
zhar he pianne! to ioad the sludge into a manure spreader and apply it to his
pasture. it appearei :hat no sludge had been on this site for some rime. Mr. Sminh
indicatel zhat none had been hauied for 6-2 weeks. Adequate buffers appeared to hav
been left betasen the sludge pile and any surface waters. it is expected that therf
will be no impact on any nearby streams.
Upon return to the -MG, Mr. Jerry Twiggs, Director of Kilities for the Cit,m-
of Hickory, was contacted and the problem explained to him. nr. Two ggs was verr!
concerned about the problem. He stated that no sludge had been taken to Mr. Smith'E-
property for at least several months. He al.80 stated that the City would not haul
anymore to Mr. Smith and if the sludge on site was creating a serious problem the,. -
City would remove the sludge for disposal in the landfill.

Investigation revealed that on two occasions around the latter part of
June, sludge from the Hickory Wastewater Treatment Plant had been spread on
a garden owned by Mr. Tom, y Barnard. Mr. Pollard explained that at the time,
the weather was hot and humid and the associated odors were a nuisance.
Since that time, the sludge had been plowed under and several rains had
he i Ped to dui his h the odor to what Mr. Pol I and felt was a tot erabl e I eves .
It appears, from talking to Mr. Pollard, that this is the first time this
has happened and that if it does not occur again, the problem will be solved.
I discussed this matter with Mr. Jerry Twiggs, "its. of Hickory, and Mr.
Twiggs has agreed to refrain from spreading any sludge in this area.

between you and r. Monty Payne of this Office, ice, regarding problems noted at:
the City's sludge application sites.
The problems noted by fir, Payne were: Mauser Fa — Livestock is grazing
in the pastured where the: sludge is being, applied, dry sludge is being piled
up instead of being spread. Boman Farm lode is being applied too close
to the stream and livestock is allowed to graze where the sludge is being applied.
Please have the above problems corrected as soon as possible, Also, these

the City. If these violations continue to occur, your Permit to land apply

1. Provide scaled site topo maps for the disposal areas in question. Show
where sludge is to be applied, property lines, potable water wells, surface
waters, and site access. (Where is site in relation to WWTP's?)
2. Submit an E.P. toxicity analysis and indicate ift—cif -sludges.
3. Indicate, specifically, how sludge will be applied. at equipment will
be used, bow site cover will be harvested and when.
4. Note buffer zones on the application site map. We recommend the following:
a. wells - 100 ft. d. property lines 100 ft.
b. surface water - 100 fte, right of ways 50 ft.
c. residences - 100 ft. f. drainage ways 50 ft.
5. Indicate exactly how much land will be used.
6. Is the application area in a flood plain?
7. How is sludge stored during inclement weather?
8. Is the land owned by the City? If not we require that you submit a letter

This is to advise you of the measures taken by the City o
Hickory to correct actions taken by the City of Hickory haulers,
as el.l as, our contract 'haulers wh e resulted n a violation of
our permit.
In investigating why our drivers were applying l d in an
improper area, I found that they were following the instructions
of the property owner. They were advised that the property
owner r could not approve areas for sludge disposal which were no
n the permit. After talking with the property owner her and
advising him of the violation, I do not think this will occur
again.
We ;r moved all the grass within the non--p rinitt d area; the
area was then raked into ;ridges which ch were vacuumed up with
city truck. The material was thew taken to our landfill for
proper disposal. A sample was taken from the well and the
results how d be known by April 30th.
We have contracted a local farm supply dealer to apply lime
to the area.

I air writing to advise you of the status of Spe i l Order,by Consent
CMC WQ 84-14 A (NPDES # NCCU C 4) which outlines permit conditions for the
City of Salisbury's Grants Creek Regional Wastewater Treatment Plant. While
the city has made progress in meeting the terns of the S. O� C , we were not
able to meet the March 17, 1987 deadline for awarding of construction contracts
for upgrading the plant. Authorization to construct > as not received until
after April 10, 1987 (copy attached). The project has now been let out for
bids with the bid opening scheduled for May C, 1 7� We are not certain at
this time how this will affect the date of completion of construction on this
project. Please be assured that we intend to complete this project in a timely
manner as soon as possible after the award of contract.

to the Grants Creek wastewater treatment facility to provide a total

flow splitter box, repair of the existing primary treatment system

treatment plant operator to be in responsible charge of the wastewater
treatment facilities. Such operator must hold a valid State certificate of
the grade at least equivalent to the classification assigned to the wastewater
treatment facilities by the Certification Commission. When a new chief
operator must be obtained to be in responsible charge of the new facilities,
it is required that this be done by the time the construction of the facili-
ties is 50% completed.
This Authorization -to -Construct is issued in accordance with Part III,
Paragraph C of NPDES Permit No. NCO023844 issued December 19, 1985,
and shall be subject to revocation unless the wastewater treatment facilities
are constructed in accordance with the approved plans, specifications, and
supporting documents; and are in compliance with the conditions and
limitations specified in Permit No. NCO023844,
The permittee shall obtain a sludge analysis and a sludge E.P. toxicity
analysis; and obtain approval of these analyses from the Division of
Health Services, Solid Waste Management Branch prior to the disposal of
any sludge from the new wastewater treatment plant. Copies of the
analyses, supporting documents, and approvals shall be submitted to the
Division of Environmental Management's Water Quality Section and the
Regional Office.
During the construction of the proposed additions/nodifications,
the permittee shall continue to properly maintain and operate the
existing wastewater treatment facilities at all times, and in such
manner, as necessary to comply with the effluent limits specified in the
*APES Permit.
You are reminded that it is mandatory for the project to be constructed in
accordance with the North Carolina Sedimentation Pollution Control Act and,
Ehen cable, the North Carolina Dam Safety Act. In addition, the
specifications must clearly state what the contractors responsibilities
shall be in complying with these acts.
The selling or free distribution of wet, dried, composted sludge or
sludge -like materials from wastewater facilities without prior review and
approval by this Division is illegal.

City of Salisbury's Grants Creek Regional Wastewater Treatment Runt. While
the city has made progress in meeting the terms of the S. 0. C.,'we were not
able to meet the March 17, 187 deadline for awarding of construction contracts
for upgrading the plant; Authorization to construct was not received until
after April 10, 1987 (copy attached). The project has now been let out for
bids with the bid opening scheduled for May C, 1987. We are not certain a
this time how this will affect the date of completion of construction on this
project; Please be assured that we intend to complete this project in a timely
manner as soon as possible after the award of contract

REPORT: on June 5, 1984, this Office received a complaint through Mr. Tom Spurling of the
Catawba County Health Department regarding; the disposal of sludge on Dr. Hart"s
property allegedly by ;;the City of Newton's trucks. The complainant complained of odor
and of spillage on the road. Mr. Dwight Wilson with ' the City of Newton was contacted
by telephone by Mr. Larry Coble of this Office concerning this matter. Mr. Wilson
informed ter. Coble that the sludge as being hauled from the City of , Hickory's wastewater
treatment facilities.
Mr. Jerry Twi.ggs with the City of Hickory was also contacted, He was rem n ed
that land application without a permit is illegal and should be ceased immediately.
Can June g, 1984, Mr. Mike Parker of this Office investigated. At that time, no
evidence of sludge disposal: was found
Can June 20, 1984, this Office received an additional complaint concerning; the lend
application of sludge ;on Dr. Hart's property, The complainant said that he had
observed two loads of sludge being hauled the previous day, June 19, 1984. He
complained of the land: application of sludge and of the odor. He gave more specific
directions to the site. Can June 21, 1984, Mr. lie Parker investigated the second
complaint and discovered that sludge had indeed been disposed of on the Hart
property.
Mr. Tw ,ggs could not be contacted, but Mr. Gene Haynes with the City of Hickory

was notified. He said he would stop the land application of sludge without a permit.
In a warning letter dated June 25, 1984, Mr. Jerry Twiggs was reminded that the
land application of sludge without a permit is illegal and should be ceased immediately.
Mr. Twiggs, was also informed that this Office would have no alternative than to
recommend enforcement action should future violations occur.
During an investigation of land application of sludge at a different site, it was
determined that trucks belonging to Sigmon Brothers Dairy were responsible for the
transport and land application of the sludge and not the City of Newton's trucks.
Mr. Jake Sigmon has been notified in a warning letter dated June 25, 1984, that land
application of sludge is illegal and that he should immediately cease the transport
and disposal of sludge until such time as the City of Hickory has received the
necessary land application permit.

was being lance applied on the Wilfong property located at the corner of SR 2019

A follow-up investigation revealed the sludge had been turned under. firs. .Tarr
Wilfong was contacted, and she was satisfied with the result.

you taking the time to keep us updated on your efforts to improve sludge
application procedures and record keeping. We particularly appreciate your
personal committment to these efforts.
With respect to the records presented to its during our meeting on July 15, 1985,
1 felt it might be advisable to provide some further clarification as to their
adequacy and some suggestions for possible improvements.
The records which were presented are considered to be adequate with respect
to the requirements of the old permit (10587Rl). However, the requirements of
your new permit (10587R2), issued on May 22, 1985, are some what more demanding
than these records will accomodate. As you will recall, in our meeting we reviewed
some monitoring report forms which should now be used in order to meet the new
permit requirements. We believe that these forms will not only provide us with
the information we need for compliance monitoring, but they can also be a tool
to assist your staff in managing,the program of land application. If you or any
of your staff have any questions concerning these forms or if we can be of any
other assistance to you, please call Thurman Horne or me at (704/663-1699).

Thank you for the opportunity to meet with you and Thurman Horne on
July 16, 1985. 1 believe our meeting was beneficial and productive,.
I believe the +ity's contractor did improperly apply sludge on the
Dr. Robe,rt Hart property:. As Jerry Twiggs and I indicated to you;, any
application of sludge which dues not meet permit conditions is immediately
corrected when we become aware of any improper application.
On the site where the violation took place, there is a grass airstrip.
Our contracted mauler was instructed as to which end of the airstrip to
begin application. Apparently, the inst-ructions were misunderstood since
application began on the opposite end. When we became aware of the
problem, we immediatelZ stopped sludge application on this site,
o prevent a reoccurance of this problem we have staked the buffer
areas on all our permitted sites. Also, we have divided our sites into
subsites and identified each subarea.. We will monitor each subarea to
determine the area covered in a week by sludge generated at our plants.
This will provide us with a measure of the loading rates on each parcel.
We are not now applying sludge to the Hart property.
I trust our record keeping, as you viewed same on July lb, of sludge
applications from the two treatment plants is satisfactory® However,
would appreciate any assistance you can provide to insure that we are
keeping records in accordance with our permit.

regional sludge composting facility to be built here. The $6 million
project has been approved for funding by the State and is currently being
reviewed by the U.S Environmental Protection Agency. We anticipate

project is completed, the City of Hickory, as well as all m nicipialities
and septic tank haulers in Catawba County, will have an alternative to land
application of sludge.

The firm of Burmeister, Wright & Associates, P.A. is a civil engineering
consulting firm based in Charlotte, N. C. The firm is headed by principals
John Burmeister and Revil Wright who are here tonight to discuss the findings
of the 201 Amendment. This firm has done a considerable amount of work in
and around this area including engineering projects for the City of Newton,
the Town of Maiden, the City of Asheville, the City of Cherryville and others.
Recil Wright was born and grew up in Catawba County and presently resides on
Highway 16 just south of Newton. The 201 Amendment has been completed by
this firm in a satisfactory manner to all parties. I am confident in their
ability to perform the additional engineering work related to the composting
facilities.
I will now turn the presentation over to John Burmeister, who will
describe some of the 201 Amendment findings.

OBJECT AND 'APPROACH
The approach taken in developing the necessary design criteria for the
composting facilities was first to determine 'both the present and future
quantities of sludge generated from; each of the municipalities. Secondly,'
was to determine hoer much the present steer of sludge disposal was costing

WHAT IS PS
Before proceeding any further, it may be appropriate to describe what
composting is and some of the methods of manufacturing as it applies to the
regional facility we will be discussing.
Composting is a process that converts organic materials into humus -like
product using aerobic organisms. Composting_is a natural process and 1 am
sure that any of you that have piled up any leaves and; gone back later to see
the results will know what composting and the results of composting are.
Composting of sewage sludge consists of simply adding a buying or carbonaceous
material to sludge from which the water;has been partially removed. The
carbonaceous or bulking material can be almost anything including sawdust,
bark, woodthips, peanut bulls, rice hulls, or any other similar material..
The addition of the air and combination of the carbonaceous materials causes
n endothermic reaction and heat is generated. The process of composting
takes roughly 14 days in a controlled environment. Chart 11 illustrates in
simplified manner how sewage compost is manufactured'

of you.
This material is most suited for nursery usage, golf courses, turf farms
and the like.; The markets for this material are ;.numerous. Recent market
research in the Asheville area has determined that all materials can be readily
sold and Morganton has a composting facility and is presently selling all that
is manufactured.
Where are several methods of manufacturing of sewage compost. Two of the
most applicable methods were analyzed in depth in the amendment, including the
"Static Pile System" and the "Mechanically Enclosed System".
The "static pile system" as the name implies relies on creating large
p iles of the sludge and bulking material mixture and blowing air into the
i
piles until the composting process has finished. The system requires
considerable land area, is very labor intensive, and subjected to weather.
The "mechanical enclosed system" relies on the use of art► enclosed tank
in which the composting process takes place. This system requires a larger
capital investment than the static pile system, but is far less labor
intensive. It is also more environmentally sound, since the system is
enclosed. Other advantages of the enclosed system is that it is unaffected
by weather and is odor free.
I would like to now turn the presentation over to Recil Wright who will
go into the specifics of the regional facility.

REGIONAL COMPOSTIOG FACILITY
Based on the cost, environmental and subjective analysis performed in the
amendment, the proposed disposal methods for the Hickory -Newton Complex were
selected. The chosen method was to compost sludges in an enclosed system that
will be located central to the four municipalities. The tentative site that
has been selected is near the existing Fairgrove Wastewater Treatment plant
located on Clark Creek, just south of Highway 64-70.
The proposed composting facility would be designed to meet the needs of
the communities over the next 20 years and will have an ultimate capacity to
process 20 tons per day of dry sludge. At start-up, these facilities will be
treating approximately 50% of this amount.
The "mechanical enclosed system" includes reactors in which the actual
composting process takes place; carbonaceous storage tank; air blowers and
scrubbers; conveyor and solids handling system; and associated buildings and
structures. Sludges from the treatment plants will be transported to the
regional facility for dewatering. Delivery of the sludges to the regional
plant will be accomplished by either pumping or by hauling in tankers.
Sludge from Newton's Clark Creeik plant and Hickory's Henry Fork plant will
be pumped to the regional facility. It is planned to haul the sludges from
Hickory's Northeast Plant, Conover's plants, and Longview's plant by tanker
to the facility. Two tankers will suffice initially although they will have
to be replaced within ten (10) years plus the purchase of an additional
tanker. A schematic of the major components of the regional facility are
shown in Chart III on page 6.

Capital costs of the entire system is estimated to be $7,109,000. This
amount uld be offset by Federal Grants totaling up to f the eligible
costs„ 17eimplementation of the project will result in an overall savings
to all the municipalities over the present methods of disposal.-
Savings will be proportionate to the Federal share that can be obtained
and the actual amount and price of the compost sold. A chart has been prepared
which illustrates the overall savings to the four municipalities. This is

In response to complaints received concerning the it's sludge disposal
practices, Mr. J. Thurman Horne of this Office conducted a site 'investigation
on Thursday, dune 27, 1985. as a'result of this investigation it was observed
that the City has violated several of the minimum buffer requirements stipulated
in conditions number 13, 1., and 15 of the subject permit.
The violations were noted for recent surface applications of sludge on areas
of the. Dr. Robert dart, III property. The following violations of the aforementioned
buffer requirements were noted:
l Sludge has been applied approximately 80 feet from a potable water
Drell. The permit requires a minimum buffer of 100 feet be maintained.
Sludge has been applied within .n approximately 100 feet of an existing
occupied residences The permit requires a minimum buffer of 200 feet
be maintained:

In addition to these violations, you should be aware that an investigation was
conducted on Thursday. May 2, 1985 which revealed that the :City was in violation of
condition No. lq of the subject permit for failing, to maintain adequate records of
sludge applications. Further, in a letter to Mr. Jerry Twiggs, Director of Public
Utilities, City of Hickory from Mr. D. Rex Gleason dated October 1, 1984, the City
was advised of observed violationof permit requirements and informed that continued
violations might result in revocation of the subject permit.

SITE INVESTIGAT10N ADDENDUM
NORTH CAROLINA
The town of Hickory, North Carolina is currently permitted to lad treat
sludge on several locations ns throughout Catawba County, North'' Carolina.
Additional sites have been investigated ;for purposes of land treatment and the
purpose of this report is to describe the: conditions encountered on four of
the additional ;sites. In addition, 'recommendations regarding the application
of sludge and appropriate loadings will be made. This report is considered: an
addendum to the report previously submitted.
SITE INVESTIGATION
Site Locations
Four additional sites were investigated for purposes of sludge treatment.
These 4 sites include: l a farm located approximately I mile from the Henry
Fork plant, 2l`a farm south and east of the plant henceforth labeled Finger
Farm, l the airport property, and l Alexander County farms

The four additional sites` investigated for purposes of land treatment
were typical of the piedmont phsiojgeographiic providence of the state. The
slope is gentle on all sites and the maximum Mope; did not appear to exceed
10%. The first site investigated appeared to have the most severe slope
problem and slope did not appear to exceed any maximums which can easily
tolerate sludge application. In general, the maximum slope encountered on
most sites was no more than 5 or 62 and topography should pose little or no
limitation to the operation of these land treatment facilities.

'Soils
r
The soils on all sites appeared to be very well drained upland soils
typical of the piedmont. The predominant soil encountered on all sites
appeared to be a Cecil pacolet-like clay loam or an A plin -like sandy clay
loam. The airport property was drastically disturbed Band and a soil profile
description for the airport property is really unnecessary. The soils
encountered on the natural siteq are very similar to those reported in the
original soil sampling program and for that reason soil profile descriptions
for those soils are not included in this report and questions concerning soil
profile descriptions can be referred to the original report.
Additional soil > sampling was accomplished can the fur sites and a; portion
of the data was provided by the town of Hickory. Site 1, that located nearest
the plant, however, had not been sampled at the time of the investigation and
sampling was accomplished to determine the physical and chemical properties of
that soil. Soil testing included determination of soil pH, acidity, exchange
rapacity and nutrient status. In general, the soil testing indicated that
each site should receive between .5 and 1.5 tams of lime per acre per year.
This should be accomplished prior to receiving any sludge. :additional
potassium (between 30 and pounds per acre per year) should also be added to
ensure balanced nutrient loadings are placed on the site. The potassium;
should be added: at the same time as the lime since both constituents move
slowly into the soil`. The chemical testing indicated that the exchange
capacity in the, sub -soil was well above the 5 milliequivalents per hundred
gram category; however, the exchange capacity in the topsoil was generally
in the 3 to 5 millie uivalents;per hundred gram range and for this reason
conservative sludge loadings would be recommended. The metal loadings ;onto
7the site can be calculated based upon the lov range for the EPA sludge
ppp,application, Exchange capacity in the sandy and sandy 'loam topsoil was
sufficiently low to warrent this conservatism.
WASTE CHARACTERISTICS AND SLUDGE LOADINGS'
The sludge generated at the Hickorywastewater treatment facility has
been analyzed by a commercial laboratory and determined to b non -toxic. I
addition, nutrient analysis have been performed on the sludge and that data
was submitted with the original report. All calculations were accomplished
with the initial report and are not necessary in this addendum. Any questions
regarding sludge loadings should be answered in the initial or original
report. if there have been significant changes in the quality of the sludge
generated at the sludge or if there have been significant changes in the
industrial processes ongoing in the; town of Hickory, then additional sludge
characterization data may be necessary and subsequent calculations for
determining land application rates way be necessary. For purposes of this
report, however, the sludge loadings onto the four additional sites are
identical to those originally recommended.
Cana ement
The sites investigated are currently either well managed grasslands in
fescue or Sericea hespede a or fallow land which is currently poorly managed.
The fallow site should be cut,, limed and supplemental nutrients should be
applied prior to any sludge application. Sludge loading onto the poorly
managed site should begin lightly and proceed up to the maximum loading. The
airport site, currently in Sericea Lespedeza, should be, cut prior to receiving
sludge. The heavy stand of ge icea' Lespede a currently on that site will be
an excellent receiver as will the fescue on Field l and the fescue pasture in
Alexander County.

North Carolina Division of Environmental Management. The revisions to
subject plan documents as designed by Ashebrook, Simon and Hartley are

(1) set to the Corps of Engineers, Inspection Branch, under separate

Dear Mr. Twiggs.
As you are aware, yesterday, September 6, 1984, an investigation was
made of several potential sludge land application sites in the Rickety, area.
The investigation was made at your request and involved Dr. Bob Rubin, North
Carolina State University; Mr. Ed Nolly, SCS; Mr. Thurman Horne of this Office
and Mr. Nuitt Sanders and you representing the City.
One of the sites vitich was investigated was the abandoned landfill at the
airport (you were not present during this part of the investigation). At the
landfill site, Mr. Horne observed that sludge has been dumped in mounds several
feet high in an area of the site inmediately adjacent to a steep embankment.

that City of Hickory employees would dump waste sludge from one of Hickory's municipal
WWTP's on property owned by the airport
Upon arrival the writer waited at v4iatl I a g , e point whicb I allowed a clear view of
the airport property. At approximately 0912 hours a City of -Hickory dump truck
carrying a load of dried sludge passed by the writer and entered a gate leading onto
the airport property. The writer followed, and observed,city employees preparing to

Can Friday, day September 21, i984 this Office received a complaint concerning
odors coming from sewage being land applied on the Mau er Farm, The complainant did not
see how the sludge was being applied, but complained about the odor steadily increasing
over the past three and one --half creeks;'
An. investigator (Monty Mayne) from this Office went to the Mauser Farm to see what
was actually occurring. He found that both Bret and dry sludge was being applied to the
land. The wet sludge was being spread on the surface evenly; the day sludge was;not
being spread, but was being piled gip. After further investigation Mr. Payne could find
only two infractions occurring at the site livestock is being allowed to graze on the
site; and the dry, sludge is being plied up instead of being spread
Odors on the day of investigation were not detectable, but the investigator did note
how odors could arise when the wet sludge is being applied to the land®

As per your request, the staff of the M Cl have reviewed the history of
Hickory's unpermitted sludge disposal practices and offer this memorandum and
attached correspondence,, etc. to summarize the events that have transpired.
As can be seen from review of the "Chronological File Summary" there have,
been numerous incidences, dating back to July 14, 1980, of illegal sludge disposal
practices-. There have been at least three (3) letters sent to the City, advising
there that this activity repulses a permit. There have been at least as many
ti warnings" by telephone.
The KRO has tried to work with the City to obtain a land application permit
beat this has been a; frustrating e: paerleatee. The City has been aware of pe lttlra
requirements for several years but did not make application for permit until early
this year (application received January 3, 1984).y, bpo . receiving this application
the Permits d Engineering Licit: advised the C itv of elcrtici.encies in the permit
application documents. Since that time there have been several- telephone calls
by the P & E Unit (Arthur Ha d trom) arad _ the MRO (Thurman porno) to the City (Mr.
Jerry Twiggs) trying to get the City to submit the required additional infosraaa con.
Only: recently has it appeared that our message hafinally gotten through. After
this latest incidence of unpermitted sludge disposal. (as referenced in the newspaper
article in question) and our subsequent warnings by telephone and by letter, it
appears that the City realise.s that we can not tolerate any future such incidences.
It appears that the City has now submitted all of the requested additional. information;
(received in Raleigh June 27, lSdd) to allow compl,at:ion of processing their permit
application.
Tl:e City has stressed that itt urgently needs a permit and. we ,:are glaring their
application out, priority ; attention, even though, as we have expressed to the City,
tlxe;w have essentially brow 1;€t this dilettmia on themselves through darer procrastinations
In the interim we have advised the City to seek perrn ss°ion from the County landfill
to dispose of sludge there

disposal on land belonging to Dr. Hart. In a phone call Gene
Haynes with the City of Hickory said he would see that this
was stopped.

Complaint investigation (by Mike Parker) concerning disposal
of sludge by land application on Dr. Hart's property. Through
telephone conversation with Dwight Wilson with the City of
Newton it was learned that the sludge was being hauled from
the City of Hickory Wastewater Treatment plants.
January 23, 1984
Application for sludge land application permit received.
July 27, 1983
Complaint investigation (by Larry Coble) concerning land
application of §ludge. The investigation found a large pile
of sludge in a pasture belonging to Xr. Merritt Smith. Mr.
Smith planned to apply the sludge to his pasture. Mr. Jerry
Twiggs of the City of Hickory stated that the city would not
haul anymore sludge to Mr. Smith.
July 5, 1983

Dear Mr. Twiggs:
Reference is made to my letter to you dated April 19, 19,82 (a copy of which
is attached). This letter advised that this Office was aware that the City of
Hickorwas land applying wastewater treatment plant sludge without the necessary
Permits from the Division of Environmental Management. It also set foigth the
Items needed to acquire these Proper Permits. As of this writing this Office has
not received an application for Permit to land apply sludge.
On June 27 and June 28, 1983 this Office received complaints concerning land
application of sludge. On June 30, 1983 an investigation found that sludge had
been applied to grass lands owned by Mr. Clyde T. Bolick located off Highway 127
in Alexander County. This Office has no record of this site being Permitted for
sludge disposal.
As the results of these complaints Mr. Don Brooks with the City was contacted
and advised not to apply any more sludge to Mr. Bolick's property. Mr. Bolick was
also advised that any land application of sludge without Permit was illegal and
should not be done.
This is to advise you that land application of wastewater treatment plant
sludge without a Permit is a violation of N. C. General Statute 143-215.1.
Violations of this nature are also subject to enforcement action by this Division.
Enforcement actions of this nature are subject to civil fines of up to $10,000 per
day per violation.
You are: hereby requested to cease disposing of sludge on land without first
obtaining an appropriate Permit.

On July 3 1984 at 1330 hours, Mr. Richard H. Peace telephoned the Mooresville
Regional Office to report that the City of hickory had dumped sludge on the Bowman
property and that the sludge was still wet. Mr. Peace is the Regional Supervisor
at the Mooresville Regional Office. Mr. Peace suggested that personnel from the
Office investigate the site, collect samples of the sludge, and take photographs
of the application of the sludge.
An investigator from this Office arrived at the Bowman property at
approximately 1520 hours. Sludge had been recently applied to the field.
portion of the property had been recently graded where the sludge; was applied
and had allowed the sludge to flow into a nearby tributary. The investigator'
took; a sample of the sludge for analysisand photographs of the disposal area;
Later, the investigator met with 2r-. Bowman, the owner, and inspected all
of the properties being used for sludge disposal. Mr. Bowman told the investigator
that sludge, in the area where the sample was collected, was placed there on
Monday, July 2, 1984 by the City of Hickory.

complained of the land application on of sludge and of the odor. He gave more specific
directions to the site. On June 1, 1984, Mr... Mike Parker investigated the second
complaint and discovered that sludge had indeed been disposal of on the Hart
property.

was notified. He said he would stop the land application of sludge Witnout a permit.
In a warning letter dated June 25, 1984, Mr. jerry Iviggs was reminded that the
land application of sludge without a permit is illegal and should be ceased immediately
Mr. Twiggs was also informed that this Office would have no alternative than to
recommend enforcement action should future violations occur.
During an investigation of .and application of sludge at a different Ate, it was
determined that trucks belonging to Sigmon Brothers Dairy were responsible for the
transport and land application of the sludge and not the City of Newton's trucks.
Mr. Jake Sigmon has been notified in a warning lettur dated June 25, 1984, that land
application of sludge is illegal and that he should immediately cease the transport
and disposal of sludge until such time as the City of Hickory has received the
necessary land application permit.
