HDR Engineering, Inc. of the Carolinas (HDR), on behalf of our client, Chambers Engineering PA,
is requesting a Nationwide Permit No. 39 request and 401 Water Quality Certification N. 3821 for the
proposed ethanol transfer facility (Facility) located in Davidson County, North Carolina (Figure 1).
Project Description
The proposed Facility is to be located at the south comer of Bringle Ferry Road and NC Highway 8
intersection near the town of Healing Springs, along the existing High Point, Thomasville & Denton
Railroad. The preliminary design for this project is the construction of a new intermodal ethanol rail car
unloading and storage facility at the existing JT Russell rail terminal. The Facility will consist of a
railroad yard with four rail tracks constructed on fill to bring them to the elevation required by the
railroad design criteria. A 164-linear foot (If) 48" ductile iron pipe (DIP) and two (2) 16 foot drainage
structures are proposed to be placed in an unnamed tributary to Lick Creek (UT) to accommodate the
proposed railroad yard. Additional permanent impacts will result from the installation of 30 if of rip rap
apron at the outfall of the proposed pipe system.
Jurisdictional Waters
A jurisdictional determination (JD) for the project properties was submitted by S&ME (dated
September 19, 2009) and has been approved by the U.S Army Corps of Engineers (USACE) Raleigh
Field Office (Action ID 200902142), see attached.

Proposed Impacts
Chambers Engineering proposes to install a 48" DIP and drainage structures in an UT to Lick Creek to
accommodate the proposed railroad yard. A rip rap apron at the outfall of the pipe will be installed to
dissipate flows and to protect the downstream channel, resulting in approximately 30 if of permanent
impacts to the UT. The proposed Facility alignment will avoid all other jurisdictional streams and
wetlands delineated on the property. Sediment and erosion control measures will be employed
throughout the duration of the project.

Based upon conversations with John Thomas of the USAGE, compensatory mitigation will be required
at a 1:1 ratio for the 210 if of permanent impacts to the UT. Payment will be made to the North Carolina
Ecosystem Enhancement Program's (NCEEP) in-lieu fee program. An acceptance letter from the
NCEEP is attached.
Ree-ulatorv Correspondence
HDR reviewed the National Register of Historic Places (NRHP) GIS database and found that no known
historical structures or historic districts are located within the proposed Project area. Correspondence
was sent to the State Historic Preservation Office (SHPO) requesting information on any cultural
resources that may be impacted by the proposed construction. Comments from the SHPO are attached.
HDR reviewed the U.S. Fish and Wildlife Service (USFWS) protected species list and consulted the
North Carolina Natural Heritage Program (NCNHP) Element Occurrence database and GIS layer for
Davidson County. HDR determined that the proposed Project does not exhibit suitable habitat for
federally protected species. HDR requested comment from the USFWS regarding these findings in
correspondence dated March 24, 2011. Comments from the USFWS are attached.
We are hereby requesting written authorization to construct this project a Nationwide Permit No. 39 and

According to the land cover and land use classification adopted by North Carolina, the project and surrounding properties
are classified as managed herbaceous cover, mixed upland hardwoods, and cultivated land. Recent aerial imagery
illustrate a light industrial area (JT Russel Facility) and scattered single family residences.

Two forested wetlands and one emergent wetland are located in the adjacent floodplain of Lick Creek totaling
approximately 0.20 acres.

All practable alternatives were assessed to avoid jurisdictional waters to the U.S. The culvert length was designed to the

We strongly suggest you have this delineation surveyed. Upon completion, this survey should be reviewed and verified by

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project as indicated in the table below. Please note that this decision does
not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation for project impacts. It is the
responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. You must also
comply with all other state federal or local government permits regulations or authorizations associated with the proposed activity
including SL 2009-337: An Act to Promote Compensatory Mitigation by Private Mitigation Banks.
This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are
summarized in the following table.

Subject: Endangered and Threatened Species Assessment, Proposed J.T. Russell Intermodal
Ethanol Facility, Near the Town of Healing Springs, Davidson County, North Carolina
On April 4, 2011, we provided comments on the subject project to Mr. Thomas Crown. On
May 13, 2011, we received a request from your office for a signed copy of the letter; it was
e-mailed to you that day. Mr. Bryan Tompkins of our staff spoke with you by phone on May 18,
2011, regarding additional information (the inclusion of a "no effect" concurrence) needed for
the FEMA-CLOMR certification. Mr. Tompkins informed you of the additional information that
would be needed for us to concur with a "no effect" determination for the project. On May 19,
2011, we received a letter from you (via e-mail) that included the information needed for us to
concur with your "no effect" determination. We have reviewed the information you presented
and are providing the following comments in accordance with the provisions of the Fish and
Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and section 7 of the Endangered
Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act).
Endangered Species. According to our records and a review of the information you presented,
no listed species or their habitats occur on the site. Therefore, we believe the project will have
"no effect' on federally listed species or designated critical habitats and that the requirements
under section 7 of the Act are fulfilled. However, obligations under section 7 of the Act must be
reconsidered if. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered, (2) this action is
subsequently modified in a manner that was not considered in this review, or (3) a new species is
listed or critical habitat is determined that may be affected by the identified action.
Erosion Control and Wetland/Stream Protection. Given the proximity of the project to
aquatic environments, measures to control sediment and erosion should be installed before any
ground-disturbing activities occur. Grading and backfilling should be minimized, and existing
vegetation should be retained (if possible) to maintain shoreline cover for fish and wildlife.
Disturbed areas should be revegetated with native grass and tree species as soon as the project is
completed.

This site is located approximately 1,500 feet from the Snider House (DV 0479), which is on the State Study
List-a preliminary step in the review of potential nominations to the National Register of Historic Places.
However, since the proposed ethanol rail car unloading and storage facility will be located at an existing rail
terminal, the new construction and operation should not have an adverse effect on historic properties if the
ethanol is handled safely.

Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR
Part 800.
