The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge
Elimination; System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports. The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper -based).
EPA is phasing in the requirements of the rule over a 5-year period, The two phases of the rule, and their
key milestones, are:
• Phase 1—Starting can December 21, 2016, regulated entities that are required to submit Discharge
Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently
reporting your DMR data electronically using;eDMR then you simply need to continue reporting
in the same way as you are now. The key change is that, starting on December 21, 2016,
electronicreporting of CMRs will be required, instead of voluntary.
• Phase 2 -Starting on December 21,2020, regulated entities that are required to submit certain
other NPDES repeats will begin submitting these reports electronically. Reports covered in the
second phase include Notices of Intent to discharge in compliance with an NPDES general permit,
Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports.
Incorporating Electronic Reporting Requirements into NPDES Permits
The NPDES' Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21., 2015. Under the new rule, the
electronic reporting process supersedes the paper reporting process, According to our files, your NPDES
permit became effective after November 2013, and should contain the requirement to electronically
report your Discharge Monitoring Reports using NC DWR`s eDMR system,
In addition to requiring permittees to report information electronically, the rule also requires permittees
to identify the initial recipient for the NPDES electronic reporting data (see 40 CFR 122. 1(I)(9)), Initial

In the fall of 2015 and due to the large number of facilities that: require electronic submittal, Charlotte
Water requested that the deadline established in the referenced permits be extended. The Division of
Water resources agreed that the establishment of an electronic monitoring protocol for so many facilities
was a significant undertaking..A such, the Division agreed to exercise enforcement discretion until
March 31, 216 so that Charlotte Water may continue their efforts toward ultimate electronic submittal.
Since that time, Charlotte Water contacted the Envision by letter on February 22, 2016 requesting a
further extension of this deadline. The new request was made flue to technical difficulties with setup and
implementation of a new Laboratory Information Management System (L ). As a. result of the
communications between the Division and the Charlotte Water, it was obvious that you are snaking a
signi: t and sustained effort to comply with the electronic permitting requirements in the pe its. ' So,
the Division has decided to extend the timeframe we will exercise enforcement discretion with respect to

Due to the time constraints with the implementation of eDMR for numerous facilities, Charlotte Water
requested that the deadline be extended for any NPDES permits that include the eDMR permit condition.
After discussion by phone conference on July 21, 2015, between the -Division of Water Resources and
Charlotte Water, it was determined that more time was needed to begin submitting discharge monitoring;
reports electronically (el ) for your facilities under the operation of Charlotte "Water.
Pursuant to the requirements of North Carolina General Statute 143-I .1(b), no later than March 31,
2016, Charlotte Water, shall begin submitting discharge monitoring reports electronically using the

In response to your request to renew the subject NPDES permit, the Division of Water Resources (DWR or
the Division) hereby transmits this draft for your review and comment. Please review this document to
assure your understanding ofthe 'permit limits and monitoring conditions, and to correct errors, if any.
We have made the following updates to your previous permit:
• removed monitoring for Total Iron, Total Copper and Total Manganese
• added quarterly Total Fluoride monitoring because of the use of fluoride additive to finished water
which is used as filter backwash water
• added updates to facility map and parameter codes.
Eligibility for Covera e under the General Permit it NCG5 0000 — The Lee S, Duke WTP is not eligible for
the general permit because there is not enough toxicity data. The facility needs an additional year (four
quarters) of passing toxicity tests to be eligible for the general permit.
Proposed federal regulations require electronicsubmittal of all discharge monitoring reports (DMRs) and
specify that, if a state does not establish a system to receive such submittals, then Permittees must submit
DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these
regulations will be adopted and is beginning implementation.
The requirement to begin reporting discharge monitoring data electronically using the NC DWR's Electronic
Discharge Monitoring Report (eDMR) rote et application has been added to your NPDES permit. [See
Special Condition A. (3.)] For information on eDMR, registering for eDMR and obtaining an eDMR user

IV. PAPER TRAIL INVESTIGATION:
The paper trail consisted of compering original records (e.g., laboratory benchsheets, logbooks; etc.)
and contract lab reports to Discharge Monitoring reports; (DMRs) submitted to the North Carolina
Division of Water resources. Data were reviewed for ' March, July and September, 2014. No
transcription errors were detected. The facility appears to be doing a good job of accurately
transcribing data.
V. CONCLUSION
Correcting the above -cited findings and implementing the recommendations will help this lab to
produce quality data and meet certification requirements. The inspectors would like to thank the staff
for its assistance during the inspection and data review process. Please respond to all findings.

FACILITY SITE REVIEW:

the inspection. During the inspection it was noted that an additional span was added to the
overflow pipe on the equalization basin to increase its capacity.
FLOW MEASUREMENT:
Flow measurement is accomplished using a magnetic flow meter in the effluent discharge
pipe before the effluent enters the creek. Instantaneous measurements are recorded. The flow
meter is calibrated annually and was last completed in September 2008,

LABORATORY:
Lee S Dukes Jr. Water Treatment Plant WWTP personnel are certified to perform field
parameter laboratory analyses of temperature, pH, and residual chlorine under certificate #55 1.
Pace Analytical Services, Inc. is certified. (#1 to perform all other wastewater analyses. Pace
Analytical Services, Inc. was not evaluated under this inspection.
EFFLUENT/RECEIVING WATERS;
The facility was not discharging during the inspection. The receiving water slid not
appear to be adversely affected by the effluent. The effluent is discharged to McDowell Creek,
which is a Class C water, in the Catawba River Basin,
SELF -MONITORING PROGRAM:
Discharge Monitoring Reports (DMRs) were reviewed for the period May 2007 through
April 2008. The perittee did have one total residual chlorine limit violation (33' µg/L— limit 2
µg/L limit) ± on November 6, 2007, which was reported to the Division of Water Quality. The
violation was most likely caused by manganese interference (0.144 nag/L at sampling location).
The WTP had experienced elevated manganese concentrations due to the low water levels in the
reservoir (drought conditions in the region). The permittee did not have any monitoring
violations within the review period.
OPERATIONS & MAINTENANCE:
The facility and grounds appeared to be properly operated and maintained. The current
overall operating strategy appears acceptable for the size and type of the facility.
SLUDGE DISPOSAL:
Waste solids are being pumped as needed from the lagoon by Synagro, Inc., a residuals
management company, and land applied at the facility, and on some neighboring farms under the
facility's land application permit (WQ000057). Synagro, Inc. was not evaluated under this
inspection.

A fast track application for Authorization to Construct dechlorination facilities was
received on October 12, 2006, by the Division. Authorization is hereby granted for the
construction of modifications to the existing Lee S. Dukes WTP, with discharge of treated
wastewater into McDowell Creek in the Catawba River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Installation of a dechlorination system utilizing sodium bisulfite pursuant to the
fast track application received on October 12, 2006, and in conformity with the
Minimum Design Criteria for Dechlorination Facilities.
NPDES Permit No. NCO084387 issued March 3, 2005, and shall be subject to revocation unless
the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0084387.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.

The Mooresville Regional Office, telephone number [phone], shall be notified at
least forty-eight (48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Pursuant to 15A NCAC 2H .0 140, upon completion of construction and prior to operation of
these permitted facilities, the completed Engineering Certification form attached to this permit shall be
submitted to the address provided on the form.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at least
equivalent to or greater than the classification assigned to the wastewater treatment facilities by
the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class H, III and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T I 5A: 8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
Carolina Dam Safety Act, In addition, the specitications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Water Quality in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

RECORDS/REPORTS:
Discharge Monitoring Reports (DMRs) were reviewed for the period August 2005
through July 2006. The facility did not have any limit or monitoring violations within this
period. During the inspection, a comparison between facility records/analytical data and the
information contained on the relevant DMR was completed. This review did not find any
discrepancies. All reviewed records, reports, and logs were clear and well maintained.
As per 15A NCAC 8G.0204, Responsibilities of an Operator in Responsible Charge
(ORC) and the standard conditions of NC0084387

and all visitation of the system in a daily log that shall be maintained at the system. During the
inspection it was discovered that an operator's log is not being maintained for the wastewater
treatment facility. Please institute the use of an ORC log as soon as possible.

FLOW MEASUREMENT:
Flow measurement is accomplished using a magnetic flow meter in the effluent discharge
pipe before the effluent enters the creek. Instantaneous measurements are recorded. The flow
meter is calibrated annually and was last completed in September 2006.
LABORATORY:
Lee S Dukes Jr.i Water Treatment Plant WWTP personnel are certified to perform field
parameter laboratory analyses of temperature, pH, and residual chlorine under certificate #5521.
Pace Analytical Services, Inc. is certified (#12) to perform all other wastewater analyses. Pace
Analytical Services, Inc. was not evaluated under this inspection.
EFFLUENT/RECEIVING WATERS. -
The effluent was clear at the time of the inspection. The receiving water did not appear
to be adversely affected by the effluent. The effluent is discharged to McDowell Creek, which is
a Class C water in the Catawba River Basin.
SELF -MONITORING PROGRAM:
Discharge Monitoring Reports (DMRs) were reviewed for the period August 2005
through July 2006. The reports indicate that the facility was meeting permit effluent limits
during this period and that all parameters are being monitored at the proper frequency and
location.
OPERATIONS & MAINTENANCE:
The facility and grounds appeared to be properly operated and maintained. The current
overall operating strategy appears acceptable for the size and type of the facility.
SLUDGE DISPOSAL:
Waste solids are being pumped as needed from the lagoon by Synagro, Inc., a residuals
management company, and land applied at the facility under the facility's land application permit
(WQ0000057). Synagro, Inc. was not evaluated under this inspection.

issuance of the last permit. Submit one signed original and two copies.

Representative. Submit one signed original and two copies,

the renewal package, written documentation must be provided showing the authority delegated to any
such Authorized Representative (see Part II.13.1 Lb of the existing NPDES permit).

solids) generated during wastewater treatment are handled and disposed. If your facility has no such
plan (or the permitted facility does not generate any solids), explain this in writing. Submit one signed
original and two copies.
The following items must be submitted ONLY by Industrial facilities discharging process
wastewater:
1:1 'Industrial facilities classified as Primary Industries (see Appendices A-D to Title 40 of the Code of
Federal Regulations, Part 122) must submit a Priority Pollutant Analysis (PPA) in accordance with 40
CFR Part 122.21. If the PPA is not completed within one week of February 1, 2001, submit the
application package without the PPA. Submit the PPA as soon as possible after February 1, 2001.
The above requitement does NOT apply to municipal ornon-indusni'tlfaciYties.
