Harkers Island Subdivision and Marina

This Office has reviewed your CAMA application dated May 13, 2011 for the redevelopment of an
existing marina and subdivision. The Division of Water Quality (DWQ) has determined that your
application was incomplete as discussed below. The DWQ will require additional information in order
to process your application to impact protected wetlands and/or streams on the subject property.
Therefore, unless we receive the additional information requested below, we will have to move toward
denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as
incomplete until we receive this additional information. Please provide all of the following information
so that we may continue to review your project.
On May 18, 2011, David Timpy of the USACE wrote a letter stating that the project as proposed:
1) Needs to go through the avoidance and minimization process to provide justification for the
proposed wetland impacts. Are there no other upland alternatives for the two proposed lots
that will impact these wetlands?
2) In addition, it is the DWQ's understanding that the wetlands as shown on the plans does
NOT match the signed Jurisdictional Determination (JD). Please explain this variation.
Please include the DWQ in your response to the USACE's letter.
Please respond within three weeks of the date of this letter by sending this information to me int writing
and two copies to Ian McMillan c/o 401 Wetlands and Stormwater Branch, 1650 Mail Service Center,
Raleigh, NC 27699-1650. Please reference the DWQ Project # of 2011 0483 in all future
correspondence. If we do not hear from you within three weeks, we will assume that you no longer...,,.
want to pursue this project and we will consider the project as withdrawn.
