I have your letter of May 2, 2011 which was received on May 3, 2011.
Condition 10- We found one instance in the logs where on April 21, Trent Tidwell wrote
in the log 22 inches. He did this only because Peggy Finley said that it was 22 inches.
He measured the distance after she left and found 24 inches which is not a violation.
Condition 12- We have tried to establish a vegetative cover and have spent a great deal of
time and money to do this. We have had a great deal of problems getting this done. We
cannot make something grow there. We are going to continue trying.
Condition 28- I cannot find the logs that say there is a violation and therefore as far as I
am concerned there was no violation.
Condition III.5- We are not aware of the discrepancies. I believe the site life is up to date
and is 10 years. DELTA may think 6 years. I am at a loss to understand how this could
possibly be a NOV. To the best of our knowledge we have been in complete compliance
after I fired Jason Desiato.

Chapter 143, North Carolina General Statutes, authorizes and directs the Environmental Management
Commission of the Department of Environment and Natural Resources to protect and preserve the water
and air resouces of the State. The Division of Water Quality (division) has the delegated authority to
enforce adopted pollution control rules. This letter is a standard notification and is intended to advise you
of the legal requirements under the law.
On February 28, 2011, staff of the Mooresville Regional Office, Aquifer Protection Section (Ellen Huffman
and Peggy Finley) conducted an inspection of the Alchem facility in Rockwell. Ms. Huffman and Ms.
Finley appreciated the time that your staff took in assisting them during the inspection. One purpose of
the visit was to determine if the violations/deficiencies identified during the April 2010 inspections had
been corrected. While several issues have been dealt with, the inspection revealed that the facility was
still in violation of conditions of the subject permits:
WQ0002702, Condition 10 requires at least two feet of freeboard in all three lagoons.
Freeboard measurements for lagoon #1 were recorded in the facility log as follows:
April 22 22 inches June 10 20 inches
May 12 20 inches October 20 inches
WQ0002702, Condition 12 requires that a protective vegetative cover be maintained on all earthen
lagoon embankments.
The earthen embankments were observed to still be essentially devoid of vegetaion.
WQ0002702, Condition #28 requires the permittee to report noncompliance.
Facility logs indicate inadequate freeboard on a number of occasions and no reports were filed.

WQ0016338, Condition 111.5 requires that a report, providing the required information, be
submitted annually to the Division.
The 2010 Annual Report was deficient in the following areas:
1. There were discrepancies between the facility log and the annual report regarding freeboard
measurements.
2. The site life estimate that was included in the annual report is outdated; it stated that the
remaining site life was 10 years. In 2009, Delta Enviromental calculated the site life to be 6
years. In addition, staff has observed what appear to be noticeable changes in the size of the fill
area over the last few inspections.
Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to
the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that
twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance
with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A. Please note
that each day a violation continues may be considered a separate violation, subject to additional civil
penalties.
As a result of the violations described in this Notice this office is considering a recommendation for a
civil penalty assessment to the Director of the Division. If you wish to present an explanation for the
violations cited, or if you believe there are other factors that should be considered, please send such
information to me in writing within ten (10) days following receipt of this letter. Your response will be
reviewed, and, if an enforcement action is still deemed appropriate, it will be forwarded to the Director
and included for consideration.

Many improvements have been made to record keeping but some deficineicies still exist.
The site manager stated that ALCHEM is no longer producing alum. The permittee may want to
consider requesting a permit modification for permit WQ0002702 (Industrial recycle) to reflect these
changes to the recycle system and modify permit WQ00016338 (Bauxite residuals monofil) to
suspend spent bauxite sampling.
A protective vegetative cover is still deficient on the earthen berms of the lagoons as well as the site in
general.

Comment: Alum production has apparently ceased. The piping for the mixer and the mixer itself has
been removed from the reactor. There was very little bauxite ore observed in the storage area. Spent
bauxite is present in all three lagoons. The permittee may want to consider a permit modification for
permit WO0002702 (Industrial recycle) to reflect these changes to the recycle system and modify
permit WQ00016338 (Bauxite residuals monofil) to suspend spent bauxite sampling.

Comment: The wastewater in lagoon #3 appears to have a mustard color. Mr. Tidwell stated that this
was from adding lime. Despite efforts to establish a vegetative cover on the outer walls of the lagoons
as noted in the last inspection, they remain effectively devoid of such vegetation for erosion control.

Residuals
Mr. Tidwell stated that, except for transfers of the slurry from one lagoon to another, residuals have
not been removed from the basins. The residuals analysis data was not available at the time of the
inspection. Reportedly, it was in the possession of Mr. Andrews.
Transport of Residuals
It was stated that no residuals have been removed from the lagoons last year or this year (January 1,
2010, to the present).
Residuals Fill Area and Storrs -water Basin
As noted in previous inspections, most of the fill area has been graded and appears to meet berm
level. A report from Delta (2009) stated that site -life has been reduced from 9.5 years to 6 years. It is
unclear why site life has been reduced. A revised site -life calculation is in order. As noted during the
last inspection, a very large amount of what appears to be fill dirt is still being stored on top of the
monofill area.
Other Site Conditions
Vegetative cover on the lagoon earthen berms and areas where runoff needs to be controlled has
been an ongoing problem and is still deficient throughout the entire ALCHEM site.
Compliance Monitoring
Groundwater monitoring required by permit WQ0002702 is currently being conducted on a triannual
schedule as part of continuing groundwater investigation for 2L violations. GW-59 reports have been
submitted in a timely manner by John Reuscher with Antea Group (formerly Delta).
Recordkeeping

The annual report was due March 1, 2011. An extension was granted and the report was received on
March 31. Inconsistencies and deficiencies were noted in the report. The laboratory results for the
required semi-annual spent bauxite sampling were incomplete.

Reporting Noncompliance
Several instances of noncompliance were uncovered that were not reported to the regional office as
required by the permits:
1. Lagoon freeboard — at least four instances of freeboard measured less than two feet were
recorded during 2010;
2. Vegetative cover on lagoon berms and bare areas continues to be deficient.

We (MRO) received your letter dated April 15, 2011 requesting a 90 day extension for the Fannie Pullam site cleanup
(NOV-2010-PC-0940 dated August 11, 2010). Please note that the original deadline for this clean up was November 1,
2010. We gave Mr. Andrews a 90 day extension on November 24, 2011 with a new deadline of January 28, 2011.
Our office believes that Mr. Andrews has had sufficient time to complete this clean up. Mr. Andrews needs to finish this
clean up asap. Our consideration of any civil penalties associated with this violation will include the level of response
demonstrated by Alchem.

Paragon Environmental Consultants, Inc. on behalf of Alchem, Inc. would like to request
an extension for the completion of the soil remediation project at the above referenced
facility. Alchem is obtaining bids from several soil excavation contractors to perform the
removal of the sandy material that has been previously disposed at the project site. This
work is going to require a specialized plan by the selected contractor as soil must be
gathered within the treeline at this site and then transported to the upper portion of the site
in order to be loaded into a truck for off -site disposal. This may require hand -excavation
or a small excavator which can access tight confines in some areas of the property, so it
may take a few weeks to award the contract to the selected remediation company.
A meeting between Paragon and a representative of Alchem was conducted at the facility
on Thursday, April 14 in which the directives of NCDENR agents were fully explained to
the responsible parry. We believe that an extension of 90 days should allow sufficient
time to complete the required cleanup at 165 Fannie Pullum Road in Thomasville, NC.

We'd be happy to come out to take a look at the site together after y'all have taken a stab at removing the remainder of
Alchem's material. We're not sure how long the removal may take this time around, but perhaps you can let us know
ahead of time when it is happening and, if schedules allow, we could come up that afternoon as things wrap up or
something like that.
Please note that we specifically required that the work and final report be overseen/signed/sealed by a PG/PE to provide
confidence that the work is done properly and completely. Final DWQ response to the dumping at this location would
only come after the cleanup is fully documented, submitted, and reviewed.

Alchem Site -165 Fannie Pullum Road - Thomasville, NC
Dear Mr. Pitner:
Please find enclosed a summary of the soil remediation and sampling activities at
the above referenced location. The soil removal was performed by IAC Services,
Inc. of Red Springs, NC with supervision provided by Paragon Environmental
Consultants, Inc. of Thomasville, NC. The site activities consisted of the
excavation and disposal of twenty-eight truck loads (average load of
approximately 13 tons) of material and the collection of seven confirmatory
samples and one "background" sample in native soils at the facility. The soils
which were removed from 165 Fannie Pullum Road were transported to the
Davidson County Landfill in Lexington, NC for disposal. Attachment A contains
copies of the disposal tickets for each of the loads of soil excavated from the
subject site. Samples were collected from native soils underneath the excavated
material at depths of approximately 18 inches below land surface following the
soil removal. The seven in -situ soil samples were submitted to Meritech, Inc. for
analyses according to RCRA metals and for pH. Only Arsenic was detected
above the lowest NCDENR standard; however, Arsenic was also present in the
"background" sample labeled as BG. With the "background" Arsenic
concentration of 8.59 mg/kg subtracted from the in -situ sample results, all of the
Arsenic levels would also be below the NCDENR standard of 4.4 mg/kg. The
other RCRA metals were below the state's lowest standard for each analyzed
metal. The pH results ranged from 3.9 to 6.1 which are similar to the
"background" level of 4.3 for pH. Table 1 summarizes the laboratory analytical
results for metals and pH. Attachment B contains copies of the laboratory
analytical reports and the chain -of -custody records for the soil samples obtained
at 165 Fannie Pullum Road in Thomasville, NC.
Paragon, on behalf of Alchem, Inc., is requesting a notice of No Further Action
for this facility since all soil concentrations are below the state's standards (with
Arsenic being corrected for the "background" level) and the pH levels are no
more acidic than the surrounding native soils. Please contact our office at (336)

We received the report from Paragon Environmental Consultants, Inc. for the subject site on January 5,
2011. The report has been reviewed and placed on file at the Mooresville Regional Office (MRO). Based on our
review of the report, it did not include information requested in the subject Notice of Violation to document the
cleanup of the Fannie Pullam site and additional information will need to be submitted.
Please note that a site visit on January 25, 2011, by MRO staff concluded that the cleanup is incomplete.
The following items will need to be addressed in another report:
• A pile of Alchem material was missed directly behind the on -site home; it appears to have been used
as a loading ramp. Other areas of the site also had noticeable amounts of Alchem's spent bauxite
dispersed throughout (see attached photos).
• There was no assessment/discussion of potential damages to soil, groundwater and/or surface
water. Are pH levels consistent with mapped soils? Was any lime applied? Were areas re -seeded?
• No photos of before and after clean up were submitted with the report.
• No map was provided identifying the extent of the cleanup. No map was submitted indicating the
locations of the confirmatory soil samples and the background sample location.
• No list of companies or persons hired for the clean-up activity was provided (i.e. trucking company,
etc.), and no load transportation documentation (trucking/hauling bills) was provided.
A report documenting the remaining cleanup as well as the above items is due in this office no later than
March 11, 2011.

Dear Mr. Andrews:
We received your signed response letters on November 7, 2010. The letters contained the basic information
on your plan to address the dumping that we had requested be submitted in August. Though your letters arrived as
unsigned attachments by email before the cleanup deadline of November 1, 2010, which was established in the
subject NOV, it is our current understanding that cleanup activities have yet to occur. The Division of Water Quality
is troubled by the continued apparent lack of concern demonstrated by Alchem's slow response.
One of your letters requests an extension of 90 days to complete the cleanup work and to submit the final
report assessing any environmental damages that may have resulted from the dumping conducted by Alchem. As a
result of extenuating circumstances outlined in your correspondence, an extension will be granted and the work will
have to be completed with all analysis and reporting outlined in the subject NOV to be submitted to this office no
later than January 28, 2011. Please note that failure to comply in the manner and time specified may result in the
assessment of additional civil penalties.

I went by to see Vernon Sechrist in Thomasville again. I have decided to ask Vernon to
dig the sand out and transport it to the Davidson County Landfill. Vernon has a front end
loader and a dump truck. At some point we will need to bring in our track hoe to dig the
material out of the ground. Until we get into this we will not know how much is there.
Vernon said that he does not know how many trucks delivered the sand. Vernon was told
by Robert Wolcott and Greg Gallimore that there was nothing wrong with the sand. He
was conned by Robert Wolcott just like me. Vernon is going into the hospital in
Salisbury today for back surgery. I would like to ask for a 90 day extension from you to
complete this work. It took much longer than I had believed to get everything approved
by the Davidson County Landfill and driving to Thomasville to work with Vernon on
how we are going to accomplish all of this. I had never heard of Vernon until I received
your letter.

This is a formal response to your letter about the sand at Thomasville. I have not been
able to determine how much is there. I cannot find any records that show it was trucked
to Thomasville. An employee thought that he knew who trucked it. I asked him to ask
that person how many truckloads were transported. The answer I got back was that Jason
Desiato and Robert Wolcott are both low-lifes and this man hoped that the next thing he
heard or saw of them was their obituary in the newspaper.
I am guessing that there is 100-150 tons. When we dig it out and take it to the landfill we
will know. You have asked that we do some soil sampling after that and get the PG to
look at this and give us his opinion. After that is done we will lime and fertilize and seed
the area and do the best we can to restore it. I hope this is 11-Lat you needi will call you
shortly about this.

B. Site History
1. Introduction
In August of 2010 a N.O:V. was issued to Alchem notifying them that some bauxite
material had been transported and disposed in an improper location behind a residence
located at 165 Fannie Pullum Road in Thomasville, NC. The location of the project site
is illustrated in Figure 1. The North Carolina Department of the Environment and
Natural Resources (NCDENR) directed Alchem to remove their material and transport it
to a Subtitle D landfill. Following receipt of the NCDENR notification, Paragon
Environmental Consultants, Inc. was contracted by Alchem, Inc. to supervise the soil
remediation activities and conduct confirmatory soil sampling and laboratory analyses in
the subject area of the property at 165 Fannie Pullum Road. Contained herein is a
summary of activities which were completed at the project site.
2. Scope of Services
This Initial Abatement Report contains documentation concerning the following activities
which have been conducted at this facility:
o Excavation of bauxite soil performed by IAC Services, Inc. of Red Springs, NC
and Alchem, Inc. of Rockwell, NC
Transportation of contaminated soil by IAC Services, Inc. and Vernon Sechrist,
property owner, to the Lopp Road Landfill in Lexington, NC for final disposal
o Collection of samples from in -situ soils and collection of a surface water sample
by Paragon Environmental
o Laboratory analyses of samples conducted by Meritech, Inc. of Reidsville, NC
C. Site Investigation
Excavation and Sample Collection
The soil removal was performed by both IAC Services, Inc. of Red Springs, NC and
Alchem personnel from Rockwell, NC with supervision provided by Paragon
Environmental Consultants, Inc. of Thomasville, NC. Between December 13 and 17,
2010 approximately 269 cubic yards (372.52 tons) of bauxite material were removed
from the upper tier in the primary disposal area.

Following a site inspection by agents from the NCDENR, another 16 cubic yards (22.46
tons) of soil were removed from the subject site on June 9 and 10, 2011. The majority of
the material removed in June of 2011 was excavated from the lower tier within the tree
line which was where surface runoff had washed the bauxite down the slope and into the
wooded area.
Following the soil excavation at the subject site, Paragon collected seven confirmatory
samples and one "background" sample from the in -situ soils at the facility. Samples were
collected from native soils underneath the excavated material at depths of approximately
18 inches below land surface following the soil removal. The seven in -situ soil samples
were submitted to Meritech, Inc. for analyses according to RCRA metals and for pH.
Only Arsenic was detected above the lowest NCDENR standard; however, Arsenic was
also present in the "background" sample labeled as BG. With the "background" Arsenic
concentration of 8.59 mg/kg subtracted from the in -situ sample results, all of the Arsenic
levels would also be below the NCDENR standard of 4.4 mg/kg. The other RCRA
metals were below the state's lowest standard for each analyzed metal. The pH results
ranged from 3.9 to 6.1 which are similar to or even more neutral than the "background"
level of 4.3 for pH. Figure 2 illustrates the locations of the soil samples, and Table 1
summarizes the soil laboratory analytical results for metals and pH. Appendix A contains
copies of the laboratory analytical reports and the chain -of -custody records for the soil
samples obtained at 165 Fannie Pullum Road in Thomasville, NC.
One water sample was also obtained as directed by NCDENR from a surface water
collection area immediately below the main soil remediation location. This water sample
was obtained on April 11, 2011 and was immediately submitted to Meritech, Inc. for
analyses for RCRA metals and for pH. The water sample showed a pH of 6.2 which is
essentially neutral with regards to acidity. Several metals were detected in the surface
water sample at concentrations below the state's action levels. Figure 2 depicts the
location of this sample, and the analytical results for the water sample are summarized in
Table 2. Appendix B contains a copy of the laboratory analytical report and the chain -of -
custody record for the water sample from 165 Fannie Pullum Road.
2. Soil Disposal
A total of approximately 285 cubic yards (394.98 tons) of bauxite material were removed
during the site remediation activities at the Alchem site in Thomasville, NC. All of the
excavated material was transported by Vernon Sechrist and by IAC Services, Inc. to the
Lopp Road Landfill in Lexington, NC for proper disposal as directed by the NCDENR.
Copies of the soil disposal weight tickets from the landfill documenting each load of soil
are contained as Appendix C.

3. Conclusions and Recommendations
3. A Conclusions
The soil remediation activities at the Alchem site at 165 Fannie Pullum Road in
Thomasville, NC have been completed. From a review of all information gathered during
this removal project, Paragon Environmental Consultants, Inc. makes the following
conclusions:
Laboratory results for sampling of in -situ soils and of surface water were below
the NCDENR action levels for RCRA metals. No significant impact to pH has
occurred based on the sample results when compared to the "background" pH
level reported for the subject site.
A total of 394.98 tons of bauxite were removed from 165 Fannie Pullum Road in
Thomasville, NC during this soil remediation project. All of the excavated
material was transported to the Lopp Road Landfill in Lexington, NC for proper
disposal.
3. B. Recommendations
Based upon a review of all information gathered during the Initial Abatement activities,
Paragon makes the following recommendations:
o A notice of No Further Action should be issued for this facility since all soil
concentrations are below the state's standards (with Arsenic being corrected for
the "background" level) and the pH levels are no more acidic than the surrounding
native soils.

3. C. Limitations
This report has been prepared for the exclusive use of Alchem, Inc. for the specific
application to the referenced site located in Davidson County, North Carolina. The
assessment was conducted based on the scope of work and level of effort desired by the
client. Our findings have been developed in accordance with generally accepted
standards in the practice of soil remediation projects, available information, and our
professional judgment. No other warranty is expressed or implied.
The data presented in this report are indicative of conditions that existed at the precise
locations sampled and at the time the samples were collected. Additionally, the data
obtained from the samples would be interpreted as meaningful with respect to the
parameters indicated in the laboratory reports. No additional information can be logically
inferred from this data.

Dear Mr. Pitner:
I went to the location in Thomasville, NC. That has the sand. The man's name is Vernon
Sechrist. Robert Wolcott told Mr. Sechrist that the sand was fine to use. 1, nor anyone
else at ALCHEM told Robert Wolcott to do this. I had no knowledge of it and Mr.
Sechrist was unaware of a problem.
Robert Wolcott, Denise Wolcott, and Jason Desiato stole $500,000.00 from ALCHEM.
Robert then threatened that he . would reveal problems if I went to the Sheriff's
Department. I did not know what problems he was talking about and.I am not going to
be intimidated by him.
I am going to immediately get someone to help me with this. I am going to see about
finding a land fill in the area. I will do what I can to see who took this sand to
Thomasville, and try to determine how much is there. I should be able to get back in
touch with you within 10-15 days with a much more concrete plan about what is to
happen.

Dear Mr. Andrews:
Chapter 143, North Carolina General Statutes, authorizes and directs the Environmental Management
Commission of the Department of Environment and Natural Resources to protect and preserve the water and
air resources of the State. The Division of Water Quality (Division) has the delegated authority to enforce
adopted pollution control rules. This letter is a standard notification and is intended to advise you of the legal
requirements under North Carolina law.
On April 4, 2010, staff from the Mooresville Regional Office, of the Division's Aquifer Protection Section
(Ellen Huffman, Andrew Pitner) investigated a complaint regarding a dump site located at 165 Fannie Pullam
Road, Thomasville, Davidson County, NC. Samples taken from the dump site physically and chemically
matched Alchem spent bauxite residuals and the material was found in substantial quantity among other debris
at the location. As a result of these findings, Alchem is in violation of conditions of the subject permits and the
November 27, 2007, Settlement Agreement. Specific violations are discussed below:
Permit WQ0016338, Condition 1.3 - the facilities should be effectively maintained and operated as a
non -discharge system to prevent the discharge of any wastes resulting from the operation of this
program.
Permit WQ0002702, Condition 6 — The residuals generated from these treatment facilities must be
disposed of in accordance with General Statute 143-215.1 and in a.manner approved by the Division.

The aforementioned location is not an appropriately permitted facility for disposal and the
Division did not approve the manner of disposal or the location.
In order to correct this violation, you shall immediately cease disposal of residuals at locations that are
not permitted for disposal. You must also remove the spent bauxite residuals from their present location in
Davidson County and dispose of them in a Subtitle D landfill. Any future plans for using the residuals in such
processes must be submitted and approved in writing by the Division prior to off -site transport. Alchem is not
permitted to give away spent bauxite for fill or any other use without prior approval from the Division.
You are required to document the cleanup and proper final disposal of the material and to submit a
report assessing any damage to the soil and/or surface water and groundwater at the unapproved disposal site
in Davidson County. The clean up and assessment report shall be prepared by a North Carolina Licensed
Geologist or Professional Engineer. Clean up documentation shall include (but is not limited to) the following:
photos of the dumpsite before and after, names of any companies hired to clean up the site, documentation of
all loads transported, documentation of final disposal (such as landfill tipping charges/manifests), and any
necessary testing of the material, soils and water. This report shall be submitted no later than October 31,
2010.
You are required to respond to this notice by submitting a plan for removal and proper disposal of the
residuals dumped in Davidson County to the Division's Aquifer Protection Section of the Mooresville Regional
Office within 10 days following receipt of this notice. The plan shall identify the approximate amount of material
that will be sent to a Subtitle D landfill and the name and location of that facility.
Pending further investigation, the Division reserves the right to issue additional notices of violation and
recommendations for enforcement. As the permit holder and generator of these residuals, it is Alchem's
responsibility to ensure that they are handled properly and disposed of within the conditions of your permit and
applicable laws. The material shall not be given away to be used as fill.
Failure to comply with conditions in a permit may result in a recommendation of enforcement action to
the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty-
five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms,
conditions, or requirements of a permit under authority of G.S. 143-215.6A. Please note that each day a
violation continues may be considered a separate violation, subject to additional civil penalties.
As a result of the violations described in this Notice this office is considering a recommendation for a
civil penalty assessment to the Director of the Division. If you wish to present an explanation for the violations
cited, or if you believe there are other factors that should be considered, please send such information to me in
writing within ten (10) days following receipt of this letter. Your response will be reviewed, and, if an
enforcement action is still deemed appropriate, it will be forwarded to the Director and included for
consideration.

April 10, 2010 — MRO investigates dumping complaint at 165 Fannie Pullam Road, Thomasville, NC.

August 11, 2010 — MRO issues NOV-2010-PC-0940 for WQ0002702 and WQ0016338 for dumping.
August 23, 2010 — letter via email and unsigned from Mr. Andrews stating "no knowledge" and blaming
Mr. Wolcott. Letter also states that he would get help to clean it up.
October 27, 2011— email from Mr. Andrews included an attached text message from Mr. Wolcott dated
4 months prior (June 22, 2010). Mr Andrews states that he is having trouble "finding anything out"
because he is dealing with nutcases. Mr. Andrews portrays the old text message as a recent threat
toward himself.
November 7, 2010 — received letter from Mr. Andrews requesting an extension for clean up. The
deadline for clean up was November 1, 2010.
November 8, 2010 — received two letters from Mr. Andrews both are dated October 27, 2010. One letter
is "a formal response" about the sand in Thomasville. Mr. Andrews states that he cannot find any
records that show sand was taken to Thomasville but, after talking to employees, he is guessing 100-150
tons were dumped. The other letter states that he went to see the land owner, Vernon Sechrest, again.
Mr. Andrews has decided to have Vernon remove the "sand" and transport it to the Davidson County
landfill. Letter also asks for a 90 day extension. Also states that he has never heard of Vernon until after
he received our letter.
November 24, 2010 —A new deadline of January 28, 2011 was given by MRO.
January 5, 2011— Soil remediation report was received from Paragon.
February 8, 2011— MRO sends letter of review of the Assessment report with a list of deficient and /or
missing data including no pH, no report of lime applied, no re -seeding, no photos, no map recording
points where samples were taken, no transportation documentation. A site visit on January 25, 2011
showed incomplete clean up. A deadline of March 24th is given to send the missing data.
February 11, 2011— email from Mr. Andrews stating that Brandon (Paragon) is taking some vacation.
March 7, 2011— email from Brandon requesting a visit from MRO to evaluate what else needs to be
cleaned up at the site. MRO responded with an email that we would be happy to look at the site after
they attempt to remove the remainder of the material.
April 15, 2011— letter from Brandon (Paragon) requesting an extension of 90 days to complete the clean
up.
April 27, 2011— email to Paragon in response to extension request. "Mr. Andrews needs to finish this
clean up asap. Our consideration of any civil penalties associated with this violation will include the level
of response demonstrated by ALCHEM."
May 4, 2011— follow up phone call requesting when report would be submitted.
