PROJECT SUMMARY: The proposed project is a major modification to existing major permit # 103-09 Field Investigation Report: Beaufort Partners, LLC Beaufort Marina Project Page 02 and includes a reconfiguration and expansion of an existing marina with associated dredging. This project submitted an Environmental Assessment on Fel -uo-v 3, 2009 and received a Finding of No Significant Impacts on February 19, 2009. 9. Narrative Description The Beaufort Marina commercial project is located immediately east of the bridge at 103, 113 and 115 Cedar Street in Beaufort, Carteret County and is adjacent to Town Creek and the USACE Federal Harbor. The high ground property is 1.9 acres in its entirety and is an average of 10' above NHW. The property is partially developed. The developed portion of the high ground contains a vacant one-story Hardees restaurant building with its parking lot and driveways. The vacant portion has been cleared with the exception of the vacant gas station building, parking lot and driveways. There is riprap, consisting mainly of relic broken masonry debris, at and below nhw along the shoreline along with large amounts of solid waste debris. There is a steep escarpment along the shoreline as well as a 10' x 145' fringe of coastal marsh which starts on the west side and ends 145' from the east side of the property. It is located waterward of the existing larger concrete rip rap (not the relic broken masonry bricks). It consists of Spartina alterniflora (Smooth Cordgrass). The high ground is comprised mostly of grasses, a few cedars, oak trees and scrub bushes. There are commercial properties on both sides of the project area. The Town of Beaufort's Land Use Plan classifies this property as Developed with all AECs classified Conservation. Town Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish. Town Creek within this area carries a water classification of SC and is approximately 1,100' wide. Water depths within this area range from -2.5' nlw to -3.75' nlw. Riparian corridors have been set to parallel the existing alignment of the adjacent neighbor "Discovery Diving" dock to the east. Substrate is mostly silty sand. No SAVs or shellfish beds were observed within the current proposal project area although there are scattered oysters along the shorelinc. 10. Project Description: The current proposal is for the addition of 18 slips to the previously permitted 59-slip marina (77 in total) with reconfigured floating docks/piers, floating finger piers, tie pilings, the addition of 2 parking spaces over existing impervious surface, and the expansion of the previously permitted excavation area. In order to accommodate for the additions, the previously permitted docks/piers have been reconfigured. The piers would extend out to an imaginary line set by the permitted (but not installed) docks at both L'or Decks to the east and Homer Smith to the west. The most western pier (pier A) would start at the previously permitted bulkhead, located a distance Field Investigation Report Beaufort Partners, LLC Beaufort Marina Project Page 03 of 80' from the western riparian corridor and would be 8' in width. It would span 15' of coastal wetlands while continuing waterward for 420'. There would be 44 permanent slips located within this area. The slips would be numbered Al-A44 with twelve (5' x 20') finger piers, eleven 5' x 22') finger piers and a total of 67 tie pilings within this area. The tie pilings at the west would be located a maximum distance of 40' from the pier and 40' from the western riparian corridor. The eastern tie pilings for pier A would be located a maximum distance of 45' from the pier. The most eastern pier (pier B) would extend from the previously permitted bulkhead over open water for 165, turn east for 30', then north for a final 265'. It would be located a distance of 50' to 70', depending on location, from the eastern riparian corridor. There would be 33 permanent slips located within this area. The slips would be numbered B1- B33 with one (5' x 17') finger pier, three (5' x 20') finger piers, fourteen (5' x 15') finger piers and a total of 49 tie pilings. The tie pilings within slip areas B30-1333 would be a maximum distance of 40' from the pier and a distance of 35' from the eastern Riparian Corridor. The tie pilings within slip areas 1318-1329 would be a maximum distance of 35' from the pier and a distance of 15' from the eastern riparian corridor. According to the applicant, the typical boat would be 40'with a mixed use design. The marina policy would prohibit overboard discharge, no fueling and no overnight or live aboard dockage. The only "amenities" would be the previously permitted bath house located on the high ground portion and the mobile pump out station located on the western dock (A). The width of Town Creek in this area is 1,117'. The western pier would extend 415' waterward from the edge of the marsh and the eastern pier would extend 430' from nhw. The outermost portion of the dock and finger piers for dock A would be located 70' from the federal channel setback while pier B would be 55'. Pier A would be a distance of 60' from the western riparian corridor as shown on plat dated 4/6/2011 by Baldwin Design Consultant, PA showing the "A" dock riparian line intersecting the permitted dock location of Beaufort Harbor Marina Yacht Club (Homer Smith) with pier B a distance of 35' from the eastern riparian corridor. The applicants are proposing the expansion of the previously permitted excavation area. The permitted excavation dimensions are 350' wide x 325' long. The expanded dimensions propose to add 185' in length and would widen the area to 380'. The total excavation area (permitted and new) would be 510' long x 380' wide. The applicants would excavate the boat basin area with a bucket to barge method. A total of 4,750 cubic yards of material would be removed below nhw. The new excavation dimensions would be 100' to 185' in length x 350' in width. The average existing depth is -3.75' nlw with a proposed final depth of -6' nlw. The connecting water depths within this area are an average of - 6.75' nlw. The material would be trucked offsite to an approved disposal area. Field Investigation Report Beaufort Partners, LLC Beaufort Marina Project Page 04 The applicants are proposing the addition of two new spaces over existing impervious surface to the previously permitted 18 space parking area (20 in total). The additional spaces are to ensure consistency with the Town of Beaufort's Land Use Plan. 11. Anticipated Impacts: The proposed dock and fingers for pier A would shade 5,770 ft' of shallow estuarine bottom and incorporate 36,106 ft2 of open water. It would shade 120 ft2 of fringe coastal wetlands. Pier B would shade a total of 4,875 ft2 of shallow estuarine bottom and incorporate 14,008 ft2 of open water. The new pier configurations would exceed 1/4 of the width of the water body (1,117') in this area, with pier A extending a distance of 153' beyond the 1/4 and pier B extending 73' beyond the 1/4 distance. The expanded excavation area would disturb 70,300 ft2 of shallow bottom habitat and remove 4,750 cubic yards of silty sand material from the shallow bottom habitat. These shallow water areas would be deepened to a final depth of -6' nlw. Although the proposed docks would be located 55' to 70' from the federal channel setback the project could cause potential navigational impacts to small boats and individuals anchoring in the area. The setting of pilings and excavation would cause an increase in temporary turbidity. There would be_ 18 additional permanent slips added to the boating usage of Town Creek; however the t-shaped finger piers located on docks 'A and B also have the potential to create more slip areas in addition to the proposed 18. There would not be an increase in the existing high ground impervious surface with the additional parking spaces. BEAUFORT The following are my comments and recommendations regarding the aforementioned proposal. The proposal is for two piers with all associated pilings and fingers, an additional 18 slips for a previously permitted-59 slip marina, the expansion of a previously permitted excavation area and the addition of two new parking spaces over existing impervious surface: There would be a total of 77 permanent slips. The slips would be numbered A 1-44 and B 1-33. A total of 116 tie pilings and 41 finger piers would be located within the new slip areas. A total of 4,750 cubic yards of material would be removed below nhw to a final depth of -6' nlw from an average depth of -3.75'nlw. All work would be a distance of 55' to 70' from the federal channel setback. The high ground work would consist of the addition of two new parking space areas over existing impervious surface. The width of the docks would be greater than six feet, however per 7H.0208 (6) (A) could be permitted if the greater width is necessary for safety or to improve public use access. The length of the docks/piers would exceed 1/4 the width of the water body within this area. The proposed excavation and parking space addition is consistent with 15A NCAC 7H.0208 and .0209 however the docks/piers are inconsistent with 15A NCAC 7H.0208(b)(6)(G)(iii) therefore the Morehead City District office recommends this portion of the project be denied. This permit authorized the development of a 59-slip marina facility on Town Creek, adjacent to US Hwy 70 (Cedar Street) in the Town of Beaufort, Carteret County. Besides the boat docks and slips, this permit authorized the excavation of a boat basin, the stabilization of the shoreline, the construction of a bathhouse and associated parking areas and upland walkways. The proposed modification will extend the two main piers approx. 160' further out into Town Creek and will rearrange the footprints of the previously permitted boat slips to provide greater access to the adjacent property owners' marina facilities. The piers will not extend any further waterward than the pier line which has been established on the south side of Town Creek by recently issued permits to Beaufort Harbor Marina and Yacht Club's and the Lo'er Deck's docking facilities. The proposed piers will be located between 50' and 60' from the federal setback line established for the nearby harbor of refuge. The total number of slips for this project will change from 59 to 77. In order to maintain a -6' water depth at low tide for the marina facility, the previously authorized excavated basin will need to be expanded by a width of approx. 380'x an average length of approx. 150'. Water depths in this area are presently approx. -3.75' NLW. A shellfish and SAV survey was conducted in this general area in 2007 and the results indicated that the general area did not contain any SAV or any significant shellfish resources. Excavation will be accomplished by barge and bucket with the location of the future upland disposal site being the contractor's responsibility. The remaining aspects of the applicant's permitted project will remain the same as permitted except that an additional 2 parking spaces will be provided to meet Town requirements. This increased parking will be provided over an existing asphalt surface which will not increase imperious areas.
