Dear Mr, Fox:
The Mooresville Regional Office conducted a compliance inspection, on May 7"', 2015, This was a
final permit inspection as a result of your Permit Rescission Request, and included a records
review and site visit to the Northeast WWTP. The annual report, which was reviewed prior to
inspection, reflected there was no land application in 2014.
The hauling records to the Hickory Regional Compost Facility were complete to date and the
residuals processing and storage areas appeared well maintained at the time of inspection.

This Notice of Deficiency is being sent to you for failure to submit the 2014 annual
report. One of the requirements of your non -discharge permit is the submittal of an
annual report to the [division of Water Resources by March 11 of each year. As of this
date; our records indicate that the 2014 annual report has not been submitted for the
subject facility.
This permit expired September 30, 2014, It is a condition of your permit to submit a
renewal six months before the expiration date. As of this date no renewal has been
received.
Failure to act in accordance with the terms, conditions„ or requirements of your permit
may result in a recommendation of enforcement action, in accordance with North
Carolina General Statute 1-1.,

enforcement action will be made following the receipt of your response.

Enclosed are maps with compliance boundaries marked
for the two fields at the Sipes Orchard location. i Wish
to divide the property into two fields.
The Northern field, on the opposite side of th.E,, road
irom the main school complex, is field 1. The southern
field behind the school c6mplex is field 2.
Field I contains approximately 85 acres total with
about 70 usable after buffer,zones. The northwest section
of site'! is buffered, on the may, 400 feet from structures
of dwelling. The southwest section of field is a130
buffered 400 from dwellings. The west boundary is buffered
50 from public right of way. The southe a3tern boundary is
buffered 100 feet from the streams and 400 feet from
dwellings. On the southeastern edge of the field there are
some abandoned structures that we buffered away from. On
the northeastern part of field 1 there is a nati-ira], wooded
buffer.
The southern field behind the school complex is field 2.
Field 2 has approximately 65 total acres with about 60
after buffer zones. The field is mostly naturally buffered
by woods. There is a 100 foot buffer on the eastern
boundary for property lines. There is 100 foot, buffer on
the western side for a stream.
The City of Conover is scheduled to eliminate the
Southeast Wastewater Treatment Plant NCO024219 around April
200The flow will be sent to the City of Newton. In the
municipal contract, the Cit-y of Conover agrees to haul a
volume of sludge from the City of Newton's facility equal
to Conover's solids loading contribution. Because Conover's
wastewater will mix with Newton's wastewater prior to
entering.Newton's plant the sludge will be a combination of
Newton and Conover. We intend to compost the material but
in an emergency situation we may have to make arrangements

NEWTON AND CONOVER AGREEMENT
RE: CLARK CREEK SEWER
This agreement entered into 2003 by the cities of Newton
and Conover, both municipal corporations of Catawba County, North Carolina,
WITNESSETH:
Whereas, Newton owns and operates its Clark Creek Wastewater Treatment Plant
(Facility) which has a current capacity of 5 million gallons per day (MGD) and is capable
of being permitted to a capacity of 7.5 MGD after obtaining an "authorization to
construct"' from the state and completing minor improvements to the Facility; and
Whereas, Conover owns and operates its Southeast to Water Treatment Plant
(SEWWTP) that has a current capacity of 0.6 MGD and must complete significant
modifications as a result of the proposed construction of NC Highway 16 realignment;
and
Whereas, the parties have existing agreements for treating wastewater from Conover at
the Facility, with Conover having a current capacity of 0.479 MGD; and
Whereas, the parties desire to enter into an agreement whereby they will "partner" in the
use, operation, and maintenance of the Facility.
NOW, THEREFORE, in consideration of the terms and conditions hereof, it is agreed as
follows:

Fkrp—o—se. The parties agree to "partner" in the facility by expanding
Conover's share of the treatment capacity at the Facility from 0.479 MGD to

system, provide for management and costs of operation, maintenance, and

Definitions. The words defined in this paragraph shall have the meanings
indicated when used in this Agreement:

Wastewater Treatment Plant.

contribution will be calculated monthly based on the average flow and TSS
concentration from all points of connection to the City of Newton ontfalls.

'storieally the City of Conover has had several fields permitted to receive the digested
biosolid materials generated within the treatment facilities serving th, e Town. The fields have
not received biosolid materials for several years because of the interlocal agreement to
develop and support the regional biosolids compost facility in Fbekory. Nonetheless, less, the City
of Conover desires to maintain the permit as an active alto Live should they ever require
lead application activity to manage the biosolid materials. Should the fields be required, the
City is fully cognizant iant that there will be requirements to stabilize the materials and assure
adequate vector attraction reduction is achieved prior to any land application.

The purpose of the brief report which follows is to describe the conditions encountered on the
Sipes Orchard Site and to describe the results of the soil sampling accomplished in support of
the permit renewalp posed. This is a back-up alternative, the primary option for the City of
Conover will remain the Regional Biosolids, Compost Facility operated by the municipal
consortium and located in ffickory.
Location
The sites examined arc located north of Conover on City farm Road. The sites are currently
permitted to serve as a receiver for biosolid materials and the only applications in the last few
years have been those from the City of Lenoir accomplished`through an emergency
agreement executed between the respective municipalities and the state. The sites at Sipes
Orchard occupy landscape positions typical of those encountered throughout the Piedmont
Region of North Carolina. The sags examined are located on SR 1484 Sipes Orchard d or
County Home Rd. The sites occupy locations ns located to the east and west of the roads One of
the two sites has been designated for permit purposes as NE while the other has been
designated SW.°These sites are in pasture and they are well suited for the land application
operation proposed, The land use has not changed since the initial permit was issued in 1992,
Access to the sites is off SR 1484 and the ingress and egress are suitable. The well
established pasture sites are well suited to eei e this material.
Site and Soil Conditions
The soil resources mapped on the Sipes Orchard property are typical of those encountered
throughout the Piedmont, The Modem Soil Survey of Catawba County indicates that the
predominant soiis mapped can the site include: Cecil and Pa let on the upland landscape

positions and Altavista in the terrace positions. These soils are very well suited for crop
production and serve well as biosolids receiver sites.
The slopes on the receiver sites have not changed since the initial land application permit was
issued in 1992. The are identified as buffers and areas with the steep slopes remain a
concern with this or any land application prograrn.'These areas are evident on the site maps
and clear to anyone on the site, nonetheless the ORC must label these areas with flagging to
assure no materials are applied within designated buffers should the land application
proposed become necessary. The as with slopes in excess of 12% should not be included
in the areas intended to receive bias lid materials, or to any land application operations,
the areas with steep slopes and the areas in the flood -plain should be identified as a part of
the site buffer and no material applied therein.
Soil Testing and Recommendations
Pasture grazing and bay harvest are adequate as crop management measures on the Sipes
Orchard site. The livestock benefit from the grazing and cause no apparent damage to site
soils. Pasture grasses are well established and could benefit from the addition of lime and
phosphorus as indicated in Table 2, Nutrient and Lime Recommcndations. These nutrients

are not required for agricultural operations, but must be supplied if biosolid materials are
applied to any portion of the, site,
Conclusions
The sites intended to serve as potential receiver sites for biosolid materials are well suited for
this land use activity. Prior to any application of'biosolid materials, supplemental lime will be
required, This adjustment to improve soil fertility is essential to assureno adverse impacts
from the application of biosolids.
In addition to the soil fertility adjustments, the biosolid materials applied to these sites must
be stabilized and treated to achieve the required level of vector attraction reduction and
pathogen reduction prior to any application. This can be achieved by digesting the material or
it can be achieved through lime stabilization and injection. Regardless of the method
selected, documentation must be provided to regulatory agencies that both the VAR and
PSRP treatment has been achieved prior to any land application. Please note the
recommendations described by Mr. Frederick concerning slopes and the need to clearly
identify as of concem prior to any biosolid application.

PERMIT FOR THE CONSTRUCTION OF A WELL OR WELL SYSTEM
In accordance with the provisions of Article 7, Chapter 87, North Carolina
General Statutes, and other applicable Laws, Rules and Regulations,
PERMISSION IS HEREBY GRANTED TO
The City of Conover
FOR THE CONSTRUCTION OF A MONITOR WELL SYSTEM located off State Road 1502 in
Iredell County in accordance with the application dated August 1, 1986 and in
conformity with specifications and supporting data, all of which are filed with
the Department of Natural Resources and Community Development and are
considered a part of this Permit., The monitor well system is to be
constructed in the residuum of the Blue Ridge Inner Piedmont Belt Hydrogeologic
System.
This Permit is for well construction only, and does not waive any
provisions or requirements of the Water Use Act of 1967, or any other
applicable laws or regulations.
Construction of a well under this Permit shall be in compliance with the
North Carolina Well Construction, Regulations and Standards, and any other laws
and regulations pertaining to well construction.
This Permit will be effective from the date of its issuance until January
5, 1987 and shall be subject to other specified conditions, limitations, or
exceptions as follows:
1. The borehole shall not penetrate to a depth greater than the depth to
be monitored or the depth from which contaminants are to be
recovered.

2. e well shall not hydraulically connect separate aquifers.
. Construction materials shall be compatible with the contaminants to
be monitored or recovered. The casing shall equal or exceed Schedule

4 The well shall be constructed in such a manner that water from land
surface cannot migrate into the gravel pack or well screen area.
5. When a gravel pack is placed around the screen, a seal shall be
installed above the ,gravel.

the borehole wall from land surface to a depth within two feet
above the top of the well screen or to the bottom of the casing'
for open end wells.
. All wells shall be secured to reasonably insure against unauthorized
access and use. The well shall be permanently labeled with a warning
that it is for monitoring, purposes and the entrance to the well must
be secured with a'lockable cap.
B. All wells .shall be afforded reasonable protection against damage
during construction and use. The well head may be terminated below
land surface provided it is covered with a water tight seal.
. Each well shall have permanently affixed an identification plate.
10. A completed -1 and espies of all water quality results must be
submitted for each well to the Division of'Environmental Management.
11,. When any monitor well is no, longer useful for its intended purpose,
it shall be properly abandoned and an abandonment report filmed with
the Division of Environmental Management.

Catawba County, N. U.
A review of the permit application from the City of Conover for land
application of sludge was made by the Mooresville Regional Groundwater Staff.
The applicant proposes to haul sludge from the following sites. Southeast
Wastewater Treatment Plant, Southwest wastewater Treatment plant, Northeast
Wastewater Treatment blast, and Fairgro e Wastewater Treatment Plant.
The draft site investigation indicates the five receiver sites to be a
Cecil-Pacolet soils and eorgeville-Herndon type soils. These soils are
described as being well drained with slaw permeability. The receiver sites
consist of two fields JimRobinson) in Iredell County'and three fields (Fleta
Icehhour, Tolls Icenhour, Arlie ate) in Alexander County.
From our understanding, the sludge from all treatment plants is to be
hauled to the various sites on a schedule which will vary according to sludge
generation rates, weather conditions, and condition of the receiver site.
review of the sludge analysis conducted by the Biological and Engineering
Department at North Carolina State University and'B. A. F. Laboratories
indicates higher COD levels in the Southeast and Southwest plants. The BT
Leachate analysis for the plants indicate levels below groundwater
classification standards with the exception of iron.
It is the recommendation of this Office that a permit be issued to the
City of Conover. The applicant should be required to maintain at least one
control field for groundwater monitoring. The Jim Robinson Site(Field #1 30-
acres) and the F°leta Isenhour Site (Field #3 -acres) appears the best suited
for groundwater monitoring. The monitoring should, consist of one upgradient
and two day gradient wells. Suggested parameters would include NO3, Tip, IDS,
pH, TCC,,Cl, Fe, Specific Conductance and W/L. Background water quality should
be established prior to application of sludge.

The Groundwater Section has reviewed the subject permit
application and have no objections to the proposed project
en the following recommended conditions:
(1) Prior to beginning waste disposal operations: three
monitor wells, one upgradient and two downgradient,
should be installed to monitor groundwater quality at
the Jim Robinson Site (Field #1 30-acres} . The
location and construction details for these wells
should be by approval of the Mooresville Regional Of-
fice, from which a well construction permit must be
obtained. _# Y
(2) The monitor wells should be sampled initially after
construction (and prior to waste disposal operations)
and thereafter every March, July, and November for the
following parameters:

To&l Ammonia TOC
TDS Chloride
Water Levels Total Coliforms
The measurement of water level should be made prior to
sampling for the remaining parameters.
(5) No land application of waste activities should be
undertaken when the seasonal high water table is less
than three feet below land surface.

As part of the Division of Environmental Management's comprehen-
sive approach in addressing the impact of waste treatment, storage,
r disposal projects on the environmentt your permit application has
been forwarded to us for assessment of the potential impact of the
project can groundwater quality.
Our initial review indicates that the data submitted is not suf-
ficient to slake this assessment.
Before your application can he processed therefore, you are re-
quested to submit the following information to the Groundwater Sec-
tion;
1 site -specific map, with topographic contours (contour interval
should not exceed 10 feat or 25 percent of total site relief,
whichever less) , showing all facility -related structures
within the property boundary and the location of all wells,
springs, lakes, ponds, or rather surface drainage features within
500 feet of the principal waste treatment/disposal site is .
Wells should he labeled as to their primary usage (drinking
water, ;process water, monitoring, etc.)

A review of the permit application from the. City of Conover Land Application
was maderby the Regional Groundwater Staff. The report by G. Eugene Smithson
Associates, Inc. makes no mention of soil characteristics below a depth of four'
feet. Additional information needed to evaluate the impact`of these application
sites would be as follows
1 A map should be supplied providing location o sites with reference
to state road numbers. The -map should include the location of any
well, springs, etc.. within 1000 feet of each site,
(2) "topographic maps should be de available detailing existing topography.
Borings should be made to a depth. of 20 feet or anger refusal at each
site and'a geologic description of soils encountered.
4 Depth to the ` an seasonal high water table needs to be determined
for each site.
Background groundwater quality needs to be determined prior to
application of sludge.
