The 401 and 404 are dill ent processes with different showings. The applicant has clearly detailed the total impacts and agreed to mitiga . All the information your staff requested including some that was not necessary for the 401 (site plan for stormwater was provided to Ian two weeks ago. He does not need the purpose and need clarification the corps is requesting to do the 401. Looks like an end run again. The owners are not going to be very happy when they get this update. I've talked and met with Ian 2-3 times in the past three weeks and none of this was mentioned. Again, typical and the kind of thing that has the regulated community wanting blood. I thought your process was independent from the Corps. Wish you had indicated this to me a week ago when I asked the status. One would think the purpose and need would be a Corps consideration not WQ. The application is clear as to what the total impacts to stream and wetlands will be. I got an email this afternoon from Crystal Amschler with the USACE stating that this package must be delivered to the USACE by June 15, 2011, or the USACE will withdraw the application. We cannot write the 401 Water Quality Certification until we know what the project is (as this affects impacts to surface waters) and this currently is not settled. Once the purpose and need is established, it will be more clear how the 401 Water Quality Certification will need to be written and ideally what the total impacts to streams and wetlands will be. Hopefully we will receive this information soon and the project determination and impacts can be established so we may move forward. Thanks, Ian McMillan Ian J. About two weeks ago we provided Ian the last of the information they had requested at the meeting you attended with staff, Chris Huysman and me as couple months back. Still have not seen anything from the 401 folks and I have to brief the owner (David Levinson) and Governor Holshouser this Friday. I also know that Representative Lewis has been asking them about the project. Whatever you can find out from staff would be beneficial. E-mailed Ian a week or so ago and all he said was he was working on it. I just hope to keep things on a positive note because I know you guys have plenty of more important things to be working on than a simple 401. The owners are ready to proceed with the next phase but the key for the entire design and layout centers around the lake and this 401. Appreciate any feedback. Still nothing on Anderson creek south, but I spoke to chris yesterday and he said he was having trouble getting info together and asked for another extension until 6/15. Received 81/2" x 11", 11" x 17", sheets at 1"=100' and 1"=300'. Also requested all surface waters (wetlands and streams) to be located on the site plans, as well as all existing and proposed roads, structures, and proposed impacts. 4. Have not included mitigation plan as requested and stated that would not submit mitigation plan without assurance of receiving certification. 5. Stated would not seek reclassification until received permits to build lake. Betsy thought it unlikely EMC would approve reclassification. 6. Disagree with agencies position that residential development is actual purpose and need of project. 7. States flows will not be altered by lake, and later goes onto state that estimated 7Q10 is zero. 8. Has not provided storm water plans as requested. Applicant requests deed restrictions on lots to control imperviousness. 9. Did not provide building envelopes on lots with surface water features as requested. 10. Did not provide dam details as requested. 11. States DWQ does not consider science in review of water quality impacts that may result from construction of impoundment. 12. Page 14, states DWQ may not comment on alternatives analysis. 13. No geotechnical exploration of subsurface soils in vicinity of proposed lake has been performed to assure lake will hold water. 14. I will be meeting with the applicant later this week to address the outstanding issues. We understand that we will need to 1) get a letter from the NC EEP that can serve as a place holder for the mitigation, 2) get detailed site plans for the first couple of phases of work, and 3) get a lake management plan. We understand that you will be sending us a copy of the soil survey of the project vicinity and a copy of the lake management plan for the Girl Scout Lake in Iredell County.
