Dear Mr. Mills:
You have our approval, in accordance with the attached conditions and those listed below, to incur the following impacts
to an unnamed tributary to South Fork Rattlesnake Creek in order to pave and improve SR 1593 (Kimbro Rd) in Caswell
County.
• 30 linear feet of piping impacts;
• up to 20 linear feet of rip rap for bank stabilization; and
• Temporary dewatering impacts of approximately 40 linear feet.
The project shall be constructed in accordance with your application dated March 2, 2005 and additional information
received July 29, 2005.
Please note that an additional stream crossing on SR 1593 was replaced as part of this project. This crossing was
indicated as an ephemeral channel in the March 2, 2005 application. The Division of Water Quality (DWQ) classified this
stream as intermittent and requiring a permit for pipe replacement. The US Army Corps of Engineers determined that this
pipe replacement was authorized under a Nationwide General Permit Number 3 and therefore did not require written
concurrence from the DWQ.
After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Nos.
3404 and 3366, corresponding to the U.S. Army Corps of Engineers Nationwide Permit Numbers 14 and 33. In addition,
you should acquire any other federal, state or local permits before you proceed with your project including (but not
limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will
expire with the accompanying 404 permit, unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified below). Shuuh!
your project change, you must notify the Division of Water Quality (Division) and submit a new application. If the
property is sold, the new owner must be given a copy of this approval letter and certifications, and is thereby responsible
for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if'
total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions
listed in the attached certification and any additional conditions listed below.

1. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such Best Management Practices in order to protect surface
waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be
such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow
sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with the
requirements of the Sedimentation Pollution Control Act.
2. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of
the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be
performed so that no violations of state water quality standards, statutes, or rules occur.
3. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the completion of the project.
4. Riparian vegetation must be reestablished within the construction limits of the project by the end of the growing
season following completion of construction.
5. Stormwater should be directed to vegetated buffer areas, grass lined ditches or other means appropriate to the site
for the purpose of pre-treating stormwater runoff, and must not be routed directly into streams. Mowing of
existing vegetated buffers is strongly discouraged, so that they may be utilized for stormwater sheet flow.
6. Where practicable, culverts that are less than 48-inch in diameter should be buried to a depth equal to or greater
than 20% of their size to allow for aquatic life passage. Culverts that are 48-inch in diameter or larger should be
buried at least 12 inches below the stream bottom to allow natural stream bottom material to become established
in the culvert following installation and to provide aquatic life passage during periods of low flow. These
measurements must be based on natural thalweg depths. This may require increasing the size of the culvert to
meet flow conveyance requirements. If any of the existing pipes are perched, they shall be removed and replaced,
and re-installed correctly, unless demonstrated that this is topographically unfeasible. All waters must flow
through without freefalling or damming on either end of the culverts during low flow conditions, to maintain
aquatic life and/or fish passage.
7. The dimension, pattern and profile of the stream above and below the crossing should not be modified by
widening the stream channel or reducing the depth of the stream.
8. Disturbed floodplains and streams should be restored to natural geomorphic conditions.
9. Use of rip-rap for bank stabilization is to be minimized; rather, native vegetation is to be planted when practical.
If rip-rap is necessary, it must be limited to the stream bank below the high water mark, and vegetation must be
used for stabilization above high water. Any rip-rap used must not interfere with aquatic life passage during low
flow conditions.
10. If concrete is used, work must be accomplished so the wet concrete does not contact the stream water. This will
lessen the chance of altering the stream's water chemistry and causing a fish kill.
11. Heavy equipment must be operated from the banks rather than in the stream channel in order to minimize
sedimentation and reduce the likelihood of introducing other pollutants into the stream.

12. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent
contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
13. The presence of equipment in the channels must be minimized. Under no circumstances must rock, sand or other
materials be dredged from the wetted stream channel under authorization of this permit, except in the immediate
vicinity of the culverts.
14. Temporary dewatering sites must be restored to preexisting conditions unless more natural geomorphic conditions
can be provided.
15. All work shall be performed during low flow conditions.
16. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion
Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party
shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality upon
completion of the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

For your records, John Thomas stated that the pipe that was
replaced on Kimbro Road over the recent stream call did not
require a NW 14 and was eligible for a NW 3. His assessment was
based on the pipe length only increasing four feet and no
proposed widening of the existing road (only paving).
Call me if you have any questions.
Also, I will be mailing you a change in a dewatering plan used on
a project in Guilford County. John Thomas has already approved it
but I wanted to make you aware. I actually had it in my car on
Thursday but in old age I forgot to give it to you.

The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project. Review of your application revealed it lacking necessary information required for
making an informed permit decision. The permit application was deficient in the following areas:
• It was determined that the middle surface water feature identified is an intermittent stream rather than an
ephemeral stream as noted in the permit application. Please revise the permit application to include impacts
at this location.
Therefore, pursuant to 15A NCAC 211.0507(a)(5), we will have to place the permit application on hold until we
are supplied the necessary information. Furthermore, until the information is received by the NC Division of
Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit
application on hold.

The North Carolina Department of Transportation (NCDOT) proposes to replace a undersized
culvert on Kimbro Road (SR 1593) in Caswell County associated with secondary road paving. In an
effort to obtain the necessary permits for the subject culvert replacement, we are providing a pre-
construction notification application with supporting documentation. We believe this project can be
permitted under the Nationwide Permit numbers 14 and 33. NCDOT is requesting an exemption
from USCOE mitigation based on the scoured area adjacent to the existing outlet pipe (see

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are

9. Describe the existing conditions on the site and general land use in the vicinity of the project
at the time of this application: Residential and agricultural
10. Describe the overall project in detail, including the type of equipment to be used:
The project will involve paving an unpaved secondary road and bringing the travel lane,
shoulders, ditchlines, and drainage structures up to current standards. Travel lane wideningz
will be required to bring the road up to current standards. Standard shoulder widths will be
6'-8' with deviations shown on the attached site plan. Ditch widths will vary based on site
conditions. Culverts at two locations on the road are proposed to be replaced and another
culvert adjacent to a pond) is proposed to be extended. Of the three sites, only one has been
determined to be a stream for which this permit is applied The extended pine is proposed on
the opposite side of the road from the pond. All road widening activities in that area will
occur on the opposite side of the pond. Proposed ri 'ht-of-way width is illustrated on the
attached site plan. Equipment used will be standard road construction equipment (trackhoe,
grader, backhoe, and bulldozer).
11. Explain the purpose of the proposed work:To upgrade an unpaved secondary road to a
paved secondary road. Paving and widening_ are being conducted to reduce future
maintenance costs, bring the road up to current construction standards, and increase traffic
safety.

VI. Proposed Impacts to Waters of the United States/Waters of the State

wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accompanying site

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Pine replacement activities are necessary to increase travel lane and shoulder width to current
construction standards. Impacts will be minimized by strict enforcement of Best Management
Practices for the protection of wetland and surface waters, restrictions against the staging of
equipment in or adjacent to waters of the US, and coordination (including a pre-construction
meeting) with the Division Environmental Officer.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmizide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
desa4gibaafthe current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
A finding of insignificant impact is anticipated, therefore, a mitigation plan is not provided.
Cumulative impacts are less than 150 feet. The maximum amount of impact to a single
stream is 30 linear feet. No Outstanding Resource Waters, federally protected species or
their habitats, or essential fishery habitats occur in the project area. The project is not located
in a High Quality Water.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the

Construction Sequence and Erosion Control Plan for Replacement of
Pipe with Pipe Using a Pump Around - Caswell County, Kimbro Road

Work to begin as soon as practicable following authorization.
Construction is anticipated to take 2 weeks.
1. Install a rock silt dam downstream of the work area to prevent incidental sediment
loss.
2. Install ABC aggregate or a less intrusive dewatering device to allow dewatering of
the work area.
3. Install pumps to divert flow around the work area.
4. Remove existing line pipe.
5. Excavate to sufficient depth to allow burial at a minimum depth of one foot or 20 %
of the pipe diameter.
6. Backfill the new line of pipe and place rip rap only as needed.
7. Starting from the downstream end, remove the dewatering device and restore the
natural stream contours.
8. Notify landscape department for final seeding.
9. Silt fences to be placed as site conditions require.
10. Ifnecessary, a 10' X 15' dirt bag will be used to remove excess water in the hole
where the new pipe is being replaced.
11. Site conditions and weather may alter these plans.
12. A method less intrusive than a pump around system may be utilized if site conditions
allow.
