APPROVAL of 401 Water Quality Certification with Additional Conditions

You have our approval, in accordance with the attached conditions and those listed below, to permanently
impact a total of 92 linear feet (If) of an unnamed tributary to Campbell Creek (an intermittent stream) for the
purpose of extending an existing culvert for the addition of an eastbound travel lane as described in your
application received by the Division of Water Quality (DWQ) on August 23, 2005 and your revised drawing
received December 7, 2005. The location of the project is NC 24-27 (Albemarle Road) in Mecklenburg County.
After reviewing your application, we have determined that this project is covered by Water Quality General
Certification Number 3404. This certification corresponds to the Nationwide Permit Number 14 issued by the
U.S. Army Corps of Engineers (USACE). Please note that you should get any other federal, state or local
permits before proceeding with your project, including those required by (but not limited to) Sediment and
Erosion Control, Non-Discharge, and Water Supply Watershed regulations.
This approval is valid solely for the purpose and design that you described in your application (unless modified
below) and will expire with the associated USACE permit unless otherwise specified in the Water Quality
certification. Should your project change, you must notify the DWQ in writing and you may be required to
submit a new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear
feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this
approval to remain valid, you must adhere to the conditions in the attached certification and those listed below:
Placement of culverts and other structures in waters, streams and wetlands must be below the elevation of
the streambed by one (1) foot for all culverts with a diameter greater than 48 inches, and 20 percent of the
culvert diameter for culverts having a diameter less than 48 inches, to allow for low flow passage of water and
aquatic life, as well as prevent headcutting of the streams. Design and placement of culverts and other
structures including temporary erosion control measures shall be installed in such a manner that the original
stream profiles are not altered (i.e., the depth of the channel must not be reduced by a widening of the
streambed). Existing stream dimensions (including pattern and profile) are to be maintained above and
below locations of each culvert. The applicant may be required to provide evidence that the equilibrium has
been maintained, if requested in writing by the DWQ.
2. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions.
Riprap placed for bank stabilization should be limited to the stream bank below the high water mark and
vegetation should be used for stabilization above the high water mark.

3. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in
order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
4. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic
conditions can be provided.
5. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened.
6. The dimension, pattern and profile of the stream above and below the crossing should not be modified.
Disturbed floodplains and streams should be restored to natural geomorphic conditions.
7. All mechanized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
8. All work shall be performed during low or normal flow conditions.
9. Discharging hydroseeding mixtures and washing out hydroseeders and other equipment in or adjacent to
surface waters is strictly prohibited.
10. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full
compliance with all specifications governing the proper design, installation, and operation and maintenance of
such BMP in order to protect surface water standards:
a. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of
the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all
construction sites, borrow pit sites, and waste pile (spoil) projects, including contractor-owned or
leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina Surface
Mining Manual.
c. The reclamation measures and implementation of these measures must be in accordance with the
requirements of the Sedimentation Pollution Control Act.
11. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has
released the project.
12. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not
excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this
project within waters and/or wetlands, except as authorized by this Certification, or any modification to this
Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall
be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this
Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it
is a direct impact from road construction activities.
13. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please
include photographs upstream and downstream of the structure to document correct installation.

14. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state
water quality standard [including any requirements for compliance with section 303(d) of the Clean Water Act]
and any other appropriate requirements of state and federal law. If DWQ determines that such standards or
laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal
law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate
and modify this certification to include conditions appropriate to assure compliance with such standards and
requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify
NCDOT and the USACE, provide public notice in accordance with 15A NCAC 2H.0503, and provide
opportunity for public hearing in accordance with 15A NCAC 21-1.0504. Any new or revised conditions shall
be provided to NCDOT in writing, shall be provided to the USACE for reference in any permit issued pursuant
to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless
you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

Dear Mr. Lund:
The North Carolina Department of Transportation (NCDOT) proposes to widen NC 24-27 by
twelve feet for the addition of an eastbound travel lane that will run from Pierson Drive to
approximately 0.11 mile west of Reddman Road in Mecklenburg County. The total length of the
proposed project is 0.805 mile.
Protected Species
The subject project area has been reviewed for the presence of federally listed threatened and
endangered species (Mecklenburg County list includes: Haliaeetus leucocephalus, Lasmigona
decorata, Rhus michaurii, Helianthus schweinitzii, and Echinacea laerigata). It has been
determined that the construction of this project will have no effect on any listed plant or animal
species.
Impacts to Waters of the United States
This project cannot be completed without impacts to waters of the United States. The project is
located within the Catawba River Basin (Hydrologic Unit # 03050103), affecting the drainage of
an unnamed tributary to Campbell Creek. There will be approximately 92 linear feet of permanent
stream impacts as a result of the proposed widening.

Summary
The NCDOT anticipates that the permit application will be authorized under a Section 404

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an
accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation trap, whether or not impacts are proposed to these systems.
Wetland and stream evaluation and delineation forms should be included as appropriate.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach draw-ii gs of alternative, lower-impact
site layouts, and explain why these design options were not feasible- Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts-
The surface waters not affected by the construction of this project will be protected from
unnecess encroachment. The staging of construction eauipment will not be allowed near the
stream Strict enforcement of the sediment and BMP's for the protection of wetlands and surface
waters will be enforced during all phases of project construction.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed-
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.

The Division of Water Quality (DWQ) has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Based on our review, the following information is needed for this office to complete
the processing of your application:
The application proposes 16 linear feet (If) of culvert extension and 20 If of riprap outlet protection. As
depicted on the plans, and field verified, the culvert extension and outlet protection would be located in
the bank of the stream, rather than aligned with the stream. In addition, the plans depict the riprap
outlet protection within the streambed. Placement of riprap outlet protection is prohibited in the
streambed and should be limited to the streambanks. Provide revised plans depicting the proper
alignment of the culvert extension within the stream and the appropriate placement of the riprap outlet
protection.
Pursuant to 15A NCAC 21-1.0507(a)(5), we will place the certification request on hold until we are provided the
necessary information. Furthermore, until the information is received by the North Carolina Division of Water
Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the 404 Permit
application on hold.

The North Carolina Department of Transportation (NCDOT) proposes to widen NC 24-27 by
twelve feet for the addition of an eastbound travel lane that will run from Pierson Drive to
approximately 0.11 mile west of Reddman Road in Mecklenburg County. The total length of the
proposed project is 0.805 mile.
Protected Species
The subject project area has been reviewed for the presence of federally listed threatened and
endangered species. It has been determined that the construction of this project will have no
effect on any listed plant or animal species.
Impacts to Waters of the United States
This project cannot be completed without impacts to waters of the United States. The project is
located within the Catawba River Basin (Hydrologic Unit # 03050103), affecting the drainage of
an unnamed tributary to Campbell Creek. There will be approximately 36 linear feet of permanent
stream impacts as a result of the proposed widening.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

9. Describe the existing conditions on the site and general land use in the vicinity of the project
at the time of this application: The site is located in a commercially developed area within
the city of Charlotte The north side of the highway has been developed with an apartment
complex the east side of the stream has been developed with a strip mall, and the west side
of the stream is bordered by a vacant lot that is vegetated by grasses and is currently being
maintained with frequent mowing The stream is piped from it's origin to the outlet located
on the south side of NC 24/27 There are several drop inlets that introduce storm water from
the highway as well as the apartment complex located nearby The stream is vegetated at the
outlet end of the pipe but there is some stream bank erosion taking place further south,
approximately 50 -100 feet off of NCDOT right-of-way.
10. Describe the overall project in detail, including the type of equipment to be used: The 72"
RCP located at Station 43+71.92 is proposed to be extended an additional 16 feet to
accommodate the addition of a 12 foot outbound travel lane on NC 24/27 (Albemarle Road)
from Pierson Drive to 011 miles west of Reddman Road (total project length 0.805 miles).
The following equipment will be used: trackhoe grader, dump truck paving equipment and
vibratory roller

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

unnecessaa encroachment The staging of construction equipment will not be allowed near the
jurisdictional stream crossing Strict enforcement of the sediment and BMP's for the protection

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.

much information as possible, including, but not limited to: site location (attach directions and/or
map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of
mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description
of the current site conditions and proposed method of construction. Please attach a separate
sheet if more space is needed.
Any required mitigation for this project will be pursued through the EEP.
2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement
Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919)
715-0476 to determine availability, and written approval from the NCEEP indicating that they
are will to accept payment for the mitigation must be attached to this form. For additional
information regarding the application process for the NCEEP, check the NCEEP website at
