Re: Section 401 Water Quality Certification application
Dear Mr. Glover:
On June 15, 2011, 2011, the North Carolina Division of Water Quality (Division) received a copy of an
application for a 404 Nationwide Permit and coverage under a 401 General Water Quality Certification to
impact 148 linear feet of stream for the purpose of extending Sunnyside Drive in Lexington, NC in Davidson
County. Upon review of the documentation, the Division notes that additional information is necessary to
ensure this project's compliance with the Conditions of 401 General Water Quality Certification Number 3821
(GC #3821):
1. Please note that GC #3821 Condition #12 requires that "Linear transportation projects must treat
stormwater runoff to the Maximum Extent Practicable in accordance with the NCDOT BMP
manual." If this project is to be a public road built with public funds and/or maintained by public
funding, then a stormwater management plan must be developed to meet this requirement.
2. The second paragraph on Page 2 of General Certification #3821 states "Activities that are below
thresholds.... do not require written approval from the Division of Water Quality as long as they
comply with the Conditions of Certification listed below, including the Stormwater Management
Plan condition." Although written application is not required for this project, the Division
recommends that you apply for written concurrence to document review and approval of the
stormwater management plan.
Please note that you are not required to have written approval for this project per the requirements of General
Certification #3821, and therefore you are not required to respond to this letter. However please note that the
project is required to meet all Conditions of that Certification, including Condition #12 and Stormwater
Measures must be installed and operational prior to occupation of any building or use of any impervious
surfaces.
