Specific items required in wetland restoration area are included in Draft Restoration Plan by Land Management Group. • This is the document guiding us through the restoration, monitoring and successful establishment of the restored wetlands. b. Grading within the wetland restoration area must be executed within 30 days of receipt of letter, including as-built survey and field approval by Corps prior to planting; • To date, the site has been field staked with a five foot wetland buffer and the fill depth has been verified (3-3.5'). For the record, The fieldwork, holidays, vacations and immediate personal family needs pushed the work out a week. c. Planting must be planted by December 31, 2011 with specified seedlings. • Noted Wetland A to be included in Restoration activity • All the silt fence will be removed and all restoration area will be cleaned of debris and stabilized. Section D.1 b. address the use of a retaining wall around Wetland Impact areas 1 and 2 to reduce impact; explain. • The support system for the roof the shed are structural post buried and implant in concrete and rebar. Based on the depth the retaining wall would need to go down, the horizontal placement needs to be place 8'-10' away to ensure maintaining the integrity of the structure. The fill depth is 3-3.5' deep at the shed location and with the slope grade 3:1: the distance is very similar. The extra 0.5' of buffer will account for the any unexpected ground variations. The ground cover will be planted on the entire slope. Our opinion is that the 3:1 grad slope will provide been structural safety for the building and the retaining wall will not materially (if at all) benefit in reducing impacts. d. Need compensatory mitigation purchased from Hofmann Forest. • Have documentation from Hofmann Forest with credits available. Also I was under the impression that the 0.049 acre Wetland Mitigation-Restoration/ Preservation area could offset the 0.116 acre impact. The would make the proposed impacts 0.067 and at a 2:1 ratio 0.134 credits would need to be purchased from Hofmann Forest. Provide draft preservation language for Conservation areas and draft of recordable map showing areas to be preserved. • Both a draft preservation language and draft of recordable map included. The buildings impacting the wetlands have a purpose and need and were built without clear knowledge of impacting the wetlands. A line of silt fence was installed and relied upon in determinining structure location. This was an honest mistake. Other wetlands were filled that are currently used for traffic control device storage of which will be relocated to uplands and the wetlands restored to pre impact conditions. The buildings have a purpose and need to the business operations and location is critical for safety. Mitigation to keep the two structures include restoring uplands to wetlands and preservation. 3. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application. The site is currently housing the business and operations side of Onslow Grading and Paving Company, Inc and provides ingress, egress access to Stor-More Mini Storage. Existing structures for the Onslow Grading and Paving office and shop complex include corporate office, maintenance shop with outside work area, equipment shelter, striping shop, and gravel/asphalt parking for company vehicles (pickups), dumptrucks, tractor trailors, trucks, heavy paving equipment, and maintenance shop area. The site also contains storage for excess equipment and inventory items not use daily and stormwater management pond. The site was originally home to Down East Corporation and provided storage for portable restroom units.. The concrete pad of the Down East Corporation office and remnants of storage areas exist directly adjacent to US Hwy 258 with redevelopment plans for the future. Refer- to map for site layout. The properties adjoining the site along US Hwy 258 are commercial with a scrap metal processing operation to the west and bas station to east. Single family residential houses and vacant land surrounds the remaining tract to the north and east. 3d. Explain the purpose of the proposed project. The management oversight and operational execution of a grading and paving business requires a high level of coordination in order to keep a safe environment for employees, equipment and all other items. Onslow Grading and Paving has several distinctive operational components and ABJK, LLC wants to consolidate these components in one centralized location. The parcel was purchased with the ability to layout a site with a functionally safe traffic and work flow for all personnel and equipment. This centrally located site will accommodate the current business size along with anticipated growth and future expansion. The previous Down East office location is considered an outparcel and slated for redevelopment as a road frontage retail/service provider outlet like a car care center or tire shop and not available in the operations of the paving company. The site used for the paving company operations has been organized into like kind and functional areas as shown on the Complex map. The site functions to accommodate the large turning radius of the vehicles and the daily staging of the vehicles for efficient early morning mass exodus of the paving teams. The maintenance of the fleet vehicles is critical. Maintenance area includes staging area for repairs of clutches, hydraulics, oil, tires, tune ups and such along with a winch to load disabled vehicles into service bays. The ingress and egress for the site is divided into two distinctive purposes and areas. The eastern most entrance (near Stor-Mor) offers safe access to the corporate offices for employees, customers, and vendors and the Stor-Mor clientele. The Onslow Grading and Paving vehicles use the western entrance (Richlands side) providing separation from the public using eastern entrance and routed in a defined travel path around the complex. The eastern entrance has a sharp curve near the gas station and makes visibility more difficult for the large paving trucks to enter and exit especially in the daily rush hours. The Complex is laid out in a departmentalized manner separating functional divisions to ensure quick job turns by organized staging and loading methods, safety-minded movement within the complex, and protection from costly inventory and equipment damage. The operations can be monitored by all levels of management from the main office building. The covered shelter and striping shop are used in the everyday functions of paving. The shelter houses general and specific job inventories and supplies that are used across various paving jobs. The central location provides efficiencies and supply accountability. The shelter keeps the material out of the weather. The striping shop provides dry storage of the striping operations along with propane for the applications. The striping trucks are side loaded and back between the shop and stormwater pond for access to the materials. The physical locations of the buildings are on the perimeter to avoid impeding driver's field of vision and away from moving traffic including a truck's turning radius. The location was based on the silt fence installed during construction of the infrastructure and discussed below in the overall project detail. Every morning and evening, the "yard" is very busy but orderly. The driving space throughout the yard is currently safe and all designated areas are used. The contents in the shelter and striping shop are needed every day and their proximity to the trucks has to be close. Both buildings serve a critical purpose in the daily operations and all area is needed for safety and growth. 3e. Describe the overall project in detail, including the type of equipment to be used: "The project consists of constructing the infrastructure and structures of the project described above. Please refer to the attached time line of events that related to this project. The property was purchased in early 2006 and immediately the site plan was drawn and all permits were being applied for including the JD for 404 wetland delineation. Most of the permits were secured by year end 2007. The stormwater measures, including the wet pond, were constructed in I" quarter 2008. The dirt was used for site grading that included areas cleared and used in the past (per Google maps 1999) and unaware of the encroachment on wetlands. In 2nd quarter 2008, Division of Land Quality issued a NOV and installation of silt fence was needed for compliance. USACE issued a letter of Unauthorized Activity and worked with a consultant to clear wetland impacts with remedial action. In September 2009, wetland map was signed after wetland impact cleanup. With reliance on the silt fence and after issues with USACE and DLQ were rectified, the needed shelter and striping shop were constructed in the 41" quarter 2008. The overall project proposes to permanently impact existing 404 wetlands with fill of 0.116 acres that includes a 12' area adjacent to the equipment shelter for a proper 3:1 fill ratio. Depending of the depth necessary to return the wetlands to original grade, then the effective impact could be reduced. Three types of areas are proposed as preservation amounting to 0.496 acres. The types of restoration and mitigation activities are described in the "Restoration Plan for the Atlas Brown Tract" prepared by Land Management Group (See Attachment 2) and detailed on the accompanying map. In response, Land Management Group was authorized to formulate a restoration plan for submission with an after the fact permit to be prepared by Charles Riggs and Associates. The restoration plan will be divided into five sections. The impact restoration section will show how the majority of the previously filled wetlands will be restored. This area will be restored to its previous grade and replanted with native wetland vegetation. The mitigation restoration will provide on-site restoration to offset unavoidable impacts proposed in the after the fact permit application. An addition area of wetlands will be preserved in perpetuity using standard Corps deed restriction language. The restoration timeline section will document the restoration schedule and the monitoring section will show the documentation of meeting project success criteria. Please refer to the after the fact permit application for mitigation locations. 1 Impact Restoration A total of 12,116 ft2 (0.278 acres) previously impacted wetland will be restored. The impacted area will be restored to the grade of the adjacent wetland. The area will be stabilized with appropriate erosion control measures to ensure that turbidity and nutrient pollution do not affect adjacent water bodies during construction. Although it is anticipated that recolonization of the area from adjacent seed bank sources will quickly revegetate the area with native species, 128 (460 seedlings/acre) bare root seedlings will be planted evenly on eight foot spacings. All planted seedlings will be marked and tagged for monitoring purposes. An equal mixture of bald cypress (Taxodium distichum) and black gum (Nyssa sylvatica) will be planted. Vegetation success criteria will be the survival of 89 (320 trees/acre) by the end of the monitoring period. The hydrology success criterion will be considered the presence of field hydrology indicators as defined by the 1987 US Army Corps of Engineers Wetland Delineation Manual and the 2008 Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coastal Plain Region. The impact restoration area will then be preserved in perpetuity through appropriate deed restrictions using standard Corps deed restriction language. The as-built report will provide both a survey showing either elevation shots or cross sections provided by Charles Riggs and Associates which will document the grading work as well as planting success. Monitoring Plan All restoration areas will be monitored for five years or until deemed successful. Annual monitoring reports will be submitted to the Corps within three weeks of the anniversary of completion of the restoration activities. MODEL DECLARATION OF RESTRICTIONS STATE OF NORTH CAROLINA ONSLOW COUNTY CONSERVATION DECLARATION This DECLARATION of CONSERVATION COVENANTS, CONDITIONS, and RESTRICTIONS ("Conservation Declaration ") is made on this day of , 2011, by ABJK, LLC., 115 Atlas Brown Drive, Jacksonville, North Carolina 28460 "Declarant". RECITALS & CONSERVATION PURPOSES A. Declarant is the sole owner in fee simple of the certain Conservation Property (Property) being approximately 29 acres, more particularly described in Exhibit A attached hereto and by this reference incorporated herein the Wetland Conservation Map for ABJK, LLC., dated July 22, 2011, and recorded in Map Book , Page in the Onslow County Register of Deeds; and B. The purpose of this Conservation Declaration is to maintain wetland and/or riparian resources and other natural values of the Property, and prevent the use or development of the Property for any purpose or in any manner that would conflict with the maintenance of the Property in its natural condition. The preservation of the Property in its natural condition is a condition of Department of the Army permit Action ID SAW-2011-01484 issued by the Wilmington District Corps of Engineers (Corps), required to mitigate for unavoidable impacts to waters of the United States authorized by that permit, and this Conservation Declaration may therefore be enforced by the United States of America. NOW, THEREFORE the Declarant hereby unconditionally and irrevocably declares that the Property shall be held and subject to the following restrictions, covenants and conditions as set out herein, to run with the subject real property and be binding on all parties that have or shall have any right, title, or interest in said property. ARTICLE I. PROHIBITED AND RESTRICTED ACTIVITIES Any activity on, or use of, the Property inconsistent with the purposes of this Conservation Declaration is prohibited. The Property shall be maintained in its natural, scenic, and open condition and restricted from any development or use that would impair 1 or interfere with the conservation purposes of this Conservation Declaration set forth above. Without limiting the generality of the foregoing, the following activities and uses are expressly prohibited or restricted. A. Disturbance of Natural Feature. Any change disturbance, alteration or impairment of the natural features of the Property or any introduction of non-native plants and/or animal species is prohibited. B. Construction. There shall be no constructing or placing of any building, mobile home, asphalt or concrete pavement, billboard or other advertising display, antenna, utility pole, tower, conduit, line, pier, landing, dock or any other temporary or permanent structure or facility on or above the Property. C. Industrial, Commercial and Residential Use. Industrial, residential and/or commercial activities, including any right of passage for such purposes are prohibited. D. Agricultural, Grazing and Horticultural Use. Agricultural, grazing, animal husbandry, and horticultural use of the Property are prohibited. E. Vegetation. There shall be no removal, burning, destruction, harming, cutting or mowing of trees, shrubs, or other vegetation on the Property. F. Roads and Trails. There shall be no construction of roads, trails or walkways on the property. G.Sianage. No signs shall be permitted on or over the Property, except the posting of no trespassing signs, signs identifying the conservation values of the Property, signs giving directions or proscribing rules and regulations for the use of the Property and/or signs identifying the Grantor as owner of the property. H. Dumping or Storage. Dumping or storage of soil, trash, ashes, garbage, waste, abandoned vehicles, appliances, machinery or hazardous substances, or toxic or hazardous waste, or any placement of underground or aboveground storage tanks or other materials on the Property is prohibited. 1. Excavation, Dredging or Mineral Use. There shall be no grading, filling, excavation, dredging, mining or drilling; no removal of topsoil, sand, gravel, rock, peat, minerals or other materials, and no change in the topography of the land in any manner on the Property, except to restore natural topography or drainage patterns. J. Water Quality and Drainage Pattern. There shall be no diking, draining, dredging, channeling, filling, leveling, pumping, impounding or related activities, or altering or tampering with water control structures or devices, or disruption or alteration of the restored, enhanced, or created drainage patterns. In addition, diverting or causing 2 or permitting the diversion of surface or underground water into, within or out of the easement area by any means, removal of wetlands, polluting or discharging into waters, springs, seeps, or wetlands, or use of pesticide or biocides is prohibited. K. Development Rights. No development rights that have been encumbered or extinguished by this Conservation Declaration shall be transferred pursuant to a transferable development rights scheme or cluster development arrangement or otherwise. L. Vehicles. The operation of mechanized vehicles, including, but not limited to, motorcycles, dirt bikes, all-terrain vehicles, cars and trucks is prohibited. M. Other Prohibitions. Any other use of, or activity on, the Property which is or may become inconsistent with the purposes of this grant, the preservation of the Property substantially in its natural condition, or the protection of its environmental systems, is prohibited. ARTICLE II. ENFORCEMENT & REMEDIES A. This Declaration is intended to ensure continued compliance with the mitigation condition of authorizations issued by the United States of America, U.S. Army Corps of Engineers, Wilmington District, and therefore may be enforced by the United States of America. This covenant is to run with the land and shall be binding on all parties and all persons claiming under the Declarant. B. Corps, its employees and agents and its successors and assigns, have the right, with reasonable notice, to enter the Property at reasonable times for the purpose of inspecting the Property to determine whether the Declarant, Declarant's representatives, or assigns are complying with the terms, conditions and restrictions of this Conservation Declaration. C. Nothing contained in this Conservation Declaration shall be construed to entitle Corps to bring any action against Declarant for any injury or change in the Conservation Property caused by third parties, resulting from causes beyond the Declarant's control, including, without limitation, fire, flood, storm, and earth movement, or from any prudent action taken in good faith by the Declarant under emergency conditions to prevent, abate, or mitigate significant injury to life, damage to Property or harm to the Property resulting from such causes. ARTICLE III. PUBLIC ACCESS A. This Conservation Declaration does not convey to the public the right to enter the Property for any purpose whatsoever. 3 ARTICLE IV. DOCUMENTATION AND TITLE A. Conservation Property Condition. The Declarant represents and acknowledges that the Property is currently undeveloped land, with no improvements other than any existing utility lines, Declarations and rights of way. B. Title. The Declarant covenants and represents that the Declarant is the sole owner and is seized of the Property in fee simple and has good right to make the herein Declaration; that there is legal access to the Property, that the Property is free and clear of any and all encumbrances, except Declarations of record. ARTICLE V. MISCELLANEOUS A. Conservation Purpose. (1) Declarant, for itself, its successors and assigns, agrees that this Conservation Property shall be held exclusively for conservation purposes. B. Entire Agreement. This instrument sets forth the entire agreement of the parties with respect to the Conservation Declaration and supersedes all prior discussions, negotiations, understandings or agreements relating to the Conservation Declaration. If any provision is found to be invalid, the remainder of the provisions of this Conservation Declaration, and the application of such provision to persons or circumstances other than those as to which it is found to be invalid, shall not be affected thereby. C. Recording. Declarant shall record this instrument and any amendment hereto in timely fashion in the official records of Onslow County, North Carolina, and may re-record it at any time as may be required to preserve its rights. D. Environmental Condition of Conservation Property. The Declarant warrants and represents that to the best of its knowledge after appropriate inquiry and investigation: (a) the Property described herein is and at all times hereafter will continue to be in full compliance with all federal, state and local environmental laws and regulations, and (b) as of the date hereof there are no hazardous materials, substances, wastes, or environmentally regulated substances (including, without limitation, any materials containing asbestos) located on, in or under the Property or used in connection therewith, and that there is no environmental condition existing on the Property that may prohibit or impede use of the Property for the purposes set forth in the Recitals. 4 IN WITNESS WHEREOF, Declarant has hereunto set his hand and seal, the day and year first above written.
