Request to Amend Permit No. 10587R3
City of Hickory Sludge Land Application
Catawba County, North Carolina
This office is in receipt of a request and supporting
documents from Mr. William Jerry Twiggs, Public Utilities
Director, City of Hickory, to allow Huffman Finishing Company to
temporarily land apply sludge at sites No. 9 and 10 in the
subject Permit. Hickory's request stems from an emergency need
of Huffman Finishing to remove and dispose of sludge from their
existing wastewater treatment facilities. Use of the designated
sites is requested until Huffman has received approval and
instituted a land application program.
Supporting inform,ation as submitted by the engineer for
Huffman Finishing reflects an annual sludge generation of 18.7
tons/year (dry weight). Total available acreage (sites 9 and
10) is approximately 228 acres. Phosphorous is the limiting
constituent; however, based on available acreage, site life is
estimated at over 4000 years. Based on analysis submitted by
Huffman, metals did not appear to be a problem.
The two (2) sites have a cover crop of mixed grass and
fescue hay. Sludge application, will be either surface
application or subsurface injection. All buffers specified in
the subject Permit under conditions No. 12, 13, 14 and 15 shall
apply. Hickory should be required to maintain a written log of
all sludge applications as specified in condition No. 19 of the
subject Permit.

Pending final review of the supporting data by the ERG,
approval is recommended for amending the subject Permit to
Include the disposal of Huffman Finishing sludge on sites No. 9
and 10. Approval should be in the form of a condition (or
conditions) added to the subject Permit which allows for the
disposal of sludge from the Huffman Finishing Company wastewater
treatment facilities for a period of two (2) years from date of
Permit amendment. The amended Permit should also reflect the
new tracking number (WQ 0002154), and void No. 10587R3.

Considering the areas requirements for various loading parameters, it
can be seen that the sludge applciation rate will be limiting to PHOSPHORUS
LOADING.
3.0 AVAILABLE LAND AREA:
The City of Hickory has agreed to allow Huffman finishing Company to
use the following fields for sludge disposal that are currently included in
the Permit 10587R3.

*Field No. 11 is not approved for sludge disposal in the Permit No.
10587R3 due to the shallow depth to the bedrock. Accordingly, the total'
land area available for Huffman finishing Company's sludge disposal i
approximately 11 + 112 = 228 Acres.
4.0 EXPECTED SITE LIFE
Considering the metal constituents in sludge and maximum metalloading
allowable at sites having soil CEC of 5.0 Mgq/100 gm Of soil, the expected
site life is calculated as follows:

conditions, or failure of the irrigation area to adequately absorb the wastewater,
the Permittee, shall take such immediate corrective action as may be required
by the Division of Environmental Management.

Plants shall be applied to the sludge disposal site.
13. A 100-foot buffer shall be maintained between the appropriate land owner's property
line and any applied sludge.
14. A 50 foot buffer shall be maintained between drainageways, a 100 foot buffer shall
be maintained between each landowner's property lines, and a 200 foot buffer shall
be maintained between any residence and any applied sludge.
15., No liquid sludge will be applied by surface or subsurface application within 100
feet of any surface water or well, or within 200 feet of any tributary of public
water supply.
16. Maximum slope for sludge application shall be 10% for surface application and
18% for subsurface applications.
17. No sludge shall 'be disposed in areas subject to the 100-year flood.
18. The owner of the disposal site shall be furnished an analysis of sludge delivered
to the site.
19. A recorded log of applications including amounts applied, dates, whether injected
or incorporated, coordinates of application, etc., shall be maintained at the
wastewater treatment plant as a permanent record..

20. In any future transfer of this land, a notice shall be given to the new owner
that gives full details as to the materials applied or incorporated at this
site.
21. The Permittee, at least six (6) months prior to the expiration of this Permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if indicated,
will extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
22. Sludge shall be evenly applied and then plowed or disced in within 24 hours
after application, where no cover crop is established.
23. Prior to initial sludge application, the Permittee shall apply lime and potassium
in accordance with the following schedule:

25. Any monitoring deemed necessary by the Division of Environmental Management
to insure surface and ground water protection will be established and an
acceptable sampling reporting schedule shall be followed.
a. Monitoring wells shall be constructed and sampling schedules, arranged as
required by the Division of Environmental Management and constructed in
accordance with 1.5 NCAC 2C 0.0100.
b. Initially, groundwater monitoring shall be conducted at each site using
(1) up gradient well and two (2) down gradient wells. Contact the Mooresville
Groundwater Regional Supervisor for well siting and other related questions.
c. The wells shall be sampled initially and then quarterly for Cl, NO3, NH3,
Pb, Zn, Cu, Fe, Cr, Fecal Coliform, pH, Conductivity, and phenol. Reports
shall be forwarded to the Mooresville Groundwater Regional Supervisor within
sixty (60) days of each sampling.
26. The application rates shall not exceed:
a. Sludge from Henry Fork Wastewater Treatment Plant
1. 200 lbs. of plant available nitrogen (PAN) per acre per year
2. 1.11 lbs. of cadmium per acre per year
3. 29.4 lbs. of zinc per acre per year

of digested stabi-lized municipal sludges from the Henry Fork and the Northeast Wastewater
Treatment Plants by land application to sites having a total approximate area as identified
in Condition No. 3.1. of this permit,
pursuant to the application received July 27, 1984, and in conformity with the project
plans. specifications, and other supporting data, subsequently filed and approved
by the Department of Natural Resources and Community Development and considered a
part of this permit.
This Permit shall be effective from the date of issuance until, September 30, 1986,
and shall be subject to the following specifiedcconditions and limitations:
1. The permit shall become voidable unless the land application sludge disposal
facilities are used in accordance with the approved documents.
2. This permit is effective. only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. This permit shall 'become voidable in the event of failure of the soil to adequately
absorb the wastes, and may be rescinded unless the facilities are installed,
maintained and operated in a manner which will protect the assigned water quality
standards of the surface waters and ground waters.
4. If any nuisance condition arises concerning the land application operations of
the sites including creation of an odo�r pro"'blem the City of Hickory shall terminate
S.,.udge disposal, operation immediately after notification by the Division of Environ-
mental Management.
5. Diversion or bypassing of the untreated wastewater from the sludge land application
site is prohibited,

2. Proposed Modifications: The applicant wishes to amend
Permit No. 10587R2 to add the proposed sites to the list of
sites permitted for land application.
All other tarns, - conditions and limitations of the permit
are to remain unchanged.
Note: The applicant has a current application to add
another site to thosepermitted for land application. A
R for this application was sent from the MRO dated
March 27, 1997
PART III - EVALUATION AND RECOMMENDATIONS
1.. Performance Evaluation: Meitner of these sites have:
received any previous applications of sludge
The City employs the services of AMSCO to do the balk of
their land application but the City continues to do a small
portion of the applications with their own resources.
Overall, the land application program appears to be well
managed, ed, particularly when AMSCO is making applications.
However, the MRO has recently discovered violations in
buffer zone requirements at a, site where the City has been
making the applications. The City has been advised of our
findings and the fact that we are considering enforcement
action. The City if al.sc, performing corrective action
(removal of sludge, restoration of site, etc.) as directed
by
. Recommendations and/or Special Conditions: 1t is
recommended that the permit be amended as requested.

In accordance with your amendment request received May '101. 1989, we are fonvand ing
herewith Permit No. WQ0001669, dated December 6, 1989, to the City of Hickory for the
continued operation of the subject land application program. This amendment consists of the
continued operation of 1440 acres and the addition of 697.4 acres; fields 18.03, McSwain fami,
17.06, Jarrett farm, and 16.03, Huffman farm has been eliminated from consideration due to
unsuitable conditions and are not included in this permit amendment.
This perti-fit shall be effective from the date of issuance until February 28, 1993, shall
supersede Permit No. 10587R3 issued February 16, 1988, the amendment issued May 16, 1988,
and shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this perniit are unacceptable to you,
you have the right to request an adjudicatorhearing upon written request within 30 days
following receipt of this permit. This request must be in the form of a written petition, con forming
to Chapter 150B of.North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are made this pennit shall

SLUDGE LAND APPLICATION PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
C,uohna as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
City of Hickory
Catawba County
FOR THE
operation of a sludge land application program consisting of the land application of sludge from
the City of Hickory's Wastewater Treatment Plants to sites identified in condition number VI 6
with no discharge of wastes to the surface waters, pursuant to the application received May 10,
1989, and in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Environment, Health and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until February 28, 1993, shall
supersede Permit No. 10587R3 issued February 16, 1988, the amendment issued May 16,1988,
and shall be subject to the following specified conditions and limitations:
1. ME RFORMANCE STANDARDS
1 The Mooresville Regional Office, phone no. 704/663-1699, and the appropriate
local governmental official (county manager/city manager) shall be notified at least
twenty-four (24) hours prior to the initial application of the sludge so that an
inspection can be made of the application sites and application method. Such
notification to the regional supervisor shall be made during the normal office hours
from 8:00 a.m. until 5:0O p.m. on Monday through Friday, excluding State

2 This permit shall become voidable if the soils fail to adequately absorb the wastes
and may be rescinded unless the sites are maintained and operated in'a manner
which will protect the assigned water quality standards of the surface waters and
ground waters.
3.
The land application;program shall be effectively maintained and operated as a
non -discharge system to prevent the discharge of any wastes resulting from the
operation of this program.
4.
The issuance of this perrnit shall not relieve the Pern-tittee of the responsibility for
damages to surface or groundwaters resulting front the operation of this facility,
5.
In the event that the land application program is not operated satisfactorily, including
the creation of nuisance conditions, the Permittee shall cease applying sludge to the
sites and take any immediate corrective actions, including the construction of
additional or replacement wastewater treatment or disposal facilities.

No crops for direct human consumption shall be raised on these sites for a period
of 18 months following sludge application.
7.
Maximum slope for sludge application shall be 10% for surface application and
18% for subsurface applications.
8.
The following buffers zones shall be maintained:
a) 400 feet from residences under separate ownership for surface
application method,
b) 200 feet from residences under separate ownership for injection method,
c) 100 feet from "SA and SB" classified waters and public surface water
supplies for both methods,
d) 50 feet from "WS" classified waters and other streams, creeks, lakes,
rivers, and surface water drainage ways for injection method.
e) 100 feet from "WS" classified waters and other streams, creeks, lakes,
rivers and surface water drainage ways for surface application
method,
17) 100 feet front property lines for both methods,
g) 50 feet from public right of ways for surface application method,
h) 10 feet from upslope interceptor drains and surface water diversions for
both methods,
i) 25 feet from downslope interceptor drains, surface water diversions,
groundwater drainage systems and surface drainage ditches for both
methods.

during the life of this project,

All sludges included in this permit must be stabilized by a process to significantly
reduce pathogens as described in 40 CFR Part 257, Appendix 11) prior to
,application or incorporation, An evaluation of all sludges as specified in condition
11 4 must be conducted as to their ability to demonstrate compliance with this
requirement. A copy of this report must be submitted to the Assistant Chief for
Operations, Division of Environmental Management, Water Quality Section,
Operations Branch, PO Box 27687, Raleigh, NC 27611-7687, on or before January
1, 1990.
11.
Specific sludge application area boundaries shall be clearly marked on each site prior
to and during sludge application,

OPERATION AND MAINTENANCE REQUIREMENTS
I The facilities and disposal sites shall be properly maintained and operated at all
times.
2. A suitable vegetative cover as listed in condition 11 3, shall be maintained in
accordance with the crop management plan approved by this Division.

responsible charge of the lend application operation. The operator must hold a
certificate of the grade at least equivalent to the classification assigned to the
land application program by the Certification Commission.
7. Adequate facilities shall be provided to prevent surface runoff from c",ing any
disposed or stored material into any surface waters.
. Animals should not be grazed on sludge applied land within as 0-t ay period
following the sludge application. Application sites that are to he used for grazing
shall have fencing that will be used to prevent access after each application.
c Surface applied sludge will be plowed or disced within twenty-four 4i hours
after application on lands with no cover crop established.
10For areas that are prone to flooding or within the 1 fl-year flood elevation, sludge
may be applied during periods of dry weather. The sludge must be incorporated
into the soil within twenty-four 4 hours of application.

Il L MONUORING AND &EPQRTINQ RE
1. Any monitoring (including groundwater, surface water, sludge, soil, or plant
tissue anatlyses)' deemed necessary by the Division of Environmental Management
to insure, protection of the environment will be established and an acceptable
sampling and reporting schedule shall b followed. if monitoring data indicates
minimal or no concern to the Division, reduction of monitoring requirements may be
pursued after two annual reporting periods.

2. Proper records shall be maintained by the Pe tree tracking all disposal activities, E.
'These -records shall include, but are not necessarily limited to the following
infortnation:
a) source of sludge
b) date of sludge application
c) location of sludge application (site, field, or one #)
d) method of application
e) weather conditions
f) soil conditions
g) type, of crop growing on field
h) volume of sludge applied in gallons/acre and, dry tons/acre

cumulative pounds/acre of each heavy metal, annual pounds/acre of plant
available nitrogen (PAN), and annual pounds/acre of phosphorus applied
to each field.
3. A representative annual soils analysis shall be conducted of each site receiving
sludge in the respective calendar year and the results maintained on file by the
Permittee for a minimum of five years. The soils analysis shall include but is not
r necessarily lirated to the following par-ameters:

4. A complete sludge analysis and EP Toxicity analysis shall be conducted by the
Permittee quarterly and annually, respectively and the results maintained on file by
the Permittee for a rninimum of five years. If land application occurs at a frequency
less than quarterly, sludge analysis will be required for each instance of land
application. The sludge analysis shall include but is not necessarily limited to the
following parameters:

6. :Noncompliance Notification:
The Permittee shall reportby telephone to the. Mooresville, Regional Office
telephone no. 04/6-1 , as soon as possible, but in no case more than 24 hours
or can the next working day following the occurrence or first knowledge of the
occurrence of any of the following:
a. Any occurrence with the land application program which results in the
land application of significant amounts of wastes ;which are abnormal in
quantity or characteristic.
ba Any failure of the land application program resulting in a discharge of
wastes to receiving waters.
C. Any time that self -monitoring infonnation indicates that the facility has
gone out of compliance with the conditions and limitations of this permit
or the parameters tin which the system was designed,
d, Any process unit failure, due to known or unknown reasons, that render
the facility incapable of adequate sludge treatment.
e. Any spillage or discharge from a vehicle or piping system transporting
sludge to the application site.
Persons reporting such occurrences by telephone shall also file a written report in
letter form; within 15 days following first knowledge of the occurrence. This report
must outline the actions taken or proposed to be taken to ensure that the problem
does not recur.

IV. GROUNDWATER REQUIREMENTS

Environmental Management ment shall be provided.
2. No application of waste activities shall be undertaken when the seasonal high
water table is less than three feet blow land surface.
. The fifteen 15) existing monitor wells must be sampled every March, July,. and
November for the following parameters:

[Groundwater Classifications and Standards]. Unless otherwise noted, ;tire
concentrations are given in parts per million,
The analytical methods used for T X must be capable of detecting the natal of all
halogenated organic compounds present at a concentration of 5.0 parts per billion
(pp) or greater. In the event that a TOX concentration of 5.0 ppb or ,greater is
detected, any individual halogenated organic compound(s) present at a concentration
at or above the 'method detection limit (L) must be identified and quantified
utilizing PA methods 601, 602, 604, and 611.
If TOC concentrations ,greater than 10 mg/I are detected in any do tn, radient
monitoring well, additional sampling and analysis must be conducted to identify the
individual constituents comprising this "Tt CI concentration. If the T C concentration
as measured in the bAQkgLQu-n-d monitor well exceeds 10 , this concentration will
be taken to represent the naturally occurring TOC concentration. Any eceedanes
of this naturally occurring T C concentration in the downgradient wells shall: be
subject to the additional sampling and analysis as described above.
The results of the sampling and analysis shall be sent to the N.C. Division of
Environmental Management on For W-5 (Compliance Monitoring Report
Form) every April, August, and December.
The {Corntalianc 1 o -nJ delineated on the attached site plan for the disposal
system is specified by regulations in 15 NCAC 2L, Classifications and Water
Quality Standards applicable to the groundwater of North Carolina An eatceedance
of Groundwater'.Quality Standards beyond the Compliance Boundary is subject to
penalty provisions applicable under General Statute 1 - 5.1 a. The sale of
property, by the Perrnittee, which is within or contiguous to the disposal system site
may alter location of the Compliance Boundary.

For land application sites permitted on or after December r tl 1983, the Compliance
Boundary is established at the lesser of 250 feet from the edge of the lard application
sites, or 50 feet within the property boundary.

For land application sites permitted prig to December r 0, 1983, the Compliance
Boundary is established at a distance 500 feet from the edge of the land application
sites, or the property boundary, whichever is less.
If the title to any property which may affect the location of the Compliance boundary
is changed, the permittee shall notify the Division Director within 14 days, The
Director shall then establish a modified Compliance Boundary hich will be done as
a modification to the P rrit.
`Fhe REVIEW 1 �[P for the disposal system is specified by regulations in 1
L, Groundwater Classifications and Standards, A REVIEW
BOUNDA.RY is established around disposal systems midway between the
Compliance Boundary and the pe i eter of the wash disposal area. When the
concentration of any substance equals or exceeds the maximum allowable
concentration of that substance at the EM CRY, as determined by
monitoring, the permittee shall tither tij demonstrate, through predictive calculations
or modeling, that natural site conditions, facility design and operational controls will
prevent a violation of standards at the Compliance Boundary; or, (ii) submit a plan
for the alteration of existing site conditions, facility design or operational controls
that will ;prevent a violation of standards at the Compliance; oun ary, and
implement that plan upon its approval by the Director.
" INSPECTIONS
i
i the Peratittee or his designee shall inspect the sludge storage, transport, and
disposal facilities to prevent malfunctions and deterioration, operator errors and
discharges which may cause or lead to the release of wastes to the environment, a
threat to human health, or a nuisance, The Permittee shall keep an inspection log
or summary including at least the gate and time of inspection, observations made,
and any maintenance, repairs, or corrective actions taken by the Permittee. Tbis
log of inspections shall be maintained by the Pe Witte for a period of three years
from the date of the inspection and shall be made available upon request by the
Division of Environmental Management or other permitting authority.
Any dulyr authorized officer, employee, or representative of the Division of
Environmental Management ement may; upon presentation of credentials, enter and
inspect any property, premises or place on of related to the disposal site and
facility at any reasonable time for the purpose of determining compliance with this
permit; may inspect or copy any records that must be kept under the tos and
conditions of this permit; or tilay obtain samples of groundwater, surface water,
or leach ate.

V1. GENERAL CONDITIONS
1. This permit shall become voidable unless the land application activities are carried
out in accordance with the conditions of this pemrit and in the mariner approved
by this Division.
2. This pernin is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. This permit is not transferable, In the event there is a desire for the facilities to
change ownership or a name change of the Permittee, a formal permit request must
be submitted to the Division of Environmental Management accompanied by an
application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. to approval of this request will be considered
on its merits and may, or may not be. approved.
4. Prior to any transfer of this land, a notice shall be given to the new owner that
gives full details of the materials applied or incorporated at this site.
5 This permit shall become voidable unless the agreements between the Perrnittee
and the landowners/lessees are in full force and effect.

Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Environmental
Management in accordance with North Carolina General, Statute 143-215.6,

The annual administering and compliance fee must be paid by the Pen'nittee within
thirty (30) days after being billed by the Division. Failure to pay the fee
accordingly may cause the Division to initiate action to revoke this permit as
specified by 15 NCAC 211,0205 (c)(4).
9.
The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other govemment agencies (local, state, and federal) which have jurisdiction,

A set of approved documents for the subject project must be retained by the applicant
for the life of the project.
11.
The Pennittee, at least six (6) months prior to the expiration of this permit, shall
request its extension. Upon receipt of the request, the Commission will review
the adequacy of the facilities described therein, and if warranted, will extend the
permit for such period of time and under such conditions and limitations as it may
deem appropriate,
12.
This permit may be modified, or revoked and reissued to incorporate any conditions,
limitations and monitoring requirements the Division of Environmental Management
deems necessary in order to adequately protect the environment and public health.
