Thank you for the opportunity to meet with you and your staff yesterday at DWQ's Washington
Regional Office. This letter confirms the commitment made by Mr. Wichard to place an interim
complete "plug" in the excavated connection to Taylor Creek referenced in DWQ's NOV letter,
using a vinyl bulkheading material and pilings support method, pending further review by D`? 'Q
of new application materials that I anticipate in the future will be submitted to DWQ by Mr.
Whichard's environmental consultants. It is my understanding that DWQ will review any such
new application materials without any prejudice related to this enforcement action.
I anticipate that Land Management will provide assistance to Mr. Whichard in providing drawing
detail and other needed information regarding the placement of these materials, and that they will
get this information to you and your staff in the near future so that this closure can be installed.
Longer term, Land Management will be acting as Mr. Whichard's consultant and agent for
purposes of follow up application materials, requests for technical data and information, etc.
