DANIEL SMITH Director NC A&T University Attn: Douglas Jones NC A&T Porcine Research University Farm 3136 McConnell Road Greensboro, NC 27405 NORTH CAROLINA Environmental Quality January 14, 2020 Laboratory SUBJECT: Notice of Deficiency (NOD-2021-PC-0001) Certificate of Coverage #AWS410012 Facility #41-12 Guilford County Dear Mr. Jones: On December 22, 2020, Division of Water Resources (DWR) staff Caitlin Caudle conducted a routine scheduled announced compliance inspection. The facility was found the be non -compliant with the subject permit. The following deficiencies were determined during the inspection: Deficiencies: 1. Per Permit Condition V.2 "the maximum waste level in lagoons/storage ponds shall not exceed that specified in the facility's certified animal waste management plan (CAWMP)." At the time of inspection, the freeboard of Lagoon 3 was at seventeen (17) inches. Please lower the waste level in Lagoon 3 and send photos to DWR staff when the waste level is below eighteen (18) inches. 2. Per Permit Condition 111.15 "records of additional nutrient sources applied (including but not limited to sludges, unused feedstuff leachate, milk waste, septage and commercial fertilizer)... shall be maintained on forms provided or approved by the Division." Commercial fertilizer was applied to a field in the waste plan and was not recorded. Please begin recording commercial fertilizer applications to all fields included in the CAWMP. 3. Per Permit Condition 11.2 "a vegetative cover shall be maintained as specified in the facility's CAWMP on all land application fields..." At the time of inspection corn silage had been planted and waste was applied in a field included in the CAWMP. It was also discussed that the permittee intended to convert an application field to grassland. If the facility is planning to continue planting corn silage, please contact a technical specialist or the Guilford County Soil and Water District office to assist with this CAWMP modification. Failure to do so while continuing to utilize these additional crops may result in future violations. Other Concerns and Potential Violations: a. Per Permit Condition 111.5 "an analysis of a representative sample of the animal waste to be applied shall be conducted ... as close to the time of application as practical and at least within sixty (60) days (before or after) of the date of application." The General Permit defines animal waste as "livestock or poultry excreta or a mixture of excreta with feed, litter, or other materials from an animal operation." Based on this permit condition and definition, the animal waste produced by the animals in the hoop structure must be sampled at least 60-days before or after application. Please begin to sample this material within 60- days of applications. b. Per Permit Condition 11.4 "land application rates shall be in accordance with the CAWMP." Please begin using only the PAN rates listed in the CAWMP on application forms.
