With regard to the referenced site, and on behalf of the City of Lexington, we have
enclosed one original and one copy of the Pre-Construction Notification Application for
Nationwide Permit 39 for your review and approval. The site is to be developed for the
extension of Sunnyside Drive with the assistance of NCDOT funding. We have included
the PCN form, Agent Authorization Form, Notification of Jurisdictional Determination,
Stream & Wetland Report from S&EC, impact maps, and wetland delineation surveys.
We have minimized impacts to the maximum extent practical while still allowing for the
roadway extension for the City.

1. Avoidance and Minimization

The stream impact is a single roadway crossing above the confluence of two perennial streams. The alignment is held by an
existing intersection but the roadway has been moved as far upstream as possible to avoid a second perennial stream while
keeping the crossing with 15 degrees of 90. In the area of the crossing, headwalls, steeper side slopes, and a narrower road
section have been utilized.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The impact area can be accessed from both sides minimizing the need to continually cross the areas during construction. The
work should be done during the summer months when the normal stream flow in minimal. Construction materials are to be
stored on high ground. Pre-fabricated headwalls are to be used to minimize the time of construction in the channel.

process involves visiting the site with the Army Corps of Engineers' agent for Davidson County.' In

DETAILED WE, TLAND DELINEATION FOR THE SUNNYsin DRIVE EXTENSION SITE
On March 25, 2011, S&EC personnel completed a detailed wetland delineation on the Sunnyside
Drive Extension site in Davidson County. The property is located north of W. Holly Grove Road
in Lexington. Figure 1 and Figure 2 show the location of the site on the Lexington East USGS
topographic quadrangle and NRCS Davidson County Soil Survey, respectively.
EXECUTIVE SUMMARY
We have.determined that 2 perennial streams generally account for the jurisdictional waters
identified on the site. The attached wetland sketch map depicts the approximate locations of
streams identified during our evaluation. Please refer to the sketch map and the results and
recommendations section below for more detailed information.
SCOPE OF WORK
The detailed wetland delineation consisted of traversing the property to examine soils,
vegetation, and hydrology across the site in search of areas that meet the criteria for jurisdictional
wetlands as described by the procedures set forth in the Corps of Engineers Wetlands
Delineation Manual (January 1987 - Final Report) and Interim Regional Supplement to the
Corps of Engineers Wetland Delineation Manual: Eastern Mountains and Piedmont Region.
Any areas with positive indicators of hydric soils, evidence of wetland hydrology, and presence
of hydrophytic vegetation are flagged with sequentially numbered, pink S&EC logo flagging as
jurisdictional wetlands. Proof of wetland hydrology would be the existence'of hydric soils with
oxidized root channels in the upper 12 inches of the soil profile, water borne deposits, drift lines,
scour marks, drainage patterns, regional indicators of soil saturation, etc. No jurisdictional
wetlands were identified as a result of our evaluation. Surface waters including perennial stream
channels, subject to regulation by the US Army Corps of Engineers (USAGE) as waters of the
US, were identified. These surface waters may also be referred to as jurisdictional waters to
indicate that they are within the jurisdiction of the USACE. It is important to note that wetlands
are also classified as waters of the US and regulated by the USACE under authority of the Clean
Water Act (33 USC 1344).
RF,sIIjm & RECOMMENDATIONS
The results of the detailed wetland delineation are discussed below.
Wetlands and Jurisdictional Waters:
We have determined that jurisdictional waters in the form of 2 perennial streams exist on the site.
Please refer to the attached "Wetland Sketch Map" for specific flag numbers and approximate
locations. No jurisdictional wetlands or open waters were identified during our evaluation. The
> most current (2010) USGS topo quad does not indicate the presence of intermittent or perennial
streams on the property. Likewise, no stream channels are shown on the NRCS soil survey to
occur on the property.
Two jurisdictional streams were identified during the site evaluation; the approximate locations
of each are illustrated on the attached wetland sketch map. Streams identified on-site are
described below:
Stream A (Unnamed Tributary -UT to Abbotts Creek) begins near the truck parking lot of
United Furniture Industries and continues downstream to the eastern property line. The
stream origin was flagged in the field as 401. This stream will likely be considered
perennial by the USACE and determined to exhibit important aquatic function. Portions
of this particular stream are located offsite based on survey stakes identified in the field.
Stream B (UT to Abbotts Creek) begins on the property from a culvert under the existing
railroad. Flag #02 was hung at the start of this particular stream onto the property. This
particular stream forms a confluence with Stream A on the property. This stream will
likely be considered perennial by the USACE and determined to exhibit important
aquatic function.
Surface waters on this site flow into Abbotts Creek in the Yadkin River Basin, and are classified
in NC-DWQ's "Classification and Water Quality Standards Applicable to Surface Waters and
Wetlands of North Carolina" as C waters.
The 2 aforementioned stream origin flags (01 & 02) should be surveyed and,a Wetland
Delineation Map generated for use in site planning and USACE approval and permitting. Stream
widths and locations (centerline vs, bank to bank) were not provided in the field. Therefore the
surveyor will need to locate all stream bends and ordinary high water marks (OHWM) along the
stream feature. The Wctland Delineation Map should include all of the information listed on the
attached "Requirements for Wetland Delineation Maps." S&EC delineation flag numbers
should be shown on the wetland survey. Please have the property owner or contracting buyer
complete the attached agent authorization form if you would like S&EC to act on their behalf for
requesting approval of the wetland delineation. This form will also be used in preparing a permit
application for impacts to wetlands or surface waters when we are provided with a plan showing
the proposed impacts. S&EC cannot conduct correspondence with the USACE unless we
have agent authorization'(see attached Agent Authorization). This authorization form
must be filled out in its entirety and returned to S&EC (a faxed copy is acceptable).
REGULATIONS
A general list of regulations that apply to jurisdictional wetlands and waters present on the site
are discussed below. Please be aware that other local, state, and federal regulations not included
in this list may also apply. S&EC personnel are available to discuss these regulations as they
apply to your project.
Wetland Permitting:
Current Nationwide Permits were issued by the USACE on March 19, 2007 and expire in March
2012. USACE regional conditions for current nationwide permits in the Wilmington District
were issued on June 5, 2007 and expire in March 2012. Proposed USACE regional conditions

for the 2012 Nationwide Pemiits have been put out for public comment by the Wilmington
District. At this point we do not know when the proposed regional conditions will be in effect in
2012. In the case of this project a Nationwide Permit 14 can be requested from the USACE for
extending Sunnyside Drive as long as impacts to perennial streams total less than 300 linear feet.
Stream impacts equal to or greater than 150 linear feet will require compensatory mitigation as
well as written notification to the NC DWQ. Once the wetlands delineation survey has been
completed along with a proposed site plan, our staff can assist in requesting any permits from
regulatory agencies.
CONCLUSION
The wetland and stream delineation for the Sunnyside Drive extension site was completed by
S&EC on March 25, 2011. The site contains jurisdictional streams that will require
preconstruction authorization from the USACE for impacts to jurisdictional features (i.e.
streams). Depending on the size of the impact written notification to the NC DWQ may be
required. USACE and NC DWQ verification of our site assessment should be obtained. Site
meetings with regulatory agencies to verify our delineation is the next step in the stream and
wetland identification process.
