is rescinded, effective immediately,
If in the future you wish again to operate, the subject nun -discharge system, you must first apply
for and receive a new Land Application of Residual Solids Permit, Please be advised that construction
and rirr operation of the subject facilities without a valid permit is a violation of North Carolina General
Statute § I43-21 , l and may subject the owner/operator to appropriate enforcement actions in accordance
with: North Carolina General Statute 1 3- 15,6A-6C . Civil penalties of up to $25,000 per dare per
violation may be assessed for failure to secure a permit required by North Carolina General Statute § 1 3m

Subject: A provisional renewal of Land Application Permit
WQ0004381
Dear Ms. Thournburg:
The City of Conover requests a provisional renewal of our
land application permit WQ0004381. The purpose of this permit
is to backup our composting program which, is our present means
for handling residuals. The City of Conover has been a member
of a regional composting facility (WQ0004563) since the early
1990s. We have not land applied residuals in 1994. The last
time we land applied residuals we used aerobic digestion as a
means for pathogen and vector attraction reduction. We still
have that capacity but we are not presently digesting our
residuals., We feel if we began land application again we would
use aerobic digestion or lime stabilization as a treatment
method. I see no representative way at this time to analyze our
sludge for the purpose of evaluating loadings. It is possible
that additional treatment may change analytical values. I feel-
45 days of digestion could alter nutrient concentrations. At a
time in the future if we would ever need to use land application
as an residual handling option, the City of Conover would agree
to do any monitoring necessary to verify loading levels and
compliance with the issuance of a final permit prior to applying
residuals. The City of Conover feels a provisional land
application permit could expedite our ability to land apply
residuals in an emergency, when or if, composting is no longer
an option.
The State of North Carolina has purchased one of our two
wastewater treatment facilities (SE WWTP NCO024279) in order to
build a road through the site. This flow will go to the City, of
Newton within six months.

A. Application Form:
This application form must be submitted for any permitting action involving a non -dedicated residuals
land application program.
Non -dedicated residuals land application programs are ones in which all land application sites do not meet the
criteria in l A N AAC 2H M-03 (I l)(a) and tb . Specifically, a residuals land application program cannot, be
designated as non -dedicated if any of the followingapplicable-
* a lice ble.
Any land application site certified for the residuals land application program that receives residuals at
rates or frequencies greater than agronomically justifiable.
+ Any land applications site certified for the residuals land application program that is used primarily for
residuals disposal alone (i.e., versus crop production). ;
y land application site certified for the residuals land application program that is designated as
dedicated by the Division`s Director,
y changes to this application form will result in the application package being returned.

B. GeneralInformation:
V The applicant is either the existing Perrnittee or the entity that is to be responsible for the operation of the
residuals land application program and compliance with the resultant pernot. If the applicant is a corporation,
erasure that that; applicant's name as lasted. in Item I. 1. corresponds with the name tinder which the corporation
is registered with the NC Department of the Secretary of State,
e signing official must meet the criteria, stipulated in 15A NCAC ` H .fluffs (b). An alternate person may be
designated as the signing official, provided that a delegation letter from a person who meets the referenced
criteria is submitted. The delegation` letter does not have to be resubmitted if the signing official has not
changed since the last permitting action associated with this residuals land application program.
The submitted fee should be in accordance with the Division's most recently -adopted fee schedule. This fee
schedule as well as a detailed explanation of its application may be downloaded from the gels site at:

Conover, Clearly biosolids management is a critical issue for communities. Althtatr h the
primary biosolids management option for the City remains the regional compost facility, the
need to maintain the permitted sites is important as asback-tip option.
In support ofthe permit renewal, an investigation ofthe permitt-ed sites at Sipes Dairy was
accomplished. During this investigation, a walking reconnaissance of the site was performed
and samples of the sail material from the Sipes Dairy site were collected for analysis. The
soil materials have l-reen tested and those results are included with the report which follows.
i"hc site continues to appear well suited to receive l iosolid materials. The soil testing
i.,'ciicaates that sail pH is slightly below the optimum for land application, but the low pfl can
e:.asily be corrected prior to any biosolids application operation.

the regulatory agency and the City of Conover, if additional information is required, we will

1-listorically the City of Conover has had several fields permitted to receive the digested
biosolid materials generated within the treatment fi�ac:ilities serving tlae Town, The fields have.
not received biosolidmaterials for several years because of the interloca;l agreement to
develop and support the regional 'l iosolids compost facility in Hickory. Nonetheless the City='
of Conover desires to maintain the permit as an active ~alternative should they. ever rCgUire at
lazed application activity to manage the biosolid materials. Should the fields s be acquired, the
City is Fully cognizant that there will be retlrrireraaents to stabilize the materials and assure
adequate vector attraction ra:daacti011 is achieved prior to any land application.
The purpose of the brief report which folloA.s is to describe the,. conditions c.rrCOUntercd on the
Sipes Orchard Site and to describe the results of the soil sampling accomplished in support of
the permit renewal proposed. This is as back-up alternative., the priniai-y option for the City of
Conover will 'remain the Regional Biosolids C',ornpo t Facility operated by the rrararaicipatl
consortium and located in Hickory.
Location
The situ examined are located north ofC.`onov er on City la:rrat Road. The sites are cc rrcutlN,,
permitted to serve as a receiver for biosolid materials and the oral:; applications in the last teas
years have been those t'rorn the City of t.ealcair accomplished through an emergency
agreement execrated betvve rr die respective municipalities lities and the: state.. The sites at Sipes
Orchard occupy landscape positions typical eat those encountered throughout the Piedmont
Region trt`North t."arolina. The sites examined are located on SR 1484 Sipes Orchard lid or
County Home;l d. 'Fhe sites occupy locations located to the east and west ofthe road. One o
the two .sites has been designaated.'f'or pernut parrpose,s as NE while the other has been
designated SW. These sites are in pasture and they are well suites for the land application
operation proposed. The land use has not changed since the initial permit was issued in 19921.
Access to the sites is oJTSR 1484 and the ingress and egress are suitable. The well
established pasture sites are well suited to receive this materiaal.
Site and Soil Condition
The sail resources recapped on the: Sipes Orchard property are typical of those encountered
throughout the.. Piedmont he Modern Soil Starved ofC'ataa vba County indicates that the
predon-unant soils aaaapped on the site include Cecil and Paacolet can the art)iaand landscape
positions and Altavista in the terrace positions. These soils are ver\, NveH suited for crop
production and serve well as biosolids receiver sites,.
The slopes on the receiver sites have not changed since the initial land application permit was
issued in 1992. The areas identified as buffers and areas with the steep slopes remain a
concern with this or any land application pro rani, These areas are evident on the site rnaps
and clear to anyone on the site, nonetheless the (,-)RC a1US1 label these areas with flagging to
assure no materials are applied within designated buffers should the ]and application
proposed become necessary. The areas with slopes in excess of 12% should not be included
in the areas intended to receive biosolid inaterials. Prior to any land application operations,
the areas with steep slopes and the areas in the flood -plain should be identified as a part of
the site buffer and no material applied therein.
Soil Testing and Recomniendations
Soil samples were collected from both the NW and the SLI' site. The soil materials were
subjected to a battery of standard soil fertility tests as accomplished by the North Carolina
Department of Agriculture,, Agrononaic Services laboratory, The results ofthese soil tests are
summarized in Table 1, Soil Test Results. City of Conover Sipes Orchard Site, attached and
the recommendations gleaned from these tests are suminarized in Table 2.'Nutrient and Lime
R,eco in me ndat ions, City ofConover Sipes Orchard Sites. attached.
In general the soil testing indicates that the soil fertility levels are adequate for growth ofthe
fescue pastures present on the site. The soil pH is low and should be adjjusted upwards to
optimize plant growth regardless of the use of the site as as receiver for biosolid materials, Ths,
soil pl-I ranges between 5.2 and 5.5 on the NE site and between 5.1 and 5.4 on the SW site.
The recommended soil pIJ for the f`cSCUC grass on these sails ,,NJ-icn blosolids are applied is as
minimum of 6.0, Clearly, lime will be required to ad.just the spoil pH upwards ifbio,,.,,olid
materials are to be applied at some time in the future. The recommended finie addition is
provided in Table 2. The soil pH adjiusti-nent will require a lime application of approxii-iii-ttely
1 5 tons per acre, A very high quality lime stable blosolid material is available from the City
of Lenoir and the site manager should consider application ofthe Lenoir Lirne as a soil
conditioner.
The Phosphorus and Potassium levels are also low, Supplemental Phosphorus and Potassium
must be supplied to optimize crop growth. Other minerals such as Calcium, Magnesium,
Copper and Zinc are present at levels sufficient for crop growth. The recommendations for
Potassium and Phosphorus are presented in'Table -1. These rnineral supplements should be
supplied to optimize the fertility of the fields soon.
Pasture grazing and hay harvest are adequate as crop management measures on the Sipes
Orchard site, The livestock berietit from the grazing and cause no apparent daniage to site
soils, pasture grasses are well established and could benefit from the addition of lime' and
phosphorus as indicated inTable 2, Nutrient and Lime Recommendations. These nutrients
are not required for agricultural operations, but must be supplied if biosolid materials are
applied to any portion of the site.
Conclusions
The sites intended to serve as potential receiver sites for biosolid materials are well suited for
this land use activity. Prior to any application of biosolid materials, supplemental lime will be
required. This adJustment to improve soil fertility is essential to assure no adverse impacts
from the application ofbiosolids.
In addition to the soil fertility adjustments, the biosolid materials applied to these sites must
be stabilized and treated to achieve the required level of vector attraction reduction and
pathogen reduction prior to any application. This can be achieved by digesting the material or
it can be achieved through lime stabilization and injection. Regardless of the method
selected, documentation must be provided to regulatory agencies that both the VAR and
PSRP treatment has been achieved prior to any land application. Please note the
recommendations described by Mr. Frederick concerning slopes and the need to clearly
identify areas of concern prior to any biosolid application.

I. PERFORMANCE S"TANDARD
1, The residuals land application program shall be effectively maintained and operated as a non -
discharge system to prevent the discharge of any wastes resulting from the operation of this
program.
2. This permit shall become voidable if the sails of the bind application sites fail to assimilate the,
residuals adequately and may be rescinded unless the land application sites are maintained and
operated in a manner that will protect the assigned' water' quality standards of the surface
waters and groundwater.
3, The issuance of this permit shall not relieve the Permittee of the responsibility for damages to
surface waters or groundwater resulting from ; the operation' of this residuals land application

4. In the event that the residuals land_application program is not operated satisfactorily, including
the creation of nuisance conditions, the Permittee shall cease land applying residuals to the
site, contact the Aquifer Protection Section of the appropriate Division of Water Quality's
(Division) regional office, and tape any immediate corrective actions as may be required by
the Division.

7 When residuals are land applied under the conditions of this permit, the Class A pathogen
requirements and site restrictions in 40 CFR Part 03. 2(a) or the Class l3 pathogen
requirements and site restrictions in 40 CFR Part 0.32(b), and one of vector attraction
reduction requirements in 40 CFR part 503,33 shall be met. Additionally, an evaluation shall.
be performed that demonstrates the residuals' ability to comply with this requirement. Upon
request, a copy of this evaluation, including all test results and calculations, shall be
submitted. Only residuals that are generated by the residuals source -generating facilities that
are identified as being exempt from this condition in the most recently -certified Attachment
shall not be required to comply with the specified pathogen reduction and vector attraction
reduction requirements,
Only the land application sites listed in the most recently -certified Attachnaent l3 of this permit
are approved for residuals land application.
. This permit shall become voidable unless the agreements between the Pertanittee and the
landowners and lessees or operators of any land application sites listed in the most recently
certified Attachment B of this permit not owned by the Pernaittee are in full force and effect.
These agreements shall be considered expired concurrent with the expiration date of the
permit and shall be renewed at the same time the permit is renewed.
10. The appropriate local governmental official (i.e,, county manager, city manager, etc,) shall be
notified at least 24 hours prior to the initial residuals `land application event to any new land
application site, In addition, the appropriate county manager's office shall be notified prior to
the initial residuals land application event on any new site so that they will be aware that
residuals land application activities have conartenced on the site.

11.; The Aquifer Protection Section of the appropriate Division's regional office shall be notified
at least 24 hours prior to the initial residuals land application event on any new land
application site. Such notification to the regional Water Quality Supervisor shall be made

3� No residuals shall be stored at any land application site at any time, unless written approval,
has first been requested and obtained from the Division,
4, A copy of this permit shall be maintained in all manned equipment t the land application sites
when residuals are being; land applied during the, life of this permit. A swill prevention and
control plan shall be maintained in all residuals transport and application vehicles.
, When land applying residuals to any lard application site, the following buffer zones shall be
maintained at all times:
a. 400 feet from residences or places of public assembly under separate ownership for
surface application methods; however, the buffer zone requirement may be :reduced to a
minimum of 100 feet upon written consent of the owner and approval from the Aquifer
Protection Section of the appropriate Division's regional office in Attachment B of this
permit;
b. 200 feet from residences or places of public assembly under separate ownership for
subsurface application methods; however, the buffer zone requirement ent may be reduced to
minimum of 100 feet upon written consent of the owner and approval from the Aquifer
Protection Section of the appropriate Division's regional ogee in Attachment B of this
permit;
c. 100 feet from any public or private water supply source, waters classified as SA or Slag
and any; Class 1 or Class 11 impounded reservoir used as a source of drinking water for
both methods;
d. 100 feet from any streams classified as WS or 11, any other stream, canal, marsh or coastal
waters and another tape or impoundment for surface application;
e. 50 feet from any streams classified as WS or 1 , any other stream, canal, marsh or coastal
waters and any other lake or impoundment for subsurface application..;
f. 50 feet from property limes for both surface and subsurface application methods;
g. 50 feet from public right of ways for both surface and subsurface applicationmethods;
li. 10 feet from up lope interceptor drains and surface water diversions for both surface and
subsurface application inethods; and
L 25 feet from downslope interceptor drains, surface water diversions, groundwater drainage
systems, and surface drainage ditches for both surface and subsurface application methods.
6. Maximurn slope for land application of residuals shall be 10 percent for surface application
methods and 18 percent for subsurface application methods.
7. Specific residuals land application area boundaries shall be clearly marked, on each land
application site prior to and during a residuals land application event,

9. An acceptable pH shall be maintained in the soil, residuals, and lime mixture, greater than 6.0,
on all land application sites onto which residuals are land applied to ensure optimum yield for
the crops specified in Condition 11. 13, The agronomist shall provide information On the pl-I
best suited for the specified crop and the soil type.
10. Should any of the residuals generated by the residuals source -generating facilities listed in the
most recently -certified Attachment A of this permit contain as high salt content (i.e,, high
sodium adsorption ratio (Safi) of five. or higher), the exchangeable sodium percentage (ESP)
or other method as approved by the Division, using the results from the annual soils analysis
as required by this permit, shall be monitored on all of the land application sites. The local
Cooperative Extension Office, the Department of Agriculture and Consumer Services, the
Natural Resource Conservation Service, a North Carolina -licensed Soil Scientist, or other
agronomist shall review the results and make recommendations regarding soil amendments
(e.g., gypsum, etc.) or other ameliorative mechanism filar maintaining the integrity of the site in
terms of suitability for land application of residuals and maintaining conditions conducive to
crop growth. The Permittee shall implernent such recornmendations accordingly and shall
maintain 'written records of each monitoring event that includes details of the sites covered
and rate of soil amendment application.

11. Prior to land applying residuals to any land application site that has previously received or is
intended to receive aninial waste (e,g,, poultry liver, etc.) or other source of nutrients (e,g,,
fertilizer, etc.) in the hature, the Pennittee shall obtain infix-mation pertaining to the volume
and analysis of the applied waste/nutrients from the landowner and/or lessee/operator of the
site. The Permittee shall be responsible for verifying the volume of residuals that may be land
applied to the site such that the plant available nitrogen (PAN) loading rate for the specified
crop (i.e, see Condition 11. 13.)'shall not be exceeded by all of the sources of PAN applied.
Should the maximum PAN loading rate be met or exceeded, then no additional residuals shall
be land applied to the site,
12. A suitable vegetative cover, as listed in Condition 11. 13., shall be maintained on land
application sites onto which residuals are land applied in accordance with the crop
management plan outlined by the local Cooperative Extension Office, the Department of
Agriculture and Consumer Services, the Natural Resource Conservation Service, or other
agronomist and as approved by file Division.
11 Residuals and other sources of PAN shall be land applied to all land application sites at
agronomic rates in accordance with the crop management plan outlined by the local

The Permittee shall apply for and receive a modification of this permit before land applying
residuals on any land application site that is to be established in a crop other than those listed
above. A maximum PAN loading rate for the desired crop shall be approved with the pen -nit
toodification.
If the land application sites are to be overseeded (e.g, bermuda grass in the summer and rye
grass in the winter with BOTH crops to receive residuals), then the second Crop shall receive
an application of PAN at a rate of no greater than 50 pounds per acre per year. This practice -
shall be allowed as long as the second crop is to be harvested, If the second crop is to be
planted for erosion control only and is to be tilled into the soil, then no residuals shall be land
applied to these sites because the PAN will essentially be returned to the soil,

the Division.
14, Animals shall not he grazed on any land application site for 30 days after any residuals land
application event, Sites that are to be used for grazing shall have fencing that will be used to
prevent access after; each event.
15. Food crops, feed crops, and fiber crops that do not come in contact with the residuals shall not
be harvested for 30 days after any 'residuals land application event,
16. brood crops with harvested parts that touch theresidual/soil mixture and are totally above the.:
land surface (e.g,, tobacco, melons, cueurnbers, squash, etc.) shall not be harvested for 14
months after any residuals land application event.
17. Food crops with harvested parts below the surface of the. land (i.e., root crops such as potatoes,.
carrots, radishes, etc,) shall not be harvested for 20 months after any residuals land application
event when the residuals remain on the land surface for four months or longer prior to
incorporation into the soil.

21, Adequate procedures shall be provided to prevent surface runoff` from: carrying any land
applied or stored residuals into any surface waters.-
22. Surface -applied residuals shall be plowed or disced within 24 hours alter land application on
land application sites with no cover crop established.
23. For land application sites that are prone to flooding or within the 100-year flood elevation,
residuals shall be land applied only during periods :of dry weather., The residuals shall b
incorporated into the soil within 24 hours after land application.
24. Residuals shall not be lazed applied during inclernert weather or until 24 hours following
rainfall event of 0t5-inch' or greater in 24 hours. Any emergency residuals land application
easures shall first be, approved in writing by the Division.
25. Residuals shall not be land applied to any land application site that is flooded, frozen, or
snow-covered:
26. Appropriate measures shall be taken to control public access to the land application sites
during active site use and for the 12-month period following:the last residuals land application
event.. Such controls may include the hosting of signs indicating the activities being
conducted at each site;

III. MONI'I TORING Ili REPORTING REQUIREMENTS

I Any monitoring (i.e-, including groundNvater, surface water, residuals, soil, or pliant tissue
analyses) deemed necessary by the Division to;ensure 'protection of the environment shall be
established, and an acceptable sampling and reporting schedule shall be followed.
3. Residuals generated by each residuals source -generating facility listed in: the must -recently -
certified Attachment A of this permit shall be analyzed to demonstrate that they are non-
hazardous under the Resource Conservation and. Recovery Act (RCR . A.corros vity,
ignit bility, and reactivity analysis as well as a Toxicity Characteristics Leaching Procedure
(TC LP) analysis shall be conducted on residuals generated by each: residuals source -
generating facility listed in the most recently -certified Attachment A of this pernat. The
analyses shall be performed at the frequency uency specified in the most recently -certified
Attachment A of this permit, and the results shall be maintained on file by the Permittee for a
minimum of five years. If residuals generated by particular residuals source- rncratin
facility are land applied at a frequency less than that which is specified in the most recently -
certified Attachment A of this permit, the analyses shall be required for each residuals land
application event. Only residuals that are generated by the residual source -generating
facilities that are identified as being exempt from this condition in the most recently -certified
Attachment A of this permit shall not be required to comply with this monitoring requirement.

monitored for two years at the frequency specified in the most recently -certified Attachment
of this peraaait, the Pernintee may submit a request to the Division for a permit modification to
reduce the frequency of this monitoring requirement. In no case, however, shall the frequency
of this monitoring be less than once per year when a residuals land application event of
residuals generated by the residuals source -generating facility occurs during that year:
. Residuals generated by each, residuals source -generating facility listed in the most recently
certified Attachment A of this permit shall be monitored for compliance with Condition I. 7
The monitoring shall be performed at the frequency specified in the nrost recently -certified-
Attac rnent A of this permit, and data to verify pathogen and vector attraction reduction of the
residuals shall be maintained on Cale by the Pennittee for a minimum of five years. The
required data shall be specific to the stabilization process utilised, but also shall be sufficient
to demonstrate clear compliance with the Class A pathogen reduction requirement,-, in 40 CF
Part 03.32() or the Class B pathogen reduction requirements and site restrictions in 40 CFR
Part 303.32(b) as well as one of vector attraction reduction requirements in 40 CFR Part
303.33. In addition, the Environmental Protection Agency (EPA) certification statements
concerning compliance with pathogen reduction requirements, vector attraction reduction
requirer°nents, and management practices shall be completed at the frequency specified in the
most recently -certified Attachment A of this pennit by the proper authority or authorities, if
more than one is involved (i.e., either the person who prepares the residuals, the person who
derives the material, or the person who applies the residuals). Only residuals that are
generated by the residuals source -generating facilities that are identified as being exempt from.
Condition I. 7. in the most recently -certified Attachment A of this permit shall not be required
to comply with this monitoring requirement.
3, Laboratory analyses as required by Condition III, 2., Condition III. 3., and Condition 111. 4.
shall be perfornredfpfathered on the residuals as they are to be land applied. Furthermore,
analytical determinations made pursuant to the monitoring and reporting requirements of this;
permit shall be made by a laboratory certified by the Division for the required parameter(s)
under l 5A NCAC 2H .0800 or p 3A NCAC. 2H , 1100.
6. Proper records shall be maintained by the Permittee tracking all residuals land application
events. These records shall include, but are not necessarily limited to, the, following
infonnation:
a. Source of residuals-,
bDate of land application;
c, Location of land application (i.e., site., field, or zone number);
d. Method of land application;
e. Weather conditions (i.e., sunny, cloudy, raining, etc.);
f. Soil conditions (i.e., dry, wet, frozen, etc.)-,
& Type of crop or crops to be grown on field-,
h. Volume of residuals land applied in gallons per acre, dry tons per acre, or kilograms per
hectare.-
i. Volume of animal waste or other nutrient source applied in gallons per acre, dry ton per
acre, or kilograms per hectare (if applicable);
jVolume of soil amendments (i.e., lime, gypsum, etc.) applied in gallons per acre, dry for
per acre, or kilograms per hectare (if applicable); and
k. Annual and cumulative totals of dry tons per acre of residuals as well as animal waste and
other sources of nutrients (i.e., if applicable), annual and cumulative pounds per acre of
each heavy metal (i.e., shall include, but shall not be limited to, arsenic, cadmium, copper,
lead, mercury, molybdenum, nickel, selenium, and zinc), annual pounds per acre of PAN,
and annual pounds per acre of phosphorus applied to each field,
T A representative annual soils analysis (i.e., Standard Soil Fertility Analysis) shall be
conducted on each land application site on which a residuals land application event in the
respective calendar year has occurred or is to occur, and the results shall be maintained on file
by the Permittee for a minimum of five years. The Standard Soil Fertility Analysis shall
include, but is not necessarily limited to, the following parameters:

8. Three copies of all required, monitoring and reporting requirements as specified in Condition

and Condition 111. 7. shall be submitted annually on or before March I at of the year following

9. Noncompliance Notification:
The Permittee shall report by telephone to the Aquifer Protection Section of the Division's
Mooresville Regional Of at telephone number 704-663-1699, as soon as possible, but in no
case more than 24 hours or on the next working day following the occurrence or first
lo-iowledge of the occurrence of any of the following:
a. Any occurrence with the residuals land application program that results in the land
application of significant amounts of residuals that are abnormal in quantity or
characteristic.
b. Any failure of the residuals land application program resulting in a release of material to
receiving waters,
c. Any time that self -monitoring inforination indicates that the residuals land application
program has gone out of compliance with the conditions and, limitations of this permit or
the parameters on which the program system was designed.
d. Any process unit failure, due to known or unknown reasons, that render the residuals land
application progorram incapable of adequate residuals treatment.
e. Any spillage or discharge from a vehicle or piping system transporting residuals to the
application site.
Persons reporting such occurrences', by telephone shall also file a written report in letter form
within five days following first knowledge of the occurrence. This report shall outline the
actions taken or proposed to be taken to ensure that the problem does not recur.
IV. GrROUNDWATYR REQUIREMENTS,
a. Each land application site identified with a GW-A in the most recently -certified
Attachment B of this pen -nit is dominated by soils with a mean seasonal high water table
greater than three feet below the land surface. Residuals land application events may
occur on these sites throughout the year.
b. Each land application site identified with a GW-B in the most recently -certified
Attachment B of this permit is dominated by soils with a mean seasonal high water table
between one and three feet below the land surface. Residual land application events on
these sites shall be prohibited from December through March, inclusive. No residuals
shall be land applied to these sites when the vertical separation between the depth of
residuals land application and the water table is less than three feet. The actual water
table depth for seasonally -restricted soils shall be verified by soil borings within 24 hours
prior to any residuals land application event that occurs from April through November,
inclusive. The number of borings advanced shall be sufficient to characterize water table
conditions across the land application site adequately. Any open borings shall be properly
filled with native soil, prior to the residuals land application event, to decrease the chance
of any residuals contaminating the groundwater.

a, The COMPLIANCE BOUNDARY for residuals land application programs is specified by
regulations in 15A NCAC 2L (i.e., "Groundwater Classifications and Standards"), The
Compliance Boundary for each land application site is established at either 250 feet from
the residuals land application area or 50 feet within the property boundary, whichever is
closest to the residuals land application area, An exceedance of Groundwater Quality
Standards at or beyond the Compliance Boundary is subject to immediate remediation
action according to 15A NCAC 2L .0106 (d)(2).
b. The REVIEW BOUNDARY shall be established around each land application site
midway between the Compliance Boundary and the perimeter of the residuals land
application area. Any exceedance of Groundwater Quality Standards at the Review
Boundary shall require action in accordance with 15A NCAC 2L.0106 (d)(2)
3 Additional, Rectuirements:
a. Any groundwater quality monitoring, as deemed necessary by the Division, shall be
provided,
V. INSPECTIONS
L Prior to each residuals land application event, the Permittee or his designee shall inspect the
residuals storage, transport, and application facilities to prevent malfunctions and
deterioration, operator errors, and discharges that may cause or lead to the release of wastes to
the environment, a threat to human health, or a nuisance. '17he Permittee :shall maintain an
inspection log or summary including at least the date and time of inspection, observations
made, and any maintenance, repairs, or corrective actions taken by the Permittee, This log of
inspections shall be maintained by the Permittee for a period of five years ftorn the date of the
inspection and shall be made available to the Division or other permitting authority, upon
request.
2. Any duly authorized officer, employee, or representative of the Division may, upon
presentation of credentials, enter and inspect any property, premises, or place on or related to
the land application sites or facilities at any reasonable time for the purpose of determining
compliance with this permit; may inspect or copy any records that must be kept under the
terms and conditions of this permit; and may obtain samples of groundwater, surface water, or
leachate,
Vt. GENERAL CONDITIONS
1. This perrint shall becorne, voidable unless the residuals land application events are carried out
in accordance with the conditions of this permit, the supporting materials, and in the manner
approved by the Division.
2. This permit shall be effective only with respect to the nature and volurne of residuals described
in the application and other supporting data,
3. Failure to abide by the conditions and limitations contained in this pee it may subject the
Permittee to an enforcement action by the Division in accordance with North Carolina General
Statutes § I 43-215.6A through § 143-215.6C

4. The annual administering and compliance fee shall be paid by the Pernrittee within 30 days
rafter being billed by the Division. Failure to pay the fee accordingly may cause the Division
to initiate action to revoke this permit, as specified by 15 NCAC 2H .0205 (c)(4):
5 The issuance of this permit does not preclude.. the Pea ittee from complying with any and all
statutes, rules, regulations; or ordinances that may be unposed by other government agencies
(i.e,, local, state, and federal) which have jurisdiction, including*, but not limited to, applicable
river buffer rules in 15A NC°A B .0200, soil erosion and sedimentation control requirements
in 15A NCAC Chapter 4 and under the Division's General permit ]' C G010000, and any
requirements pertaining to wetlands under 15A NCAC" 2B .0200 and 15A NC:AC .05t1t1.
6. This perrint may be modified, revoked, and,/or reissued to incorporate any conditions,
limitations and monitoring requirements the Division deems necessary in order to protect the
environnient and public health adequately.
The Perinittee, at least six months prior to the expiration of this permit, shall request its
extension, Upon receipt of the request, the Division shall review the adequacy of the facilities
and residuals land application program described therein, and if warranted, shall extend the
peril t for such period of tune and unifier such conditions and limitations as it may deem
appropriate.
8. This permit shall not be automatically transferable. In the event that there is a desire for the
residuals land application program to change ownership or to change the name; of the
Permittee, a formal permit request shall be submitted to the Division documentation from the
parties involved and other supporting materials as may be appropriate. The approval of this
request shall be considered on its merits and may or may not be approved.

Dear Mr. Joshi:
Enclosed are maps with compliance boundaries marked
for the two fields at the Sipes Orchard location. I wish
to divide the property into two fields.
The Northern field, on the opposite'side of the road
from the main school complex, is field 1. The southern
field behind the school complex is field 2.
Field I contains approximately 85 acres total with
about 70 usable after buffer zones. The northwest section
of site 1 is buffered, on the inap, 400 feet from structures
of dwelling. The southwest section of field is also
buffered 400 from dwellings. The west boundary is buffered
50 from public right of way. The southeastern boundary is
buffered 100 feet from the streams and 400 feet from
dwellings, On the southeastern edge of the field there are
some abandoned structures that we buffered away from. On
the northeastern part of field 1 there is a natural wooded
buffer.
The southern field behind the school complex is field 2.
Field 2 has approximately 65 total acres with about 60
after buffer zones. The field is mostly naturally buffered
by woods. There is a 100 foot buffer on the eastern
boundary for property lines. There is 100 foot buffer on
the western side for a stream.
The it of Conover is scheduled to eliminate the
Southeast Wastewater Treatment Plant NCO024279 around April
2004. The flow will be sent to the it of Newton. In the
municipal contract the City of Conover agrees to haul a
volume of sludge from the City of Newton"s facility equal,
to Conover's solids loading contribution. Because Conover's
wastewater will mix with Newton's wastewater prior to
,entering Newton's plant the sludge will be a combination of
Newton and Conover. We intend to compost the material but
in an emergency situation we may have to make arrangements
for eider Newton or Conover to land apply the slu

Historically the City of Conover has had several fields permitted to receive the digested
biosolid materials generated within the treatment facilities serving the Town, The fields have
not received biosolid materials for several years because of the interlocal agreement to
develop and support the regional biosolids, compost facility in Hickory. Nonetheless, the City
of Conover desires to maintain the permit as an active alternative should they ever require a
land application activity to manage the biosolid materials. Should the fields be required, the
City is fully cognizant that there will be requirements to stabilize the materials and assure
adequate vector attraction, reduction is achieved prior to any land application.

The purpose of the brief report which follows is to describe the conditions encountered on the
Sipes Orchard Site and to describe the results of the soil sampling accomplished in support of
the permit renewal proposed. This is a back-up alternative, the primary option for the City of
Conover will remain the Regional Biosolids Compost Facility operated by the municipal
consortium and located in Hickory,
Location
The sites examined are located no of Conover on City farm Road. The sites are currently
permitted to serve as receiver for biosolid materials and the only applications in the last few
years have been those from the City of Lenoir accomplished through an emergency
agreement executed between the respective municipalities and the state. The sites at Sipes
Orchard occupy landscape positions typical of those encountered throughout the Piedmont
Region of North Carolina. The sites examined are located on SR 1484 Sipes Orchard Rd or
County Home Rd. The sites occupy locations located to the east and west of the road. One of
the two sites has been designated for permit purposes as NE while the other has been
designated SW. These sites are in pasture and they are well suited for the land application
operation proposed. The land use has not changed since: the initial permit was issued in 1992.
Access to the sites is off SR 1484 and the ingress and egress are suitable. The well
established pasture sites are well suited to receive this material.
Site and Soil Conditions
The soil resources mapped on the Sipes Orchard property are typical of those encountered
throughout the Piedmont. The Modem Soil Survey of Catawba County indicates that the
L predominant soils mapped on the site include: Cecil and Pacolet on the upland Iands-cape

positions and Altavista in the terrace positions, These soils are very well suited for crop
production and serve well as biosolids receiver sites.
The slopes on the receiver sites have not changed since the initial land application permit was
issued in 1992. The are identified as buffers and areas with the steep slopes remain a
concern with this or any land application program. These areas are evident on the site maps
and clear to anyone on the site, nonetheless the ORC must label these are with flagging to
assureno materials are applied within designated buffers should the land application
proposed become necessary. The as with slopes in excess of 12% should not be included
in the areas intended to receive biosolid materials, Prior to any land application operations,
the are with steep slopes and the areas in the flood -plain should be identified as a part of
the site buffer and no material applied therein.
Soil Testing and Recommendations
Soil samples were collected from both the NW and the SE site. The soil materials were
subjected to a battery of standard soil fertility tests as accomplished by the No Carolina
Department of Agriculture, Agronomic Service's laboratory. The results of these soil tests are
summarized in Table 1, Soil pest Results, City of Conover Sipes Orchard Site, attached and
the recommendations gleaned from these tests are summarized in Table 2, Nutrient and Lime
Recommendations, City of Conover Sipes Orchard Sites, attached.
In general the soil testing indicates that the soil fertility levels are adequate for growth of the
fescue pastures present on the site. The soil pH is low and should be adjusted upwards to
optimize plant growth regardless of the use of the site as a receiver for biosolid materials. The
soil pH ranges between .2 and 5.5 on the NE site and between 5.1 and 5.4 on the SW site,
The recommended soil pH for the fescue grass on these soils when biosolids are applied is a
minimum of 6.0, Clearly, lime will be required to adjust the spoil PH upwards if biosolid
materials are to be applied at some time in the future. The recommended lime addition is
provided in Table 2. The soil p1l adjustment will require a lime application of approximately
L5 tons per acre. A very high quality lime -,table biosolid material is available from the City
of Lenoir and the site manager should consider application of the Lenoir Lime as a soil
conditioner.
The Phosphorus and Potassium levels are also low. Supplemental Phosphorus and Potassium
must be supplied to optimize crop growth. Other minerals such as Calcium, Magnesium,
Copper and Zinc are present at levels sufficient for crop growth. The recommendations for
Potassiurn and Phosphorus are presented in Table 2. These mineral supplements should be
supplied to optimize the fertility of the fields soon.
Pasture grazing and hay harvest are adequate as crop management measures on the Sipes
Orchard site. The livestock benefit from the grazing and cause no apparent damage to site
soils. Pasture grasses are well established and could benefit from the addition of lime and
phosphorus as indicated in Table 2, Nutrient and Lime Recommendations. These nutrients

are not required for agricultural operations, but must be supplied if biosolid materials are
applied to any portion of the site.
Conclusions
The sites intended to serve as potential receiver site's for biosolid materials are well suited for
this land use activity. or to any application of biosolid materials, supplemental lime will be
required. This adjustment to improve soil fertility is essential to assure no adverse impacts
from the application of biosolids.
In addition to the soil fertility adjustments, the biosolid materials applied to these sites must
be stabilized and treated to achieve the required level of vector attraction reduction and
pathogen reduction prior to any application. This can be achieved by digesting the material or
it can be achieved through lime stabilization and injection. Regardless of the method
selected, documentation must be provided to regulatory agencies that both the VAR and
PSRP treatment has been achieved prior to any land application. Please note the
recommendations described by Mr. Frederick concerning slopes and the need to clearly
identify are of concern prior to any biosolid application,

NEWTON AND CONOVER AGREEMENT
RE: CLARK CREEK SEWER
This agreement entered into 2003 by the cities of Newton
and Conover, both municipal corporations of Catawba County, North Carolina.
WITNESSETH:
Whereas, Newton owns and operates its Clark Creek Wastewater Treatment Plant
(Facility) which has a current capacity of 5 million gallons per day (MGD) and is capable
of being permitted to a capacity of 7,5 MGD after obtaining an "authorization to
construct' ' from the state and complefin g minor improvements to the Facility; and
Whereas, Conover owns and operates its Southeast to Water Treatment Plant
(SEWWTP) that has a current capacity of 0.6 MGD and must complete significant
modifications as a result of the proposed construction of NC Highway 16 realignment;
and
Whereas, the parties have existing agreements for treating wastewater from Conover at
the Facility, with Conover having a current capacity of 0,479MGD; and
Whereas, the parties desire to enter into an agreement whereby they will "partner" in the
use, operation, and maintenance of the Facility.
NOW, THEREFORE, in consideration of the terms and conditions hereof, it is agreed as
follows:
A. "WWTP" or "Facility" means Newton's existing Clark Creek
Wastewater Treatment Plant.
B. "SEWWTP" means Conover's existing Southeast Wastewater
Treatment Plant,

Dear Ms. Thournburg:
The City of Conover requests a provisional renewal of our
land application permit WQ0004381. The purpose of this permit
is to backup our composting program which is our present means
for handling residuals. The City of Conover has been a member
of a regional composting facility (WQ0004563) since the early
1990s. We have not land applied residuals since 1994. The last
time we land applied residuals we used aerobic digestion as a
means for pathogen and vector attraction reduction. We still
have that capacity but we are not presently digesting our
residuals. We feel if we began land application again we would
use aerobic digestion or lime stabilization as a treatment
method. I see no representative way at this time to analyze our
sludge for the purpose of evaluating loadings. It is possible
that additional treatment may change analytical values. I feel.
45 days of digestion could alter nutrient concentrations. At a,
time in the future if we would ever need to use land application
as an residual handling option, the City,of Conover would agree
to do any x-nonitoring necessary to verify loading levels and
compliance with the issuance of a final permit prior to applying
residuals. The City of Conover feels a provisional land
application permit could expedite our ability to land apply
residuals in an emergency, when or if, compcsting is no longer
an option.
The State of North Carolina has purchased one of our two
wastewater treatment facilities (SE WWTP NCO024279) in order to
build a road through the site. This flow will go to the City of
Newton within six months.

A. Application Form. -
This application form must be sulintitted for any permitting action involving a non -dedicated residuals
land application program.
Non -dedicated residuals land application programs are ones in which all land application sites do not meet the
criteria in 15A NCAC 2H .0203 (1 D(a) and (b). Specifically, a residuals land application program cannot be
designated as non -dedicated if any of the following is applicable:
+ Any land application site certified for the residuals land application program that receives residuals at
rates or frequencies greater than agronomically justifiable.
+ Any land application site certified for the residuals land application program that is used primarily for
residuals disposal alone (i.e,, versus crop production).
+ Any land application site certified for the residuals land application program that is designated as
dedicated by the Division's Director.
Any changes to this application form will result in the application package being returned.

11. General Information -
The applicant is either the existing Permatee or the entity that is to be responsible for the operation of the
residuals land application program and compliance with the resultant permit. If the applicant is a corporation,
ensure that that applicant's name as listed in Item 1. 1. corresponds with the name under which the corporation
is registered with the NC Department of the Secretary of State.
V The signing official must meet the criteria stipulated in 15A NCAC 2H M06 (b). An alternate person may be
designated as the signing official. provided that a delegation letter from a person who meets the referenced
criteria is submitted. The delegation letter does not have to be resubmitted if the signing official has not
changed since the last permitting action associated with this residuals land application program.
The submitted fee should be in accordance with the Division's most recently -adopted fee schedule. This fee
schedule as well as a detailed explanation of its application may be downloaded from the web site at:
http://h2o.enr.state.nc-us/ndpu/. Checks are to be made< payable to: North Carolina Department of
Environment and Natural Resources (NCDENR).
C. Submission of Application Packages:

Thank youfor providing Scott Frederick, CPS S with Greenvest, Inc., and I the opportunity to
continue working with you on the biosolids management program serving the City of
Conover. Clearly biosolids management is a critical issue for communities. Although the
primary biosolids management option for the City remains the regional corropost facility, the
need to maintain the permitted sites is important as a back -Lip option.
In support of the permit renewal, an investigation of the permitted sites at Sipes Dairy was
accomplished. During this investigation, a walking reconnaissance of the site was performed
and samples of the soil material from the Sipes Dairy site were collected for analysis. The
soil materials have been tested and those results -are included with the repoit which follows,
-b 11:i c site continues to appear well suited to receive biosolid materials. The soil testina
i-dicates that soil pH is slightly below the optimum for land application, but the low pH can
easily be corrected prior to any blosolids application operation.

Historically the City ofConover has had several fields permitted to receive the digested
hi solid materials generated Nvithin the treatment facilities serving the Town, The Fields have
riot received biosolid niaterials for several vears because of the interlocal tntreernent to
develop and support the regional biosolids compost hicility in Hickory, Nonetheless. the City
of Conover desires to maintain the permit as an active alternative should they ever requ I ire as
land application activity to manage the blosolid materials, Should the fields be required, the
City Is fully cognizant that there will be I-C(lUirernents to stabilize the materials andasSUre
adequate vector attraction reduction is achieved prior to any land application,
The purpose of the brief report vhich f'o1lo\kS IS tca CleSCribC the conditions encountered on the
Sipes Orchan] Site and to describe the results of the soil sampling accomplished in support of
the permit rene�,val proposed. This is as back -tip alternative. the primary option for the CM Or'
Conover will remain the Regional Blosolids Compost Facility operated by the rtlfflliCipal
consortium and located in Hickory.
Location
The sites examined are located north ofCono ver on City Iarm Road. 1-he sites are Cffrentjf
permitted to serve as a receiver for biosolid materials and the only applications in the last tle\�
years have been those front the City ofLenoir accomplished through an ernergenc,,
agreement executed bewicen the respeCLAVC, plUniCipalitieS and the state. The sites at Sipes
Orchard occupy landscape positions typical ofthose enCOUntered throughout the Piedmont
Re(oon of North Carolina, The sites examined are located on SR 1484 Sipes Orchard Rd or
County Home Rd. The sites OCCUpy locations located to the east and west of the road, One of
the two sites has been designated t,or permit purposes as NE while the other has been
designated SNN,", These sites are in pasture and they are we] I suited for the eland application 2
operation proposed. The land use has not changed since the initial permit. was issued in 199

Site and Soil Conditions
The soil resources rnapped on the Sipes Orchard property are typical ofthose encountered
throughout the Piedmont. The Modern Soil SLI-CVey Of Catawba County indicates that the
predominant soils mapped on the site include. Gcil and Pacolet on the upland landscape
positions and Altavista in the terrace positions. These soils are very, well suited tor crop
production and serve well as biosolids receiver sites.
The slopes on the receiver sites have not changed since the initial land application permit was
issued in 1992. The areas identified as buffers and areas with the steep slopes remain a
concern with this or any land application program. These areas are evident on the site maps
and clear to anyone on the site, nonetheless the OR C must label these areas with flagging to
assure no materials are applied within designated buffers should the land application
proposed become necessary. The areas with slopes in excess of I?-% should not be included
in the areas intended to receive biosolid materials, prior to any land application operations.

.Soil Testing and Recornmen (tat ions
Testing
samples were collected front both the NW aril the SE site, The soil materials were
subjected to a battery of standard soil fertility tests as accornplished by the North Carolina
Department of Agriculture, Agronomic Services laboratory. The results ofthese soil tests are
summarized in Table 1, Soil Test Results. City of Conover Sipes Orchard Site. attached and
the recommendations gleaned from these tests are summarized in'Table'-1. Nutrient and Linle
Recommendations, City of Conover Sipes Orchard Sites, attached.
In general the soil testing indicates that the soil fertility levels are adequate for growth ofthe
fescue pastures present on the site. The soil PH is lovv and should be adjusted upwards to
optimize plant growqh regardless of the use of the site as a receiver for biosolid materials. Ths
soil PH ranges- between 5.2 and 5.5 on the NF site and bet-vveen 5.1 and .5.4 on the SW site.
The reconlinended soil pF1 for the fescue grass on these soils wheii hiosolids are applied is �1
rninirnurn of 6.0, Clearly, lime will be required to adjust the spoil PH Upwards il'blosolid
materials are to be applied at some time in the future. The recommended lime addition is
provided in Table 2.The soil pf-I adjustment will require a lime application of approximately
1 .5 tons per acre. A very high quality lime stable blosolid material is available from the ChN,
of Lenoir and the site manager should consider application of the Lenoir Lime as a soil
conditioner,
The Phosphorus and Potassium levels are also IoNv- Suppleniental Phosphorus and Potassillill
must be supplied to optimize crop groxvth. Other minerals such as Calcium. Magnesium.
Copper and Zinc are present at levels sufficient for crop grmv'th. The recommendations for
Potassium and Phosphorus are presented in Table 2. These mineral supplements should be
supplied to optfinize the fertility ofthe fields soon,
Pasture :JiT azing and had, harvest are adequate am s crop manage Trent measures on the Sipes
Orchard site. 'The livestock benefit from the grazing and cause no apparent damage to site

soils. Pasture urasses are wet[ established and could benefit front the addition of lime and
phosphorus as indicated inTable 27., Nutrient and L,Ime Recommendations. These 111.1trients
are not required for agricultural operations, but must be supplied if biosolid materials are
applied to any portion of the site,
Conclusions
The site intended to serve as potential recei-vvr site for biosolid materials are well suited for
this land use activity, prior to any application of biosolid materials, supplemental lime will be
required, This adjustment to improve soil fertility is essential to assure no adverse impacts
from the application of biosolids.
In addition to the soil fertility adjustments, the biosolid materials applied to these situ must
be stabilized and treated to achieve the required level of vector attraction reduction and
pathogen reduction prior to any application. This can be achieved by digesting the material or
it can be achieved through lime stabilization and injection. Regardless dless of the method
selected.* documentation must be provided to regulatory agencies that both the VAR and
PIP treatment has been achieved prior to any land application. Tease mote the
recommendations described by Mr. Frederick concerning slopes and the need to clearly
identify areas of concern prior to any biosolid application,

the biosolids application permit it for the Sipes Dairy site. The, subject site is still a viable
lard application site and should continue to provide are alternative for biosolids disposal
for the Town
It should be noted that step slopes and buffer areas need to be delineated and remade
visible to the ORC to eliminate the possibility of encroachment or accidental biosol ds
application.
In addition, the CHI C should follow the recommendations in the report to achieve suitably
site fertility and pH for optimum vegetation growth.

In accoidwice with the amendment request received on October 10, 199:7, we are forwarding
herewith Permit No. WQ0004381, dated November 14, 1997, to the City of Conover for the continued
operation of a wastewater residuals land application program. This permit is being amended as requested
to allow the City of Lenoir to land apply residuals from their wastewater treatment facilities upon to
acreage previously permitted by the City of Conover. Residuals from the two municipalities shall not be
land applied on the same acreage and shall not be co -mingled prior to application without a permit
amendment from the Division. Please be advised, the City of Conover will be responsible for ensuring
compliance with this permit for both municipalities.
This permit shall be effective -from the date of issuance until April 30, 2001, shall void Permit No.
WQ0004381 issued May 17, 1996, and shall be subject to the conditions and limitations as specified
therein. Please pay particular attention to the monitoring and reporting requirements contained in this
permit. Failure to establish an adequate system for collecting and maintaining the required operational
information will result in future compliance problems.
If any parts, requirements, or lintitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,
Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

operation of a wastewater residuals land application program consisting of the application of 760 dry tons
per year of residuals from sources listed in Condition 115, to approximately 146 acres of land in Catawba
County with no discharge of wastes to the surface waters, pursuant to the amendment request received on
October 10, 1997, and in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Environment, Health and Natural Resources and
considered a part of this pen -nit.
This permit shall be effective from the date of issuance until April 30, 2001, shall void Pertnit No.
WQ0004381 issued May 17, 1996, and shall be subject to the following specified conditions and
linutations:

1. This permit shall become voidable if the soils fail to adequately assimilate the wastes and
may be rescinded unless the sites are maintained and operated in a manner which will
protect the assigned water quality standards of the surface waters and ground waters.
2. The land application program shall be effectively maintained and operated as a non -
discharge system to pre -vent the discharge of any wastes resulting from the operation of this
program.
3. The issuance of this, permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this program.
4� In the event that the land application program is not operated satisfactorily, including the
creation of nuisance conditions, the Pennittee shall cease applying residuals to the sites and
take any in mediate corrective actions as may be required by the Division, of Water Quality
(Division).

i. Some of the buffers specified below may not have been included in previous permits for
this land application operation. However, any sins or fields that are included in this
permit, but were approved with different applicable buffers shall be reflagged to comply
with the below buffers. The following buffer zones shall be maintained:

subsurface applications..
0. When wastewater residuals are applied, the Class A pathogen requirements and site
restrictions in 40 CFRpat a or the Class B pathogen requirements and site
restrictions in 40 CFR Part 503,32(b), and one of vector attraction reduction requirements
in at CFR Part 503.33shall be met. additionally, an evaluation must be performed which
demonstrates the residuals ability to comply with this requirement, Upon request, a copy
of this evaluation must be submitted including l test results and calculations.

7, Upon classification of the facility by the Water Pollution Control System Operators
Certification Commission (p'), the Per ittee shall employ a certified land
application/residuals operator to be in responsible charge (t;tl,) of the land application
program. The operator must hold a certificate of the type classification assigned to the land
application program by the WPCSOCC. The Perrmttee must also employ a certified back-
up operator of the appropriate type to comply with the conditions of 1 A N . 2 2.
Adequate procedures shall be provided to prevent surface`runoff from carrying any
disposed or stored residuals into any surface waters..
10. Surface applied residuals will be plowed or disced within twenty-four (24) hours after
application on lands with no cover crop established,
11 For areas that are prone to flooding r within the l -year flood elevation.:, residuals may
be applied only during periods of dry weather. The residuals must be incorporated_ into the
soil within twenty-four (4) hours after application
12., appropriate measures roust be taken to control public access to the land application sites
during; active site use and for the 12- onth period following the last residual application
event. Such controls may include the posting of signs indicating the activities being
conducted at each site.
13, adequate provisions shall be taken to prevent wind erosion and surface runoff from
conveying pollutants from the residuals application area onto the adjacent property or into
y surface waters',
14, Residuals shall not be applied in inclement weather or until 24 hours following a rainfall
event of 1/2-inch or ,greater in 24 hours. Any emergency residuals disposal measures roust
first be approved by the Division;
15. residuals shall not be applied to any land application site that is flooded., frozen or snow-
covered.
16. Residuals shall not be applied at rates greater than agronomic rates, unless authorized by
the Division.
17. animals shall not be grazed on an application site for 30 days after residuals application.
Application sites that are to be used for grazing shall have fencing that will be used to
prevent access after each application:

18, Food crops, feed crops and fiber crops that do not come in c, mact with he esi als shall
not be harvested for 30 days after residuals application.
19. Food crops with harvested parts that touch the residual/soil mixture and are totally above
the land surface (ex. tobacco, melons, cucumbers, squash, etc,) shall not be harvested for
14 months after residuals application.
20� Food crops with harvested parts below the surface of the land (root crops such as potatoes,
carrots, radishes, etc.) shall not be harvested for 20 months after application of residuals
when the residuals remain on the land surface for four (4) months or longer prior to
incorporation into the soil.
21, Food crops with harvested parts below the surface of the land shall not be harvested for 38
months after application of residuals when the residuals remain on the land surface for less
than four (4) months prior to incorporation into the soil.
22. Turf shall not be harvested for I year after residuals application if the turf is to be placed on
land with a high potential for public exposure.
I Any monitoring (including groundwater, surface water, residuals, soil, or plant tissue
analyses) deemed necessary by the, Division to insure protection of the environment will be
established and an acceptable sampling and reporting schedule shall be followed,
2. Proper records shall be maintained by the Permittee tracking all application activities.
These records shall include, but are not necessarily limited to the following information,.
a. source of residuals
b, date of residual application
c . location of residual application (site, field, or zone #)
d. method of application
e� weather conditions (sunny, cloudy, raining, etc.)
f. soil conditions
g. type of crop or crops to be grown on field
h. volume of residuals applied in gallons/acre., dry tons/acre or kilograins/hectare
i. annual and cumulative totals of dry tons/acre of residuals, annual and cumulative
pounds/acre of each heavy metal (which shall include, but not be limited to arsenic,
cadmium, copper, lead, mercury, molybdenum, nickel, selenium and zinc), annual
pounds/acre of plant available nitrogen (PAN), and annual pounds/acre of phosphorus
applied to each field,
3. A representative annual soils analysis (Standard Soil Fertility Analysis) shall be conducted
on each site receiving residuals in the respective calendar year and the results maintained on
file by the Permittee for a rninimurn of five years.
The Standard Soil Fertility Analysis shall include, but is not necessarily limited to, the
following parameters:

The Standard Soil Fertility analysis (see above) and an analysis for the following
pollutants shall be conducted once prior to permit renewal on soils from each site which has
received residuals during the permit cycle,

8, Noncompliance Notification:
The Permittee shall report by telephone to the Mooresville Regional Office, telephone
number (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the
next working day following the occurrence or first knowledge of the occurrence of any of
the following:
a. Any occurrence with the and application program which results in the land application
of significant amounts of wastes which are -abnormal in quantity or characteristic.
b. Any failure of the land application program resulting in a release of material to receiving
waters.
c. Any time that self -monitoring information indicates that the facility has gone out of
compliance with the conditions and limitations of this permit or the parameters on
which the system was designed.
d. Any process unit failure, due to known or unknown reasons, that tender the facility
incapable of adequate residual treatment.
e. Any spillage or discharge froth a vehicle or piping system transporting residuals to the
application site.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within five (5) days following first knowledge of the occurrence. This report must
outline the actions taken or proposed to be taken to ensure that the problem does not recur.

In accordance with 15A NCAC 2L, a EEYjE)M_BDjjNDARY is established around the
disposal systems midway between the Compliance Boundary and the perimeter of the
waste disposal area. Any exceedance of standards at the Review Boundary shall require
rernediation action on the part of the pernuttee.
2. Any groundwater quality monitoring, as deemed necessary by the Division, shall be
provided.
3. No land application of waste activities shall be undertaken when the seasonal high water
table is less than three, feet below land surface.

I . The Permittee or his designee shall inspect the residuals storage, transport, and application
facilities to prevent malfunctions and deterioration, operator errors and discharges which
may cause or lead to the, release of wastes to the environment, a threat to human health, or a
nuisance. The Permittee shall maintain an inspection log or summary including at least the
date and nine of inspection, observations made, and any maintenance, repairs, or corrective
actions taken by the Pe. `tree. This log of inspections shall be maintained by the Permittee
for a period of five years from the date of the inspection and shall be made available to the
Division or other permitting authority, upon request.
2 Any duly authorized officer, employee, or representative of the Division may, upon
presentation of credentials, enter and inspect any property, premises of place on or related
to the application site or facility at any reasonable time for the purpose of determining
compliance with this permit; may inspect or copy any records that must be kept under the
terms and conditions of this permit-, and may obtain samples of groundwater, surface
water, or learhate.
VL qENERALL CONDITIQNS
This permit shall become, voidable unless the land application activities are carried out in
accordance with the conditions of this permit, the supporting materials, and in the manner
approved by this Division.
2 This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. This permit is not automatically transferable. In the event that there is a desire for the
facilities to change ownership or a name change of the Permittee, a formal permit request
must be submitted to the Division accompanied by an application fee, documentation from
the parties involved, and other supporting materials as may be appropriate. The approval
of this request will be considered on its merits and may or may not be approved.
