Randleman, NC 27317 Subject: Notice of Violation — NOV-2021-PC-0018 Green Valley Farm, LLC Certificate of Coverage AWC760022 Randolph County Dear Mr. Hockett: This Notice is a follow-up to the compliance inspection conducted on December 15, 2020 by Division of Water Resources (DWR) staff. A review of the subject facility reflected non-compliance with the Animal Waste General Permit. The following violations were determined during the inspection: Violations 1. Permit Condition V.2 states that "the maximum waste level in lagoons/storage ponds shall not exceed that specified in the facility's Certified Animal Waste Management Plan." At the time of inspection, the observed freeboard of the New Waste Storage Pond (New WSP) was at the spillway level. A previous reconnaissance visit by DWR staff June 10th, 2020 revealed that waste was into the spillway of the New WSP and coming out. Failure to maintain adequate storage capacity is a violation of the Permit. Permit Condition 111.17.e states that the Regional office shall be notified "as soon as possible, but in no case more than twenty-four (24) hours following the first knowledge of the occurrence of ... failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in Condition V.2 of this General Permit." On June 10, 2020, DWR staff was not notified until wastes began to overflow through the spillway of the New WSP. Failure to notify DWR within 24-hours of freeboard levels being out of compliance with the facility's CAWMP is a violation of the Permit. Corrective Action: Ensure that DWR staff are contacted when freeboard levels reach that "start - pump" mark on the waste level marker. It was noted that the two new 4000-gallon trucks were calibrated in 2020 and will not be due again until 2022. • Sand was placed within the spillway of the New WSP to prevent further overflow and potential discharge. When freeboard levels have been lowered to a compliant level, be sure to restore the spillway to its designed elevation by removing the newly placed sand. • It was indicated during the inspection that you would like to utilize composting to manage on - farm mortality. This is not yet an approved mortality management method per the NC State Veterinary Office and is not included in your CAWMP as an acceptable method. Please continue to utilize burial or rendering as required by your CAWMP. • Two fields have been acquired by your facility and need to be added to your CAWMP prior to use for waste disposal. Please contact your technical specialist to assist in adding the new fields. • The implementation of dragline irrigation was discussed during the inspection. Please be sure to have the required documents added and modifications made to your CAWMP prior to utilizing dragline. Reauired Written Response Please respond to our office within 30 days describing the action you have taken, or propose to take, to address the violations listed above, both now and in the future. Your response should be sent to my attention at the address listed in the footer on page one. A follow-up inspection will need to be scheduled to review the actions taken to address the violations listed above.
