Concurrently with this letter, we are submitting a copy of the PCN to Andy Williams with the USACOE.
The package is being submitted to Andy requesting a Nationwide Permit 18, which requires notification
only (see attached email from Andy Williams).
Also, please be advised that we have had communication with Sue Homewood of the Winston-Salem
Regional Office and we are sending her a copy to expedite the approval process.
The Town of Elon plans to construct a 5' ft wide pedestrian concrete sidewalk along the northern
shoulder of E. Haggard Avenue from Lawrence Avenue to Gilliam Road (approximate length is 3,360 ft).
Approximately 50% of the sidewalk will be constructed immediately adjacent to the existing curb and
gutter section and the remaining 50% of the project will be constructed in an existing ribbon pavement
section. Where the sidewalk will be adjacent to the existing curb and gutter, the flow will be directed to
the curb and gutter and existing storm sewer system. Where the sidewalk is constructed in the ribbon
pavement section, the sidewalk will be constructed beyond the existing grass lined ditch and the runoff
from the new concrete will drain towards the existing grass lined ditch. The existing grass lined ditches
will be retained and the flow form the sidewalk will be diffused in this section. The existing grass lined
ditches are sufficient to accept the additional runoff from the proposed sidewalk and remain stable.

Please be advised that the project will be adjacent to 1 stream as delineated on the Burlington, NC USGS
Map. Currently the stream flows through an existing 54" culvert pipe under the existing curb and gutter
section. Currently there is no rip rap on the downstream side of the culvert. Please be advised that
NCDENR, LQS has issued a permit for the project; however, the permit was issued contingent upon the
downstream culvert be stabilized with rip rap; therefore, we plan to stabilize the outlet of an existing
54" RCP by placing rip rap along the bottom and sides of the existing bank as required by NCDENR-LQS.
Please note that during the design process, we have minimized the impacts to the stream/buffer areas
by proposing to construct a headwall at the end of the existing culvert pipe to eliminate extending the
pipe. We are proposing a fill slope in the vicinity of the stream/buffer area, since the existing shoulder
and fill slopes do not comply with NCDOT requirements. NCDOT typically recommends a 3:1 fill slope
for the roadway; however, adjacent to the stream, we have reduced the slope to a 2:1 slope at the
headwall and 2.5:1 in the buffer area to minimize impacts.
The Town is most anxious to begin this project while the Elon University students are out for summer

If you will recall, you had indicated that should we need to place rip rap downstream of the culvert, we
would need to obtain a Nationwide Permit 18. In order for the Town to comply with the Land Disturbing
Activity Permit, the Town will need to install the rip rap; therefore, we hereby request approval of a
NWP 18. In addition, the Town will need to obtain a buffer encroachment from DWQ (Jordan Lake
Rules). Concurrently, we are submitting a package to DWQ for a riparian Buffer Authorization.
The Town is most anxious to begin this project while the Elon University students are out for summer

Based on our telephone conversation on May 25, 2011 and the project plans you
submitted, there is only 1 jurisdictional stream located within the project
area. The project plans and your description indicate there will not be any
fill located within the stream. We also discussed bank stabilization by use
of live stakes. As described, a permit from the US Army Corps of Engineers
is not required to complete this project.
We also discussed rip rap dissipation pads. You stated there are currently
no plans for a rip rap dissipation pad associated with this project. If one
is required, it could potentially be authorized by Nationwide Permit 18. If
you find that a rip rap dissipation pad is necessary, please contact me to
discuss further.

Andy,
It is my understanding that you have spoken with Jerry Parker with NCDOT
regarding the subject project and that the Town will need to make application
for a Nationwide 14 permit. I am not sure if you have seen the plans for the
proposed impacts and wanted to forward to you the plan sheet for what is
actually proposed and provide you with some background information..
The project consists of installing a 5-ft wide concrete sidewalk behind the
curb. At one location, approximate station 5+45, an existing culvert is
under the road and the watercourse would most likely be considered a stream
and is a blue line in the USGS map. Currently the shoulder or berm width

beyond the back of curb does not meet NCDOT typical requirements for slope or
width. The plan indicates that we will construct a headwall at the end of
the existing pipe without extending the pipe. Fill would be added over top
of the existing pipe to allow the construction of the sidewalk. We are
proposing to construct wing walls on each side of the pipe to tie back into
the existing grade on each side of the culvert.
We will be installing a temporary impervious dike downstream of the culvert
and the contractor will be required to install a pump and pump the effluent
into a stilling basin beyond the top of bank. We have received an erosion
control permit for the project; however, the approval is based on providing
bank stabilization downstream. Our intent at this time would be to plant
some "live stakes" on each side of the stream to assist with stabilizing the
bank as required by Land Quality Section.
Since we are not extending the pipe, we have been previously advised that
this would not be considered a stream impact or require a permit. In this
scenario, would you concur that a permit is not required or will a Nationwide
permit be required? Should a permit be required, we most likely will modify
the plan to extend the pipe and eliminate the headwall to reduce project
costs. It is my understanding that if the impact is less than 150-ft, we
will still qualify for a Nationwide permit? Please confirm if that is
correct.
Please review and advise if a permit will be required as we are trying to
complete this project this summer prior to students returning for the fall
semester. Should you have any questions or need any additional information,
please feel free to contact me.
