Explanation of QC Qualifier Codes
Qualifier Meaning
(ESC) Sample diluted due to matrix interferences that impaired the ability
to make an accurate analytical determination. The detection limit is
elevated in order to reflect the necessary dilution.
Qualifier Report Information
ESC utilizes sample and result qualifiers as set forth by the EPA Contract Laboratory Program and
as required by most certifying bodies including NELAC. in addition to the EPA qualifiers adopted
by ESC, we have implemented ESC qualifiers to provide more information pertaining to our analytical
results. Each qualifier is designated in the qualifier explanation as either EPA. or ESC.
Data qualifiers are intended to provide the ESC client with more detailed information concerning
the potential bias of reported data. Because of the wide range of constituents and variety of
matrices incorporated by most EPA methods,it is common for some compounds to fall outside of
established ranges. These exceptions are evaluated and all reported data is valid and useable
unless qualified as 'R' (Rejected).
Definitions
Accuracy - The relationship of the observed value of a known sample to the
true value of a known sample. Represented by percent recovery and
relevant to samples such as: control samples, matrix spike recoveries,
surrogate recoveries, etc.
Precision - The agreement between a set of samples or between duplicate samples.
Relates to how close together the results are and is represented by
Relative Percent Differrence.
Surrogate - Organic compounds that are similar in chemical composition, extraction.,
and chromotography to analytes of interest. The surrogates are used to
determine the probable response of the group of analytes that are chem-
ically related to the surrogate compound. Surrogates are added to the
sample and carried through all stages of preparation and analyses.
TIC - Tentatively Identified Compound: Compounds detected in samples that are
not target compounds, internal standards, system monitoring compounds,
or surrogates.

Dear Ms. Hoffman,
This letter is in response to your NOV dated February 21, 2008, that was based upon your inspection
on January 29, 2008. Following please find my opinion and evaluation of Alchems` current situation in
regards to the Settlement Agreement dated November 27, 2007 and the steps Alchem, Inc has taken
to rectify some of the issues. Attached you will also find photos of the progress that has been made,
receipts for expenditures, man hours, etc.
Alchem's Environmental Progress Report

LAGOONS
Lagoon #1: Since your last inspection, Alchem has been able to empty 70% of this lagoon, 50% of this
is down to the GEO lined floor of the cell. (Please see supporting photos)
Lagoon #2: Alchem has been able to create an 8 — 10 foot Freeboard around this lagoon, to achieve
this we have stacked a pile of the material in the center of the lagoon for drying purposes to enable us
to haul it off site. This appears to be the only way to achieve both of our goals i.e. empty the lagoon
and be able to have an inspection done by a licensed NC PE.
Lagoon #3: We have created some Freeboard around #3 but this lagoon will continue to receive
Bauxite Residuals until we achieve emptying Lagoons 1 & 2, at that point we will be able to begin the
neutralizing and wash process. At this point we will be able to attack this lagoon with the same
aggressiveness we used on Lagoons 1 & 2.
RECYCLE & WASH SYSTEM
At this time I believe it is counter productive to neutralize and wash the Bauxite Residual without having
an uncontaminated area to place the clean material. Once we achieve completely emptying Lagoon #1
we will then immediately start the neutralizing process. Our neutralization process will be accomplished
by mixing the Bauxite Residuals and 10% Soda Ash Solution into the Alum Reactor (cleaned out of
course), we have done several micro tests and have calculated the right formula to achieve a PH of 6.0
— 7.0 su on a continuing basis. Alchem has purchased approx. 10,000 gallons of 10% Soda Ash
Solution and approx. 45 tons of Soda Ash Powder to produce its own solution once all is achieved as
stated above.
PH READINGS & MATERIAL REMOVAL—
Alchem will continue to take PH readings, document tonnage removed from the site and where the
material was transported to, just as you received during your last inspection, if this is acceptable.

WASTE LEVEL GUAGES
The installation of the waste level gauges will begin as soon as each lagoon is cleaned, repaired and
inspected by a licensed NC PE.
VEGETATIVE COVER
Alchem is in the process of removing all pine saplings and bushes from all earthen embankments,
when this is achieved, we will use rolls of erosion control blankets, seed and fertilizer to stabilize
Lagoon embankments from any further erosion. The projected completion date of this step, weather
permitting, is no later then April 21, 2008.
SUMMARY OF LAGOONS
It is my opinion and assessment that from an Environmental & Business standpoint it would be counter
productive to put good neutralized material with a PH of 6.0 — 7.Osu on top of a material with a PH of
3.0 — 4.Osu. I believe we share the same goals on this issue. Before Alchem begins neutralizing its
residuals, which would not only help us environmentally, but also from a business stand point, giving us
a clean recycled sellable product, instead of a large expense and burden.

STORMWATER BASIN
At the time of your inspection storm water was ponded beyond the reinforced Hydraulic Engineered
Bermed area. We have since pumped the water into tanks for use in product manufacturing. Though
water still exists in our storm water pond, it is not beyond the reinforced area. As summer approaches
it is my plan to finish the retention pond so that this overspill no longer happens. It is my plan that using
the water in the manufacturing of product and the summer heat assisting in evaporating the excess
water, that we should be able to control this area with some elevation changes and a more efficient
pumping system. However please keep in mind that even after this work is completed, I can not
honestly say this will NEVER HAPPEN again, due to the fact that we can not control the Forces of
Nature or Acts of God.
SEEPAGE
You have stated in your NOV the reinforced area of our Berm has seepage, this is not true. I did see
what looked to be seepage which was approx 200' beyond the engineered bermed area. Our
reinforced area extends 230 linear feet north of the catch basin, your photo and the delineated line you
used to show the reinforced berm was over 200' too long. The seepage from the un-reinforced area
will be repaired by lowering the water levels to the reinforced area only and regrading the berm in that
area. I believe we can accomplish this work no later than April 30, 2008, again weather permitting.
RAIN RECORD
As you explained to me during your last inspection, the DWQ uses rain gauges around the area to
determine rainfall amounts and that you have used this method to determine how much storm water
should be in our bermed area. Respectfully, it is my contention to get an accurate reading of the
ponded water in our retention pond, you would have to use area rainfall records and calculate the total
square footage of the area and also take into consideration the topography of the area to retrieve a true
and accurate measurement of rainfall for this area. As I am not a PE, it would only seem logical to me
to use the whole runoff surface area and not a straight downpour of rain just in the pond itself. I know
we have discussed this issue on several different occasions and in no way am I trying to make this a
point of argument. If I am wrong in my theory of calculating storm water runoff, I would please ask you
to advise me as to what the correct calculation method is and what should be in our pond after a rainfall
of/", 1 ", 2", etc atone time.
FINAL SUMMARY
As I am very aware of the Settlement Agreement dated November 27, 2007 and all that it entails, I can
only tell you that Alchem will rectify all of the points/issues as requested in the above mentioned
agreement at some point. I cannot honestly say that we will have 100% of all the issues completed by
June 1, 2008; 1 say this due to the fact that I have only held my current position with FULL operational .
control since December 21, 2007. As you are all aware, November 2007 when we met for the first
time, Alchems' prior management was still on staff, which hampered my authority and complete control
at that time. I am in no way making excuses for the delay in achieving the Settlement Agreement
issues, but the truth of the matter is that prior management did have approx 1 '/ years to begin or
complete all of the issues in a timely manner and instead CHOSE to "SWEEP IT UNDER THE
CARPET". With all of this being said, I truly hope that you and your colleagues have seen a major
difference 'in ALCHEM as a company. I feel that in a very short period of time we have made great
strides in cleaning up the image and reputation of Alchem, Inc. I do however realize that Alchem still
has a long way to go to achieve all of the neglected Environmental issues and all the other
mismanaged business issues as a whole.--

It is at this time that I would humbly request that NCDENR & Alchem, Inc irebuild our relationship based
upon TRUST, an open line of honest communication and the visual/documented-progress- that -has
_
been accomplished in a short though very expensive timeframe (please see attached expense
documentation i.e. man hours, equipment rentals, before & after photos, etc).
In closing I would like to request that NCDENR reconsider your decision to impose a civil penalty at this
time due to all the visible work and documented expenses, I truly believe this would only add to the
extreme financial burden that years of neglect, lack of management and complete disregard have
already caused. At this time 100% of all revenues being generated by Alchem, Inc are being
streamlined into labor, equipment rental, fuel and other additional expenses needed to come into
compliance and survive as a company.
