Sullins Dee Freeman Governor Director Secretary October 6, 2011 DWQ Project # 06-0888, Ver. 2 Johnston County Mr. Will Moore TWM Properties, LLC 808 Parkridge Drive Clayton, NC 27527 Subject Property: Holts Lake West Subdivision Holts Lake (Black Creek) [030404, 27-45-(14), C, NSW] APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN Dear Mr. Moore: On August 28, 2007, the Division of Water Quality (DWQ) issued a 401 Certification to impact 0.1854 acre of 404/wetland and 0.3929 acre of open waters (pond) in order to construct Holts Lake West Subdivision in Johnston County. Condition Number 7 of the 401 Certification requires that the approved stormwater management plan for this project be implemented before any permanent building is occupied at the site, that the structural stormwater practices and drainage patterns be maintained in perpetuity and that no changes to the structural stormwater practices be made without written authorization from the DWQ. On September 20, 2011, the DWQ received a revised stormwater management plan (dated September 20, 2011) from your consultant, Mr. Brian Leonard, PE, PLS of BRL Engineering. This plan requests permission to add four additional lots to the subdivision but holds the level of impervious surface to below 30 percent, which was the threshold for requiring engineered best management practices at the time the 401 Certification was issued. The DWQ approves the modified SMP to satisfy Condition Number 7 of the 401 Certification. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, then the new owner must be given a copy of this approval letter and is thereby responsible for complying with all conditions. The SMP approved by this office consists of a grassed outlet swales and all associated stormwater inlet and outlet structures approved by this Office on August 28, 2007. The approved SMP must be maintained in perpetutyo;. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. The stormwater management structures shall have maintenance access and at least a 10-foot drainage easement on each side to allow for the ability to maintain the structures, and to perform corrective actions. The stormwater easements shall be recorded to provide protection of the structures from potential alterations by future property owners.
