PROJECT SUMMARY: The applicant proposes new grade level pathways to provide handicap accessibility to existing beach access areas and historical monuments within the Fort Fisher State Historic Site. PROJECT DESCRIPTION: The project site is adjacent to the ocean shoreline of Fort Fisher State Historic Site located in New Hanover County, immediately south of Kure Beach. This area of Fort Fisher is located on a peninsula which separates the lower Cape Fear River from the Atlantic Ocean. To locate the project site from South College Road (NC Highway 132) and Carolina Beach Road (NC Highway 421), travel south on Carolina Beach Road. Continue over the Snows Cut bridge that crosses the AIWW towards the Town of Carolina Beach. At the second stop light turn right onto Dow Road. Follow Dow Road to Kure Beach and at the stop light turn right onto Fort Fisher Blvd. South. Continue travelling south on Fort Fisher Boulevard South (US 421) for approximately 3.0 miles until you reach the project site at the existing Fort Fisher State Historic Site. The eastern portion of the site consists of a rock revetment that is located partially below the normal high water (NHW) boundary of the Atlantic Ocean, measuring approximately 3,000 feet in length by 70 feet in width, which was authorized in 1993 under State Permit No. 96-93 (DWQ Permit No. SW8 940822) to protect. this historic site. Located on the western portion of the site across Fort Fisher Blvd. South are the Fort Fisher Museum and Visitor Center with an associated parking lot (Work Area "A"). Also located on this side of Fort Fisher Blvd. South is the preserved earthwork fortifications of Fort Fisher's Land Face and existing concrete pathways that leads towards the Cape Fear River, which are outside the project limits. There is an unpaved path that leads from the Visitor Center parking lot and buildings towards the eastern side of the project site that tie into existing asphalt pathways (Work Area "B"). The pathway is along the landward side of the revetment, which runs entirely along the same alignment as the revetment. The path ties into two gazebos/overlooks, one that is located on the north and one located on the south end of the rock revetment. The "Battle Acre" Monument (Work Area "C") is located on the landward side of Battle Acre Road towards the south end of the project site that consists of an approximately 27 feet in length by 32 feet in width at grade brick pad with the monument located in the center. The area between the existing monument consists of grass and unimproved parking areas, which may be problematic for handicap access to the monument. There is additional existing gravel public parking areas and the asphalt pedestrian pathway located on the southern end of Battle Acre Road (Work Area "D). Vegetation on the upland portion of the project site is located partially within a Maritime forest that consists primarily of live oak (Quercus virginiana) and wild grasses. According to the DCM 1998 Erosion Rate Maps, the erosion rates for Work Areas "A" and "B" are 5 feet/year and for Work Areas "C" and "D" are 7 feet/year . ___ (See-Sheet_1-of-5). The Wilmington-New Hanover County CAMA 2006 LUP classifies the upland areas of the project site as Conservation. The waters of the Atlantic Ocean are classified as SB by the NC Division of Water Quality (DWQ). The NC Division of Marine Fisheries (DMF) has not designated this area of the Atlantic Ocean as Primary Nursery Area and the waters adjacent to the proposed project are closed to the harvesting of shellfish. PROPOSED PROJECT: The applicant proposes new grade level pathways to provide handicap accessibility to existing beach access areas and historical monuments within the Fort Fisher State Historic Site. A new at grade concrete pathway would be constructed along the eastern side of the Museum and Visitor Center, which measures approximately 210 feet in length by 6 feet in width. The new walkway would be located between an existing brick patio and concrete pad that are adjacent to the existing building. The structure would be landward of the Ocean Hazard Areas small structure setback for this area, which is 150 feet from the first line of stable natural vegetation. In this case, it has been determined that this line would be the seaward toe of the rock revetment. NC Department of Cultural Resources-Fort Fisher State Historic Site c/o Jim Steele Page 3 The application states that the proposed walkways would be constructed over existing dirt paths (See Sheet 2 of 5, Section "A"). A new at grade concrete pathway would be constructed along the eastern side of the parking lot of the Museum and Visitor Center, which measures approximately 40 feet in length by 6 feet in width. The pathway would terminate onto a concrete pad, measuring approximately 6 feet in length by 10 feet in width at the existing crosswalk of Fort Fisher Blvd. South right-of-way. Located on the eastern side of Fort Fisher Blvd. South right-of-way adjacent to the existing crosswalk would be another concrete pad, measuring approximately 6 feet in length by 10 feet in width that would lead onto a new at grade concrete pathway that would be constructed towards the east, which measures approximately 130 feet in length by 6 feet in width. The structure would be landward of the Ocean Hazard Areas small structure setback for this area, which is 150 feet from the first line of stable natural vegetation. The pathway would lead onto a new at grade slatted wooden walkway, measuring approximately 45 feet in length by 6 feet in width, which would lead to the existing asphalt pathway. The structure would be within the Ocean Hazard Areas small structure 150 foot setback for this area, therefore, the applicant has designed the pathway with panels using 2" x 4" raised decking with 1 " x 4" spacers between that are connected with threaded galvanized rods with counter sunk nuts and washers. The structure would be similar to a "Hatteras Ramp" type structure that is common along oceanfront communities to allow for emergency vehicles to access the public beach and handicap access from parking areas to public beach accesses. The proposed walkways would also be constructed over an existing dirt path (See Sheets 4 and 5 of 5, Section "B"). The applicant proposes to allow for handicap accessibility to the existing Battle Acre Monument from the existing unimproved parking area along Battle Acre Road. A new at grade slatted wooden walkway, measuring approximately 75 feet in length by 8 feet in width would lead from the existing unimproved parking area towards the monument. The applicant also proposes to construct two (2) at grade handicap spaces, each measuring approximately 20 feet in length by 7 feet in width on each side of the walkway. These structures would be within the Ocean Hazard Areas small structure setback for this area, which is 210 feet so it is designed with panels using 2" x 4" raised decking with 1" x 4" spacers between that are connected with threaded galvanized rod with counter sunk nuts and washers, aforementioned. The wooden pathway would lead onto a new at grade concrete pathway that would continue towards the monument, which measures approximately 32 feet in length by 8 feet in width. The concrete walkway would continue around the existing raised monument pad a distance of approximately 164 feet in length by 6 feet in width. The concrete portion of the walkway would be landward of the Ocean Hazard small structure 210 foot setback for this area (See Sheet 3 of 5, Section "C"). - --Three-p)-additional-at-grade handicap parking spaces, each measuring approximately 20 feet in length-by 7 feet in width would be constructed on the southern end of the project site within the existing gravel parking area. A new at grade slatted wooden walkway, measuring approximately 28 feet in length by 6 feet in width, would lead to the existing asphalt pathway. The structure would be within the Ocean Hazard Areas small structure setback for this area, which is 210 feet so it is designed with the wooden panels, aforementioned. 10. ANTICIPATED IMPACTS: The proposed project would disturb approximately 5,238 sq. ft. (0.12 acres) of highground area within the Ocean Hazard Areas AEC. Approximately 3,640 sq. ft. of this amount would be at grade concrete walkways, and approximately 1,598 sq. ft. of this amount would be raised wooden decking to address the small structure setbacks. As stated, portions of the proposed structures are located within existing dirt pedestrian pathways and unimproved parking areas. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alterations are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. Permits issued in the Ocean Hazard Area of Environmental Concern include the condition that structures be relocated or dismantled if they become imminently threatened by changes in shoreline configuration. Shortly before work begins on the project site, the Local Permit Officer must be contacted to determine the vegetation line and setback distance at your site. If the property has seen little change since the time of permit issuance, and the proposed development can still meet the setback requirement, the LPO will inform you that you may begin work. Substantial progress on the project must be made within 60 days of this setback determination, or the setback must be re-measured. Also, the occurrence of a major shoreline change as the result of a storm within the 60-day period will necessitate re-measurement of the setback. It is important that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal can be authorized. It is unlawful to continue work after permit expiration. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual long-term average oceaan,erosion rate for the area where your property is located is feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year, and, sooner or later, will threaten oceanfront structures. These are the facts of life for oceanfront property owners. The Reasons The beachfront is an ever-changing landform. The beach and the dunes are natural "shock absorbers," taking the beating of the wind and waves and protecting the inland areas. By incorporating building setbacks into the regulations, you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are intended to avoid an unreasonable risk to life and property, and to limit public and private losses from storm and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge, you can make a more informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal management rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront, less than 5,000 square feet in size, must be behind the frontal dune, landward of the crest of the primary dune, and set back from the first line of stable natural vegetation a distance equal to 30 times the annual erosion rate (a minimum of 60 feet). The setback calculation increases as the size of the structure increases [15A NCAC 7H.0306(a)(2)]. For example: A structure between 5,000 and 10,000 square feet would require a setback from the first line of stable, natural vegetation to a distance equal to 60 times the annual erosion rate (a minimum of 120 feet). The graduated setback continues to increase through structure sizes greater than 100,000-square-feet. -- --- -- The Exception The Coastal Resources Commission recognized that these rules, initially passed in June 1979, might prove a hardship for some property owners. Therefore, they established an exception for lots that cannot meet the setback requirement. The exception - allows buildings in front of the current setback, if the following conditions apply: 1) the lot must have been platted as of June 1, 1979, and is not capable of being enlarged by combining with adjoining land under the same ownership; 2) development must be constructed as far back on the property as possible and in no case less than 60 feet landward of the vegetation line; 3) no development can take place on the frontal dune; 4) special construction standards on piling depth and square footage must be met; and 5) all other CAMA, state and local regulations must be met.
