Dear Mr. Davis:
On August 7, 2003, at your request I conducted an on-site determination to review two stream features located at
the East / Southeast Portion of the property off property (on left entering the main entrance off of Hwy 301), on the subject
property for applicability to the Tar- Pamlico Buffer Rules (15A NCAC 2B .0259). The stream features are labeled as "A,
B, & C" on the attached map initialed by me on August 13, 2003.
At your request, I conducted an on-site determination as stated above. During my review I evaluated the stream
using the Nash County Soils and the Drake Quad USGS topographic maps. This feature labeled as "B" becomes
protected where the two features B & C converge into one labeled as "A". Stream feature "B" continues east towards Hwy
301 & off of the subject property. (See attached maps).
The DWO has determined that the stream labeled as "B" on the attached map is at least "intermittent" and
is subject to the Tar-Pamlico Buffer Rule. (15A NCAC 2B .0259) This stream and it's associated buffers should be
identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant
agencies) of this decision in any future correspondences concerning this property.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers.
Nor does this letter approve any activity within Waters of the United States or Waters of the State. If you have any
additional questions or require additional information please call me at [phone]. Any disputes (e.g., appeal
requests) over this on-site determination shall be referred to the Director in writing c/o of John Dorney, DWQ
Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260.
