Nikki,
Amy and I discussed the Trackside South project today and have determined the following:
1) Fill slopes in Zone 2 associated with the stormwater ponds are Allowable based on the Item (6) of the buffer rule
"Stormwater management ponds excluding dry ponds: New stormwater management ponds provided that a
riparian buffer that meets the requirements of Items (4) and (5) of this Rule is established adjacent to the pond"
is Allowable. DWQ is considering this activity allowable because Zone 2 is revegetated in grass and Zone 1 is
being allowed to naturally revegetate with woody vegetation. Please be aware that grass is required in Zone 2
for this activity not to require mitigation. Therefore, a good stand of grass should be established in this location.
DWQ understands that you have opted not to replant the small portions of Zone 1 that were impacted due to
the natural revegetation. In order for this area not to require mitigation, this areas need to continue to
revegetate without future disturbance, DWQ requires that tree protection fencing be placed along/outside Zone
1.
2) Fill slopes adjacent to the parking area are exempt based on Item (6) of the buffer rule "grading and
revegetation in Zone 2 only provided that diffuse flow and the health of existing vegetation in Zone 1 is not
compromised and disturbed areas are stabilized" is Exempt. In this location, Zone 1 veg has not been
compromised and Zone 2 (last I was out there) was fairly stable with grass and diffuse flow was being
maintained. These areas need to continue to demonstrate the above or the Exempt status will not apply.
Amy will be getting the approval letter out. A variation of the above may be included in the approval letter.

Hey Lauren!!
I know you are on vacation and won't get this until next week, but I need your help.
I have attached Impact Map Sheet 6 from the Trackside application package that I submitted before I left for vacation on
7/1. Amy was one of the reviewers and placed the project on hold because of the area that I have bubbled out in blue on
the attached map. This area was all fill associated with that building, the parking lot and the access. Amy determined
during her review (and when we met yesterday to go over the "on hold" letter) that it was fill at least partly associated with
a Transportation Facility and that would require mitigation. I of course disagreed and said that regardless of the "access"
that area would have to be filled to have a "building pad" - regardless of what got put there. Does that make sense? The
topography and the slopes meant that area would have to be filled to make it "buildable" otherwise, the building would be
on a cliff. In any event, I also countered that argument with the fact that Zone 2 impacts typically do not require mitigation
when Zone 1 is not harmed, as we have done on numerous other projects.
I recalled from our site visit (last summer) and from our office meeting(s) this year, that you were not overly concerned
with the Zone 2 impacts (where Zone 1 was not compromised) and Zone 2 was stabilized and grassed. I mentioned this
to Amy and Ian yesterday as well. I also reminded them both that any impacts associated with the stormwater BMP were
being addressed (i.e. Zone 1 buffer being replanted/revegetated and Zone 2 being grassed) as part of the NOV resolution.
In short, Amy said she is fine with the stormwater ponds not requiring mitigation since we are repairing/replanting the
buffer. However, she wants confirmation from you that you are ok with the Zone 2 impacts not requiring mitigation.
Can you confirm this for me with her? We are so very close to getting this turned loose and I hope to get it resolved (and
underway) soon.
