Subject: Inspection Report and Notice of Noncompliance

Dear Mr,White:
On June 13,201.1, Suc Homewood of the Division of Water Quality conducted a site visit of the
Diamonds Keep Subdivision on Archdale Rd in Archdale NC. Mr.Mack Summey from Summey
Engineering Associates was present during the site visit. During this site visit it was determined
that one home within Drainage Basin#1 and one horne within Drainage Basin#2 have been
constructed. These drainage basins have been designed and approved to include a stormwater
wet detention basin to treat stormwater from impervious surfaces.
As a result of the site inspection and file review, the following problems, detailed below, are
noted:
Item I.Failure to follow permit conditions:
You submitted a Pre-Construction Notification(PCN)on July 17, 2008. The impacts
were requested.under U.S. Army Corps of Engineers Nationwide Perrnit(s) 39, and the
corresponding.General Water Quality Certifications. The Division issued an approval
letter for the impacts on.March 15,2010.
The approval letter specifies that the activities must follow the conditions listed in the
General Water.Quality Certifications,as well as additional conditions listed in the letter.
The Approval Letter DWQ#08-1121, Condition 3 states the following: "The final written
stormwater.management plans(including a signed and notarized Operation and
Maintenance Agreement) as approved by the Division of Water Quality must be
implemented and the stormwater management facilities shall be constructed and
operational before any permanent building is occupied at the subject site. The structural
stormwater practices as approved by this Office as well as drainage patterns must be
maintained in perpetuity. No changes to the structural stormwater practices shall be
made without written authorization from the Division of Water Quality".
1. The site inspection determined the following design and installation discrepancies:

o The approved forebay was not present in either wet detention basin.

o The approved littoral shelf was not present in either vet detention basin.
o It appears that drainage may be by-passing wet detention basin#2.
2, The following maintenance problems were noted during the inspection:
o The approved minimum water level was not present in either wet detention basin.
o Both wet detention basins were overgrown with native and invasive vegetation.

o Wet Detention Basin #2 has trees growing on the berm as well as within the
basin.
Required Response
Accordingly,you are directed to respond to this letter in writing within 45 calendar days of
receipt. Your response should be sent to both this office at the letterhead address and to the
attention of Ms. Karen Higgins at the Wetlands, Buffers, Stormwater Compliance and Permitting
Unit, 1617 Mail Service Center, Raleigh,NC 27699-1617. Your response should address the
following items:
1. A certification by a professional engineer indicating that both wet detention basins have
been completely restored and re-installed to the approved design specifications.
2. A re-notarized Operation and Maintenance Plan for the long term maintenance of both
wet detention basins.
By copy of this letter to the Randolph County Building Inspection Office,NCDENR is requesting
that the Building Inspector withhold building permits and Certificates of Occupancy for this
project until this matter is satisfactorily resolved.
Thank you for your attention to this matter. This Office is considering sending a recommendation
for enforcement to the Director of the Division of Water Quality regarding these issues and any
future/continued violations that may be encountered. Your above-mentioned response to this
correspondence will be considered in this process. This office requires that the noncompliance
items, as detailed above, be.abated immediately. These noncompliance items and any
future violations are subject to a civil penalty assessment of up to$25,000.00 per clay for
