DWQ Project No. 06-0362
DOT Project #8C.062036
You have our approval, in accordance with the attached conditions and those listed below, to
place fill material in a total of 40 linear feet of streams as part of proposed road improvements to
SR 1563 in Montgomery County. The specifically approved impacts are identified in the project
application dated March 6, 2006, and in an amended drawing provided by Mr. Art King, Div. 8
DEO, received March 28, 2006. The approved impacts are as follows:
Site location Type of impact Length of impact
Site #1 Culvert Replacement 20 ft. of perennial stream
Sta.53+10 UT Cheek Creek (replacement of 30' of 42" CMP w/50' of
73"x 55" CMPA)
Site #2 Culvert Extension 20 ft. of perennial stream
Sta. 61+00 Ivey Branch (replacement of 40' of 72" CMP with 60' of
87"x 63" CMPA)
The project shall be constructed in accordance with your March 6, 2006 application and Mr.
King's amended drawing. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Nos. 3404, which may be viewed on our website
at http://h2o.enr.state.nc.us/ncwetlands. This certification corresponds to Nationwide Permit No.

or local permits before you proceed with your:project including (but not limited to) Sediment and
Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will
expire with the accompanying 404 permit issued by the US Army Corps of Engineers. This
condition supercedes Condition No. 19 of GC No. 3404.
This approval is valid solely for the purpose and design described in your application (unless
modified below). Should your project change, you must notify the DWQ and submit a new
written application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter, and is thereby responsible for complying with all the
conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total
impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be
required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to remain valid,
you must adhere to the conditions listed in the attached certification.
l.) Upon completion of the project, the responsible party within NCDOT shall complete and
return the enclosed "Certification of Completion Form" to notify DWQ when all work
included in the 401 Certification has been completed.
2.) NCDOT shall conduct its activities in a manner consistent with State water quality
standards (including any requirements resulting from compliance with section
303(d) of the Clean Water Act) and any other appropriate requirements of State law
and federal law. If DWQ determines that such standards or laws are not being met
(including the failure to sustain a designated or achieved use) or that State or
federal law is being violated, or that further conditions are necessary to assure
compliance, DWQ may re-evaluate and modify this certification to include
conditions appropriate to assure compliance with such standards and requirements
in accordance with 15A NCAC 2H.0507(d). Before modifying the certification,
DWQ shall notify NCDOT and the US Army Corps of Engineers, provide public
notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public
hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions
shall be provided to NCDOT in writing, shall be provided to the US Army Corps of
Engineers for reference in any permit issued pursuant to Section 404 of the Clean
Water Act, and shall also become conditions of the 404 Permit for the project.
3) The dimension, pattern, and profile of the stream and floodplain above and below
structures shall not be modified by widening the stream channel or reducing the
depth of the stream. However, this does not prohibit the pipe relocation (skew)
as discussed on site with Mr. King and as provided in his modified drawing.
This slight skew should be more in alignment with the existing downstream
flow path.
Mr. Timothy Johnson
April 5, 2006
Page 3
4) All work should be performed during low flow conditions. Also, heavy
equipment must be operated from the banks rather than in the stream channel in
order minimize sedimentation and reduce the likelihood of introducing other
pollutants into the stream.
5) All mechanized equipment operated near surface waters must be regularly
inspected and maintained to prevent contamination of stream waters from fuels,
lubricants, hydraulic fluids, or other toxic materials.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition that conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
This certification and its conditions are -final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act. If you have any questions, please contact Ken Averitte at 910-486-1541, ext 703.
Sincerely,

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required- by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http:/'/'h2o.eiir.state.nc.us/"ncwetl ands/strmaide. html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offfsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
N/A
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that
you would like to pay into the NCWRP. Please note that payment into the NCWRP must be
reviewed and approved before it can be used to satisfy mitigation requirements. Applicants
will be notified early in the review process by the 401/Wetlands Unit if payment into the
NCWRP is available as an option. For additional information regarding the application
process for the NCWRP, check the NCWRP website at littp:; 1i2o.enr.state.nc.usAvrD ndex.htm. If
use of the NCWRP is proposed, please check the appropriate box on page three and provide
the following information:
Amount of stream mitigation requested (linear feet):
Amount of buffer mitigation requested (square feet):
Amount of Riparian wetland mitigation requested (acres):
Amount of Non-riparian wetland mitigation requested (acres):

Subject: Nationwide Permit #14

Project # 80.062036 (DWQ Permit Fee $200)
Mr. Ridings:
LYNDO TIPPETr
SECRETARY

The North Carolina Department of Transportation, Highway Division 8 is requesting Nationwide
Permit Number 14 for project # 8C.062036 on SR 1563 (Loving Hill Rd.) in Montgomery County.
The proposed project will replace an existing deficient crossing pipes as follows:
Site i- Replace existing 42"x 30' CMP with a 73"x 55"x 50' CMPA.
Site 2- Replace existing 72"x 40' CMP with a 87"x 63"x 60' CMPA.
These pipes are being replaced in anticipation of a scheduled grading and paving project. The amount of pipe
length increase (20ft. per site) is needed to accommodate the widening of the roadbed. The total percentage of
impervious. surface within the project area will remain at less than 30%. All erosion control devices will be
appropriate to the location and in compliance with the current version of the NCDOT Best Management Practices
manual.
The crossings are located on Ivy Branch (site 2) and an unnamed tributary of Ivy Branch, (site 1). Ivy Branch is a
class C streams within the Yadkin River basin. Any dewatering required at these sites will be done with the use of
moveable structures (i.e. pre-cast concrete barriers or sheet metal piles). Construction will be done under dry
conditions whenever possible. There were no threatened or endangered species observed within the project area
during the required minimum criteria check. Any detours required for this project will be done off site using local
state roads.
If you require any additional information, please contact me.
Sincerely,
Art C. King
