Dear Mr. Levinson:
On November 9, 2010,the Division of Water Quality(DWQ)received your application dated November
28,2010,with Public Notice issued by the USACE on December 23,2010,and received by the DWQ
December 23,2010, and by additional information received on March 10, 2011, May 19,2011, May 26,
2011, May 27,2011, and June 16, 2011,currently proposing to fill or otherwise impact 12.98 acres of
404/wetland(2.43 acres for dam fill and roadways and 10.55 acres for flooding), 1,512 linear feet of
perennial stream(642 linear feet perennial stream for dam fill and roadways and 870 linear feet flooding),
and 1,91 linear feet intermittent stream(194 linear feet perennial stream for dam fill and roadways and
987 linear feet flooding),to construct the proposed Anderson Creek Development at the site.
On July 8,2011,a meeting was held at the USACE office in Wilmington,North Carolina,to discuss the
Anderson Creek South project. Representatives from the USACE,NCDWQ and your staff and agents
were in attendance at the meeting. It is our understanding,based on the discussions at this meeting,that
your agents will be submitting a revised alternatives analysis for the project. We are therefore placing
your project on hold as incomplete until we receive this additional information. If we do not receive the
requested information within 60 calendar days of the date of this letter,your project will be formally
returned as incomplete,and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands,waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized(at
this time)by the DWQ. Please call Karen Higgins or Ian McMillan at 919-807-6301 if you have any
questions or would like to set up a meeting to discuss this matter.
