Sullins Dee Freeman Governor Director Secretary September 2, 2011 DWQ Project # 11-0767 Wake County CERTIFIED MAIL: 70101870 0001 3428 0686 RETURN RECEIPT REQUESTED Aaron Brower City of Raleigh One Exchange Plaza, Suite 620 Raleigh, NC 27602 Subject Property: Mango Creek Interceptor Sewer Replacement Mango Creek [030402,27-32, C; NSW] UT to Neuse River [030402, 27-(22.5), C; NSW] REQUEST FOR MORE INFORMATION Dear Mr. Brower: On August 9, 2011, the Division of Water Quality (DWQ) received your application dated August 5, 2011 to fill or otherwise impact 0.52 acre of wetland (temporary impacts), 0.01 acre of wetland (permanent impacts), 47 linear feet of intermittent stream channel (temporary impacts), 114 linear feet of perennial stream impacts (temporary impacts), 5,353 square feet of Zone 1 Neuse River basin protected riparian buffer (temporary impacts), 310 sqaure feet of Zone 1 Neuse River basin protected buffer (permanent impacts), 6,138 square feet of Zone 2 Neuse River basin protected riparian buffer (temporary impacts), and 216 square feet of Zone 2 Neuse basin protected riparian buffer (permanent impacts) to replace a sanitary sewer line adjacent to an existing line. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected streams and buffers on the subject property. This project is on hold and incomplete until we receive the additional information requested below. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The buffer impact table in the PCN application indicates that B 1 and 132 are temporary impacts. However, these impacts will be in a permanent easement as indicated on the Impact Sheets and the cover letter to the application packet states that maintenance corridors will be reduced to 10 feet in riparian buffer areas. Explain the discrepancies and submit revised Impact Sheets, PCN form, and cover letter accordingly. Impact Sheet 7 indicates that buffer impacts (for this sheet) are temporary but the PCN form has it broken out into permanent and temporary impacts. Please explain the inconsistency and adjust your application to accurately portray/depict proposed impacts. 3. On Impact Sheet 1, a wetland appears to be located within the temporary construction easement. However, no impacts are accounted for in the application. Is this correct? 4. Section 3i of the PCN application indicates that all stream crossings are currently disturbed. However, the Impact Sheets indicate forested areas along the streams which does not seem consistent with the statement in 3i. Please explain and provide pictures documenting currently disturbed areas. 5. Existing conditions observed on the Plan Sheets depict rip-rap located around Impacts 1 and 2. Please note that currently permanent stream or buffer impacts (rip-rap) are not proposed in the permanent easement outside of the currently rip-rapped areas. Therefore, only the footprint of the currently rip- rapped area can contain rip-rap at the end of the construction. 6. Have you obtained permission from NCDOT to impact waters of the State and riparian buffers on NCDOT's Mitigation Parcel? If so, what type of impacts (temporary and/or permanent) have you been granted permission? Are Impacts 1 and 2 proposed along features that are currently being used as NCDOT mitigation credits? Please submit five copies of this information within 30 calendar days of the date of this letter. Please send additional information to DWQ Central Office, Attn: Karen Higgins, 1650 Mail Service Center, Raleigh, NC 27699-1650 and copy Lauren Witherspoon (lauren.witherspoon@ncdenr.gov). If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. If you need additional time to compile the information requested above, please email Lauren Witherspoon (lauren.witherspoon@ncdenr.gov) requesting an extension and indicate a new date for submittal. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
