The Division of Environmental Management has recently evaluated all existing individual permits for potential
coverage under general permits currently issued by the Division. 15A N.C.A.C. 2H .0127 allows the Division to
evaluate groups of permits having similar discharge activities for coverage under general permits and issue
coverage where the Division finds control of the discharges more appropriate in this manner. The Division has
determined that the subject discharge qualifies for such coverage. Therefore, the Division is hereby issuing the
subject Certificate of Coverage under the state-NIDES general permit no, NCG500000 which shall void NPDES
Permit NCO005789. This Certificate of Coverage is issued pursuant to the requirements of North Carolina and the
US Environmental Protection Agency Memorandum of Agreement dated December 6,1983 and as subsequently
amended.
If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to
you, you have the right to submit an individual permit application, associated processing fee and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and binding. Please
take notice this Certificate of Coverage is not transferable. Part 11, EA. addresses the requirements to be followed
in case of change of ownership or control of this discharge.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Pennittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement wastewater treatment or disposal facilities. Construction of any
wastewater treatment facilities will require issuance of an Authorization to Construct from this Division.
Failure to abide by the requirements contained in this Certificate of Coverage and respective general permit may
subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C. Please note that the general permit does require
monitoring in accordance with federal law. The monitoring data is not required to be submitted to the Division
unless specifically requested, however, the permittee is required to maintain all records for a period of at least
three (3) years.

The issuance of this Certificate of Coverage is an administrative action initiated by the Division of
Environmental Management and therefore, no fees are due at this time. In accordance with current rules, there
are no annual administrative and compliance monitoring fees for coverage under general hermits. The only fee
you will be responsible for is a renewal fee at the time of renewal. The current permit expires July 31,1997.
This coverage will remain valid through the duration of the attached general permit. The Division will be
responsible for the reissuance of the general permit and at such time, you will be notified of the procedures to
follow to continue coverage under the reissued permit. Unless you fail to follow the procedures for continued
coverage, you will continue to be permitted to discharge in accordance with the attached general permit.

PART IV - EVALUATION AND RECOMMENDATIONS
The 'Permitt e, Westinghouse Electric Corporation, has applied
for permit renewal. The subject NPDES'Permit serves the Charlotte
"Turbine/Generator Plant.
There are three discharges, all of which are non -contact
cooling water. Water is pumped from Lake Wylie and discharged
through the three discharges. All three discharge locations are
above the facilities water intake-. All domestic ,and industrial
process wastewater is pumped to the CMUD collection system.

Westinghouse Electric Corporation, Charlotte Turbine/Generator Plant, hereby requests renew -al of it
existing National Pollutant Discharge Elimination system (NPDE ) Permit to discharge its non -contact
cooling water to the receiving waters of Lake Wylie, of the Catawba River Basin,
Enclosed is the permit application completed and signed by an authorized officer of the corporation along
with our corporate draft in the amount of four hundred dollars ( Alt 0,00) the required processing fee.
As outlined in our current pennit, the effluent waters discharged. by Westinghouse to Lake Wylie are
exclusively non -contact cooling and receive no chemical treatment, therefore, as instructed by your office,
Westinghouse hereby requests exemption from the priority pollutant analysis as part of this permit
renewal application.
Westinghouse had previously advised Mr. B. Rex. Gleason of your Mooresville office, that additional
discharges not emanating from or controlled by the Westinghouse hou turbine Generator Plant appeared to be
entering the Westinghouse spray pond upstream of outfall 001, Drawing MS 2001A indicates the
locations Mons of these discharges in relation to the Westinghouse spray pond. In conversations with Mr.
Gleason, we pointed out that these other discharge sources may have the potential to influence
Westinghouse's permitted outfall 00 1.

The discharges appear to be from storm water runoff from new construction and industrial activities in the
area. We understand that your office has issued permits for the discharges, with outfalls into the
Westinghouse spray pond,
Mr, Gleason advised its that this issue would be considered when the permit was renewed. As part of our
Renewal Application, Westinghouse below outlines its concerns tegarding the additional discharges
entering our spray pond from off -site sources.
As our permit indicates, the Westinghouse discharge to the pond, consisting of only non -contact cooling
water, has not been problematic. Westinghouse has at its own expense sampled the non -Westinghouse
discharges at their point of entry into the spray pond. The analytical results are attached for your review.
You mill note that the results indicate some elevated levels of metals in the discharges, By contrast,
analyses of our permitted outfall 001 for metals, plienols, conventional and non -conventional pollutants,
BOO, COD, TOC, TSS, ammonia, and pH (also attached) do not reflect such results.
These analyses of the Westinghouse outfall confirm that, consistent with results of past sampling,
Westin ghouse's discharges conform to regulatory requirements. Obviously, we are concerned that this
situation may change over time, as the new discharges over which we have no control continue into our
pond. Although these discharges may not present a problem now, at some point these may negatively
impact the water at outfall 001, which to this point has consistently tested to be well NNithin applicable
standards. Westinghouse does not believe it should be responsible for such a situation.
Westinghouse thus requests some reassurance from your office, which we understand has issued permits
for these new discharges, that we will not be prejudiced under our renewed permit because of these
sources, and the potential that these sources inay contain regulated _pollutants which Westinghouse does
not discharge. Westinghouse should not be held responsible for, not should it be penalized, if for
example, additional testing or monitoring is required because of these new discharges or if the new
discharges cause exceedance of Westinghouse's permit,

Part T
B. Schedule of Compliance
1. The permittee shall comply with Final Effluent Limitations specified for
discharges in accordance with the following schedule:
Permittee shall comply with Final Effluent Limitations by the effective
date of the permit.
2. Permittee shall at all times provide the operation and maintennnce
necessary to operate the existing facilities At optimum efficiency.
3. No later than 14 calendar days following a date identified in the above
schedule of compliance, the permittee shall submit either a report of
progress or, in the case of specific actions being required by identified
dates, a written notice of compliance or noncompliance. In the latter
case, the notice =shall include the cause of noncompliance, any remedial
actions taken, and the probability of meetipg the next schedule
requirements.

PART I I
STANDARD CONDITIONS FOR NPDES PERMITS

negligently violates a permit condition is guilty of a misdemeanor punishable
by a fine not to exceed $15,000 per day of violation, or by Imprisonment
not to =exceed six months or both.

The permittee shnll take all reasonable steps to minimize any adverse impact
to navigable waters resulting from noncompliance with any effluent limitations
specified in this permit, including accelerated or additional monitoring as
necessary to determine the nature and impact of the noncomplying discbarge.
4. Permit'flodification
After notice and opportunity for a hearing pursuant to NCGS 143-215.1(b)
(2) and NGGS 143-215.1(e) respectively, this permit way be modified, suspended,
or revoked in whole or in part during its term for cause Including, but not
limited to, the following:
A. Vaintion of any terms or cnnditlons of this permit;
b. Obtaining this permit by misrepresantation or fnil"re to disclose fully
all relevant facts;
C. A change in any condition that requires either a temporary or permanent
reduction or elimination of the authorized discharge; or
& Information newly acquired by the Division indicating the discharge poses
a threat to human health or welfare.
If the permittee believes that any past or planned activity would be cause for
modification or revocation and reissuance, the permittee must report such
information to the Permit Issuing Authority, The submittol of a new application,

may be required of the permittee. The filing of a request by the permittee for
a permit modification, revocation and reissuance, or termination, or a
notification of planned changes or anticipated noncomplOnces, does not stay
any permit condition.
5. Toxic Pollutants
Notwithstanding Part IT, A-4 above, if a toxic effluent standard or prohibition
(irrcludiNg any schedule of comPlil"ce rMified in such effluent standard Or
prohibition) is established under Section 307(a) of the Art for a toxic
pollutant which is present in the discharge, if such standard or prohibition
is more stringent tbnn any limitation for such pollutant in this permit, this
permit shall be revised or modified in accord6ticc with t" toxic effluent
standard probibitfon and the permitteA so notified.
The permittee shall comply with effluent standards or prohibitions established
under Section 307(m) of the Clean Water Act for toxic poll"tants within the
time provided in the regulations that establish those stnnOrds or prohibitions,
even if the pormit has not yet been modified to incorporate the requirement.

The permittee shall at all times maintain in good working order and operate
as efficiently as possible all treatment or control facilities or systems
installed or used by the permittee, to achieve complKnee with the terms
and conditions of this permit.

Any diversion from or bypass of facilities is prohibited, except (i) where
unavoidable to prevent loss of life or severe property damage, or (if)
cohere excessive storm drainage or runoff would damage any facilities
necessary for compliance with the effluent limitations rand prohibitions of this
permit. All permittees who have such sewer bypasses Or OVOTHOWS Of this
discharge shall submit, not later than six months from the date of issuance
of this permit, detailed data or engineering estimatco which identify:

This requirement is waived where infiltration/inflow analyses are scheduled
to be performed as part of an Environmental Protection Agency facilities
planning project.
The permittee shall report by telephone to either the central office or
appropriate regional office of the Division as soon as possible, but in
no case more than 24 hours or on the next working day following the
occurrence or first knowledge of the occurrence of any division from or
bypass of facilities,

"Upset" means an exceptional incident in which there is unintentional and
temporary noncompliance with technology based permit effluent limitations
because of factors beyond the reasonable control of the permittee. An upset
does not include noncompliance to the extent caused by operational error,
improperly designed treatment facilities, inadequate treatment facilities,
lack of preventive maintenance, or careless or improper operation. An upset
constitutes an affirmative defense to an action brought for noncompliance
with such technology based permit limitation if the requirements of 40 CFR S
122.41(n)(3) are met.
5. Removed Substances
Solids, sludges, filter backwash, or other pollutants removed in the course of
treatment or control of wastewaters shall be disposed of in accordance with
NCGS 143-215.1 and in a manner such as to prevent any pollutant from such
materials from entering waters of the State or navigable waters of the United
States.
6. Power Failures
The permittee is responsible for maintaining adequate safegiiards as requfrod
by DEM Regulation, Title '15, North Carolina Administrativo Code, Subcbapter 2H,
.0124 Reliability, to prevent the discharge of untreated or inadequately treated
wastes during electrical power failures eitber by means of alt ernate powe'r
sources, standby generators or retention of inadequately treated effluent.
SECTION C. MONITORING AND RECORDS
1. Repre§,qn1�ptJvq Sampling

Samples collected and measurements taken, as required herein, shall be
characteristic of the volume and nature of the permitted discharge. Samples
collected at a frequency less,
than daily shall be taken on a day and time that
is characteristic of the discharge over the entire period which the sample
represents. All samples shall be taken at the monitoring points specified in
this permit and, unless otherwise specified , before the effluent joins or is
diluted by any other wastestream, body of water, or substance. Monitoring points
shall not be changed without notification to and the approval, of the Permit
Issuing Authority.

Monitoring results obtained daring the previous month(s) shall be summarized for
each month and resorted on a monthly Discharge Monitoring Report (DMR) Form
(DEM No. MR 1, 1. 1, 2, ) or alternative forms approved by tlae Director, DEM,
postmarked no later than the 30th day following the completed reporting period.
The first DMR is due on the last day of the month followia:g the issuance of the
permit or in the case of a now facility, on the last day of the month following
the commencement: of discharge. Duplicate signed copies of these, and all other

Appropriate flow measurement devices and methods consistent with accepted
scientific practices shall be selected and used to insure the accuracy and
reliability of measurements of the volume of monitored discharges. The
devices shall be 'installed, calibrated and maintained to insure that the
accuracy of the measurements are consistent with the accepted capability of
that type of device. Devices selected shall be capable of measuring flows
with a<maximum deviation of less than,-+ 10 from the true discharge rates
throughout the range of expected discharge volumes. ' Once -through condenser
cooling water flaw which is monitored by pimp logs, or pump hoar meters as
specified in Part l of this permit and based on the manufacturer's pump
curves - shall not be subject to this requirement.

Test procedures for the analysis of pollutants shall conform to the EM
regulations published pursuant to NCGS 143- 15. 3 et secs, the Later. and Air
Quality Reporting facts, and to regulations published pursuant to Section 304(g)
33 USC 1314 of the Federal Water Pollution Control Act; as Amended, and
Regulation 40 CFR 136.

The Clean Water Act provides that any person who falsifies, tampers with, or
knowingly renders inaccurate, any monitoring device or method required to be
maintained harder this permit shall, upon conviction by punisb& by a fine of
not more than $10,000 per violation, or by imprisonment for not more than
six months per violation, or by both.

6. Retention
All records and information resulting from the monitoring activities required by
this permit including all records of analyses performed and cnlibration and
maintenance of instrumentation and recordings from continuous monitoring
instrumentation shall be retained for a minimum of three (3) years by the
permittee. Thisperiod of retention shall be extended during the course
of any unresolved litigation or if requested by the Division of Environment&
Management or the Regional Administrator of the Environmental Protection Agency.
7. Recording Re #!s
For each measurement or sample taken pnrsuant to the requirements Of this
permit, the pormittee shall record the following SHIMItion:

b. Amy process unit failure, due to known or unknown reasons, that render
the facility incapable of adequate wastewater treatment such as mechanical
or electrical failures of pumps, aerators, compressors, etc.
C. Any failure of a pumping station, sewer line, or treatment fac:il.lty
resulting in a by-pass directly to receiving waters without: treatment
of all or any portion of the influent to such station ' or facility.
d. Any time that: self --monitoring information indicates that: the facility has
gone out of compliance`with its NPDPS permit limitations.
Persons reporting such occurrences by telephone shall also file a written
report in letter form within 15 days following first knowledge of the
occurrence.

The permit:tee shall notify the Permit Issuing Authority as soon as it knows or
has reason to believe.
a. That any activity has occurred or will occur wh tch would insult in the
discharge, on a. routine or frequent basis, of any toxic substance(s) (listed
at 40 CPR S 122, Appendix D, Table 11 and 111) which is not limited in the
permit, if that discharge will exceed the highest of the following
"notification levels".
(1) One hundred micrograms per liter (1 0 sag/ 1) ;
(2) '£t,To laaaasdred micrograms por liter (200 ,ug/1.) for acrol 1p and
ac.rrlon t rtle; five e hundred 'micrograms per liter (500 a /1)
for 2,-di.nitrophenol and for -methyl- ,6-dini ropbenol, and one
milligram per liter (l mg/1) for antimony; or
(3) five (5) times the maximum concentration value reported for that
pollutant(s) in the permit application.
b. That: any activity has occurred or will occur which would result in any
discharge, site a non -routine or infrequent basis, of a toxic pollutant
(listed at 40 CFR S 122, Appendix D. Table 11 and 111) which is not
limited in the permit, if that discharge will exceed the highest of the
following "notification levels":

(2) one milligram per liter (I mg11) for antimony; or
(3) Ten (10) times the maximum concentration value reported for that
pollutant(s) in the permit application.
8. KjrAKi2R of_Permit Permittee is not authorized to discharge after the expiration date. In order to
receive a"thorizntion to disohnrge beyond toe pxpiretion date, the permittee
shall submit such information, forms, and fees as are required by the agency
authorized to issue permits no later than 180 days prior to the expiration date.
Any discharge without a permit after thy expiration will subject the permittee
to enforcement procedures as providad in NCGS 143-215J and 33 USC 1251 et seq.
9.
All applications, reports, or information submitted to the Permit Issuing
Authority shall be signed and certified.
a. All permit applications shall be signed as follows:
(1) For a corporation: by a responsible corporate officer. For the
purpose of this Section, a responsible corporate officer means:
(a) a president, secretary; treasurer or vice president of the
corporation in charge of a principal business Onction, or any
other person who performs similar policy or decision making
functions for the corporation, or (b) the manager of one or more
manufacturing production or operating facilities employing more
than 250 persons or having gross annual sales or expenditures
exceeding 25 million (in second quarter 1980 dollars), if authority
to sign documents has been assigned or delegnted to the manager in,
accordance with corporate procedures.
(2) For a partnership or sole proprietorship: by a general partner or
the proprietor, respectively; Or
(3) For a municipality, State, Federal, or other public agency: by either
a principal executive officer or ranking elected official.
b. All reports required by the permit and other information requested by the
Permit Issuing Authority shall be signed by a person described above or by
a duly authorized representative of that person. A person is a duly
authorized representative only if:
(1) The authorization is made in writing by a person described above;
(2) The authorization specified either an individuil or a position having
responsibility for the overn1l operation of the regulated facility or
activity, such as the position of plant m4nngrr, operator of a well or

well field, superintendent, a position of equivalent responsibility,
or an individual or position having overall responsibility for environ-
mental matters for the company. (A duly authorized representative
may thus be either a named individual or any individual occupying a
named peas ition0; and
(3) The written authorization is submitted to the Permit Issuing Authority.
C. Certification. Any person signing a document under paragraphs a. or b. of
this section shall making the following certification:
"I certify, under penalty of law, that this document and all attachments
were prepared under my direction or supervision in accordance with a system
designed to assure that qualified personnel properly gather and evaluate the
information submitted. Based on my inquiry of the person or persons who
mnnage the system, or thn5e persons directly responsible for gathering the
information, the informnt ion submitted is, to the best of my knowledge and
believe, true, acc"rate, and complete. T am aware that there are
significant penalties for submitting false information, including the
possibility of fines and imprisonment for knowing violations.''
10. Availabili,ty--Pf--,�Rapart

Except for data determined to be confidential under NCGS 143-215.3(a) (2) or
Section 308 of the Federal Act, 33 USC 1318, all reports prepared in accordance
with the terms shall be available for public inspection at the offices of the
Division of Environmental Management. As required by the Act, effluent data
shall not be considered confidential. Knowingly making any false statement on
any such report may result in the Imposition of criminal penalties as provided
for in NCGS 143-215.1(b) (2) or in Section 309 of the Federal Act.

arithmetic mean (weighted by flocs value) of all the samples collected

daily concentration value is equal to the concentration of a composite

flow value) of all the samples collected during that calendar day. The
average yearly count for fecal coliform bacteria is the geometric mean
of the counts for samples collected during a calendar year. This limitation

7. Other Measurements
a. Flow, (MGD): The flow limit expressed in this permit is the 24 hours
average flow, averaged monthly. It is determined as the arithmetic mean
of the total daily flows recorded during the calendar month.
b. An "instantaneous flow measurement" is a measure of flow taken at the time
of sampling, when both the sample and flow will be representative of the
total discharge;

a. Composite Sample: These samples consist of grab samples collected at
equal intervals and combined propottional to flow, A Sample continuously
collected proportionally to flow, or equal volumes tal,,en at varying time
intervals. If a composite sample is obtained from grab samples, the
following requirements apply. The intervals bete O(In influent grab
samples shall be no greater than hourly. Intervals between effluent grab
samples shall be no greater than hourly except where the detention time
of the wastewater in the facility is greater than 24 hours, in which
case, the interval between grab samples shall, be no greater in number of
hours than the detention time in number of days; provided, however, in
DO case may the time between effluent grab samples be greater than six
hours nor the number of grab samples less than four during any discharge
period of 24 hours or less.
b. Grab Sample: Grab samples are individual samples collected over a
period of time not exceeding 15 minutes; the grab sample can be taken
manually.

of the individual values divided by the number of individual values.
b. Geometric Mean: The geometric mean of any set of values is the Nth root of
the product of the individual values where N is equal to the number of
individual. values. The geometric mean is equivalent to the antilog of
the arithmetic mean of the logarithms of the individ"al values. For
purposes of calculating the geometric mean, values of zero (0) shall be
considered to be one (1).

a. The "daily average" discharge means the total discharge by weight
during a calendar month divided by the number of days in the month`
that the production or commercial facility was operating. Where lass
than daily sampling is required by this permit, the daily average
discharge all be determined by the summation of all the measure
daily discharges by weight divided by the number of days sampled
during the leh ar month when the measurements were made.

for a minimum of three'( ) years,, or longer if requested by the State
Division of Environmental Management or the Regional Administrator of
the Environmental Protection Agency.

A. MA14AGEME14T REQUIREMENTS
1. Change in Discharge
All discharges authorized herein shall be consistent with the terms and
conditions of this permit. The discharge of any pollutant identified
in this permit more frequently than or at a level in excess of that
authorized shall constitute a violation of the permit. Any anticipated
facility expansions, production increases, or process modifications which
will result in new, different, or increased discharges of pollutants must
be reported by submission of a new NPDES application or, if such changes
will not violate the effluent limitations specified in this permit, by
notice to the DEM of such changes. Following such notice, the permit
may be modified to specify and limit any pollutants not previously limited.
2. on compliance Notification
If, for any reason, the permittee does not comply with or will be unable
to comply with any effluent limitation specified in this permit, the per -
mitt ee shall provide the Division of Environmental Management with the
following information, in writing, within five (5) days of becoming aware
of such condition. -
a. A description of the discharge and cause of noncompliance; and
b. The period of noncompliance, including exact dates and times; or,
if not corrected; the anticipated time the noncompliance is expected
to continue, and steps being taken to reduce, eliminate and prevent
recurrence of the noncomplying discharge.
3. Facilities Operation
The permittee shall at all times maintain in good working order and
operate as efficiently as possible all treatment or control facilities
or systems installed or used by the permittee to achieve compliance with
the terms and conditions of this permit.
4. Adverse Impact
The permittee shall take all reasonable steps to minimize any adverse
impact to navigable waters resulting from noncompliance with any effluent
limitations specified in this permit, including such accelerated or
additional monitoring as necessary to determine the nature and impact of
the noncomplying discharge.
5. Bypassing
Any diversion from or bypass of facilities necessary to maintain compliance
with the terms and conditions of this permit is prohibited, except (i) where

unavoidable to prevent loss of life or severe property damage, or
(ii) where excessive storm drainage or runoff would damage any
facilities necessary for compliance with the effluent limitations
and prohibitions of this permit. The permittee shall promptly
notify the Water Quality Section of DEM in writing of each such
diversion or bypass.
6. Removed Substances
Solids, sludges, filter backwash, or other pollutants removed in the
course of treatment or control of wastewaters shall be disposed of in
a manner such as to prevent any pollutant from such materials from
entering waters of the State or navigable waters of the United States.
7. Power Failures
In order to maintain compliance with the effluent limitations and
prohibitions of this permit, the permittee shall either:
a. In accordance with the Schedule of Compliance contained in Part I,
provide an alternative power source sufficient to operate the waste-
water control facilities;
or, if such alternative power source is not in existence, and no date for
its implementation appears in Part I,
b. Halt, reduce or otherwise control production and/or all discharges
from wastewater control facilities upon the reduction, loss, or
failure of the primary source of power to said wastewater control
facilities.
8. Onshore or Offshore Construction
This permit does not authorize or approve the construction of any onshore
or offshore physical structures or facilities or the undertaking of any
work in any navigable waters.

B. RESPONSIBILITIES
1.
Right of Entry
The permittee shall allow the Director of the Division of Environmental
Management, the Regio al Administrator, and/or their authorized represen-
tatives, upon the presentations of credentials:
a. The enter upon the permittee's premises where an effluent source i
located or in which any records are required to be kept under th
terms and conditions of this permit; and
. At reasonable tires to have access to and coy any records required
to be kept under the terms and conditions of this permit; to inspect
any monitoring equipment or monitoring method required in this permit;
and to sample any discharge of pollutants.
2.
Transfer of 04nership or Control
This permit is not transferable. In the event of 'any change in control
or ownership of-facilitiesof-fTacilities from which the authorized discharge emanates
or is contempl te.i, the permittee shall notify the prospective owner or
controller by letter of the existence of this permit and of the need to
taro a Pe mit'ir the name of the prospective owner. A copy of the
letter shall, beforwarded to the Division of Environmental Management.

Availability of Reports
Except for data dete mined to be confidential under N. Cm G. S. 1 3 215.
3(a)(2) or Section 30of the Federal Act, 33 USC 1318, all reports r p r
in accordance with the terms shall be available for public inspection at the
offices of the Division of Environmental Management. As required y the Act,
effluent data shall not be considered confidential. Knowingly making
false statement on any such report may result in the im osition of criminal
penalties as provided for in N. C. Cm S. 14321. )2 or in Section
309 of the Federal Act

Permit Modification
After notice and opportunity for a hearing pursuant to N. C. C. S. 1 3
1S.1b)2) and S 14�2151e respectively, this permit maybe
modified, suspended, or revoked in whole or in part during its term for
cause including, � ut Pat limited to, the following:
a. Violation of any terms or conditions of this e it
b. Obtainirg Ws permit by misrepresentation or failure to disclose
ful ly rt t e l cy ant facts; or
C. A change in any condition that requires either a temporary or
permanent reductior or elimination of the authorized discharge.

Notwithstanding Part III 4 above, if a toxic effluent standard or
prohibition (including any schedule of 'compliance specified in such
effluent standard or prohibition) is established under Section 30a '
of the Act for a toxic pollutant which is present in the discharge and
such standard r prohibition is more stringent than any limitation for
such pollutant in this permit, this permit shall be revised or modified
in accordance with the toxic effluent standard or prohibition and the
permittee so notified
t Civil and Criminal Liability
Except as provided in permit conditions on "Bypassing" (Part I, 5 ,
an "Power Failures" (Part II, A-7), nothing in this pewit shall be
construed to relieve the permittee from civil or criminal penalties for
noncompliance pursuant to N. C. G. S. 143-215.6 or Section ,30of the
Pederal Act, 33 USC 1319.
7. Oil and Hazardous Substance Liability
Nothing in this permit shall be construed to preclude the institution
f any legal action or relieve the permitteefrom any responsibilities,
liabilities, or penalties to which the permittee is or may be subject
under N. C. Gm S. 13-15.5'et seq. or Section 311 of the Federal Act,
33 1SC 1321.
8. Property Rights
The issuance of this permit does not convey any property rights in either
real or personal property, or any exclusive privileges, nor dos it
authorize any injury to private property or any invasion of personal
rights, nor any infringement of Federal,State or"local laws or regulations.
S. Severabi l i ty
The provisions of this permit are severable, and if any provision of this
pe pit, or the application of any provisionofthis permit to any circum-
stance, is held invalid, the application of such provision to other cir-
cumstances, and the remAinder of this permit shall not be affected the

10. Expiration of Permit
Permittee is not authorized to discharge after the expiration date.
In order to receive authorization to discharge beyond the expiration`
date, the permittee shall submit such information, forms, and fees a

cooling tower bleedoff, boiler blowdown, air washers, and combinations of these systems.
Such discharges shall be limited and monitored by the permitte6 as specified below where
materials containing these containments are subject,to being discharged.

B. MONITORING AND REPORTING

Samples and measurements taken as required herein shall be
representative of the volume and nature of the monitored
discharge.
. Reporting
Monitoring results obtained during the previous 6 months
shall be summarized and reported on a Discharge Monitoring
Report Form (EPA No. 3320-1), postmarked no later than the
28th clay of the month following the completed reporting 'period.
The first report is dug on March 31, 1975. Duplicate signed w
copies of these, and all other r arts re aired herein shall
be submitted to the Regional Administrator and the State at the
following addresses;

3. Definition
a+. The daily average discharge shall be determined by the
summation of the measured daily discharges divided by
the number of clays during the calendar month 'when the
measurements were made.
b. The "daily maximum" discharge means the total flow
during any calendar day.

4. Test Procedures
Kest procedures for the analysis of pollutants shall conform
to regulations published pursuant to Section 304(g) of the Act,
under which such procedures may be required.
5. Recording, of Results
For each measurement or sample taken pursuant to the requirements
of this permit, the permittee shall record the following
information:
a. The exact place, date, and, time ofsampling;
b. The dates the analyses were perfo ed;
c. The person(s) who performed the analyses,
d. The analytical techniques or methods used; -and
e. The results of all required analyses.
6. Additional Monitoring by Permittee
If the permittee monitors any pollutant at the location(s)
designated herein more frequently than required by this
permit, using approved analytical methods as specified above,
the results of such monitoring shall be included in the cal-
culation and reporting of the values required in the Discharge
Monitoring Report Form (EPA. No. 33 0-1). Such increased
frequency shall also be indicated.
7. Records Retention
l: records and information resulting from the monitoring
activities required by this permit including all records ,of
analyses performed and calibration and maintenance of instru-
mentation and recordings from continuous monitoring instrumen-
tation shall be retained for a minimum of three(3) years, or
longer if requested by the Regional Administrator or the State

C. SCHEDULE OF COMPLIANCE

2. No later than 14 calendar days following a date identified
in the above schedule of compliance, the per "ttee shall
submit either a report of progress or, in the case of
specific actions being required by identified dates, a
itten`noice of compliance or noncompliance. In the
latter case, the notice shall include the cause of non-
compliance, any remedial actions taken, and the probability
of meeting the neat scheduled requirement.

MANAGEMENT REQUIREMENTS
1. Chan in Ilischare
All discharges authorized herein shall be consistent with ;the
terms and conditions of this permit® The discharge of any
pollutant identified in this permit more frequently than or
t a level in excess of that authorized shall constitute a
violation of the permit. Any anticipated facility expansions,
production increases, or process modifications which will
result in new, different, or increased discharges of pollutants
must be reported by submission of a new NPDES application or, if
such changes will not violate the effluent: limitations specified
in this permit, by notice to the permit issuing authority of
-such changes.. following such notice, the permit may be modified
to specify and limit any pollutants not previously limited.

If, for any reason, the permittee does not comply with or will be
unable to comply with any dni ly maximum eff I.uent Limitation
specified in this permit, tho permittee shall provide the Regional
Administrator and the State with the following information, in
writing, within five (5) drays of becoming aware of such condition:
a A description of the discharge and cause of noncompliance, and
b. The period of noncompliance, including exact dates and times,
or, if not corrected, the anticl.pated time the noncompliance
is expected to continue, and steps being taken to reduce,
eliminate and prevent recurrence of the noncomplying
discharge.
Facilities t} erasion
The permittee shall at all tames maintain in good working order
and operate as efficiently as possible all treatment or control
facilities or systems installed or used by the permittee to
achieve compliance with the terms and conditions of this permit.

4. Adverse Impact
The permittee shall take all reasonable steps to minimize any
adverse impact to navigable waters resulting from noncompliance
with any effluent limitations specified in this permit, including
such accelerated or additional monitoring as necessary to deter-
mine the nature and impact of the noncomplying discharge.
5. Bypassing
Any diversion from or bypass of facilities necessary to main-
tain compliance with the terms and conditions of this permit
is prohibited; except (i) where unavoidable to prevent loss
of life of severe property damage, or (ii) where excessive storm
drainage or runoff would damage any facilities necessary for
compliance with the effluent limitations and prohibitions of
this permit. The permittee shall promptly notify the Regional'
Administrator and the State in writing of each such diversion
or bypass.
6. Removed Substances
Solids, sludges, filter backwash, or other pollutants removed
from or resulting from treatment or control of wastewaters shall
be disposed of in a manner such as to prevent any pollutant from
such materials from entering navigable waters.
7. Power failures
In order to maintain compliance with the effluent limitations
and prohibitions of this permit, the permittee shall either:
a. In accordance with the Schedule of Compliance contained in
Part I, provide an alternative power source sufficient to
operate the wastewater control facilities;
or, if no date for implementation appears in Part I,
b. halt, reduce or otherwise control production and/or all
discharges upon the reduction,joss, or failure of one
or more of the primary sources of power to the wastewater
control facilities.

B. RESPONSIBILITIES
1. Kight of Entry
The permittee shall allow the head of the State water pollution
control agency, the Regional Administrator, and/or their
authorized representatives, upon the presentation of credentials:
a. To enter upon the permittee's premises where an effluent
source is located or in which any records are required
to be kept under the terms and conditions of this permit;
and
b. At reasonable times to have access to and copy any records
required to be kept under the terms and conditions of this
permit; to inspect any monitoring equipment or monitoring
method required in this permit; and to sample any discharge
of pollutants.
2. Transfer of Ownerstipo Contril
In the event of any change in control or ownership of facilities
0
from which the authorized discharges emanate the permittee shall
notify the succeeding owner or controller of the existence of this
permit by letter, a copy of which shall be forwarded to the
Regional Administrator and the State water pollution control agency.

Except for data determined to be confidential under Section 308
of the Act, all reports prepared in accordance with the terms of
this permit shall be available for public inspection at the
offices of the State water pollution control agency and the
Regional Administrator. As required by the Act, effluent data
shall not be considered confidential. Knowingly making any
false statement on any such report may result in the imposition
of criminal penalties as provided for in Section 309 of the Act.
Permit Modification
After notice and opportunity for a hearing, this permit may be
modified., suspended, or revoked in whole or in part during its
term for cause including; but not limited to, the following:

a. Violation of any terms or conditions of this permit;
b. Obtaining this permit by misrepresentation or failure
to disclose fully all relvent facts; or
c. A change in any condition that requires either a temporary
or permanent reduction or elimination of the authorized
discharge.
5. Toxic Pollutants
Notwithstanding Fart II, 5--4 above, if a toxic effluent standard
or prohibition (including any schedule of compliancy: specified
in such effluent standard or prohibition) is established under
Section 307(a) of the Act for a toxic pollutant which is present
in the discharge and such standard or prohibition is more stringent
than any limitation for such pollutant in this permit, this permit,
shall be revised or modified in accordance with the toxic effluent
standard or prohibition and the permittee so notified.
6.. Civil and Criminal Liabilit
Except as provided in permit conditions on "Bypassing" (Part II,
A-5) and "Power Failures" (Part II, A-7), nothing in this permit
shall be construed to relieve the permittee from civil or criminal
penalties for noncompliance, whether or not such noncompliance is
due to factors beyond his control, such as accidents, equipment
breakdowns, or labor disputes

Nothing in this permit shall be construed to preclude the institution
of any legal action or relieve the permittee from any responsibil-
ities, liabilities, or penalties to which the permittee is or may
be subject under section 311 of the Act.
S. State Lawn
Nothing in this permit shall be construed to preclude the institution
of any legal action or relieve the permittee from any responsibil-
ities, , liabilities, or penalties established pursuant to any appli-
cable State law or regulation under authority preserved by section
510 of the Act.

The ,issuance of this Dermi.t does not convey any property .rights
in either real or personal property, or any exclusive privileges,
nor does it authorize any injury to private p uperty or any
invasion of personal rights, nor any infringement of Federal,
State or local laws or regulations.
10. Severdbilit
The provisions of this permit are severable, and if any provision
of this permit, or the application of any provision of this permit
to any circumstance, is held invalid, the application of such
provision to other circumstances,,and the remainder of this permit
shall not be affected thereby..
PART Ill
OTHER REQUIREMENTS
1. Pesticides (Algaecides, Biocides, etc.) Any pesticide discharge
from any point source- shall comply with the requirements of the
Federal Insecticide, Fungicide and Rodent cide Act, as amended
(7"U.S. U.S.C. 13 at seq.) and the use of such pesticide shall be in
a wanner consistent with its label.
2. State Certification: The State of Tot Carolina, Department of
tr tural and Economic Resource , Office of Water and Air Resources,
has certified the discharge(s) covered by this permit with conditions
(Attachment I). Section 401 of the Act requires that conditions of
certification shall become a condition of the permit. The monitoring
and sampling shall be as indicated in North Carolina Regulation LXXI,
Monitoring and Reporting Wastewater Discharges and Their Effect on the
Receiving inters, for those parameters included in the certification
In the event of any conflict between the conditions listed in fart I
or other conditions of this permit and in the certification attached,
the more restrictive shall rule.

Pursuant to Section 401 of the Federal rater Pollution: Control Act (3
U. S. C. 1251, 1341; hereafter the "Act"), the State of North Carolina issues
this Certification to subject applicant fora National Pollutant Discharge
Elimination System (NPDES) permit to discharge into navigable waters..
'ping evaluated the applicant's application and having reviewed the con-
ditions to be imposed in the NPDES permit, the State of North Carolina certi--
figs that if the applicant complies with the conditions developed for the NPDES
permit, the applicant's discharge will comply with the applicable provision
of Section 301 of the act and appropriate requirements of Chapter 143 of the
North Carolina General Statutes. Furthermore, in so far as it can determine,
the State of North Carolina certifies that there are no limitations under
Section 302 nor standards under Section 306 or 307 which are applicable to the
