Subject: Tar Pamlico River Basin Riparian Buffer Rules

Dear Mr. Davis:
I have reviewed the maps that were submitted to the Raleigh Regional Office for project NBRRO-02-155.
An evaluation of the stream feature was performed to determine whether the site would require compliance
with the Tar Pamlico River Basin-Nutrient Sensitive Waters Management Strategy: Protection and
Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0259).
The feature represented on the Nash County Soils and the Drake USGS topographic maps was
evaluated to determine their subjectivity to the Rule. It was determined that there is one feature
represented on the maps that is subject to buffer protection. This feature becomes subject to protection less
than 100 feet from Highway 301 in the northeastern corner of the property. The approximate location of the
beginning of the protected stream is shown on the attached map.
This letter addresses only those issues involving the riparian area. For information relative to impacts within
the wetlands or buffers, or 401/404 issues, please contact Mr. John Dorney at 919-733-1786. Thank you
