BACKGROUND The City of Asheville operates this water treatment plant [WTP] producing up to 7.5 MGD of potable water extracted from the Mills River. In 1996 the Division issued an Authorization to Construct (ATC) permit to the previous regional water authority for settling lagoons, but in 2006 ownership was transferred to the City of Asheville and formally named the Mills River Water Treatment Facility. Treated filter backwash (about 0.050 MGD) is discharged to the main stem of the French Broad River (see Site Map) resulting a negligible instream waste concentration (IWC = < 0.1 %). The receiving -stream segment is currently classified WS-IV, B, CA. Wastewater Treatment. This WTP facility utilizes conventional wastewater -treatment technology [coagulation, flocculation, sedimentation, and disinfection]. The Permittee adds alum and other additives prior to mixing [see permit Supplement to Cover Sheet]. Conventional treatment is finalized by filtration through three (3) multimedia gravity filters. The Permittee backwashes the filters at minimum once every 96 hours; more often as needed, based on filter -head pressure. Flow-meter/recorders monitor the backwash events and provide data for the DMR. The Permittee backwashes the filters with finished drinking water treated with chlorine derivatives (disinfectant), zinc orthophosphate (anti-scalant), and fluoride. Ammonia is not used. Upon initiating each backwash, the operator doses the effluent with the appropriate amount of dechlorination chemical. The discharge is diverted to one of two (2) each 750,000-gallon settling lagoons where the treated wastewater decant is allowed to flow to the outfall. As needed each lagoon can be isolated to allow further solids dewatering and sludge removal. A Sludge Management Plan is in place, and states that annually a contractor pumps the accumulated sludge from the lagoons, and disposes into an approved manhole of The Metropolitan Sewer District. The Permittee requires Quarterly Acute WET testing based on IWC < 0.25 % - all tests were passed. One failure occurred in November 2019 but the facility passed after re -testing. No change recommended. The RPA is conducted in accordance with 40 CFR 122.44 (d) (i). The NC RPA procedure utilizes the following: 1) 95% Confidence Level/95% Probability; 2) assumption of zero background; 3) use of/2 detection limit for "less than" values; and 4) streamflows used for dilution consideration based on 15A NCAC 213.0206. Effective April 6, 2016, NC began implementation of dissolved metals criteria in the RPA process in accordance with guidance titled NPDES Implementation of Instream Dissolved Metals Standards, dated June 10, 2016. Maximum monthly average flow in past 36 months (Qw) = 0.064 MGD (Dec 2019) A Reasonable Potential Analysis was conducted for copper, fluoride, and zinc using data from the past 4 1/2 years (Jan 2016-June 2020). • Monitoring Only. For individual permits: The following parameters will retain a monitor -only requirement since they did not demonstrate reasonable potential to exceed applicable water quality standards/criteria, but are additives during the treatment process: Fluoride, Aluminum • No Limit or Monitoring: For individual permits: The following parameters will not receive a limit or monitoring, since they did not demonstrate reasonable potential to exceed applicable water quality standards/criteria and the maximum predicted concentration was <50% of the allowable concentration: Copper. Fact Sheet - Renewal Aug2020 NPDES NCO085511 Page 2 of 3 PERMIT RENEWAL STRATEGY For renewal, the Division referenced the Water Treatment Plant Guidance (2009) for conventional WTP facilities. For this renewal, the Total Copper database suggests no RP, therefore copper monitoring should be discontinued. Manganese monitoring can also be removed, because there is no longer an action level standard for this parameter. This would be the strategy for renewal of the individual permit. However, this permittee is eligible to switch to the NCG59 general permit. NCG59 GENERAL PERMIT ELIGIBILITY - Permittee is passing all tox tests, therefore they are eligible - Permittee does not have limits for any parameters, therefore they are eligible - Permittee uses conventional treatment technology, therefore they are eligible - Conclusion: Permittee is eligible for NCG59 SUMMARY OF PROPOSED PERMIT CHANGES The following were suggested for this renewal: (PRIOR TO DECISION TO TRANFER TO GENERAL PERMIT) • The language in sections A.(2.) and A.(3.) have been updated to be consistent with the finalization of requirements for electronic reporting and for toxicity monitoring. • Manganese quarterly monitoring requirements were removed from this permit. There are no longer action level standards for this parameters. • A review of the past 4 % years of discharge monitoring data found no reasonable potential for discharge of copper from this facility. The requirement of quarterly monitoring for copper has been removed from this permit. • A previous footnote citing the need to sample metals concurrent with WET testing has been removed — this is no longer required. • A previous footnote stating a minimum PQL of 10 ug/L for copper, zinc, and manganese was removed. These constituents do not have the same PQL. Currently, copper has a PQL of 2 ug/1 and zinc has a PQL of 10 ug/L. This permit was developed to expedite the issuance and reissuance of these types of permits. The City of Asheville's existing Individual NPDES permit for its Mills River Regional Water Treatment Plant (WTP) is up for renewal and qualifies for coverage under NCG590000. The annual permit fee for the general permit is $100 verses $860 for an Individual permit, and monitoring requirements are less frequent than those listed in NC0085511. Similar to Individual NPDES permits, General Permits expire every five years but can be renewed by completing a short and simple general permit renewal form. The General Permit is reissued every five years and is sent to all the Permittees covered under it, all at the same time. To switch to the General permit, the City will need to make a written request to DWR. Please note, the issuance of the General Permit would require the rescission of your individual permit. The Division suggests that you review the attached file containing the General Permit and decide whether you would like the Division to renew the individual permit or proceed with issuance of a Certificate of Coverage for the WTP. Note that the Mills River Regional WTP operates a conventional water treatment system that discharges to freshwater, so the facility would be subject to the limitations listed on page 3 (B. (3.) Conventional WTP Effluent Limitations and Monitoring Requirements— Discharging to Freshwater) in the attached General permit. To request that the Division proceed with issuing the General Permit instead of renewing the existing Individual permit, the City should respond with the wording below, or equivalent text: The City of Asheville has reviewed the Division of Water Resources General Permit NCG590000 for greensand and conventional type water treatment plants and requests that the discharge from the Mills River Regional WTP be covered under this new general permit. The City understands that the Division will rescind the individual NPDES permit for the Mills River Regional WTP — NCO085511 when the Certificate of Coverage for the General Permit NCG590000 is issued to the City for the WTP. The written request shall be signed by an authorized City of Asheville official in accordance with 15A NCAC 02H .0106(e). Only comments I have are: • Would it be possible to add the electronic submittal email language somehow? I know the general permit has all of the language for mailing, but maybe we could add the ATForms.ATB(@ncdenr.gov to the Supplement to CoC portion? • Also, the general permit has parameter codes for cerio and mysid, but not for the fathead testing. This facility was formerly permitted as NPDES permit NC0085511. Transferal to coverage under the NCG590000 General Permit was requested on 9/22/2020. In order to provide more convenience, control, and security to our permittees and assist them in processing their transactions, The Division of Water Resources is currently transitioning towards electronic correspondence. This will hopefully provide more efficient service to our permittees and other partners and will allow us to more effectively process and track documents.
