Dear 'Mr_ 'Holder.
You :have our approval, in accordance with the attached conditions and hose listed below, to permanently
impact 20 linear feet (If) for nprap floodplain benches and "inletloutlet protection and to .temporarily impact 12 If
"for a cofferdam of Buffalo Shoals Creek, a perennial stream. The impacts are proposed for the purpose of
replacing failed, double corrugated metal culverts as described in your.application received bythe Division of
Water Quality (DWQ) on October 20,2005. The location of the project is State Road 1006 (islandFord Road)
in"Iredell County. After reviewing your application, we have determined that this project is covered by Water
Quality General Certification Number .3404. This certification correspondsto:Nationwide Permit 14 issued by
the U.S. Army:Corps of-Engineers.(USACE).:Please note that you should get.any otherfederal, state or local
-permits before proceeding with `your ;project, :including those required by (but riot limited to) Sediment and
Erosion :Control, =Non-Discharge, and Water•Supply Watershed regulations. This :approval will expire with the
associated 404 permit unless otherwise specified in :the Water•QualityCertification.
This approval is valid solely forthepurpose and design'thatyou described-in your.application (unless modified
below). Should your project change, you must-notifythe'DWQ in writing and you maybe required to submit a
new.-application. If the property is sold, the :new owner must be -.given a copy of this Certification and approval
letterand'is thereby responsible for complying': with all conditions. If total ;wetland fills'forthis project (now or in
the future) exceed one acre, ?oriftotal :impacts to streams (now,or`in the future:) exceed 1,50 linear feet,
compensatory:mitigation may be required as described in 15A=NCAC 2H0506 (h)(6) and (7). For this approval
to remain valid, you must adhere to the conditions listed in the attached certification andthose listed below:
1. Placement of culverts and other structures in waters, streams and wetlands must be belowthe -elevation of
the streambed by one .(1) foot for.all .culverts with a .diameter greater than 48 :inches, and 20 percent-of the
culvert tliameter forculverts having`a "diameter1ess than "48 inches, to -allow for' low flow- passage of water and
aquatic aife as well as prevent beadcutting -of the streams. If bedrock is encountered .in the-stream channel at
theaocation ofthe culvert installation, DWQwill=not require the burial of the culvert. ?However, design and
placementof _cuiverts.and other structures including temporary erosion control "measures shall' be installed in
I such `a man. ner that the -original stream profiles.are not altered (i.e., the depth of the channel must not be
:reduced by a widening of the streambed). Existing stream dimensions (including pattern and profile) are to
be maintained above and below`locations of each culvert. The applicant may be-required to provide evidence
that the equilibrium has `been maintained, if requested in writing by the DWQ.

3. Erosion-.and sediment control practices must utilize Best Management Practices (BMP) and be in full
compliance with all specifications governing the proper design, installation, and operation and maintenance of
such BMP in order to protect surface water standards:
a. The design, installation, operation, -and maintenance of the sediment and erosion control measures
must be such'that they equal, or exceed, the requirements specified in'the most recent version of
the .North Carolina Sediment and Erosion Control Manual.
The devices shall be maintained on all construction sites, =borrow pit sites, and waste pile (spoil)
projects, -including contractor-owned or leased borrow pits associated with the project.
b. .For.borrowpitsites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version =of the °North.Carolina :Surface
-Minn9Manual.

:c. Thereclamationmeasuresand.implementation of these:measures must'be in accordance with the
requirements of the SedimentationPollution Control:Act.
4. Heavy equipment rmust be operated from the`banks rather than in the stream channel, when-possible, in
orderto minimize sedimentation and reducethe likelihood of introducing other pollutants into the stream.
5. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic
conditions =can -be'provided.
6. :No'live.orfresh concrete shall come into contact with waters ofthe.state untilthe concrete-has hardened.
7. The>dimension, ?pattem and profile of the stream above -and-.below the crossing should :not be modified.
,Disturbedfloodplains and streams should be restoredto natural geomorphic conditions.
:8. All mechanized equipment operated near surface-waters must-be regularly inspected and maintained to
prevent::contamination of-stream waters from fuels, :lubricants, hydraulic fluids, or other-toxic materials.
S. :All work shall beperformed during low or normal flow conditions.
10. Discharging hydroseed:mixtures and washing out hydroseeders and other:equipment in or adjacent to
:surface waters isprohibited.
11. 'Sediment and erosion control :measures shall not=be .-placed -inwetlands=orwaters to themaximum extent
practicable. If placement of sediment and erosion control devices inwetlands.and waters_is=.unavoidable,
they, shall be removed and:thenatural;graderestored Within 30-days `after theDivision of Land Resources has
:released ,.the project.
12. ThexNorth?Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not
excavate, fill or perform mechanized land-clearing at anytime in .the construction: or maintenance ofthis
project within=waters:and/or wetlands, except•as authorized bythis certification, or.anymodifcation to this
Certifcation,(e.g no work shall occur -outside of -the footprint of the.plans provided).:In addition, there shall
be no excavation from --or waste disposal into jurisdictional wetlands or waters associated with this
Certification without appropriate modification. If this occurs, compensatory : mitigation may be required since it
is a direct'impact from road construction activities.
13. -Upon -completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to notify'.DWQ when all work- included in the 401 Certification has been completed. Please
include photographs _upstream and downstream of the structure to document correct installation.

14. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state
water quality standard [including any requirements for compliance with section 303(d) of the Clean Water Act]
and any other appropriate requirements of estate and federal -law. If DWQ determines that such standards or
laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal
law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate
and modify this certification to include conditions appropriate to assure compliance with such standards and
requirements in accordance with 15 A`NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify
NCDOT and the USACE, provide public notice in accordance with 15A NCAC 2H.0503, and provide
opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions -shall
.be provided to NCDOT in writing, shall .be provided to the'USACE for reference in any permit issued pursuant
to Section 404 of the Clean Water Act, and -shall also -become conditions of the 404 Permit for the project.
If you do not accept any Df the conditions of this,certification, you may ask=for an adjudicatory hearing. You,must
act within 60 days of the .date that you receive this Getter. To ask for a hearing, send :a written petition that
conforms to Chapter 1 506 of the'North=Carolina General 'Statutes to the Office of. Administrative Hearings,:6714

SUBJECT: Replacement of failing pipe, SR 1006 (Island Ford Road), Iredell County
Dear Mr. Hennessy:
The North Carolina Department of Transportation proposes to replace a failing pipe on SR 1006, Island
Ford Road, in Iredell County. Please note that this project is considered an emergency project and
construction will commence immediately. The failing double 96" CMP, which was -66 feet long will
be replaced with 60-foot long, double 96" CMP with inlet concrete headwall. Ten feet of riprap will be
utilized at the pipe inlet and outlet for stabilization. It was noted that there is bedrock in the stream above
and below the existing pipe: therefore, pipe burial may not be possible. If bedrock is encountered during
excavation it will be necessary to install replacement pipe at the same elevations as the old pipe. Riprap
faced bankfull benches will be constructed at the inlet and outlet of the flood flow pipe to maintain
channel dimensions and to direct low flow through the main flow pipe.
Temporary cofferdams and bypass pumping will be used for stream management during construction.
The scope of the work will result in a 6 foot reduction of pipe fill impacts, 10 feet of riprap impacts for
structure stabilization, and 12 feet of temporary impacts to Buffalo Shoals Creek, which is classified as
WS-IV waters by the Division of Water Quality.
The proposed project is not located within %2 mile of a critical watershed area and SR 1006 is a rural
arterial roadway; however, hazardous spill basins are not required. Enclosed is the NCDOT hazardous
spill basin checklist.
I have enclosed a PCN application for the Division of Water Quality's WQC#3404 (NW #14) for
permanent fill impacts associated with linear transportation crossings, sketches of planned activities,
photographs documenting existing conditions, and location maps relative to the project.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

VI. Proposed Impacts to Waters of the United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
A headwall is to be used on the upstream side of pipe to reduce impacts of pipe from 66 feet to
60 feet The minimum amount of riprap necessary to protect the structure will be used. Rock
faced benches to be constructed to maintain channel dimensions.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application

incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmaide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
