Sullins Dee Freeman Governor Director Secretary October 18, 2011 DWQ Project # 04-2059v2 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Whit Wheeler City of Raleigh - Public Utilities Department 219 Fayetteville Street Mall Raleigh, NC 27602 Subject Property: City of Raleigh: Dunn Road Sewer Extension UT to Neuse River [030402, 27-(20.7), WSIV, NSW] APPROVAL OF MODIFICATIONS TO STORMWATER OUTFALL WITHIN A PROTECTED NEUSE RIVER BASIN RIPARIAN BUFFER Dear Mr. Wheeler: On December 14, 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification and Buffer Authorization to impact the following waters and buffers in order to construct a new sewer line: • 0.39 acre of jurisdictional wetland, • 88 linear feet of perennial stream (temporary impact), • 120 linear feet of intermittent stream (temporary impact), • 91,523 square feet of Zone 1 Neuse River protected riparian buffer, and • 96,835 square feet of Zone 2 Neuse River protected riparian buffer. On October 12, 2011, the DWQ received a request for a revision to the 401 Water Quality Certification and Buffer Authorization from your consultant, Mr. Justin Story of Dewberry & Davis (dated June 29, 2011). The purpose of the revision was to address erosion issues that are occurring in the sewer easement and the riparian buffer adjacent to the Summermill at Falls River Apartments. The proposed revisions to the Dunn Road Sewer Extension Project have been reviewed and satisfy the stormwater management condition of the 401 Water Quality Certification. The modifications to the stormwater outlet as approved by this office must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the DWQ. The stormwater management structures shall have maintenance access to allow for the ability to maintain the structures, and to perform corrective actions. The stormwater easements shall be recorded to provide protection of the structures from potential alterations by future property owners. You or your authorized agent shall provide a completed Certification of Completion Form to the DWQ 401 Program within ten (10) days of the project completion (available at: http://portal.nedenr.oriz/web/wq/swp/ws/40 I/certsandpermits/appl/fy orms).
