The project shall be constructed in accordance with your application dated received August 2, 2005. After
reviewing your application, we have decided that the stream impacts and riparian buffer impacts described are
covered by General Water Quality Certification Numbers 3404 and 3366. This certification corresponds to the
Nationwide Permit 14 and Nationwide Permit 33 issued by the Corps of Engineers. This approval is also valid for
the Tar-Pamlico River Buffer Rules (15A NCAC 2B .0259). In addition, you should acquire any other federal, state
or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control,
Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404
permit, unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified below).
Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying
with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total
impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as
described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the
conditions listed in the attached certification.
1.) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of
Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The
responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of
Water Quality upon completion of the project.

2.) All stormwater runoff shall be directed to sheetflow through stream buffers at nonerosive velocities, unless
approved otherwise by this certification.
3.) During the construction of the project, no staging of equipment of any kind is permitted in waters of the U.S., or
protected riparian buffers.
4.) Riparian vegetation must be reestablished within the construction limits of the project by the end of the growing
season following completion of construction.
5.) The dimension, pattern and profile of the stream above and below the crossing should not be modified by
widening the stream channel or reducing the depth of the stream. Disturbed floodplains and streams should be
restored to natural geomorphic conditions.
6.) Any riprap used must not interfere with thalweg performance and aquatic life passage during low flow
conditions.
7.) All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent
contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
8.) Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface
waters is prohibited.
9.) The outside buffer, wetland or water boundary located within the construction corridor approved by this
authorization shall be clearly marked by highly visible fencing prior to any land disturbing activities. Impacts
to areas within the fencing are prohibited unless otherwise authorized by this certification.
10.) There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this
permit without appropriate modification of this permit. Should waste or borrow sites be located in wetlands or
stream, compensatory mitigation will be required since it is a direct impact from road construction activities.
11.) Pursuant to NCACI5A 2B.0259(6), sediment and erosion control devices shall not be placed in Zone 1 of any
Tar-Pamlico River Buffer without prior approval by the NCDWQ. At this time, the NCDWQ has approved no
sediment and erosion control devices in Zone 1, outside of the approved project impacts, anywhere on this
project. Moreover, sediment and erosion control devices shall be allowed in Zone 2 of the buffers provided that
Zone 1 is not compromised and that discharge is released as diffuse flow.
12.) Heavy equipment must be operated from the banks rather than in the stream channel in order to minimize
sedimentation and reduce the likelihood of introducing other pollutants into the stream.
13.) Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation
of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the
culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water and
aquatic life. Design and placement of culverts and other structures including temporary erosion control
measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or
banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide
evidence that the equilibrium shall be maintained if requested in writing by DWQ.
14.) If the above condition (#13) is unable to be met, due to bedrock or other-limiting features encountered during
construction, please contact the NCDWQ for guidance on how to proceed and to determine whether or not a
permit modification will be required.
15.) No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened

16.) The presence of equipment in the channels must be minimized. Under no circumstances must rock, sand or
other materials be dredged from the wetted stream channel under authorization of this permit, except in the
immediate vicinity of the culverts.
17.) All work shall be performed during low or normal flow conditions.
18.) All fill slopes located in jurisdictional wetlands shall be placed at slopes no flatter than 3:1.
19.) A copy of this Water Quality Certification shall be posted on the construction site at all times. In addition, the
Water Quality Certification and all subsequent modifications, if any, shall be maintained with the Division
Engineer and the on-site project manager.
20.) For all of the sites being impacted due to site dewatering activties, the site shall be graded to its preconstruction
contours and revegetated with native vegetation.
21.) All protected riparian buffers impacted by the placement of temporary fill or clearing activities shall be restored
to the preconstruction contours and revegetated with native woody species upon completion of the project
construction. A post-construction as-built with the restoration activities included shall be submitted to the
DWQ no later than 60 days after the project is closed out by the Department of Transportation.
22.) All channel relocations will be constructed in a dry work area, and stabilized before stream flows are diverted.
Channel relocations will be completed and stabilized prior to diverting water into the new channel. Whenever
possible, channel relocations shall be allowed to stabilize for an entire growing season. Vegetation used for
bank stabilization shall be limited to native woody species, and should include establishment of a 30 foot wide
wooded and an adjacent 20 foot wide vegetated buffer on both sides of the relocated channel to the maximum
extent practical. A transitional phase incorporating coir fiber and seedling establishment is allowable. Also, rip-
rap may be allowed if it is necessary to maintain the physical integrity of the stream, but the applicant-must
provide written justification and any calculations used to determine the extent of rip-rap coverage requested.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms
to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Subject: Jurisdictional impacts associated with the NC Moving Ahead Program:
proposed improvements to NC Hwy 58 in Warren and Franklin Counties.
WBS Element 37653.
As part of the NC Moving Ahead Program, the North Carolina Department of
Transportation (NCDOT) proposes improvements to NC Hwy 58. This will involve
upgrading cross lines, widening travel lanes, and resurfacing the roadway. This project
begins at the junction with US 158B in Warren County continuing south through
Franklin County and ending at the Franklin/Nash County line.
The existing roadway has 9 ft travel lanes and no paved shoulders. The upgrade proposal
is to provide 10 ft travel lanes with 1 ft paved shoulders. Please note: this activity will be
performed within the existing right-of-way. There will be only minimal changes to the
current fill slopes or to the ditch lines as necessary to upgrade existing cross lines.
There are five sites along this project that will have jurisdictional impacts associated with
upgrading cross lines. Impacts at these sites include surface water fill, stream loss due to
a small segment of relocated channel, rip rap for structure protection, and temporary
dewatering. Additionally impacts to the Tar-Pamlico River basin protected buffers are
proposed. Details regarding all impacts are presented below. [List of Appendices and

Impacts to Waters of the United States
Jurisdictional impacts from five pipe replacements will result from the proposed activity.
Sites: 1.4, 17, 22, and 1 will require temporary dewatering for approximately 3 days each.
Dewatering will be accomplished by using either sand bags or sheet piling in the streams
at the upstream and downstream construction limits. To maintain water flow during
construction, water upstream of the impervious structures will be temporarily pumped
around and conveyed downstream of the impervious ,structures. All materials used for
dewatering will be removed after construction.

Proposed structure: 30-inch rcp that is 44 feet long
Due to the alignment of the stream and the placement of the new pipe, a small segment of
the stream must be relocated resulting in total of 8 ft of stream loss [Figure 8 and
Photograph 7]. Proposed discharge of fill material associated with this pipe extension,
stream relocation, and minimal amounts of rip rap to protect the structure include
14 linear feet existing channel impacted. This includes 8 ft stream loss on inlet end (4 ft
longer pipe and 4 ft additional loss) and 5 ft rip rap at inlet (4 ft of this rip rap overlaps
stream loss). Additionally, 5 ft of rip rap will be used on the outlet end for stabilization.
Temporary concurrent impacts to the stream from this activity will result in the
dewatering 14 linear feet of stream. The 8 ft of stream loss will require mitigation.
Franklin Site 13

The cross line at this location carries only storm water and not a jurisdictional stream
[Figure 9 and Photograph 8]. Therefore, dewatering will not be necessary at this pipe
replacement site and no fill in surface water is proposed. Please note that there is a
jurisdictional stream (UT to Sandy Creek) which runs parallel to the roadway near this
site. Once the dry line crossing is replaced, rip rap will be placed at the outlet to protect
the structure. This rip rap will fall along the western bank of the parallel stream but will
total no more than (310 sf, 10 linear feet). This structure protection of 10 if within
protected riparian buffers will NOT require mitigation.
Riparian Buffer Impacts
Please note that the proposed roadway widening and resurfacing activity will be
performed within the existing right-of-way. There will be only minimal changes to the
current fill slopes or to the ditch lines. Proposed impacts to protected riparian buffers are
associated with only the minimal space needed for equipment to operate in performing
the pipe upgrade work. Each permit site involves a stream that is subject to the Tar-
Pamlico Riparian Buffer Rule. Based on the impacts to the riparian buffers at each site,
these crossings are EXEMPT.

Impacts total: 568 s.f in Zone 1 and 0 s.f. in Zone 2 (totaling 18 linear ft).
Warren Site 17
Impacts total: 625 s.f in Zone 1 and 0 s.f in Zone 2 (totaling 20 linear ft).
Warren Site 22
Impacts total: 391 s.f. in Zone 1 and 0 s.f. in Zone 2 (totaling 12 linear ft).
Franklin Site 1
Impacts total: 434 s.f. in Zone 1 and 0 s.f in Zone 2 (totaling 14 linear ft).

Waters of the U.S. Mitigation
Avoidance: All surface waters not affected by the project will be protected from
unnecessary encroachment. No staging of construction equipment or storage of
construction supplies will be allowed or near surface waters.
Minimization: Strict enforcement of sedimentation and erosion control Best Management
Practices for the protection of surface waters will be enforced during project construction.
Continued coordination will occur with maintenance forces and the Environmental
Officer during construction to minimize impacts to these sites.
Compensatory Miti ag tion: Unavoidable impacts to 28 lft of stream associated with this
project will be mitigated (at a 2:1 ratio) by providing 56 lft of stream restoration
equivalent warm water stream channel in the Tar-Pamlico River Basin (Hydrologic
Cataloging Units 03020101 and 03020102). All compensatory mitigation requirements
will be assimilated on a quarterly basis and provided to the Ecosystem Enhancement
Program (EEP) for their acceptance with a copy provided to the USACE for verification
and accounting purposes.

Protected Species
Plants and animals with federal classifications of Endangered, Threatened, Proposed
Endangered and Proposed Threatened are protected under provisions of Section 7 and
Section 9 of the ESA. As of January 29, 2003, there are three federally protected species
listed for Franklin County and two federally protected species listed for Warren County.
They include dwarf wedgemussel (Alasmidonta heterodon), Tar spinymussel (Elliptio
steinstansana), and Michaux's sumac (Rhus michauxii). The grassed shoulders of NC
Hwy 58 are highly maintained and support no habitat for Michaux's sumac. Therefore, a
Biological Conclusion of "No Effect" has been rendered for Michaux's sumac based on
lack of suitable habitat. Mussel surveys were conducted by Alderman Services, Inc. on
07/27/04. No protected specimens were observed and no habitat was determined to exist
at the five permit sites. However, these smaller streams do flow directly to occupied
listed species habitat. Therefore we need to conserve this habitat. If HQW water quality
protection measures are implemented throughout all phases of project development
within the watershed, then this activity is given a biological determination of "May
Affect, Not Likely to Adversely Effect" the dwarf wedgemussel or the Tar spinymussel.
In a letter dated 03/28/05 the US Fish and Wildlife Service concurred with this biological
conclusion (see Appendix Four for USFWS concurrence letter).
Historical Compliance
This project has been screened by all pertinent parties to ensure historic compliance. In a
letter dated 07/19/05, the NC-Historic Preservation Office concurred that the project will not
have an adverse effect upon the following National Register properties as long as certain
commitments are excuted: Buxton Place, Cherry Hill, the Solomon and Kate Williams
House, the Liberia Rosenwald School, and the Warren County Fire Tower (see Appendix
Five for SHPO concurrence and committments).

Application is hereby made for a Department of the Army Section 404 Nationwide
Permit (NWP) 14 and NWP 33 for above-described activities at each site and for
NCDENR-DWQ Section 401 Water Quality Certification (WQC) No. 3404 and WQC
No. 3366. Application is also made for a Tar Pamlico Buffer Certification. An automated
payment procedure has been implemented between the NCDOT and NCDWQ. This
procedure will enable the Division to apply for the 401 WQC without submitting a check for
this permit application. This procedure will provide payment to the NCDWQ by charging the
permit application fee of $200.00 directly to the appropriate NCDOT WBS element 37653.

Attach a cfiiy a (clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

at the time of this application: Sites are surrounded by wooded areas and agricultural land.
10. Describe the overall project in detail, including the type of equipment to be used: Upgrade
pipes widen travel lanes and resurface roadway along NC Hwy 58 from Warrenton south
through Warren Co and then through Franklin Co ending at the Franklin/Nash Co. Line.
The NCDOT will also dewater the permit site work zones during pipe upgrade activities.
Equipment may include excavator, backhoe bulldozer, grader, and crane.
11. Explain the purpose of the proposed work: This project is part of the NC Moving Ahead
program to modernize and maintain NC Hwy 58 by upgrading pipes widening travel lanes,
and resurfacing the roadway.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were :minimized once the desired site plan was developed. If applicable, discuss construction

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open water$ such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stn-ngide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide

Tar-Pamlico River Basin (Hydrologic Cataloging Units 03020101 and 03020102) All
compensatory mitigation requirements will be assimilated on a quarterly basis and provided
to the Ecosystem Enhancement Program (EEP) for their acceptance with a copy _provided to

This letter is in response to your letter of March 18, 2005 which provided the U.S. Fish and Wildlife Service
(Service) with the biological determination of the North Carolina Department of Transportation that the
proposed replacement of four pipe culverts associated with a NC Moving Ahead project on NC 58 in Franklin
and Warren Counties may affect, but is not likely to adversely affect the federally endangered dwarf
wedgemussel (Alasmidonta heterodon) and Tar spinymussel (Elliptio steinstansana). These comments are
provided in accordance with section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C.
1531-1543).
The four pipe replacements will occur at the following locations along NC 58:
• Unnamed tributary to Sandy Creek in Franklin County
• Headwaters to Maple Branch in Warren County
• Headwaters to Long Branch in Warren County
• Unnamed tributary to Long Branch in Warren County
According to information provided, all four pipe replacements will occur on very small streams with little or
no flow. No habitat for mussels is present at each of the project sites, though each stream eventually flows into
areas occupied by federally listed mussels. Due to the significant distance of the project sites from suitable
habitat and the small size of the streams, the Service concurs with your determination that the proposed project
may affect, but is not likely to adversely affect the dwarf wedgemussel and Tar spinymussel. We believe that
the requirements of section 7(a)(2) of the ESA have been satisfied for these species. We remind you that
obligations under suction '17 consultation must be reconsidered if. (1) new information reveals impacts of this
identified action that may affect listed species or critical habitat in a manner not previously considered in this
review; (2) this action is subsequently modified in a manner that was not considered in this review; or (3) a
new species is listed or critical habitat determined that may be affected by this identified action.

Thank you for your Memorandum of May 12, 2005, from Division 5 concerning the above project.
We have reviewed the information provided in the memo concerning historic properties within the Area of
Potential Effects. We concur that the project will not have an Adverse Effect upon Buxton Place, Cherry
Hill, the Solomon and Kate Williams House, the Liberia Rosenwald School, Fire Tower, and the Little
Shocco Creek Bridges, as long as the following commitments are executed:
1) When grading the shoulders (one foot on each side) great care will be taken to protect the condition
of the road frontage of all listed properties, but especially to protect the cedar trees within the Buxton
property boundaries.
2) To protect mature tree roots, NCDOT will make square cuts at any ditches, no more than six inches
wide within the Buxton property boundaries.
3) During the project, orange plastic fencing will be employed to protect trees within the Buxton
property boundaries.
4) Although no impacts to mature trees are proposed with this project, NCDOT Historic Architecture
and the State Historic Preservation Office will be notified in advance of any trees taken within the
Buxton property boundaries.
5) Replacement of the cross lines will not affect the historic integrity of any listed property.
6) At Buxton Place, Cherry Hill, the Solomon and Kate Williams House, the Liberia Rosenwald School,
and the Fire Tower, no road improvements will extend beyond the roadway's existing ditch lines.
During construction, no heavy trucks or equipment will be parked on the listed property, but will use
primary and secondary roads.
7) No impacts to the Little Shocco Creek bridges or their bridge plaques are proposed with this project.
