8 Pro1ect Summarx
The proposed pro�ect is a ma�or modification to eYisting ma�or permit 131 08 and consists
of the addition of 20 new wet s�ips at th.e eYisting 9 slip dockin� facility There has been a
change m use of the area(previously a menhaden factory(Beaufort Fisheries)to a commercial
mixed use/urban waterfront)
9 Narrative Description
The Edgewater Properties Inc (Front Street Village Phase II)pro�ect is located at 2400
Lennoxville Road in the Town of Beaufort Carteret County The site is found by turmng
right off of Hwy 70 east(ad�acent to Gaskills general store) onto Lennoxville Road
Follow this road for about 3/4 of mile to the site It is not located within the Beaufort
Historic District or the National Historic District The site was previously permitted for
(Phase I) a 234 boat dry stack marina boathouse shop with ship store and offices two
gravel parkmg areas nine slip open water marma excavation with soil disposal and
conerete boat launch pad (all of which have been constructed) and phase II (78 ioom inn
wrth outdoor pool 56 multi faniily residential unrts chapel restaurant all required
mfrastructure (water sewer electrical) 136 space parking area transportation center wrth
tavern offices golf barn timber raised walkways bulkheads groin and two bridges)
The commercial property is 24 62 acres in its entirety and is splrt by Lennoxville Road There
are 16 1 acres located on the north side of Lennoxville Road and 8 52 acres located on the
south side of Lennoxville road ad�acent to Taylors Creek The properiy is on the north side of
Taylors Creek and across from Carrot Island The north side is relatively undeveloped with an
existing spoil disposal site The south side is developed with a timber wharf smoke stack raw
box building net wheel 234 boat dry stack marina concrete boat launch marina and two
parking areas The pro�ect is ad�acent to the NCWRC public boat ramp to the west and
Atlantic Veneer Corporation to the east The upland vegetation mainly consists of lawn
grasses bordered by Section 404 Wetlands and Coastal Wetlands (a�oint line within certain
areas) along the 1 877 of shoreline on Taylors Creek There are two sections of regularly
flooded Coastal Wetlands ad�acent to the property mainly consisting of salt marsh cordgrass
(SpaYtrna alterntflora) The first section is approximately an 8 000 square feet area located off
of the southwestern corner of the property The second section is approximately a 6 000 square
feet area bordering the mouth of an unnamed tributary within the southeastern section of the
property The waters of Taylors Creek have an approximate 3 lunar tidal amplrtude The
pro�ect site has recently been designated as an Urban Waterfront by the Town of Beaufort s
Planning and Inspections Department as stated per the letter by Town Planner Kyle Garner
dated April 1 2011
The Division of Water Qualrty classifies this area as SC Waters Taylors Creek is not
designated as a Primary Nursery Area and is closed to the taking of shellfish The Town of
Beaufort s Land Use Plan classifies this area as Developed with Conservation within the
AECs The Town of Beaufoit has designated this area as an Urban Wateifront as well There
are no shellfish resources in the area The Federal Channel Setback withm this area of Taylors

Creek is 61 Thru previous submrttals water depths within th�s pro�ect location were
determined to range from 2 nlw to 12 nlw with an average connectmg water depth of 18 44
nlw The bottom substrate is silty sand with shell Tay lors Creek is approYimately 462 to 479
wide at this location
There is a shallow(< 6 nlw) non navigable unnamed tributary that�uts through the
southeastern portion of the property This tributary is approximately 100 from the eastern
property boundary and is connected to Taylors Creek This tributary runs in a north south
orientation(approxzmately 500 ) and continues beneath Lennoxville Road via culvert and is
10 in width The bottom substrate withm the unnamed tributary is silty sand with shell It is
bordered by Coastal and Section 404 Wetlands on both banks
IO) Proposed Development
The applicant wishes to add 20 new slips to the existing commercial9 slip dockmg
facility The dockmg facility located on the western side that houses existing sl�ps 1 4
would remain the same The existing docking facility which houses existing slips 5 9
would be ieconfigured to help accommodate the addrtion of the new access piers fingeis
and additional slrp areas (10 14) The applicants axe proposing to construct(8)new
(floating) pier access sections 12 finger piers and 11 new tie pilmgs Dock A would be
located 50 waterward of the existing bulkhead and a dzstance of 170 from the western
riparian corridor and 40 landward of the USACOE setback It would connect to a portion
of the existing dock that currently houses slips 5 9 as well as the new section of dock
labeled B Dock(B)would be 5 to 8 wide depending on location 101 long and would
extend 10 beyond the COE setback This portion of dock would extend waterward from
the section labeled dock C Dock (C) (8 wide) would start approximately 270 from the
western riparian line run parallel with the existing bulkhead east for 109 and be located a
distance of 90 landward of the channel setback It would mtersect dock(D) were at this
point rt(section D) would run south for 59 and would be located 35 landward of the
channel setback At this point rt intersects dock (F) (6 wide) which runs east for 97 is
located 30 from the channel setback and intersects dock(F) (6 wide) This section (F)
runs north for 61 is located 35 from the channel setback and intersects dock (G) Dock
(G) would continue east for 97 would be 6 in width and a distance of 90 landward of
the COE channel setback Dock(H) (6 wide) extends south from section(G) for 62 and
would be located a distance of 35 �andward of the channel setback Dock H would be
located on the western side of the previously permitted grom and a distance of 10 from
any coastal wetlands The final section of dock(I) would cont�nue east for 153 would be
6 in width and located a distance of 33 landward of the COE channel setback This
section of dock would be located 3 to 8 depending on location waterward of the existing
coastal wetlands and would be directly waterward of the existing non navigable unnamed
tributary located along the east side of the property Dock (A)would have five 5 x 51
fingers dock(G) would have two 5 x 20 fingers and dock(I)would have five 5 wide x
41 5 long finger piers A portion of the finger piers serving slips 5 13 and 22 29 would be
located a distance of 15 waterward(over) of the USCOE federal setback The applicants
previously received wrrtten permission from the USACOE navigation section m 2009 to

allow this encroachment however the applicants were advised to contact this section again
to obtain pennission since past policies may have changed The applicants have informed
DCM that they have contacted the USACOE navigation section but have not recezved
notification at this time therefore no new documentation has been submrtted by the
appl�cant The docking facility would be 180 from the riparian corridor on+he west side
and 15 from the eastern riparian corridor There would be a total of 29 permanent slips (9
existing and 20 new) located within this area The slips would be numbered 1 to 29 with a
total of 12 floating finger piers (5@ 5 x 41 5 5@ 5 x 51 and 2@ 5 x 20 ) and 11 tie
pilings withm this area The typical boat using the marina would be 20 60 mixed types
such as sail charter yachts and power boats The dockzng facilrty would prohibit
overboard discharge with no overnight or live aboard dockage The applicant proposes two
No Sewer Discharge signs and two pump out available on each side of the previously
permitted bistro They are also proposing two no wake signs on the southeast side of slip #
29 as well as two signs on the southwest side of existing slip # 4 There are existing fuel
handling facilities located on the southwest side of the dry stack facility that will remain as
previously permrtted
11 Anticipated Impacts
The proposed dock additions would shade 8 149 ftz and incorporate 32 799 ft2 of shallow
bottom with an mcrease in the number of wet sl�ps to a total of 29 (9 existing and 20 new)
The existmg water depths are sufficient for this use The slip add�tions have the potential for
overboard discharge however the applicant has proposed to place no discharge signs along the
facility m various locations to help minimize this potential impact The settmg of pilmgs has
the potential to cause a temporary mcrease Ln turbidity during construction activrties

INTRODUCTION
The pro�ect site is an approximately 30 55 acre site located in of the Town of Beaufort s
corporate limits and �s adJacent to Taylors Creek The property was formally the site of a large
menhaden factory known as Beaufort Fisheries which was in continuous operation from the
early 1930s untd 2005 The Front Street Vdlage property is located on both the north and south
side of the Lennoxville Road at 2400 Lennoxville Road (Figure 1)
A Modification to Ma�or CAMA Permit 131 08 This modification is requested under the Urban
Waterfront provisions of 15A NCAC 07H 0209 (g) The pro�eEt site was annexed into the
corporate I�mits of the Town of Beaufort m September 2008 A letter is attached to this
application from the Town of Beaufort designating the site as an urban waterfront
Front Street Village LLC has divided the pro�ect into several phases Phase One has been
constructed and consists of a 234 slip dry stack boat storage facility 9 slip docking facdity a
Boathouse shop that contains a ship store and offices and a concrete boat launch pad and two
gravel parking areas (Figure 2) Work currently permitted for Phase II (Figure 2) includes the
demolition of the bwiding known as the raw box &wharf used by Beaufort Fisheries operations
the and construction of a buddmg on approximately the same footprmt excavation of upland
area along Taylors Creek and dredging of Taylors Creek construction of 516 +/ linear feet of
bulkhead 24 mches wide along the Taylors Creek shorelme construction of 1070 +/- linear feet
of bulkhead 12 inches wide along the east and west sides of the creek construction of 850 +/
linear feet of elevated timber walkways of various widths Upland development includes the

construction of approx�mately 56 multi famdy residential urnts a 78 room Inn chapel restaurant
and water sewer and utility infrastructure requirements to serve the residential and commercial
development The exist�ng grave{ parking area constructed in Phase 1 will be redeveloped as
residential and park areas in Phase II
The pro�ect is located within the town limits of the Town of Beaufort on Taylors Creek 2 miles
�
east of the downtown Beaufort waterfront (Figure 1) A PUD was approved for the entire pro�ect
on September 8 2008 � �� ;k��

PROJECT DESCRIPTION ,f � � ��, ��
The open water marma will expand on the existing dockmg facility located on the north side of
Taylors Creek as part of Phase II of the development plan The extent of the marina is defined
by the extent of existing in water structures
The marma expansion will consist of adding 20 floating docks for permanent slips along the
north shoreline of Taylors Creek (Figure 3) Slips numbered 1 9 were previousiy permitted
under CAMA Ma�or Permit# 131 08 and constructed during Phase 1 Floating docks will be
located in naturally occurring deep water in depths from 8 to 12 ft in Taylors Creek waterward of
coastal wetiands which have been identified along the property s eastern shoreline
Access to the marina on Taylors Creek will be provided by three (3) articulated ramps 4 ft m
width from the upland development (Figures 3 4 and 5) The ramps will make the boat docks
handicap accessible during periods when water levels are at or above the normal high water
Total area of floating docks mciudmg gangways main walkways and fingers wdl be
approximately 8 600 sf
The boat siips on the floating docks in the marina will be equipped with shore power potable
water and communication utilities supplied at utdity pedestals that serve each slip A sewer
pumpout device is currently provided at the marina for use by marina patrons
Concrete pdes will be used for guide pdes and timber will be used for moormg pdes in the
manna This together with the polyethylene floats used for the floating docks makes the

floatmg dock system nearly inert in terms of mtroduction of chemicals into the water column No
permanent structures will be built withm the USACE setback

EXISTING CONDITIONS
Site Topography and Hydrography The topography of the upland development site is
relatively flat varying from 7 to 12 feet in elevation on the site The Front Street Village site
consists of fine to medium sand material The base flood elevation at the site is 7 feet (NAVD
88 datum)
Land Use - Historicaily the riverFront of the Beaufort Fisheries site was an industrial waterfront
site Beaufort Fisher�es ceased operations in 2005 The pro�ect area is located in the town
limits of the Town of Beaufort ad�acent to the town s boat launching facdity The pro�ect is on
the waters of Taylors Creek a federally maintained navigation channel The remamder of the
land parcel is expected to be developed in accordance with the PUD approved by the Town of
Beaufort
Wetlands -There are coastal wetlands that are on both sides of a tidal creek that runs through
the east side of the property and along the shoreline of Taytors Creek�ust east of the boat
launching area A permitted bulkhead spur will extend from the new bulkhead approximately 60
feet and will be constructed perpendicular to the flow of Taylors Creek at the mouth of the creek
that flows through the pro�ect site to protect the coastai wetlands
Areas of Archeological or H�storic Value The proposed pro�ect is not located within a
designa��d Historic District of the Town of B�aufort Established in the early 1330 s the
Beaufort Fisheries site was a factory that processed menhaden as a raw mater�al to make f�sh
meal fish od and high protein fish solubles
Navigation - No fixed structures (as authorized by the Army Corps of Engineers m a letter
dated March 25 2009 and in accordance with recent March 2011 USACE setback rule
changes) wdl be placed within the setback from the federal channel A copy of that
correspondence is attached The federal channel boundary line runs along the entire southern

margm of the proposed pro�ect site The federal channel is 100 feet wide with an average depth
of 15 feet at mean low water The channel m front of the pro�ect property has not been dredged
for many years because naturally occurring flows tend to maintam the channel depths without
the need for dredging
flAETHODS OF CONSTRUCTION
Construction of the marina and m water facilities will be by conventional marine construction
equipment including barges and cranes The equipment will be onsite only a sufficient time to
compiete the pde driving and dock mstallation work Equipment will be stored in the protected
waters of Taylors Creek when not in use or weather prohibits work at the site Materials for in
water improvements will be stored in upland areas and transferred to barges for in water
construction Floatmg docks wiil be launched from barges and towed to location and then used
as a template for mstalling concrete guide piles Concrete dock support and timber moormg/tie
pdes wdl be driven into the substrate to minimize turbidity
PROJECT SCHEDULE
Construction of Front Street Village Marina is expected to start soon after permit issuance and
within the permitted time frame
COMPLIANCE WITH THE N C ENVIRONMENTAL POLICY ACT
The Regulatory Reform Act of 2011 (SB 781) was passed by North Carolina Legislature in July
2011 This bill eliminates the requirement for an environmental assessment (EA)for any pro�ect
requirmg a MaJor CAMA permit Therefore the proposed pro�ect is not sub�ect to N C
Environmental Policy Act review
