D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The civil engineer for the project have determined that rehabilitation of the existing pond dam is required in order to maintain
the long term viability of that resource and reduce the likelihood of failure due to large storms events. The reasons for
rehabilitation of the dam are as follows.
1) The dam does not currently have a stable, permanent outlat structure. The current outlet structure of the pond is an non-
stabilized channel that has eroded into the default spillway for the pond. The channel is relatively steep and highly susceptible
to erosion during high flow events. A permanent riser outlet structure designed to maintain the existing normal pool elevation
and bypass large flows is proposed.
2) The existing spillway is unstable and substantially under capacity for the drainage area it serves.
3) There are a substantial number of existing trees growing on the dam . these trees need to be removed to eliminate the
possibility that they can be uprooted during a high wind event, causing failure of the existing dam.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The project will be subject to an approved sedimentation and erosion control plan. The pond will be drained slowly to minimize
potential of sediment from the pond bed moving downstream.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State

Re: I Iarris Corners Property Owners Association

Dear Mr. Rindner:
On bchal l of our client, i larris Corners Property Owners Association, wc have
evaluated the condition of the existing irrigation pond used to serve the Harris
Corners dcvclopillcnt. Our evaluation had determined that rchahilitation of' the
existing pond (1,1111 is required in order to nl,1intaill the long terill viablhty of 111,11
resource and reduce the likelihood of failure dllc to large storm events. The
reasons For rehabilitation of the dam are as fellows.
1. 'I he danl does not Curt-cntly have a Stahic, pernrulent outlet structure.
The current outlet of, the pond is an non-stabilized chmincl that has
eroded into the dcl-ault spillway fOr the pond. The channel is relatively
steep and highly susceptible to erosion dln'i11g high Ilow events. A
pernlarlent riser outlet structure designccl to maintain the existing
normal pool elevation and bypass large flows is proposed.
1. In addition to the existing spillway hein?_? 1111V'1,111110, it is subslantlally
under capacity for the drainage area it serves.
3. 'T'here arc n substantial numhcr of existing trees growillg Oil the danl.
'T'hese trees need to he removed to Chilllnalc the possibility that one
could be upruutcd during it high wind event, causing lailtil'c of' the
existing dam.
4. It is obvious there has been a lack of, maintenance on this pond Fi?r a
number of years. Without regular maintennncc, tllc likelihood of future
problem,,: is greatly increased.
11Icase Ict rile know it' you have ally (IUCSti0l1S or 11CC(I additional infornlatioll to

Re: Harris Corners Property Owners Association
Charlotte, North Carolina
RCP-09020
Dear Mr. Rindner:
On behalf of our client, Harris Corners Property Owners Association, we have
evaluated the condition of the existing irrigation pond used to serve the Harris
Comers development. Our evaluation had determined that rehabilitation of the.
existing pond dam is required in order to maintain the long term viability of that
resource and reduce the likelihood of failure due to large storm events. The
reasons for rehabilitation of the dam are as follows.
1. The dam does not currently have a stable, permanent outlet structure.
The current outlet of the pond is an non-stabilized channel that has
eroded into the default spillway for the pond. The channel is relatively
steep and highly susceptible to erosion during high flow events. A
permanent riser outlet structure designed to maintain the existing
normal pool elevation and bypass large flows is proposed.
2. In addition to the existing spillway being, innstable, it is substantially
under capacity for the drainage area it serves.
3. There are a substantial number of existing trees growing on the dani.
These trees need to be removed to eliminate the possibility that one
Research Triangle Park NC J Could be uprooted during a high wind event, causing failure of the
existing dam.
? F9(t3' 'af, f :{N
4. It is obvious there has been a lack of maintenance on this pond for a
number of years. Without regular maintenari , the likelihood of future
Sara hor i ,??.?; <; !? problems is greatly increased.

Site was evaluated during the wetland delineation process for the presence of Schweinitz's Sunflower. The site is heavily
disturbed in conjunction with previous development. Invasive grasses and grasses planted to stabize construction sites
such as Lespedeza sericea, vines, and and shrub species dominated the lower vegetative strata. Ecotonal edges along
roads and clearings were inspected to determine if Schweinitz's sunflower was present. Project site is not in a watershed
