Please find the following additional information relating to the 401 Water Quality Certification for wetland and
stream impacts on the above mentioned project as requested in your letter dated May 13, 2011. This submittal
also includes information discussed with Annette Lucas. Enclosed in this submittal is the following-
1 . Construction plans and calculations for the WS/FC Zone 7 School. This project was designed by
a different engineering firm and is currently constructed on Tract 2 within the Village Point
development. We obtained these copies from the Village of Clemmons.
2. Construction plans and calculations for the wet detention pond that we are proposing to build as
a part of the phase 2 roadway construction between Harper Road and the new WS/FC Zone 7
School.
3. Revised Overall Conceptual Stormwater Management Plan. We added additional notes clarifying
the existing and proposed sections of the development.
4. Signed and notarized O&M Agreement for the "Temporary Sediment Trap BMP" that will
temporally treat the runoff from the roadway over the dam until Tract 6 is developed. The
runoff from the roadway over the dam will be diverted into the Tract 6 BMP when Tract 6 is
developed. The existing sediment trap will be cleaned out and made operational within 30 days
of this letter. Enclosed is a copy of the email correspondence.
Please advise if the submittal package is incomplete or if you need additional information. If you should have
any questions about the design, please do not hesitate to call for a clarification.

On April 13, 2011, the North Carolina Division of Water Quality (Division) received a copy of your application for a 401
General Water Quality Certification to impact streams and wetlands for Village Point Drive in Clemmons, NC in Forsyth
County. Additional information is required in order that we may determine your project's compliance with 15A NCAC
2H.0500. The Division will require this information in order to process your application to impact protected wetlands
and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this
additional information, and if we do not receive the additional information requested below, we will have to move toward
denial of your application as required by 15A NCAC 2H .0506. Please provide the following information so that we may
continue to review your project.
1. Please provide a Pre-Construction Notification Form that is either signed by the owner of the property, or provide
an "Agent Authorization Letter" delegating signature authority to you from the owner. A sample authorization
letter can be found on the USACE website.
2. For the proposed public linear transportation portions of this project (Harper Road, Village Point Lake Drive and
Village Point Drive), please provide a plan for treating the stormwater that complies with the NCDOT Stormwater
Best Management Practices Toolbox, available at:

3. For the driveway that provides access to Tract 6, please provide a stormwater management plan that provides a
minimum of 85% TSS removal. Please provide a BMP Supplement Form for each proposed best management
practice that will be used on the site (including both worksheets, Design Summary and Required Items Checklist),
as well as all of the required items. The BMP Supplement Forms are available on the DWQ web site at:

question, does all the drainage from the road to Tract 6 drain to this outlet and sediment basin, or is there a crest in the
road somewhere sending some of the roadway back towards the roundabout? I'm sure Annette knows but you may

Thank you for the summary of our phone conversation.
Items 2-5 look, fine.
For item 1, 1 was wondering if the developer could construct a pollution removal grass swale at the discharge point.
Please reference Chapter 14 of the BMP Manual. This does not provide a full 85% TSS removal, but would help to
alleviate some of the pollution issues until the remainder of Tract 6 is constructed.
Please let me know what you think.

Sue, Thanks for the call, I was away from my desk and you were when I called back. I wanted to confirm what we plan
to submit to you as a response to your request for more information.
See comment #2 on your letter dated May 13, 2011. We are constructing a wet detention basin as a part of project to
treat Village Point Drive and Harper Road (the impervious being constructed as a part of this project) to the maximum
extent possible. The pond was designed in accordance with the NCDENR BMP manual and we are completing the
supplement forms and worksheets now. Clemmons has reviewed the BMP and we expect comments any day now. We
are not following the NCDOT linear guidelines because we are building standard BMP's within each lot to treat the
roadways and future developed lots as they are built-out. Can you confirm this is what you were looking for?
See comment #3 on your letter dated May 13, 2011. Michael Brame with ECS indicated that you had trouble following
the drainage areas on the SWM master plan. We will clean that up. Not sure if this was the basis of the comment you
made. I assume you couldn't tell how the "driveway" for tract 6 was being treated. We had planned for the "driveway"
into Tract 6 to be treated with a BMP constructed with the future development of Tract 6. We can place a bolder note
on the SWM master plan that makes this obvious for Tract 6. Will that be sufficient?

Temporary Sediment Basin Operation and Maintenance Agreement
I will keep a maintenance record on this BMP. This maintenance record will be kept in a log in a
known set location. Any deficient BMP elements noted in the inspection will be corrected,
repaired or replaced immediately. These deficiencies can affect the integrity of structures,
safety of the public, and the removal efficiency of the BMP.
The temporary sediment basin system does not incorporate a vegetated filter at the
outlet.
Important maintenance procedures:
? No portion of the temporary sediment basin should be fertilized after the first initial
fertilization that is required to establish the plants on the vegetated shelf.
? Stable groundcover should be maintained in the drainage area to reduce the
sediment load to the temporary sediment basin.
? If the basin must be drained for an emergency or to perform maintenance, the
flushing of sediment through the emergency drain should be minimized to the
maximum extent practical.
After the temporary sediment basin is established, it should be inspected once a month and
within 24 hours after every storm event greater than 1.0 inches (or 1.5 inches if in a
Coastal County. Records of operation and maintenance should be kept in a known set
location and must be available upon request.
Inspection activities shall be performed as follows. Any problems that are found shall be
repaired immediately.
