To summarize, four properties are accessed by a driveway that passes through the properties of Larry and Eric Griggs. Some years ago at the request of the landowners Eric Griggs and Larry Griggs the original driveway was rerouted in order to bypass the house of Larry Griggs. The present drive was constructed through wetlands without permits. Through the advice of legal counsel the original driveway location is not felt to be a viable option to return to leaving no other high ground access to properties beyond the Griggs' without passing through wetlands. Through a myriad of legal complexities a new easement has been established that in part overlaps the presently constructed road but that will require moving a portion of this drive off of the corner of Larry Griggs' property. We are in essence requesting retro permitting a portion of the present drive and permission to construct a new portion involving wetlands. The proposed drive rests only on the property of Eric Griggs. The area of wetlands impactjs a total of 0.165 acres. Please find enclosed: 1. A completed PCN 2. Describe the overall project in detail, including the type of equipment to be used: An existing driveway was constructed without permits through wetlands and outside of the legal easement in the past. At this time the only undisputed legal easement for a drive crosses the wetlands adjacent to the current drive. Therefore, the drive will be "moved" into the legal easement after obtaining the proper permits. Those portions of the current drive outside of the easement will be removed to the original elevation. Construction will consist of depositing concrete rubble on top of the soil for a road bed followed by gravel/sand and crused concrete for a road surface. This will require removal of trees and vegitation in the easement. Equipment used will include a tracked excavator, buldozer, tractor and compactor if needed. A barrier fabric of Geotex or similar product may be installed beneath the rubble if required. Three culverts will be installed to allow passage of water beneath the road and will be counter sunk 20% below grade. 4. Jurisdictional Determinations 4a.
