I went back to THE VUE, Tues. Nov. 251h, This was the end of the two week period to determine if there is any
accumulation of ground water. I met with Ralph Smith, the service manager, and took pictures of the tank level. There
has been no accumulation during the past two weeks; see attached picture, 10-29 and 11-25. Mr. Smith informed me
that the system pumps were turned off two weeks ago to avoid any illicit discharge if there had been an accumulation of
ground water in the tank.

renewed. if the level does not rise and there is no need to discharge, then there would be no violation and there would

water needs to be discharged then the system would need to be deactivated going forward to ensure there is no illicit
discharge in the future. A period of two weeks should be enough to determine if water is accumulating. Please advise
the status at the end of the two week period.

(C MSWS) and Marcia Allocco of the NC Department t of Environmental and Natural Resources
( 'CDE ) conducted an investigation of your property located at 215 North Pine Street in
Charlotte, North Carolina, The investigation was nducted by auffiority granted under the City

on the lookout for it. There was confusion when the building was foreclosed in 2012 regarding the discharge location of
the treated groundwater.

1 apologize for the lateness in my reply but your e-mail arrived when i was out of the office on training and it got Mast in
my inbox until my clear -out today.
The Vine property in downtown Charlotte had coverage (Certificate of Coverage NC( 510514) under our general permit
to discharge remedated groundwater that was contaminated with petroleum products (NCG510000) to the City of
Charlotte's storrnwater system with eventual discharge to surface waters. Coverage under the permit was issued on
June 11, 2007, and expired on September 30, 2011, since continued permit coverage was not requested when the
general permit was renewed.
A site visit was conducted by myself and Donna Hood on Februarys 5, 2013, to ascertain if permit coverage was still
required. We met with staff on site from Northwood -Ravin and they showed us the room where the reined ation
system had been located at one time but 1 do not remember seeing any carbon filters but 1 may be mistaken. They also
noted that they pump water from a sump in the loading area at the northeastern end of the building to a manhole on
North Pine Street. It was unclear whether this was a sanitary manhole or a stormwater manhole and from where this
water originated. Donna Hood informed the Northwood -Ravin contact that they needed to follow-up with WQ/ WR
when they determine to what system the water was being discharged and the source of the water. 1 cannot find any

treatment system. MACTEC's telephone conversation with representatives of the CIVIUD administration division on
February 5, 2007, confirmed the City Code."
I have copied Tim Downs with CIVIUD's system protection group so he can verify whether approval has been granted by
CIVIUD to discharge treated groundwater at this location.
Please follow-up with me regarding the status of the discharge from the sump at the northeast end of the building noted
during the site visit in 2013 and whether permit coverage under a NPDES permit should be obtained.

I am conduct an ESA on The VUE in downtown Charlotte. The VUE has a sump in the basement, the collected water is
discharged to the sanitary sewer system after carbon filtering. The carbon filters were set in place to address historical
UST petroleum releases from onsite (UST #36417) and (UST #06921) adjacent sources.
Questions:
1) Is there an NPDES permit associated with onsite sump? What is the current status of this release, my sources
show an NFA dated 4/17/2008?
2) What is the current status of City View Towers 425 W. 5th Street (UST #06921)? Reportedly, 2.2 feet of free
product existed on site at one point. My site, The VUE, is located down gradient.

sanitary sewer system after carbon filtering" which I find troubling since the original application for coverage under our
general wastewater permit completed by MA TEC notes, "A connection with an existing sanitary sewer associated with
Charlotte Mecklenburg Utilities Department (CMUU) is not feasible due to City of Charlotte Code (Chapter 2, Appendix
III Section 23-29b[141 that disallows the discharge of stormwater or groundwater to the sanitary sewer and wastewater
treatment system. MACT C`s telephone conversation with representatives of the CMUO administration division on
February 5, 2007, confirmed the City Code."
I have copied Tim Frowns with CMUD's system protection group so he can verify whether approval has been granted by
€:MUD to discharge treated groundwater at this location.

General Permit Coverage. In accordance with your application for discharge, the Division is forwarding herewith
the subject Certificate of Coverage to discharge under the subject state- ICES general permit. This permit is
issued pursuant to the requirements of No Carolina General Statue 143-215 .1 and the Memorandum of
Agreement between No Carolina and the US Environmental Protection agency dated May 9, 1994 (or as
subsequently amended).
The following information is included with your permit package:
• A copy of the Certificate of Coverage for your treatment facility
• A copy of General Wastewater Discharge Permit NCG510000
• A copy of a Technical Bulletin for General Wastewater Discharge Pennit NCG510000
• Engineer's Certification to be completed and returned.
If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the Division of Water
coverage. This permit does not affect the legal requirements to obtain other pennits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or
any other Federal or Local goverrintental permit that may be required.
Authorization to Construct Permit. In accordance with your application for discharge, the Division is also
authorizing the construction of a groundwater remethation system consisting of a primary settling tank, oil water
separator, oil storage tank, four bag filters (25 gpin each), two GAC vessels (2,000 lbs, each), sedimentation tank
(5,000 gallons), a sflow meter, and all associated pumps, piping, and controls with a discharge of 0.024 MGD of
treated wastewater into an unnamed tributary to Little Sugar Creek, classified C waters in the Catawba River Basin.
This Authorization to Construct pen -nit is issued in accordance with Part 111, Paragraph 2 of NPDES Permit No.
NCG550000, and shall be subject to revocation unless the wastewater treatment facilities are constructed in
accordance with the conditions and limitations specified in Permit No. NCG550000. In the event that the facilities
fail to perform satisfactorily, including the creation of nuisance conditions, the Pennittee shall take inimediate
corrective action, including those as may be required by this Division, such as the construction of additional or
replacement wastewater treatment or, disposal facilities. Failure to abide by the requirements contained in this

Authorization to Construct may subject the Permittee to an enforcement action by the Division of Water Quality in
accordance with North Carolina General Statute 143-215,6A to 143-215.6C.
The Mooresville Regional Office, telephone number 704/663-1699, shall be notified at least forty-eight (48) hours in
advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the
regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through
Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, an Engineer's Certification must
be received certifying that the permitted facility has been installed in accordance with the NPDES Permit, the
Certificate of Coverage, this Authorization to Construct and the approved plans and specifications. Mail the
completed Engineer's Certification to the NPDES Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the
facility.

PROJECT FORMATION
The VUE site is a proposed 51-story mixed residential and comanercial development located in
uptown Charlotte, luring precor structic n geotechnical and environmental subsurface
investigation, groundwater samples indicated the presence of petroleum 'hydrocarbons.
MACTFC is currently providing environmental 'activities including active free product
recovery/groundwater r mediation system of a gasoline and diesel release at an adjacent
upg-adient property. Based on historical information, there is the potential for groundwater at
The Vue site to contain petroleum hydrocarbon contamination from the adjacent property source
area. During construction activities, the proposed grade of` "he VUE site shall require excavating
and dewatering of the site, Due to the potential of contaminated groundwater to be discharged

coverage under 1` CG510000 to discharge groundwater to the storm water sewer system, operated'
by Charlotte -Mecklenburg Storrn Sewer Services.
MACTEC intends to install a trailer -mounted pre -fabricated groundwater treatment system which:
will include are, oil/water separator, bat; Ater and activated carbon chambers. A settling tank shall'
also be incorporated outside the trailer as an initial step in the treatment process. The oil/water
separator is included within the treatment design to increase settling time and will be available for
free product recovery, if necessary. The treatment system was designed by and will be supplied

ANALYTICAL I E A'
MAC,TEC proposes to utilize this renrediation system to provide 'additional assurance

Groundwater samples from monitoring wells associated with The VUE site were collected on
January 21 2007, at four existing monitoring wells located at the site. The collected samples
were analyzed at a North Carolina accredited laboratory for petroleum hydrocarbons via EPA
Method 601/602 ' and sertii-volatile organic compounds (SVOCs) by EPA Method 625,
Laboratory analytical results indicated benzene, toluene, ethylbenzene, and xylenes (BTE: ), and
naphthalene in groundwater at concentrations that exceeded the laboratory reporting limit.
Methyl -tertiary -butyl -ether (MTBE), 1,2-dichloroe pane and phenol were not detected in
groundwater at concentrations that exceeded the laboratory reporting hinit. An estimation of
carbon breakthrough time for the treatment system to be utilized at the site is attached to this
letter, The laboratory analytical report is also attached to this letter.
ENGINEERED ALTERNATIVE ANALYSIS
As required in the NC7l, alternates to direct discharge were reviewed for feasibility. The VUE
consists of an approximately 1;.3-acre parcel located within. uptown Charlotte. Due to the
development of the surrounding areas and the limited footprint area of the site, subsurface;
application (nitrification field, infiltration gallery, etc) is not considered feasible, ;A connection
with an existing sanitary sewer associated with the Charlotte Mecklenburg Utilities Department
(CMUD) is not feasible due to City of Charlotte Code (Chapter 23, Appendix 111 Section 3-7b
water treatment system. MALT C's telephone conversation with representatives of the CMUD
administration division on February 5, 2007 confirmed the City Code.
Based on these limitations, discharge of. the collected storm water;and groundwater dewatered`
from the site shall be released to the storm sewer system under proper NPDES pentritting
requirements.
