Dear Mr. Tanneberger:
Reference is made to the application of February 5, 2007, submitted on your behalf by
Mr. Matthew O'Brien of Environmental Services, Inc., for individual Department of the Army
(DA) permit authorization to impact approximately 2.78-acres of wetlands and 773 linear feet of
stream channels of the jurisdictional waters of Johnson Creek associated with the proposed
construction of the Clemmons Town Center commercial /retail facilities located off of
Lewisville-Clemmons Road northwest of the intersection with I-40, north of Clemmons, in
Forsyth County, North Carolina. The project also includes temporary jurisdictional waters
impacts of 121inear feet of stream channels and 0.07 acre of wetlands associated with a sewer
line connector.
After review of your proposal, the North Carolina Wildlife Resources Commission
(WRC) requested an extension of time to comment on your proposal and submitted comments by
memo dated April 19, 2007, a copy of which is enclosed for your consideration and response.
Specifically, the WRC provided a list of recommended conditions associated with concerns of
potential impacts to wildlife and aquatic resources that could result from your proposed project.
These recommendations are listed as items 1 thru 9 in the attached referenced memo. Please
review these recommendations and provide us comments in reference to your proposed
development.
Your response to the WRC's comments should be provided to the Raleigh Regulatory
Field Office, in writing, so we can continue timely processing of your application. If you have
