If limits of disturbance changes or additional acreage added to original plan, normally they submit a revised plan for review and approval along with additional fees if required. I just want to check in with the Mooresville Regional Office, which approved the original E&SC Plan (attached), to verify that nothing needs to be modified with the E&SC Plan first. Our approval of a modification to an NCG01 Stormwater Construction permit COC acknowledges additional boundaries or other changes are being added to the scope of the Construction Stormwater permit coverage for the project, but I am not sure it is the mechanism for modifying limits of disturbance that have not been reviewed or approved by the E&SC authority. I am engaging Zahid Khan at our regional office for his guidance. Zahid, can you please advise on how to proceed? Does the MRO need to review these proposed changes and issue any kind of modification to the current E&SC Plan for this project? Or do the changes not require review by the Erosion Control Program? Hi Bethany, The 2.5 acres associated with the restoration of Killian Creek was not included in the originally permitted LOD spatial extent (it is directly adjacent to the original LOD); however, the original permit included 198 acres of land disturbance, of which the project only utilized 190.1 acres, therefore, the additional acreage of disturbance (2.5 acres) may be covered by the original permit in Lincoln County. The intention of this modification request is to have the disturbance location itself (outside of the initially permitted LOD / right of -way) included in a permit modification, as these activities are directly associated with the original project. The figures included with the permit modification submittal, particularly the one attached to this email, depicts the space included in the initial permit, and what we are looking to include in the modification. The yellow and green areas in the figure were part of the original permitted LOD and the orange hatched area is the proposed additional LOD limits. Piedmont Natural Gas Company, Inc. is a wholly owned subsidiary of Duke Energy, so there is a little bit of cross over with names, emails, etc. The permittee should be Piedmont Natural Gas Company, Inc. and the Legally Responsible Individual should be Jason Brown, who does have a Duke Energy email address. The attached delegation of signatory responsibility details that Duke Energy / Piedmont Natural Gas project managers may sign as legally responsible individuals for the purposes of permitting. Jason Brown (CCd) is the project manager for this project. Let me know if this clears things up. Feel free to give me a call to discuss the project further. The details explained that "The limits of disturbance adjacent to the existing utility right-of-way along Killian Creek consists of the 2.5 acres associated with this modification request." Is this new disturbance associated with the stream restoration included in the original E&SC disturbance approval of 198 acres as well? There were lots of other maps, permits, and plan sheets uploaded, but only the original E&SC approval from 2019. Was there some kind of modification made to the E&SC limits of disturbance, or no?
